FAIR Continues to Fight for Arizona
On September 2, 2010, 66 members of Congress—five Senators and 61 Representatives—filed an amicus brief in the Ninth Circuit Court of Appeals appealing Judge Susan Bolton’s decision in the U.S. Justice Department’s suit against the State of Arizona over SB 1070. The brief, which was drafted with the assistance of the Immigration Reform Law Institute (IRLI) and the American Center for Law and Justice (ACLJ), was the second amicus brief to be filed by members of Congress who support SB 1070. The first brief was filed on July 20, 2010 before Judge Bolton handed down her decision enjoining several key provisions of the Arizona law, largely adopting the arguments made by the U.S. Justice Department. (See FAIR’s Legislative Update, August 2, 2010).

Judge Bolton’s ruling is now on appeal before the Ninth Circuit Court of Appeals. The appellate brief argues that Judge Bolton erred in enjoining SB 1070 in two key ways. First, the brief argues that Judge Bolton relied on case-law that was rendered inapplicable by subsequent alien registration laws passed by Congress. The brief also argues that Judge Bolton misapplied the standard articulated by the U.S. Supreme Court for evaluating statutes of the nature presented in SB 1070. The Ninth Circuit is slated to hear oral arguments in the case in November.

AP analysis: Economic pain failed to ease in July

Americans' economic struggles persisted in July, largely unchanged from the previous month, according to The Associated Press' monthly analysis of conditions around the country.
Nationally, unemployment, foreclosure and bankruptcy rates didn't budge from June. Yet the economic pain varied among localities, depending on their economic bases. Stress eased in counties whose work forces lean toward areas like agriculture, mining, wholesale trade and finance.
By contrast, counties with many employees in the retail and real estate industries suffered higher distress in July, according to a statistical analysis by AP.
Economic stress declined month to month in July in about 54 percent of the nation's 3,141 counties and in 24 of the 50 states, the AP's Economic Stress Index shows.
The AP's index calculates a score for each county and state from 1 to 100 based on unemployment, foreclosure and bankruptcy rates. A higher score indicates more economic stress. Under a rough rule of thumb, a county is considered stressed when its score exceeds 11.
The AP's index found the average county's Stress score in July was 10.5, unchanged from the previous month. About 42 percent of counties were found to be stressed. That, too, was unchanged from June.

Nevada, with a score of 22.1, was again the most stressed state. The healthiest state was North Dakota with a stress score of 4.24. Its score dipped slightly from June, aided by a lower unemployment rate. Next best were South Dakota (5.05), Nebraska (5.92), Vermont (6.29) and Wyoming (7.13).
The national unemployment rate remained the same from June to July, at 9.5 percent. So did the foreclosure rate (one in 62 homes) and the average state's bankruptcy rate (1.2 percent).
On Friday, the government said the unemployment rate for August ticked up to 9.6 percent. Most economists say it will take years for the rate to drop to near 5 percent, where it was when the recession began in late 2007.
"We still haven't seen the job creation out there that is necessary to bring down the unemployment rate," said Sean Snaith, an economist at the University of Central Florida. "That will help ease the foreclosure problem. That will help ease bankruptcies."
Besides unemployment, the economy is being held back by businesses and households still struggling with high debts and lack of confidence in the economy. U.S. economic growth slowed to a tepid annual rate of 1.6 percent in the spring.
Some analysts have raised concerns that the economy might be in danger of stalling. Most private forecasters, however, say they think growth will continue but at sluggish rates.
Sal Guatieri, senior economist at BMO Capital Markets, predicts growth at subpar rates of around 1.5 percent in the second half of this year and 2.5 percent in 2011. That would leave unemployment still painfully high at around 8.9 percent by the end of 2011, he said.
"Consumers are still paying down their debts and rebuilding their savings, and they just don't have the income growth to ramp up spending," Guatieri said.
The July stress figures illustrate the spiraling misfortunes that can start with a job loss, lead to a foreclosure proceeding and then to a bankruptcy filing. States hardest hit by foreclosures — Arizona, California, Florida and Utah — also suffered the biggest month-to-month jump in bankruptcy filings in July.
Previous state-by-state patterns intensified in July: The most economically stressed states became more so. And with one exception (South Dakota), the healthiest states suffered less stress.
Economic stress fell most in the Western states of Alaska (7.96), Colorado (11.07), Montana (7.9) and Wyoming; the Plains states of Nebraska and North Dakota; and the Southeastern states of Alabama (11.73), Louisiana (9.17) and Tennessee (12.33). The main reason for the improvement was seasonal job gains.
The states that endured the sharpest month-over-month increases in stress were Michigan, New Jersey (12.79), California, Connecticut (10.71) and Rhode Island (13.44). These states have struggled with high unemployment and foreclosures.

