It's amazing how far the L.A. Slimes can slant a story to the left. At least 12 states are preparing to put an SB1070 style initiative on their next ballot (including California). And even if Obama's activist judges shoot them all down they'll be enforced as soon as Republican take the Whitehouse back in 2 years. Seems like the only word the L.A. Slimes got right is "momentum", which is going against Obama and other open borders zealots.

I wonder if it's just me but this sure seems to be one of those Times pieces that say "public perception is more important than reality".



One big thing the piece ignores is the Obama Administrations attempt to bury Arizona in legal bills to discourage States doing anything about the problem, legal or not.



The last thing the Times and the rest of the sanctuary movement want to see is illegal immigration become an issue in the 2012 elections.



I'd really like to know the position on immigration of Mr. Obama's challengers.

Why not remove business licenses and criminally prosecute the employers that hire illegal workers? We all know that these worker end up costing tax payer Billions of dollars anually here in California. Funny you would think with Unemployment here in Calfornia over 12% you would want more legal worker paying their taxes, to help grow our State's economy. Utah state law of granting guest worker cards will end up being overturn due to our Constitition requiring Congress to be in controll of our Immigration laws. Why does L.A. Times continue to advocate for open borders? Most Legal Immigrates and American citzens do not want open borders. Why do we have Immigration laws? Do you think that anyone in the world can just show up in USA and just be granted permanente resident or a guest worker? Immigration requires criminal, medical background checks on these indivials prior to entering our country. It is a privilage to be a American citizen not a world right. No other Country in the world allows citzenship by just giving by giving birth on its soil. Of Course the U.S. Sumpreme court needs to interpret the 14 amendement . Since the @ the time this amendement was passed our Country did not even know what a illegal immigrate,alien or worker was.

Ian, you are mistaken. Yes there are countries that allow jus soli (less than 20%). When you look at the list, they are mostly third world cesspools. The only exceptions to this are USA and Canada.

Except back at the time of an active Ellis Island there was no welfare and their was no need for immigration restrictions. Hey! But Utah is open to occupation as they have just passed a law, to bring in Guest Workers from another corrupt province south of the border. So all those illegal aliens that are dismayed with the State of Arizona policing laws, are leaving and going elsewhere? MANY STATES THAT HAS NO EFFECTIVE POLICING LAWS will also become an unaware target. Conversely, those States who are mandating the federal E-Verify computer data-bases operated by the Social Security and (ICE) Immigration and Custom Services to qualify true US workers will not be swamped with foreigners.

Most States never hear the truth of the illegal alien importation, as the politicians are in collusion with businesses and other special interest. The Leftist press never reveals any of the facts about the assault on our traditions and society, using the race card if we make waves. If we offer negative dialogues about the invasion we are labeled bigots. While all the time "tired and poor" Americans are being crippled by higher taxes, to pay for the education, medical care and a other public programs. Now foreign nationals can skedaddle over to Utah as the Legislators are welcoming them. If they don't fancy Utah, the Sanctuary State of California still has a wide open welfare system, so they can start feeding off the taxpayers there. All these people need is a bogus Social Security number and Drivers license to collect hand-full’s of money and Democrat Governor Jerry Brown will leach that extra money from taxes or cut spending to legal residents. Some States are even thinking of rescinding the use of displaying drivers licenses, government ID, passports and other verification documents, to vote. This will be a major error for citizen voters, as this will become a loophole for illegal immigrants--intentional or not--to use fraudulent absentee ballots and in polling stations.

In soft States the politicians will give out Section 8 housing, taken away from Senior Citizens who have worked all their lives. Never mind that these persons come to American penniless and the females have a 14th Amendment citizenship infant, requiring no insurance and burdening the emergency rooms—because the Liberal Court system mandated it. Guaranteeing the State taxpayers will subsidize the low income housing and all public services. The more children they conceive, the more cash payments they can accumulate. Texas lawmakers are suddenly feeling guilty of these reoccurring financial circumstances, because they too have been flooded for decades with a part of the 20 million foreigners from all parts of the world. California is the perfect place to inhabit, even though they a facing massive cutbacks in their economy, as they have a 24 billion dollars deficit.

Hundreds of thousands will pour in from not just South of the border, but thousands from Arizona and other illegal alien policing enforcement states. New Mexico is suffering the exact scenario since AZ has passed it's new laws.



1,000's of Illegal Immigrants (and their families) have swamped NM.



