Unfilled tunnels a weak link at border
Key points are plugged in U.S. and Mexico, but smugglers may still try to reuse the passages

SAN DIEGO — Seven of the largest tunnels discovered under the U.S.-Mexico border in recent years have yet to be filled in, authorities said, raising concerns because smugglers have tried to reuse such passages before.

Among the unfilled tunnels, created to ferry people and drugs, is the longest one yet found — extending nearly half a mile from San Diego to Tijuana. Nearby, another sophisticated passageway once known as the Taj Mahal of tunnels has been sitting unfilled for 13 years, authorities say.

Though concrete plugs usually close off the tunnels where they cross under the border and at main entrance and exit points, the areas in between remain largely intact. Filling the seven tunnels would cost about $2.7 million, according to U.S. Customs and Border Protection officials. Accessing tunnels that run under private property is also a problem, as is a lack of coordination with Mexican authorities.

Mexican authorities have told their U.S. counterparts that they've filled their end of the tunnels. But U.S. officials express doubt, citing the high costs and examples of tunnels being compromised. The Mexican attorney general's office, which handles organized crime, did not respond to numerous requests for interviews.

In recent years nearly 50 tunnels have been discovered running under the border from San Diego to Arizona. Most are small, crudely constructed passages — called gopher holes — that are easily destroyed.

But filling the larger, more elaborate tunnels requires enormous amounts of material and expertise, especially because some were probably designed by mining engineers.

To prevent break-ins, authorities say they install motion sensors, which alert them to incursions.

But smugglers in some cases have been able to access existing tunnels by digging around the plugged entrance points, according to the U.S. Border Patrol and Immigration and Customs Enforcement, which heads the San Diego-based U.S. Border Tunnel Task Force.

In Nogales, Ariz., traffickers have used one tunnel three times over a four-year span. Tijuana smugglers were suspected of reusing a tunnel in 2004, one year after its discovery inside a house in Mexico. U.S. authorities have had to reinspect several other tunnels in response to suspicious activity or tips.

Unclear jurisdiction

Because of overlapping jurisdictions among federal border agencies, the responsibility for subterranean work was unclear for years. The Border Patrol and the Drug Enforcement Administration each had some responsibility.

After the Department of Homeland Security was created in 2003, the responsibility for filling tunnels was assigned to one agency: Customs and Border Protection.

Authorities cite this streamlining as progress. But Customs and Border Protection has not filled any tunnels, and has capped only two since assuming control. Michael Friel, an agency spokesman, said the agency is trying to find money in its budget to complete the work. The 2007 budget for Customs and Border Protection is $7.8 billion.

Critics say the existence of so many unfilled tunnels poses a needless — and inexcusable — national security risk.

"I was shocked to learn that these tunnels haven't been filled in. They should be," U.S. Sen. Dianne Feinstein (D-Calif.) said in a statement. "The department should move, find money, and do it. This is a huge department with a huge budget. And if they don't have the money, they should tell us, and we will seek to get it in the emergency supplemental."

Among the unfilled passages:

• The so-called Grande Tunnel connecting warehouses in San Diego and Tijuana. Nearly half a mile long, the tunnel was discovered in January 2006 and attracted global media attention as well as groups of local and national politicians, who were given tours of its cave-like depths. The tunnel prompted Feinstein to propose legislation outlawing the construction of tunnels under the border.

• The 1,400-foot tunnel called the "Taj Mahal" because of its lighting system and reinforced concrete walls. The tunnel was discovered in 1993. Five years later, authorities suspected the passage had been reentered after 33 illegal immigrants were found covered in mud near the opening. A metal lid over the tunnel opening had been cut. Border Patrol agents say they never determined for sure if the passage was reused.

• Two long tunnels leading from Mexicali, Mexico, to a quiet residential area in Calexico, Calif. One of them, discovered in 2005, was equipped with a ventilation system, phone line and video surveillance equipment.

It isn't cost alone that can keep tunnels unfilled. Owners of private property also can slow the process. In 2002, after a tunnel was discovered running under part of his property in eastern San Diego County, David Field, a San Diego building inspector, feuded with the DEA over how to fill the quarter-mile-long passage. The DEA wanted to use a concrete-soil mix. Field, for environmental reasons, said he wanted the portion under his land filled only with dirt.

The tunnel featured a battery-operated cart on rails and was used to ferry what may have been tons of drugs over a 10-year period, according to authorities.

In 2002, the DEA sent Field a letter saying that drug traffickers would probably reuse the tunnel if it wasn't completely closed off and threatened to seize Field's property if the tunnel was compromised. Field said the letter surprised him because he knew the agency had never filled the Taj Mahal tunnel found in 1993.

"I said that tunnel is still open…. So how could this be a national emergency?" Field said.

Authorities say they have had to check the tunnel twice to investigate tips that it had been reopened, but have found no evidence.

Smugglers can be determined about reclaiming their tunnels. Take the case of the little light-blue house in Nogales. The vacant building with barred windows is at 438 W. International St., right across the street from the border, where a 20-foot fence provides a formidable above-ground barrier.

Several years ago, smugglers, starting from a drainage canal in Mexico, dug under the border fence, under International Street, and under the yard, to a front room in the house. Wooden slats and carpeting covered the opening, said Agent Mario Cano, a U.S. Border Patrol spokesman.

In December 2001, U.S. authorities discovered the 85-foot tunnel — equipped with a rail and cart system — and plugged it. But the smugglers soon dug around the cap at the border and found their way back to the tunnel, Cano said.

Diggers used about 15 feet of that tunnel, then branched off and burrowed an additional 40 feet. They surfaced near the house's driveway and covered the new opening with trash cans. In March 2002, that opening was discovered and sealed, Cano said.

Smugglers went to work again, this time using portions of the first and second tunnel before branching off to surface in another area of the yard, where they covered their latest opening with a tarp. That branch and its opening were discovered in October 2005.

Digging a new route

This month, authorities returned to the house again. This time, two men were digging a new route, starting inside the home, Cano said. They had progressed only 15 feet, Cano said, but may have intended to link up again with one of the existing tunnels under the property.

None of the passages have been filled, Cano said, although he believes portions may have collapsed because of heavy rains. Even if the tunnels were filled, he said, the problem might not go away.

That's because smugglers have used the concrete fill to make support walls and ceilings for new tunnels, he said. The filled-in passages also serve as markers, guiding crews to new areas where they want to go below ground.