Economic conditions likely will stay static until after the November elections. Then, the stock market may respond positively to the results and kick-start the economy, Snaith said.
"That will alleviate some of the stress that consumers are under in terms of the wealth that has been lost in the housing market and stock market," Snaith said. "The biggest problem in the economy is that there is so much uncertainty."

Arizona’s illegal immigrant population is costing the state’s taxpayers even more than once thought -- a whopping $2.7 billion in 2009, according to researchers at the public interest group that helped write the state's new immigration law.

Researchers at FAIR – The Federation for American Immigration Reform -- released data exclusively to FoxNews.com that show a steady cost climb in multiple areas, including incarceration, education and health, in the last five years.

FAIR’s cost estimates – compiled for a comprehensive national immigration report it plans to release next month – include several new cost areas, including welfare and the justice system, that weren’t in previous reports.

FAIR admits that the cost to implement the new law in some of those categories, such as incarceration, will add to the economic strain on the state. But overall, it says, the loss of immigrants either from the deterrent effect of the law, voluntary exodus or from mass deportations, will help the state financially.

Also, the savings to the state will far overwhelm any fallout from boycotts (estimated at between $7 million and $52 million) being threatened in the wake of the law's passage, according to FAIR spokesman Bob Dane.

FAIR's new breakdown shows that illegal immigrants take $1.6 billion from Arizona's education system, $694.8 million from health care services, $339.7 million in law enforcement and court costs, $85.5 million in welfare costs and $155.4 million in other general costs.

The organization concedes that enforcing Arizona SB1070, the new law that allows local police to ask for immigration documents and arrest those who don’t have them, will increase the state’s incarceration costs, police training budgets and prosecution expenses -- but it says those numbers can’t yet be estimated with certainty. Also, it says, some of those costs will be offset by revenues from fines levied against businesses charged with knowingly hiring illegal immigrants, as well as from immigrants themselves who might be charged with minor crimes and fined before being deported.

But the Immigration Policy Center, a major opponent of the new law, says FAIR's data do not accurately portray SB1070's potential outcome. “They count the costs and don’t look at the benefits. We tend to look at the benefits more closely,” said Council spokeswoman Wendy Sefsaf.

“It is like having a roommate and counting how much they cost in toilet paper and incidentals without looking at the benefits of having help with the rent,” she said.

“Overall, every comprehensive study has shown that immigrants are a net benefit to states. If you add their children, they are a very great benefit.”

The Center’s cost crunching found that "if all unauthorized immigrants were removed from Arizona, the state would lose $26.4 billion in economic activity, $11.7 billion in gross state product and approximately 140,324 jobs,” -- a disaster for the Grand Canyon State.

But FAIR’s numbers tell a far different story.

(Because of the polarizing nature of the debate and the lack of solid figures on everything from the number of illegal immigrants in the state to how to accurately figure their share of the costs, there are no numbers either side agrees on or has not challenged.)

Jack Martin, the chief researcher on the report, says his data, in fact, do include benefits like the estimated $142.8 million in taxes paid by an estimated 500,000 illegal immigrants, and he says the Council’s numbers are unrealistic.