BUT - the "problem" is that NM has 10% unemployment, so there is basically no jobs for their new ILLEGAL residents.



In 2010/2011 Crime has shot up in NM, and the police are undermanned due to reduced budgets...

Forty-six state legislatures and the District of Columbia passed 208 laws and adopted 138 resolutions for a total of 346.

Mr. Janssen had more to do with the failure of his anti-immigrant bill to lost momentum while testifying in front of the Judiciary Committee who needed to approve LB 48 before the legislative bill could make the floor of the State's Unicameral. His poorly written bill along with his inability to answer key questions poised to him by Judiciary Committee members did more harm towards the passage of LB 48 than any testimony that came from proponents or opponents to this bill. Mr. Janssen's statement that his opponents to an end around on his tactics is typical of a politician who has lost touch with a segment of those he is sworn to represent. Latinos in Nebraska according to the most recent census figures have grown 77 % in ten years. Five cities in the State now have majority Spanish surname Spanish speaking inhabitants! Now that Conservative Right Wing State politicians trying to do the job the Federal government shouldbe doing are floundering in their efforts, maybe now the Feds will take action before an Arizona style sessessionist movement erupts elsewhere in the United States.

Hey Utah - these folks didn't bother following the law the first time. Why do you think they will conform now? As for AZ, the "anti immigrant sentiment" might have something to do with Phoenix being the kidnapping center of the US. Or it might have to do with AZ residents facing a budget shortfall while illegals pay no taxes on their various employment activities. And use services with impunity. If CA would face the music and stop illegal immigration, our budget would be in a lot better shape. Watch for more and more violent, senseless crime here because its building.

You Do Not talk about the merits of AZ law which merely seeks to Defend AZ from waves of drug-dealers and migrant invaders from Mexico. No, you yap about how popular or unpopular this might be in other states.



The issue is simple: America has a Right to Choose who does and does not cross its borders, enter this country, work here, reside her, become naturalized citizens. WE CHOOSE, not we are Forced to Accept whoever comes--"in your face, man, deal with it "syndrome.



Here's a Proposal : make all invader illegal migrants Register, & make their employer do the same. Place all these people of a list:NEVER ELIGIBLE to Vote or become US Citizen; never eligible to be Permanent Alien Residents. The same prohibition will apply to any child or relative they brought into America!! These kids would pay out-of-state CA university tuition.



That would end the debate:no more cheap labor, no more automatic Democrat voters, no more "Catholics" for LA Archdiocese, no more use of USA as safety valve for corrupt Mexican politicians and their over-population problem. Now, that would be social justice: justice for the aggrieved/oppressed party:the American citizen/taxpayer.

Why can't the states have their own immigration laws ? States have different laws on how old you can be to by alcohol, drive cars, the fee for registering your car, sales tax, the list goes on. Arizona acted because they are on the front line with no support from "in the rear with the gear" federal goverment.

On immigration, momentum shifts away from Arizona

A year after SB 1070 inspired a call for similar laws around the country, other states have failed to follow suit. Only Utah has passed a diluted version.

A year ago, a revolution on immigration enforcement seemed underway, with legislators in at least 20 states vowing to follow the lead of Arizona's tough new law targeting illegal immigrants.

These days, the momentum has shifted.

In at least six states, the proposals have been voted down or have simply died. Many of the other proposals have not even made it past one legislative chamber.

The most-discussed provision in the Arizona law requires police to investigate the status of people they legally stop whom they also suspect are illegal immigrants.

But even in Arizona, several tough immigration proposals have been stalled in the Senate, with business leaders and some Republicans arguing that the state does not need more controversy.

The one state whose Legislature has passed an Arizona-style law, Utah, only approved a diluted bill accompanied by another measure that goes in a dramatically different direction.

The Utah Legislature on Friday voted to create ID cards for "guest workers" and their families, provided they pay a fine and don't commit serious crimes. Immigrants who entered the country illegally would be fined up to $2,500. Immigrants who entered the country legally but were not complying with federal immigration law would be fined $1,000.

"Why not put something in place where, in five years, we can say we did something, rather than sending a few people home?" said state Rep. Bill Wright, who wrote the law. "Sending a few people home will not solve our problems."

Utah's measure is essentially a state version of the comprehensive immigration reform that many backers of the Arizona approach deride as amnesty.

Muzaffar Chishti of the Migration Policy Institute said the momentum behind Arizona's law was similar to the motivations driving Republican campaigns during the 2010 election and a bevy of new "tea party"-backed legislators eager to make their mark.