The tunnel diggers' determination has bedeviled U.S. authorities, who have teamed with structural and civil engineers and geologists to devise the best ways to close tunnels. They've experimented with a type of concrete that will cave in if smugglers use it for support.

The cost to close the unfilled tunnels ranges from $200,000 to $700,000.

But addressing the problem here solves only part of the problem because some tunnels extend hundreds of feet into Mexico, where U.S. authorities have no control.

Though Mexican authorities promise to fill tunnels, it's hard to know if they've followed through, said Assistant Special Agent in Charge Frank Marwood, who heads the U.S. Tunnel Task Force.

Mexican authorities have occasionally permitted their U.S. counterparts to inspect tunnels for suspicious activity, including one time when a corpse was discovered on the Mexican side. But it's not routine.

In 2004, smugglers in Tijuana are believed to have reused a tunnel that Mexican authorities said they had filled. The smugglers broke into a tunnel discovered a year earlier and formed a new tunnel heading toward a parking lot near the San Ysidro Port of Entry, U.S. authorities said.

The tunnel has since been filled in on the U.S. side, but the status of the Mexican side is unknown.

Corruption in Mexican border agencies complicates matters. Last year, two Mexican customs officers were arrested on suspicion of being involved in the construction of a tunnel near the San Ysidro Port of Entry.

U.S. authorities also believe Mexico can't afford to fill tunnels. If so, the U.S. should provide assistance, some say. "It's a binational security breach, and I think the way to handle it is by a binational effort," Marwood said.

"If they're not filled in, [smugglers] just branch out at one end or another."

Los Angeles names and targets city's worst 11 gangs
Mayor and police chief vow to pursue the groups with local-federal law enforcement teams. Experts question the strategy.

Launching a counteroffensive against organized street thugs, Los Angeles Mayor Antonio Villaraigosa and police officials took the unusual step Wednesday of identifying the city's 11 worst gangs, then promising to go after them with teams of police, federal agents, probation officers and prosecutors.

Facing 720 identifiable gangs with 39,000 members, the city's plan would target the most dangerous groups, which total at least 800 members. Those gangs are thought to be responsible for a disproportionate amount of mayhem.

The gangs on the list are believed to have committed 6% of the violent crime that occurred in the city last year.

How many local and federal officers will be committed to the anti-gang push remained unclear, however. And given the complexity of what has been a long-standing social problem, some experts questioned whether the plan would be any more effective than past police crackdowns.

Overall, serious crime declined in Los Angeles last year, but violent, gang-related crime increased 14%.

Gang crime was even higher in areas such as South Los Angeles, where it increased 25%, and a section of the north San Fernando Valley where it grew by nearly 160%.

"Street gangs are responsible for the majority of all the murders in Los Angeles and nearly 70% of all the shootings," Villaraigosa said Wednesday at a previously scheduled international summit on gang issues in Universal City. "We must work to address gang violence in a truly comprehensive way."

Although the police had identified certain gangs on occasion, especially when they appeared to be involved in high-profile crimes, the LAPD historically has not called out their names "because of the widely held perception that doing so elevated the criminals' influence and standing in the gang community," the mayor's plan says.

"This new strategy abandons the earlier posture and challenges these menaces by exposing their corrosive behavior to the scrutiny of a more informed and confident community," the plan says.

But Wes McBride, executive director of the California Gang Investigators Assn. and a retired Los Angeles County sheriff's deputy, said he was "not sure" that identifying the gangs was a good idea.

"These guys keep the clippings, and I don't know if you can really say which are the most dangerous gangs on any one day," he said. "It is the kind of advertising you don't need."

McBride said he feared that some gangs would feel slighted if not named and might try to up the ante with more violent crimes.

Najee Ali, a community activist and former gang member, said he also was opposed to any ranking system. "The mayor and chief shouldn't be legitimizing the gangs," he said. "To the gang members it is a badge of honor."

The list of targeted gangs includes the 204th Street gang in Harbor Gateway, which is believed to be responsible for recent racially motivated attacks and will be the subject of a special abatement effort. The list also includes Canoga Park Alabama, whose members' recent violent acts have contributed to gang crime skyrocketing 43% in the San Fernando Valley.

The other gangs on the list include 18th Street Westside in the LAPD's Southeast Division; the Avenues gang in the Northeast Division; the Grape Street Crips in the Southeast Division; Black P-Stones in the Southwest Division; the La Mirada Locos in the Rampart and Northeast divisions; the Mara Salvatrucha in the Rampart, Hollywood and Wilshire divisions; the Rollin' 40s and Rollin' 30s Harlem Crips, both in Southwest, and the Rollin' 60s in the 77th Street Division.

The Mara Salvatrucha gang has up to 50,000 members in six countries, but police will focus on cliques that operate in a few local high-crime neighborhoods.

The LAPD already has shifted 18 additional officers to the 204th Street gang turf and is expected to double that amount soon. Smaller deployments are expected for other gang-infested neighborhoods.

An additional 50 officers will be assigned to a Community Safety Operations Center in the Valley, which will analyze real-time crime data to rapidly and strategically deploy officers, including high-visibility patrols, in crime-ridden regions of the Valley.

The mayor and chief are set to formally unveil their plan at 2:30 p.m. today at the Valley's Mission Community Police Station.

Most of the gangs on the list already have been hit with injunctions that restrict their movements and ability to socialize, and some have been in the crosshairs of local and federal authorities for years.

But Villaraigosa said that the new plan is not as piecemeal as previously, and that the FBI, the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives, the federal Drug Enforcement Administration, county probation agents, county and city prosecutors, and the U.S. attorney's office have signed on to step up pressure.

"We, the police, law enforcement, can do a great deal working collectively together, with force magnification, to reduce this problem," said Police Chief William J. Bratton on Wednesday.

But, Villaraigosa added, the gang-suppression plan was only the first step in stabilizing crime-ridden neighborhoods. He said the city would later provide prevention and intervention programs to keep young people out of gangs.

The chief acknowledged that with a police force already stretched thin and expansion occurring slowly, he would have to redeploy existing officers to hot spots in the immediate future.

McBride, the gang expert, cautioned that plans without resources often fall short.

"Until everyone hires a bunch more cops, you are shoving sand in the wind," he said.

In addition to releasing a list of targeted gangs, the LAPD has submitted the name of a fugitive gang member for placement on the FBI's most wanted list and will submit another name when the first fugitive is captured, officials said.