“They assume every illegal alien will leave right away," Martin said. "That is not going to happen.”

He said FAIR'S new estimates far exceed the report he wrote in 2004, which helped gain support for the passage of the Arizona law. In 2004, he said, he estimated that illegal immigrants cost the state $1.3 billion -- less than half the new estimate.

He said the new numbers put a reliable cost estimate on the economic impact of illegal immigration -- not just in Arizona, because the debate there largely ended with the passage of the immigration law, but nationally, as the debate spreads across the country.

”The numbers just keep growing,” Dane said.

Both Dane and Martin said that among FAIR’s most important findings was an estimate that tax revenues to the state will actually increase if illegal immigrants leave.

“We discovered after looking at places where big raids were made that salaries went up after the raids because employers now had to pay competitive wages to Americans.” Martin said. “And that will mean more money for the state.”

Anchor Babies Grab One Quarter of Welfare Dollars in LA Co

The anchor baby scam has proven lucrative for illegal aliens in Los Angeles County, at considerable cost to our own poor and downtrodden legal citizenry.

The numbers show that more than $50 million in CalWORKS benefits and food stamps for January went to children born in the United States whose parents are in the country without documentation. This represents approximately 23 percent of the total benefits under the state welfare and food stamp programs, Antonovich said.

"When you add this to $350 million for public safety and nearly $500 million for health care, the total cost for illegal immigrants to county taxpayers far exceeds $1 billion a year -- not including the millions of dollars for education," Antonovich said.

I love children and I'm all for compassion -- smart, teach-them-to-fish compassion. But when laws, the Constitution, and enforcement allow illegal aliens (the operative word here being "illegal") to insinuate themselves into our nation and bleed us of our precious financial resources, then laws, the Constitution and enforcement need to be changed.

County Spends $600 Mil On Welfare For Illegal Immigrants

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.
Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.
The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars.
Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.
His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

20 illegal immigrants arrested in Orange County beach landing

Border agents arrested 20 illegal immigrants Tuesday morning who were attempting to enter the country by sea at Calafia State Beach in San Clemente.

When the small craft the immigrants were riding in land landed, the occupants attempted to flee. Agents with the U.S. Border Patrol arrested 17 men and three women, all from Mexico.

A 36-year-old woman suffered a broken leg while jumping from the boat, according to a statement from the U.S. Border Patrol in San Diego. She was taken to a hospital for treatment. The others were taken to a Border Patrol station for processing.

No further details were immediately available, but the Associated Press said the incident occurred about 3 a.m.