"There was a strong newcomer's enthusiasm for this," Chishti said. "Now I think reality has set in."

The main factor behind the retreat is skittishness about costs, said Ann Morse, who tracks immigration legislation for the National Conference of State Legislatures.

Arizona was sued by the Obama administration, which secured an injunction against most of the law. That ruling is under appeal and expected to reach the Supreme Court, costing millions in legal fees. Arizona was also hit by boycotts and canceled conventions.

"Most states are looking at where to cut money, not where to spend money," Morse said.

There's still time for the dynamic to change. Laws partly modeled on Arizona's SB 1070 have made their way out of one of the two chambers in legislatures in Indiana, Kentucky and Georgia.

But the situation in Georgia symbolizes why it has been difficult to pass Arizona-style laws. Gov. Nathan Deal, a Republican, campaigned on bringing such legislation to Georgia, but allies accuse him of equivocating because he hasn't vowed to sign the proposal that passed the state House of Representatives on Thursday.

The issue gained traction in Arizona, Krikorian said, because illegal immigration was viewed as such a serious problem there. But elsewhere, "there's no business with full-time employees trying to get immigration laws enforced. In fact, the opposite is true."

"Any progress at all surprises me," he added.

In Nebraska, state Sen. Charlie Janssen's SB 1070-style bill is stuck in the Legislature's judiciary committee, where he says six of the eight members are cool to the idea.

"When you talk to Main Street, Nebraska, they say, 'Go do it,'" Janssen said. "But when you get down here, the advocacy groups get to all the individual senators."

In Florida, a measure modeled on SB 1070 is unlikely to pass, but the Republican-controlled Legislature will still consider requiring that all people booked into jail be checked for immigration violations.

"What's encouraging is they're backing away from the blatant anti-immigrant sentiment in Arizona," said Subhash Kateel of the Florida Immigration Coalition. "But there's politicians who campaigned on doing Arizona-style stuff, and now they have to do something."

In Arizona itself, SB 1070 helped propel Republicans to record margins in both chambers of the Legislature and to a clean sweep of statewide elected offices during the November election. Polls show the measure is very popular in the state and nationwide.

But its author, Senate President Russell Pearce, has been unable to replicate the measure's smooth passage with the latest batch of immigration laws. He did not respond to requests for comment.

Proposals to require that hospitals check patients' immigration status, that teachers and social workers refer suspected illegal immigrants to the federal government and that U.S.-born children of illegal immigrants be denied citizenship have all squeaked through state Senate committees. They have yet to face a vote in the full Senate. It's possible the measures will ultimately pass, but many political observers in the state are surprised there has been Republican opposition to them.

"We have other more important issues and this distracts us from them," said Sen. John McComish, a Republican who voted for SB 1070.

The biggest shift in dynamics is in Utah, where, the day SB 1070 was signed last year, a legislator vowed to bring the same law to the Beehive State. In response, business and community groups issued a statement of principles known as the Utah Compact to fight the measure. The Church of Jesus Christ of Latter-day Saints, which is growing rapidly overseas and in immigrant communities in the United States, endorsed the compact.

When the Utah Legislature acted on immigration last week, it moved in contradictory directions, trying to satisfy activists who want a tough approach to illegal immigration and business and religious leaders who urge flexibility and compassion for working families.

The Legislature weakened the Arizona-style law, which would now only require immigration checks of people arrested for felonies and serious misdemeanors. Still, the measure easily passed both houses. The guest-worker ID program also won easy approval.

The guest-worker bill depends on a federal waiver, and there are many who are skeptical the federal government would grant it. "It sends a bad message, that Utah wants its own amnesty program," said Ronald Mortensen, a Utah-based activist against illegal immigration. "I think there's going to be a lot of upset people."

Critics call Utah's guest-worker effort an unconstitutional attempt to create a state-level immigration policy just to send a message to a deadlocked Washington. That was also a central criticism of Arizona's law.

On Friday, as the heavily conservative state Senate debated the issue, senator after senator said the measure was a needed warning for a Washington they see as out of touch on taxes and regulation. State Sen. Howard Stephenson compared the move to the opening shots of the Revolutionary War.

"We are in a sense firing a shot and saying we are going to do it right," Stephenson said, "and set a pattern for Congress and the rest of the nation to follow."