The submissions will come from the LAPD's own list of its 10 most wanted gang fugitives, which also was released Wednesday. It includes Merced "Shadow" Cambero, from the Avenues gang, and Kody "Monster Cody" DeJohn Scott, from the 8-Trey Gangster Crips.

Also, the plan includes the appointment of an LAPD gang coordinator, creates a South Bureau Criminal Gang Homicide Group, designates additional patrol officers in gang territories to enforce injunctions and warrants, and proposes community symposiums on gang awareness in affected neighborhoods.

Malcolm Klein, a professor emeritus at USC and a gang expert, said the city's gang plan would appear to use a "tip of the iceberg" strategy.

"Targeting hot spots for gangs — that is not much different than the past," Klein said.

He also questioned the methods used to choose which gangs belonged on the worst 11 list.

"The level of violence generated by a gang makes sense to me. But the interracial conflict [at the root of the 204th Street gang murders] is not common, and shooting at police officers also isn't common. The last two are more political than rational."

However, the idea of focusing on the most violent gangs was supported by Alex Alonso, an academic who studies gang territories in Los Angeles and runs the website streetgangs.com.

"What they did under [former Police Chief Daryl F.] Gates didn't work: Suppress everyone. Now they want to be more focused on the most hard-core gang members, that 10% who are really responsible for violence," Alonso said.

Title 1 schools are on the free breakfast and free lunch program. When I say free breakfast, I'm not talking a glass of milk and roll -- but a full breakfast and cereal bar with fruits and juices that would make a Marriott proud. The waste of this food is monumental, with trays and trays of it being dumped in the trash uneaten. (OUR TAX DOLLARS AT WORK) I estimate that well over 50% of these students are obese or at least moderately overweight. About 75% or more DO have cell phones. The school also provides day care centers for the unwed teenage pregnant girls (some as young as 13) so they can attend class without the inconvenience of having to arrange for babysitters or having family watch their kids. (OUR TAX DOLLARS AT WORK) I was ordered to spend $700,000 on my department or risk losing funding for the upcoming year even though there was little need for anything; my budget was already substantial. I ended up buying new computers for the computer learning center, half of which, one month later, have been carved with graffiti by the appreciative students who obviously feel humbled and grateful to have a free education in America. (OUR TAX DOLLARS A T WORK) I have had to intervene several times for young and substitute teachers whose classes consist of many illegal immigrant students here in the country less then 3 months who raised so much hell with the female teachers, calling them "Putas" whores and throwing things that the teachers were in tears. Free medical, free education, free food, day care etc., etc., etc. Is it any wonder they feel entitled to not only be in this country but to demand rights, privileges and entitlements? To those who want to point out how much these illegal immigrants contribute to our society because they LIKE their gardener and housekeeper and they like to pay less for tomatoes: spend some time in the real world of illegal immigration and see the TRUE costs.

American citizens: College and high school kids cannot find a summer job in yard care, landscape, fast food or service jobs. Why? Illegal aliens work them at a third the wage and often, under the table. Not only do young American not have jobs; their parents are paying taxes for illegal aliens who are not paying taxes. Annually, 75 percent of drugs arrive from Mexico at a net cost of $120 billion hard currency that leaves our country for good. In addition, our tax dollars pay $80 billion for the War on Drugs each year. It is a war that hasn’t been won in the past 30 years and drugs are as available today to your teenager as they were in 1970. When an alien criminal gets caught for rape, murder or drug distribution, you pay $1.6 billion annually in prison costs to house, feed and clothe those filling 30 percent of our federal and state prisons—not to mention TV, movies, weight rooms and other entertainment—they enjoy while being incarcerated. The average head of household illegal alien costs you $2,700.00 in welfare money over and above any taxes he or she pays in their meager paying jobs. The lifetime net fiscal drain—taxes paid minus services used—for an adult immigrant is $55,200.00 according to Carrying Capacity Network. With a minimum of 15 million illegal aliens in our country, these figures are the tip of the iceberg. Average bilingual education is $1,200.00 per illegal alien student. Get this! We educate 1.1 million illegal alien children each year. The American public has paid $27 billion to provide forms, ballots, interpreters, and brochures for languages other than English in 2003. An estimated one-third to one-half illegal aliens work off the books. It costs $200 million to provide for emergency health care for illegal aliens in the Border States annually. California with over three million illegals paid $79 million, and four of their major LA hospitals bankrupted and shut their doors in 2004. Texas with 1.5 million illegal aliens paid $74 million in hospital care. Georgia ran a $63 million deficit for 64,000 unpaid doctor visits to their Grady Health Care system in 2002. Georgia taxpayers paid $27 million for 11,188 anchor baby hospital births. Georgia taxpayers paid a whopping $242 million for educating illegal alien kids in 2003. What are the consequences? One in two adult African-Americans in New York is unemployed. African-American children’s poverty grew by 50 percent since 1999. Why? Their dads can’t find work. It costs the taxpayer, $68 billion a year to pay for the resettlement of legal immigrants. Only 22 companies in 2003 were taken to court for hiring illegal aliens. None went to jail. Limiting immigration has the overwhelming support of most Americans, regardless of party affiliation or race. • 65% of voters favor stopping all immigration into the U.S. during the war on terrorism. • 92% of voters favor “imposing stricter immigration and border crossing polices.” • 84% of Americans support tighter restrictions on immigration. • 77% think the government is not doing enough “to control the border and to screen people allowed into the country”. • 85% strongly/somewhat agree “that enforcement of immigration laws and the border has been too lax and has made it easier for the terrorists to enter”. • 72% think that “a dramatic increase in resources devoted to border control and enforcement of immigration laws would help reduce the chances of future terrorist attacks”. • Six in ten Americans support reducing legal immigration levels. • 77% of respondents in a CNN poll opposed granting amnesty to illegal immigrants. • 53% of Americans said the number of legal immigrants allowed into the U.S. should be decreased. Only 6% wanted to see it increased. • 41% of Republicans and 45% of Democrats support stopping legal immigration altogether. • 72% of Americans think immigration should be reduced, • A Roper poll in January found that 83% of Americans favor a lower immigration level. 70% favor restricting immigration to less than 300,000 new immigrants a year (including 70% of Republicans, 73% of African-Americans, and 52% of Hispanics). Most want even larger cuts: 54% favor an immigration level of below 100,000 a year. 20% support no immigration at all. The same Roper poll found that a large majority (75%) supports strong laws to identify and deport illegal immigrants. Only 10% disagree with strict laws against the removal of illegal immigrants. The strongest supporters of tough measures against illegal immigrants are self-styled political moderates (78%), strongly religious (76%), whites (77%), Protestants (82%), and Midwesterners (85%). 76% of Democrats, 76% of Republicans, 78% of self-described middle-of-the-roaders, and 60% of Hispanics (English-speaking) also support tough laws against illegal immigrants. • 52% of all Americans favor a five-year ban on all legal and illegal immigration to the U.S., including 54% of all Republicans and 48% of all Democrats. • 50% favor a law that would stop all legal immigration into the U.S. for the next five years. • 63% of Americans think immigration levels are too high, including 66% of Republicans and 60% of Democrats. • 62% of Americans think immigration levels should be decreased, 27% think the present levels should remain, and 12% say they should be increased. Some lawmakers are particularly concerned with the attitudes of Hispanics on the immigration issue. State Dept. Cites 'Large Firefights' in Travel Alert on Mexico

