Sanctuary veto overridden, legal action possible

1-10) 20:36 PST SAN FRANCISCO -- The San Francisco Board of Supervisors on Tuesday was successful in overriding Mayor Gavin Newsom's veto of legislation changing the sanctuary city ordinance.
Newsom, who said the ordinance conflicts with federal law, said through his spokesman that he would ignore the legislation - prompting the legislation's author to threaten a legal challenge to the mayor. The new law takes effect in 30 days, and Supervisor David Campos said the board may fight the mayor in court if no compromise can be struck.
Campos' ordinance - which garnered eight votes Tuesday - requires that undocumented juveniles be turned over to federal authorities for possible deportation only after they're convicted of a felony. Currently, under a policy enacted by Newsom last year, youth are turned over upon arrest.
"The law is pretty clear that when you have legislation that is duly enacted, the job of the executive is to implement and enforce that legislation unless there is a finding by the court the legislation is illegal," Campos said. "In this case, there isn't."
Campos, a lawyer, pointed to the California Supreme Court's ruling in 2004 that Newsom had no authority to issue same-sex marriage licenses in violation of state law just because he "personally believes" the law is unconstitutional.
Rather, the court ruled, he took an oath of office swearing to uphold the law - and must abide by it until a court overrules the law he finds objectionable.
Likewise, Campos said that just because Newsom personally believes that undocumented youth should be turned over upon arrest, he can't ignore supervisors' legislation.
But U.S. Attorney Joe Russoniello said that unlike many areas of law, immigration is purely within the purview of the federal government and that no state or city can pass its own immigration laws - and therefore, the mayor must ignore the ordinance.
City Attorney Dennis Herrera declined to comment on the legality of Newsom ignoring the supervisors' legislation, but has warned previously that the legislation would violate federal law.
Herrera sent a letter to Russoniello on Tuesday asking the U.S. attorney to assure that San Francisco's law enforcement officers and other city officials wouldn't be prosecuted for violating federal laws if they obey the new city law.
Russoniello is unlikely to grant that assurance, and Herrera said that may prompt him to file suit in federal court defending the legislation. Now that it is city law, it's Herrera's duty to defend it.
This isn't the first time Newsom, who has never gotten along well with the board, has ignored the supervisors' laws.
Under city charter, he can opt to not spend money authorized by the board - which he did in 2007 when he wouldn't spend $33 million appropriated by the supervisors for affordable housing. The year before that, he ignored a voter-approved nonbinding measure to appear before the supervisors monthly to answer questions.
Nathan Ballard, the mayor's spokesman, said Newsom only ignores legislation "after careful consideration."
Angela Chan, staff attorney for the Asian Law Caucus, said she hopes that Newsom is open to compromise on the sanctuary city matter because he's no longer running for governor and doesn't need to appeal to more conservative parts of California.
"He should get to the substance of the issue rather than turning it into more of a standoff between him and the board," she said.
Ballard countered that the notion of Newsom tailoring his beliefs on sanctuary city to benefit his run for governor is absurd. "It was never a political calculation," he said. "It was always a matter of principle."

Another victory for American workers in Arizona. Yesterday, the Ninth Circuit Court of Appeals upheld the get-tough employer sanctions law in the state. The law hits employers who knowingly hire illegal aliens with strict penalties and in some cases even strips businesses of their licenses. A lower court upheld the same law in February. But open-borders and amnesty groups along with the business lobby are considering yet another appeal.

Teenage boy found stabbed to death outside home in South San Jose

Police today are investigating the stabbing death of a teenage boy who was found by family members outside a home in South San Jose.
It is the 25th homicide in the city this year.
At 8:36 p.m. Tuesday, San Jose police received a 911 call that a person had been stabbed outside a home in the 5600 block of Comanche Drive, located near Blossom Hill Road and Highway 85, according to officer Jermaine Thomas. Police, firefighters and paramedics went to the house and located the boy, who was pronounced dead at the scene, Thomas said.
Police are not yet releasing the boy's name or age.
There is no suspect information at this time, Thomas said. The stabbing death does not appear to be gang-related, according

to police.
As police continued their investigation, neighbors gathered on nearby sidewalks and expressed grief and shock over the slaying. Neighbors said they did not yet know who had been killed.
Terri Galindo, whose teenage daughter attends Santa Teresa High, expressed concern for the boy's family. She also wondered if the boy who was killed was a classmate or friend of her daughter.
"Regardless, the fact that it happened, it's sad," Galindo said. "It's sad somebody lost a life like that. A parent lost a child. It saddens me."
The stabbing death occurred on the same night that community members gathered in East San Jose to discuss the Halloween night, gang-related attack that left a 12-year-old boy in grave condition.

Attrition through Enforcement

In the largest immigration enforcement action under the Obama Administration, 1,200 illegal aliens working as janitors in Minnesota were fired last month. The illegal aliens worked for a San Francisco-based company, ABM that is contracted to clean many of the office buildings in Minneapolis and St. Paul.

Shifting from the Bush policy of conducting worksite enforcement actions, the Obama Administration pressured the company to fire the illegal workers. The company has not said how big their Minnesota workforce was, but legal workers who continue working said about 80 percent of the workforce was fired.

Unlike the Bush-era enforcement actions, no action was taken against the fired workers. ABM will likely be prosecuted. Former ICE agent, Mark Cangemi, is unsure if the new strategy will prove to be effective.

"Why give people an opportunity to leave the employment without taking any action against them as individuals?" Cangemi told Minnesota Public Radio. "Put them into proceedings. Let them argue their case. If they have a case that allows them to remain in the United States under the law, so be it. If they don't, then the law stands to be enforced."

In an interview with MPR, an anonymous janitor said, "I really want people to hear -- and if possible even get to the ears of President Barack Obama -- that we don't come here for anything other than to work."

The unemployment rate in Minnesota in September was 7.3%. Of the 1,200 job openings created by the firings, apparently all the jobs have been filled.