Heather Mac Donald: White House doesn't want to enforce immigration

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.
It is that policy alone which conflicts with SB 1070: Arizona wants to enforce the law; the Obama administration does not. Reasonable minds can differ on whether that conflict puts Arizona in violation of the Constitution's Supremacy Clause.
But what is indisputable is that the failure of the federal government to openly acknowledge the real ground for its opposition to SB 1070 has rendered incoherent not just its own public arguments against the law, but the judicial ruling which largely rubber stamps those arguments as well.
The Arizona statute affirms the power of a local police officer or sheriff's deputy to inquire into someone's immigration status, if the officer has reasonable suspicion that the person is in the country illegally, and if doing so is practicable. Under SB 1070, such an inquiry may occur only during a lawful stop to investigate a non-immigration offense.
Both the Justice Department and U.S. District Judge Susan Bolton, in striking down most of SB 1070, couched their opposition to the statute exclusively in terms of its effect on legal, as opposed to illegal, aliens. SB 1070, Judge Bolton wrote, would impermissibly burden legal immigrants already in the country by subjecting them to unwarranted immigration checks.
There are two problems with this line of argument: First, it ignores the fact that Congress has already anticipated and approved precisely the sort of local immigration inquiries that Judge Bolton now finds unconstitutional. Second, the argument would make all immigration enforcement impossible.
In 1996, Congress banned so-called sanctuary policies, by which cities and states prohibit their employees from working with federal immigration authorities regarding illegal aliens. It was in the federal interest, Congress declared, that local and federal authorities cooperate in the "apprehension, detention or removal of [illegal] aliens."
In pursuance of that mandate, the federal government operates an immigration clearinghouse, the Law Enforcement Support Center (LESC), to provide just the sort of immigration-status information to local and state law-enforcement officials that SB 1070 seeks.
It is therefore absurd to now claim, as Judge Bolton and the Obama Administration do, that such local inquiries conflict with the federal immigration scheme. It is even more absurd to argue that the risk that a legal alien will be questioned about his immigration status makes the alleged conflict unconstitutional.
Any immigration enforcement carries the possibility that a legal alien or U.S. citizen will be stopped and questioned. The only way to guarantee that legal aliens are never asked to present their immigration papers is to suspend immigration enforcement entirely. (The same possibility of stopping innocent people for questioning applies to law enforcement generally; that possibility has never been held to invalidate the police investigative power.)
If Congress intended to create such a blanket ban on asking legal aliens for proof of legal residency, it could have revoked the 1952 law requiring aliens to carry their certificate of alien registration. Such a requirement makes sense only on the assumption that legal aliens will upon occasion be asked to prove their legal status.
Such unpersuasive reasoning suggests that something else is going on. That something is the fact that SB 1070 would have put the Obama administration in the uncomfortable position of repeatedly telling Arizona's law enforcement officers that it is not interested in detaining or deporting the illegal aliens that they have encountered in the course of their duties; the law, in other words, would have exposed the administration's de facto amnesty policy.
And SB 1070 would have shown that immigration-law enforcement can work simply by creating a deterrent to illegal entry and presence. Even before it went into operation, the Arizona law was already inducing illegal aliens to leave the state, according to news reports.
Illegal aliens are virtually absent from the Justice Department's brief or from Judge Bolton's opinion. Despite this studied avoidance, it's time to have a public debate about how much immigration enforcement this country wants and which enforcement policies--the administration's or Arizona's -- best represent the public will.

Gang dispute blamed for fatal shooting of girl, 14, in Lancaster

A gang dispute appears to have sparked the shooting Sunday in Lancaster that killed a 14-year-old girl and left six others injured, Los Angeles County sheriff’s officials said Monday.

Homicide Bureau Lt. Pat Nelson said investigators are “confident” that the shooting was gang-related, but declined to identify the gangs. There had been no arrests made by Monday evening.

Dominique Peatry, 14, was identified as the girl who was killed when gunmen began shooting early Sunday morning at a party in the 44600 block of 6th Street East. The other shooting victims, who range in age from 13 to 26, have not been identified. They are all expected to survive, Nelson said.

Obama on Labor Day: No measures to address jobs crisis

In a speech delivered to mark Labor Day in the US, President Obama made clear that there will be no significant government measures to address the most severe jobs crisis since the Great Depression of the 1930s.
Speaking in Milwaukee, Wisconsin on Monday, Obama trumpeted a plan for investment in infrastructure and transportation as a significant jobs program. Despite efforts by the media to play up the announcement, it quickly emerged that the administration is simply asking Congress to reauthorize a bill that is routinely passed every five years. His proposal for spending is little changed from previous years.
According to a White House fact sheet, the administration is proposing that Congress “front load” the Department of Transportation spending bill by about $50 billion, saying that this would create jobs as early as 2011. The administration did not propose a total figure for the bill, which will likely not be debated until after the mid-term elections in November. In 2005, the Bush administration signed a transportation bill that cost $286.4 billion over five years, or just under $50 billion a year. The money goes to states and localities to fund road and infrastructure projects and regular upkeep.
The figure proposed by Obama is not only grossly inadequate in comparison to the decayed state of American infrastructure, it will not begin to address the jobs crisis. It even pales in comparison to the administration’s own inadequate $787 billion dollar “stimulus” bill last year, which consisted largely of tax cuts and handouts to private companies.
Administration officials have repeatedly stressed that there is no new major stimulus bill in the works, let alone a program of direct government hiring. Obama is expected to announce a number of additional “jobs” measures later this week, including the extension of tax cuts for corporations and small businesses.
The administration has also pledged that all these measures will be “fully paid for,” continuing on the theme of budget cutting and fiscal austerity. While hinting at ending various tax loopholes for energy companies, payment will also likely include cuts in social programs—like those carried out with the last extension of unemployment benefits, which was accompanied by a reduction in funding for Food Stamps.