MEXICO CITY, Feb. 20 -- The latest travel advisory for Mexico from the U.S. State Department will certainly not please the tourist board. Rather than a glossy brochure advertising the country's many delights, the travel alert issued Friday reads like the plot of a crime thriller.
"Recent Mexican army and police confrontations with drug cartels have resembled small-unit combat, with cartels employing automatic weapons and grenades," the advisory reads. "Large firefights have taken place in many towns and cities across Mexico but most recently in northern Mexico, including Tijuana, Chihuahua City and Ciudad Juarez. During some of these incidents, U.S. citizens have been trapped and temporarily prevented from leaving the area."
Being "temporarily prevented" from leaving a firefight is never a good thing as far as promoting tourism goes. Tourism is one of Mexico's main sources of income, and the country that sends the most tourists to Mexico is the United States.
The State Department routinely updates its assessments of hot spots around the globe, issuing official "warnings" and "alerts." Warnings are the worst, reserved for nations posing higher risks for travelers, and cover countries such as Haiti, Iraq and Congo. "Alerts," like the one issued for Mexico, do not recommend that visitors avoid an entire country but instead advise them to employ extra caution and avoid specific locales and behaviors. In Mexico, those behaviors include driving at night, buying drugs and visiting the state of Durango.
According to the alert, the threat of bodily harm is part of the ongoing drug war: "Mexican drug cartels are engaged in an increasingly violent conflict -- both among themselves and with Mexican security services -- for control of narcotics trafficking routes along the U.S.-Mexico border. In order to combat violence, the government of Mexico has deployed troops in various parts of the country. U.S. citizens should cooperate fully with official checkpoints when traveling on Mexican highways."
The alerts are a poke in Mexico's eye as well as a source of friction. As Mexican commentators point out, the country is fighting to stop drugs heading to the world's largest consumer nation -- the United States.
The department uses strong language to describe the situation in Mexico. "U.S. citizens are urged to be alert to safety and security concerns when visiting the border region. . . . While most crime victims are Mexican citizens, the uncertain security situation poses serious risks for U.S. citizens as well," the alert states. "Robberies, homicides, petty thefts, and carjackings have all increased over the last year across Mexico generally, with notable spikes in Tijuana and northern Baja California. Ciudad Juarez, Tijuana and Nogales are among the cities which have recently experienced public shootouts during daylight hours in shopping centers and other public venues."
The State Department will review the situation again in six months.

AMERICAN turns over 12,000 ILLEGALS to BORDER PATROL where was his government?

A former Cochise County sheriff´s deputy who later was successful in the towing and propane business, Mr. Barnett spent $30,000 on electronic sensors, which he has hidden along established trails on his ranch. He searches the ranch for illegal immigrants in a pickup truck, dressed in a green shirt and camouflage hat, with his handgun and rifle, high-powered binoculars and a walkie-talkie.

His sprawling ranch became an illegal-immigration highway when the Border Patrol diverted its attention to several border towns in an effort to take control of the established ports of entry. That effort moved the illegal immigrants to the remote areas of the border, including the Cross Rail Ranch.

"This is my land. I´m the victim here," Mr. Barnett said. "When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back."

I think that he should file a counter suit against the Mexican government in the world court or the United Nations. I'm sure that there are many others that would team up for some kind of class action suit. Any lawyers out there interested?

Buzz up!An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.

The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.

Attorneys for the immigrants - five women and 11 men who were trying to cross illegally into the United States - have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.

The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at "gunpoint, yelling obscenities at them and kicking one of the women."

In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English and Spanish. At one point, it said, Mr. Barnett's dog barked at several of the women and he yelled at them in Spanish, "My dog is hungry and he's hungry for buttocks."

The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

In March, U.S. District Judge John Roll rejected a motion by Mr. Barnett to have the charges dropped, ruling there was sufficient evidence to allow the matter to be presented to a jury. Mr. Barnett's attorney, David Hardy, had argued that illegal immigrants did not have the same rights as U.S. citizens.

Mr. Barnett told The Washington Times in a 2002 interview that he began rounding up illegal immigrants after they started to vandalize his property, northeast of Douglas along Arizona Highway 80. He said the immigrants tore up water pumps, killed calves, destroyed fences and gates, stole trucks and broke into his home.

Some of his cattle died from ingesting the plastic bottles left behind by the immigrants, he said, adding that he installed a faucet on an 8,000-gallon water tank so the immigrants would stop damaging the tank to get water.

Mr. Barnett said some of the ranch´s established immigrant trails were littered with trash 10 inches deep, including human waste, used toilet paper, soiled diapers, cigarette packs, clothes, backpacks, empty 1-gallon water bottles, chewing-gum wrappers and aluminum foil - which supposedly is used to pack the drugs the immigrant smugglers give their "clients" to keep them running.

He said he carried a pistol during his searches for the immigrants and had a rifle in his truck "for protection" against immigrant and drug smugglers, who often are armed.

Almost half of California seniors struggle to survive

Groceries or medicine? Rent or heat? Two meals or three? Almost half of California's seniors confront these essential survival questions each day, according to a new study released today by researchers calling on the state to better track its seniors who have slipped off the public's radar.
The UCLA Center for Health Policy Research report measured economic stability by the real costs to eat, travel and pay for medical costs and housing in each of California's 58 counties.
Its findings reveal 47 percent of state residents 65 and older are unable to pay for their basic needs. That's 864,000 seniors, more than half of whom struggle at home alone.
The new data reveal far deeper poverty rates among seniors than was previously known. According to the decades-old standard of measuring poverty, only 9 to 10 percent of California seniors were considered poor, that is, earning less than $10,000 a year. Researchers note that amount is peanuts in high-cost California, failing to reflect the true cost of survival.
"For us, what's striking is that these numbers are not even taking into account the latest economic crisis," said co-author Susie Smith, a program director at the nonprofit Insight Center for Community Economic Development. She noted the report used 2007 census data. "We can only imagine when we update this information next year, what the numbers are going to look like."
One additional hardship is already known: The recently passed state budget cuts aid to thousands of seniors.
In Silicon Valley, more than 48 percent of seniors fell below the survival standard. In Santa Clara County — where homeownership for many has shifted from a poverty-buffer to a neck yoke — there are signs that homeowners face particularly dire trade-offs as –non-housing costs grow making mortgages more difficult to meet.
Frances Perez, a 69-year-old Santa Clara resident raising two family members she rescued from foster care, relies on Social Security to survive. Twenty years working on an electronics assembly line left her with a ruptured disc in her neck and injured an arm.
Earlier this year, Perez and her husband almost lost their home to foreclosure, and she often can't afford her medications for high blood pressure, cholesterol and a heart condition because food and house payments come first.
Still, Perez refused to complain, noting that her sister helps out with groceries.
"We're lucky we have an income. It's not much, but we get by," she said. "There are people more unfortunate than us, people that are homeless, and some of them really need help."
Indeed, Perez is far from the worst off. The UCLA report found the most impoverished seniors include single women, seniors over age 75, those living alone, and renters. The two hardest hit counties are San Francisco and Imperial counties, where 61 and 67 percent of seniors, respectively, struggle.
Deep disparities also exist for nonwhite elders, some tracing to historical injustices that kept minorities from union jobs that offered pensions or steered them to low-paying manual work, according to the study. Seven out of 10 Latino and African-American senior citizens, and six out of 10 Asians, live below the survival standard.
The researchers are calling on the state to continue their data collection and use the new measurement to determine eligibility for need-based public programs. California's aged population is expected to grow by 18 percent in the next four years.
Little in the state budget so far, or the federal stimulus package, will be of much assistance. California's budget passed last week will cut SSI payments for hundreds of thousands of California seniors by $37 each month, with the possibility of another $20 cut come July. Cuts to home health care subsidies which keep the elderly and infirm out of more costly nursing homes also loom.
President Barack Obama's stimulus plan will, however, provide some temporary relief for SSI recipients who are blind, elderly or disabled, a group that number 1.3 million in California. Those recipients will receive a one-time $250 cash payment in the coming months.
The Elder Economic Dignity Act of 2009, a bill introduced this month by Assemblyman Jim Beall, D-San Jose, calls for the state to continue tracking seniors in poverty using new measurements. At present, officials rely on a 50-year-old federal measure to determine who is above or below poverty.
"There are a lot of hungry seniors, a lot of seniors who have suffered economically over the last decade," Beall said. "So to use a measurement that goes back to the 1950s is clearly not appropriate."

In 2003, according to the Arizona Department of Motor Vehicles, 57,600 cars were stolen in Phoenix. It is now the car-jacking capital of the world. Most were SUV’s and pickup trucks. At a conservative average of $15,000.00 per vehicle, owner losses exceeded $864 million. Insurance companies in the state suffered incredible claims from policyholders. Arizona is the temporary home of 500,000 illegal aliens. Annually, 75 percent of drugs arrive from Mexico at a net cost of $120 billion hard currency that leaves our country for good. In addition, our tax dollars pay $80 billion for the War on Drugs each year. It is a war that hasn’t been won in the past 30 years and drugs are as available today to your teenager as they were in 1970. When an alien criminal gets caught for rape, murder or drug distribution, you pay $1.6 billion annually in prison costs to house, feed and clothe those filling 30 percent of our federal and state prisons—not to mention TV, movies, weight rooms and other entertainment—they enjoy while being incarcerated. Over 300,000 women annually arrive pregnant and drop them on U.S. soil. The American taxpayer pays for food, housing, medical and schooling for them to age 18 PLUS their mother. According to the Center for Immigration Studies, average annual cost per child K-12 is $7,161.00 and exceeds $109 billion annually per cycle of anchor babies. The average head of household illegal alien costs you $2,700.00 in welfare money over and above any taxes he or she pays in their meager paying jobs. With 15 to 20 million illegal aliens in the USA, that figures exceeds $20 billion of your tax dollars. That’s after their kids enjoyed free education, free lunches, and free medical care paid for by you. Mexico receives $15 billion annually from its worker drones. The lifetime net fiscal drain—taxes paid minus services used—for an adult immigrant is $55,200.00 according to Carrying Capacity Network. With a minimum of 15 million illegal aliens in our country, these figures are the tip of the iceberg. Average bilingual education is $1,200.00 per illegal alien student. Get this! We educate 1.1 million illegal alien children each year. The American public has paid $27 billion to provide forms, ballots, interpreters, and brochures for languages other than English in 2003. An estimated one-third to one-half illegal aliens work off the books. It costs $200 million to provide for emergency health care for illegal aliens in the Border States annually. California with over three million illegals paid $79 million, and four of their major LA hospitals bankrupted and shut their doors in 2004. Texas with 1.5 million illegal aliens paid $74 million in hospital care. Georgia ran a $63 million deficit for 64,000 unpaid doctor visits to their Grady Health Care system in 2002. Georgia taxpayers paid $27 million for 11,188 anchor baby hospital births. Georgia taxpayers paid a whopping $242 million for educating illegal alien kids in 2003. What are the consequences? One in two adult African-Americans in New York is unemployed. African-American children’s poverty grew by 50 percent since 1999. Why? Their dads can’t find work. It costs the taxpayer, $68 billion a year to pay for the resettlement of legal immigrants. Only 22 companies in 2003 were taken to court for hiring illegal aliens. None went to jail. However, it’s a $10,000.00 fine per illegal alien hired and up to five years in prison. You would think that would deter corporations. Not when they’ve bought off enforcement! All those cities and dozens more give sanctuary to illegal aliens with Special Order 40. Illegals remain in our country with exemption from arrest—yet, they are federal criminals! A national consensus on immigration is clear from the wide range of polls on the issue over the past several years: By overwhelming margins, Americans want to cut back drastically on immigration—not bring in new immigrants or legalize those who are already here illegally. Limiting immigration has the overwhelming support of most Americans, regardless of party affiliation or race.