The latest jobs report—showing a loss of 54,000 jobs in August—underscores the bleak outlook. The official unemployment rate, which vastly underestimates the real number of jobless workers, is expected to remain at around 10 percent at least through 2011. Of the 15 million who are officially unemployed, 42 percent have been out of work for more than six months, while millions are running out of their meager unemployment benefits.
To the extent that the administration has a jobs policy, it is the revival of a section of US manufacturing on the basis of closing the wage gap between US workers and their brutally exploited counterparts in Asia. Already, the level of exploitation of American workers has increased significantly. While labor costs for companies are falling at the sharpest rate in decades, productivity has surged—that is, workers are being forced to do far more for much less.
Sergio Marchionne, the head of the Italian auto company Fiat, summed up the thinking of the corporate elite in remarks recounted in a soon-to-be-released memoir by Steven Rattner, the Wall Street investor turned head of Obama’s Auto Task Force. According to Rattner, Marchionne told then-United Auto Workers President Ron Gettelfinger that workers needed to accept a “culture of poverty” rather than a “culture of entitlement.” Fiat was negotiating a partnership with Chrysler at the time, under the direction of the Obama administration, which was demanding that workers accept massive concessions and job cuts.
The determination to force workers to submit to a “culture of poverty” is shared by both political parties—and, for that matter, the UAW, which is presently doing everything it can to enforce such a “culture” on workers in Indianapolis.
Labor Day in the US has always been about containing class struggle. It was invented as a replacement for International Workers’ Day, May 1, in a deliberate attempt to separate American workers from their class brothers and sisters around the world, who are facing similar conditions. The day has become an empty ritual, allowing trade union officials to join hands with political representatives of the capitalist class in a hypocritical celebration of the American worker.
No amount of posturing, however, can conceal the fact that all these figures—including the president of the AFL-CIO, Richard Trumka, who joined Obama on Monday in Milwaukee—are engaged in an all-out offensive against the working class.
Politics in America is characterized by an immense vacuum. There is an enormous disparity between the social and economic strength of the working class—which today represents a far higher proportion of the population than ever before—and its political influence.
Over the course of US history, American workers have engaged in insurrectionary class battles and were able to win significant concessions in the face of the bitter resistance of the capitalist class. Politically, however, the working class has remained tied to the Democratic Party, and through it, to the capitalist system. The Obama administration is once again demonstrating the consequences of this subordination: in all its policies, foreign and domestic, it has upheld the interests of the corporate and financial elite.
There exist many organizations that continue to seek to bolster support for the Democratic Party—from the trade unions and Obama’s liberal supporters, to supposedly “left” or “socialist” groups such as the International Socialist Organization. These tendencies, however, have today a marginal political influence in the working class itself. This was demonstrated by the negligible turnout at the “jobs” march organized last month in Detroit by the UAW and sections of the Democratic Party establishment, with the full support of the Democratic Party’s various auxiliary organizations. The growth of the class struggle is inevitable. New mass struggles of the working class will develop outside of the existing framework of political life. To lead these struggles, the building of an independent political party of the working class, in opposition to the corporate-controlled Democratic and Republican Parties, and based on the fight for socialism, is the most pressing necessity.