• A Roper poll in January found that 83% of Americans favor a lower immigration level. 70% favor restricting immigration to less than 300,000 new immigrants a year (including 70% of Republicans, 73% of African-Americans, and 52% of Hispanics). Most want even larger cuts: 54% favor an immigration level of below 100,000 a year. 20% support no immigration at all. The same Roper poll found that a large majority (75%) supports strong laws to identify and deport illegal immigrants. Only 10% disagree with strict laws against the removal of illegal immigrants. The strongest supporters of tough measures against illegal immigrants are self-styled political moderates (78%), strongly religious (76%), whites (77%), Protestants (82%), and Midwesterners (85%). 76% of Democrats, 76% of Republicans, 78% of self-described middle-of-the-roaders, and 60% of Hispanics (English-speaking) also support tough laws against illegal immigrants. • 52% of all Americans favor a five-year ban on all legal and illegal immigration to the U.S., including 54% of all Republicans and 48% of all Democrats. • 50% favor a law that would stop all legal immigration into the U.S. for the next five years. • 63% of Americans think immigration levels are too high, including 66% of Republicans and 60% of Democrats. • 62% of Americans think immigration levels should be decreased, 27% think the present levels should remain, and 12% say they should be increased. Some lawmakers are particularly concerned with the attitudes of Hispanics on the immigration issue. Polls show that Hispanic Americans, like all Americans, support cutbacks in immigration. • 89% of Hispanic Americans strongly support an immediate moratorium on immigration. 74% feel fewer immigrants should be allowed and stronger restrictions should be enforced. • Hispanics favor reducing immigration by a margin of 53% to 35% in Texas, 48% to 40% in New York, and 47% to 39% in Florida. Rudolfo de la Garza, a University of Texas at Austin professor and one of the directors of the study, said: “U.S born Mexican-Americans believe that they suffer a lower quality of services because of the excess demand on them generated by the immigrants.” • 43% of Hispanics nationwide think the government is not doing enough to stop illegal immigration. The more established Hispanics are in the United States, the more likely they are to think the government is not doing enough to curb illegal immigration. 37% of foreign-born Hispanics believe not enough is being done; that belief increases to 45% of first-generation Hispanics and half of second-generation Hispanics. GEORGIA • 69% believe that the quality of life in the state will deteriorate if current growth and population trends continue. 74% are concerned about the level of immigration to the U.S. 79% are specifically concerned about the level of immigration to Georgia. 61% oppose amnesty for illegal immigrants. IOWA • 62% of Iowans feel that the U.S. should lower its current level of immigration. 65% feel that a U.S. population of 400 million in 2050, as projected by the U.S. Census Bureau, is too large. KANSAS • 86% of Kansans say levels of immigration into the U.S. are a “serious” or “very serious” problem. MARYLAND • 68% of Maryland voters are concerned about the current level of immigration to the state, and 58% want the federal government to lower immigration levels to reduce development pressures on the environment. 61% think overpopulation in Maryland is a major problem. • Two-thirds of adults in rural southern Maryland say the place where they live is growing too fast. Frustration with crowded roads is mounting, and nearly two-thirds want strict new limits on development. MICHIGAN • 52% of Michigan voters say legal immigration levels should be decreased, 41% say they should remain at present levels, and 4% say they should increase. NEW JERSEY • 82% of New Jersey residents say that illegal immigration is an important problem facing the country. 39% say it is one of the most important problems. TEXAS • 82% of Texans see illegal immigration as a serious problem (including 86% of Caucasians and 69% of Hispanics), and 61% say the federal government is not doing enough to stop it. VIRGINIA • 73% consider the pace of population growth to be an urgent problem, with 60% saying it threatens quality of life in the state. 70% say they are concerned about the level of immigration to Virginia, and 57% say they would be more likely to support a candidate for Congress who supported a reduction in national immigration levels.

What will America stand for in 2050?
The US should think long and hard about the high number of Latino immigrants.

PALO ALTO, CALIF.
President Obama has encouraged Americans to start laying a new foundation for the country – on a number of fronts. He has stressed that we'll need to have the courage to make some hard choices. One of those hard choices is how to handle immigration. The US must get serious about the tide of legal and illegal immigrants, above all from Latin America.
It's not just a short-run issue of immigrants competing with citizens for jobs as unemployment approaches 10 percent or the number of uninsured straining the quality of healthcare. Heavy immigration from Latin America threatens our cohesiveness as a nation.
The political realities of the rapidly growing Latino population are such that Mr. Obama may be the last president who can avert the permanent, vast underclass implied by the current Census Bureau projection for 2050.
Do I sound like a right-wing "nativist"? I'm not. I'm a lifelong Democrat; an early and avid supporter of Obama. I'm gratified by his nomination of Sonia Sotomayor to the Supreme Court. I'm also the grandson of Eastern European Jewish immigrants; and a member, along with several other Democrats, of the advisory boards of the Federation for American Immigration Reform and Pro English. Similar concerns preoccupied the distinguished Democrat Barbara Jordan when she chaired the congressionally mandated US Commission on Immigration Reform in the 1990s.
Congresswoman Jordan was worried about the adverse impact of high levels of legal and illegal immigration on poor citizens, disproportionately Latinos and African-Americans. The principal beneficiaries of our current immigration policy are affluent Americans who hire immigrants at substandard wages for low-end work. Harvard economist George Borjas estimates that American workers lose $190 billion annually in depressed wages caused by the constant flooding of the labor market at the low-wage end.
The healthcare cost of the illegal workforce is especially burdensome, and is subsidized by taxpayers. To claim Medicaid, you must be legal, but as the Health and Human Services inspector general found, 47 states allow self-declaration of status for Medicaid. Many hospitals and clinics are going broke because of the constant stream of uninsured, many of whom are the estimated 12 million to 15 million illegal immigrants. This translates into reduced services, particularly for lower-income citizens.
The US population totaled 281 million in 2000. About 35 million, or 12.5 percent, were Latino. The Census Bureau projects that our population will reach 439 million in 2050, a 56 percent increase over the 2000 census. The Hispanic population in 2050 is projected at 133 million – 30 percent of the total and almost quadruple the 2000 level. Population growth is the principal threat to the environment via natural resource use, sprawl, and pollution. And population growth is fueled chiefly by immigration.
Consider what this, combined with worrisome evidence that Latinos are not melting into our cultural mainstream, means for the US. Latinos have contributed some positive cultural attributes, such as multigenerational family bonds, to US society. But the same traditional values that lie behind Latin America's difficulties in achieving democratic stability, social justice, and prosperity are being substantially perpetuated among Hispanic-Americans.
Prominent Latin Americans have concluded that traditional values are at the root of the region's development problems. Among those expressing that opinion: Peruvian writer Mario Vargas Llosa; Nobelist author Octavio Paz, a Mexican; Teodoro Moscoso, a Puerto Rican politician and US ambassador to Venezuela; and Ecuador's former president, Osvaldo Hurtado.
Latin America's cultural problem is apparent in the persistent Latino high school dropout rate – 40 percent in California, according to a recent study – and the high incidence of teenage pregnancy, single mothers, and crime. The perpetuation of Latino culture is facilitated by the Spanish language's growing challenge to English as our national language. It makes it easier for Latinos to avoid the melting pot and for education to remain a low priority, as it is in Latin America – a problem highlighted in recent books by former New York City deputy mayor Herman Badillo, a Puerto Rican, and Mexican-Americans Lionel Sosa and Ernesto Caravantes.
Language is the conduit of culture. Consider: There is no word in Spanish for "compromise" (compromiso means "commitment") nor for "accountability," a problem that is compounded by a verb structure that converts "I dropped (broke, forgot) something" into "it got dropped" ("broken," "forgotten").
As the USAID mission director during the first two years of the Sandinista regime in Nicaragua, I had difficulty communicating "dissent" to a government minister at a crucial moment in our efforts to convince the US Congress to approve a special appropriation for Nicaragua.
I was later told by a bilingual, bicultural Nicaraguan educator that when I used "dissent" what my Nicaraguan counterparts understood was "heresy." "We are, after all, children of the Inquisition," he added.
In a letter to me in 1991, Mexican-American columnist Richard Estrada described the essence of the problem of immigration as one of numbers. We should really worry, he wrote, "when the numbers begin to favor not only the maintenance and replenishment of the immigrants' source culture, but also its overall growth, and in particular growth so large that the numbers not only impede assimilation but go beyond to pose a challenge to the traditional culture of the American nation."
Obama should confront the challenges by enforcing immigration laws on employment to help end illegal immigration. We should calibrate legal immigration annually to (1) the needs of the economy, as Ms. Jordan urged, and (2) past performance of immigrant groups with respect to acculturation.
We must declare our national language to be English and discourage the proliferation of Spanish- language media. We should limit citizenship by birth to the offspring of citizens. And we should provide immigrants with easy-to-access educational services that facilitate acculturation, including English language, citizenship, and American values.

The three adopted the 'Security and Prosperity Partnership of North America' and assigned 'working groups' to fill in the details. It was at this same meeting, grandly called the North American Summit, that President Bush pinned the epithet 'vigilantes' on the volunteers guarding our border in Arizona."

The CFR report – important excerpts of which are published in Whistleblower – also suggests North American elitists begin getting together regularly, and presumably secretly, "to buttress North American relationships, along the lines of the Bilderberg or Wehrkunde conferences, organized to support transatlantic relations." The Bilderberg and Wehrkunde conferences are highly secret conclaves of the powerful. For decades, there have been suspicions that such meetings were used for plotting the course of world events and especially the centralization of global decision-making.

A roadblock to Mexico
In a move that defies the North American Free Trade Agreement and hurts U.S. workers, Congress is denying Mexican truckers permission to travel more than a few miles north of the border.

Thanks to the latest protectionist move by Congress to dodge our free-trade obligations with Mexico, in six to eight weeks, more than 20,000 pounds of California strawberries that ordinarily would be headed south of the border will have nowhere to go. The 80,000 people employed by the industry, however, know exactly where their jobs will be headed -- into thin air. At least that's the worst-case scenario if Congress doesn't find a way to honor the North American Free Trade Agreement and give Mexican trucks permission to travel more than a few miles north of the border, as required by the treaty.

Earlier this month, Congress killed a successful pilot project that gave a handful of Mexican truckers freedom to haul products beyond a circumscribed region, citing specious environmental and safety concerns. And Mexico responded by slapping tariffs on 90 U.S. exports. But let's be clear, this isn't about safety; Congress just wants the benefits of free trade without the sacrifices that come with it. Nor is this recalcitrance new. In 1995, after the United States refused to comply with NAFTA's cross-border trucking provision, Mexico negotiated for three years and then sought help from an arbitration panel. The result was a unanimous ruling that the U.S. was in violation of the treaty and that Mexico was within its rights to retaliate. In response, Congress introduced 22 new safety requirements for Mexican trucks. Finally, after more negotiations, the two countries compromised on an 18-month demonstration project that permitted 45,000 border crossings by 103 trucks from Mexico and 61 from the United States. The safety records were excellent, giving the lie to the idea that the program created a hazard.

The California congressional delegation must take the lead on this matter and revive the program. Free trade is not a zero-sum game in which double-dealing with Mexico benefits U.S. workers. Maybe the Teamsters are now safe from competition, but other workers and industries will suffer. The state's grape growers, for example, face a staggering 45% tariff on their exports, which would effectively close a market worth $58 million to them and jeopardize the livelihoods of 50,000 people. Sen. Byron L. Dorgan (D-N.D.), who sponsored the amendment killing the pilot program, says he'll support Mexican trucking if his safety concerns are addressed; the Obama administration says it is committed to a new program, and the U.S. trade representative is crafting new legislation now. But they need to hurry. After 14 years of reneging on this program, the U.S. has to make good on its word -- in the next eight weeks.

Drug cartels raise the stakes on human smuggling
Exploitation of illegal immigrants has become worse, officials say, and the failure of U.S. agencies to work together has hindered efforts to stop the organizations.

Reporting from Washington — Mexican drug cartels and their vast network of associates have branched out from their traditional business of narcotics trafficking and are now playing a central role in the multibillion-dollar-a-year business of illegal immigrant smuggling, U.S. law enforcement officials and other experts say.

The business of smuggling humans across the Mexican border has always been brisk, with many thousands coming across every year.

But smugglers affiliated with the drug cartels have taken the enterprise to a new level -- and made it more violent -- by commandeering much of the operation from independent coyotes, according to these officials and recent congressional testimonies.

U.S. efforts to stop the cartels have been stymied by a shortage of funds and the failure of federal law enforcement agencies to collaborate effectively with one another, their local and state counterparts and the Mexican government, officials say.

U.S. authorities have long focused their efforts on the cartels' trafficking of cocaine, marijuana, heroin and methamphetamines, which has left a trail of violence and corruption.

Many of those officials now say that the toll from smuggling illegal immigrants is often far worse.

The cartels often further exploit the illegal immigrants by forcing them into economic bondage or prostitution, U.S. officials say. In recent years, illegal immigrants have been forced to pay even more exorbitant fees for being smuggled into the U.S. by the cartel's well-coordinated networks of transportation, communications, logistics and financial operatives, according to officials.

Many more illegal immigrants are raped, killed or physically and emotionally scarred along the way, authorities say. Organized smuggling groups are stealing entire safe houses from rivals and trucks full of "chickens" -- their term for their human cargo -- to resell them or exploit them further, according to these officials and documents.

Rep. Loretta Sanchez (D-Garden Grove) said greed and opportunity had prompted the cartels to move into illegal immigrant smuggling.

"Drugs are only sold once," Sanchez, the chairwoman of the House Homeland Security border subcommittee, said in an interview. "But people can be sold over and over. And they use these people over and over until they are too broken to be used anymore."

The cartels began moving into human smuggling in the late 1990s, initially by taxing the coyotes as they led bands of a few dozen people across cartel-controlled turf near the border.

After U.S. officials stepped up border enforcement after the Sept. 11 terrorist attacks, the price of passage increased and the cartels got more directly involved, using the routes they have long used for smuggling drugs north and cash and weapons south, authorities said.

Sometimes they loaded up their human cargo with backpacks full of marijuana. In many cases, they smuggled illegal immigrants between the two marijuana-growing seasons, authorities said.

Kumar Kibble, deputy director of the Department of Homeland Security's Immigration and Customs Enforcement's office of operations, said the cartels made money by taxing coyotes and engaging in the business themselves.

"Diversification has served them well," Kibble said.

Unlike the drug-trafficking problem, the cartels' involvement in human smuggling has received scant attention in Washington.

That is the case even as the Obama administration and Congress increasingly focus their attention on Mexico, fearing that its government is losing ground in a battle against the cartels that has resulted in the deaths of more than 7,000 people since the beginning of 2008.

At one of many congressional hearings on the subject last week, Sen. Richard J. Durbin (D-Ill.) unveiled a chart that he said described the cartels' profit centers: drugs, weapons and money laundering.

"I would add one thing, senator," said Arizona Atty. Gen. Terry Goddard, who then described to Durbin his concerns about the cartels' movement into illegal immigrant smuggling. "It is really a four-part trade, and it has caused crime throughout the United States."

Arizona has become the gateway not only for drugs, but also illegal immigrants. Fights over the valuable commodity have triggered a spate of shootings, kidnappings and killings, Goddard and one of his chief deputies said in interviews.

In Arizona, the cartels grossed an estimated $2 billion last year on smuggling humans, Goddard said.

Senior officials from various federal law enforcement agencies confirmed that they were extremely concerned about the cartels' human smuggling network.

In recent years, the U.S. government has taken significant steps to go after illegal immigrant smugglers on a global scale, setting up task forces, launching public awareness campaigns and creating a Human Smuggling and Trafficking Center to fuse intelligence from various agencies.

But at the southern border, the effort has stumbled, in part because Homeland Security and various Justice Department agencies have overlapping responsibilities and are engaging in turf battles to keep them, Goddard and numerous other federal and state officials said.

The vast majority of ICE agents cannot make drug arrests, for instance, even though the same smugglers are often moving illegal immigrants.

The reason: The Drug Enforcement Administration has not authorized the required "cross-designation" authority for them, according to Kibble and others. A top DEA official said that was partly to prevent ICE agents from unwittingly compromising ongoing DEA drug investigations and informants working the cartels.

Agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives focus almost exclusively on cartel efforts to smuggle large quantities of American-made weapons into Mexico.

"The only way we're going to be successful is to truly mount a comprehensive attack upon the cartels. They're doing a comprehensive attack on us through all four of these different criminal activities," Goddard told a Senate Judiciary subcommittee.

"I'm afraid in this country we tend to segregate by specialty the various areas that we are going to prosecute. And our experience on the border is we can't do that. We've got to cross the jurisdictional lines or we're going to fail."

Kibble agreed, saying that the cartels' diversification will require federal agencies to work together. "It means we need more teamwork so things don't slip through the cracks."

He added: "We are very focused on it and applying law enforcement pressure to all aspects of the cartels' activities."

Asked for comment, Justice Department officials referred calls to Homeland Security.

But authorities are also hampered by budget shortcomings and other obstacles.

Even though ICE has primary responsibility over illegal immigrant smuggling, it has only 100 agents dedicated to the task, Kibble said.

There is no line item in ICE's budget for human smuggling, so no one knows how much money is being spent on it, he told Sanchez's border subcommittee, before acknowledging that the agency needs more resources to fight the problem.

There are also not enough resources for providing medical treatment and protection for those illegal immigrants who are caught, so many of them are not available to testify, said Anastasia Brown, the director of refugee programs for the U.S. Conference of Catholic Bishops.

As a result, there have been relatively few prosecutions and convictions.

In fiscal 2008, ICE initiated 432 human smuggling investigations, including 262 cases of alleged sexual exploitation and 170 cases of suspected labor exploitation.

Those efforts resulted in 189 arrests, 126 indictments and 126 convictions related to human smuggling, according to Homeland Security documents provided to Congress.

Cameron H. Holmes, an assistant Arizona attorney general at the front lines of the fight against cross-border human smuggling, agreed that federal authorities were trying to collaborate better.

"Are they working together enough? Absolutely not. Are they being successful? Look around," Holmes said, before describing details of illegal immigrant smuggling cases in which people were killed or enslaved for years.

"We have a multibillion criminal industry that has grown up in the last 10 years and it all involves violations of federal law. I would not call that a success."

In January, 2007 when the minimum wage was increased from $5.15 to $7.25, Pelosi had American Samoa exempted from the increase so Del Monte would not have to pay the higher wage. This would make Del Monte products less expensive than their competition's.

Last week when the huge bailout bill was passed, Pelosi added an earmark to the final bill adding $33 million dollars for an "economic development credit in American Samoa".

Pelosi has called the Bush Administration "corrupt".