Chamber of Commerce Says It Supports Path 'To Legitimacy' for 12 Million Illegal Aliens

(CNSNews.com) - U.S. Chamber of Commerce President and CEO Tom Donohue, noting that 27 million Americans are unemployed, underemployed, or have given up on finding a job, said his organization supports a "way" "to legitimacy" for the estimated 12 to 14 million illegal aliens who are working in the United States.

“Unemployment had exceeded 9 percent for 20 consecutive months,” Donohue said in his annual State of American Business address at the Chamber’s headquarters in Washington, D.C., on Tuesday. “Some 27 million Americans are either unemployed, underemployed or have give up looking for work.”

“In fact,” Donohue said, “we must create 1.2 million jobs a year just to absorb the new entrants into our workforce.”

Later in his remarks, Donohue said the Chamber would continue its efforts in support of comprehensive immigration reform, which some conservative critics consider to be a form of amnesty.

“Almost all of us are sons, daughters, or descendents of immigrants,” Donohue said. “The Chamber will continue to pursue comprehensive immigration reform.” He also cited the "urgent" need to improve visa processing, oppose attempts to gut temporary worker programs, and increase the number of foreign worker visas.

At a press conference following his speech, Donohue was asked by CNSNews.com if comprehensive immigration reform included a so-called pathway to citizenship.

“We think the most important parts of comprehensive immigration reform would be, first of all, a way for the, shall we say 12 million here, to legitimacy so that they can easily participate in society, pay their taxes, drive cars and that sort of thing,” Donohue said. “Second we need a guest worker program,” he said. “People could easily come back and forth for work and some of that would be seasonally, for crops and for recreation organizations and so on.

“And third, we definitely need a way to deal with high-end, talented folks that are needed in this economy. Donohue called it "amazing" that after years of training in America, professionals such as Ph.Ds in chemical engineering are now finding it hard to stay here.

Donohue said citizenship for illegal aliens should not be the top priority. “I don’t think the citizenship thing is necessary right now,” said Donohue, adding that protecting the U.S. border was also important. “I think we ought to pick the four or five things that everybody needs and let’s get it done.”

Donohue also said that the United States should keep the promise it made to Mexico 15 years ago to allow “safe, carefully inspected” Mexican trucks to transport goods into the U.S., as called for in the North American Free Trade Agreement. Labor unions strongly oppose the plan.

Donohue said the U.S. economy is “in better shape than we found ourselves last year,” and he noted “a new tone coming out of the White House.”

One indication of warming relations between the White House and the Chamber, which represents 3 million mostly small businesses, includes a scheduled address by President Barack Obama at the group’s headquarters on Feb. 7.

Among the areas Donohue said the Chamber would concentrate on in 2011:

-- restraint and reform of the regulatory process, including stopping the EPA from enacting regulations to limit greenhouse gases – a task that should be left to Congress, he said.

--Expanding American trade, rebuilding the country’s infrastructure and developing U.S. energy resources, and reducing the federal debt and deficit also made the top four on Donohue’s to-do list.

Donohue concluded his remarks with his trademark line-in-the-sand approach while expressing optimism that the Chamber can “work together” with the Obama administration and Congress in the coming year.

“Our approach in Washington will be to call them as we see them,” Donohue said. ‘We’ll continue to have our differences with the White House on some issues but we’ll work together on other issues."

“We’ll support the new House leadership on many occasions, and we’ll work with Democratic legislators as well, but no one should expect the Chamber to march in lock step with anyone,” Donohue said.

“We have a clear mission and agenda of our own,” he said. “It’s to continue to win important policy victories for our members and the American business community. It’s to support, protect, and advance the free enterprise system that made this country great. And it’s to help create good jobs and promising opportunities for all the people of our country so that they can achieve the American dream."

The rich are getting richer and the poor are getting poorer at a staggering rate. Once upon a time, the United States had the largest and most prosperous middle class in the history of the world, but now that is changing at a blinding pace.

So why are we witnessing such fundamental changes? Well, the globalism and "free trade" that our politicians and business leaders insisted would be so good for us have had some rather nasty side effects. It turns out that they didn't tell us that the "global economy" would mean that middle class American workers would eventually have to directly compete for jobs with people on the other side of the world where there is no minimum wage and very few regulations. The big global corporations have greatly benefited by exploiting third world labor pools over the last several decades, but middle class American workers have increasingly found things to be very tough.

Here are the statistics to prove it:

• 83 percent of all U.S. stocks are in the hands of 1 percent of the people.

• 61 percent of Americans "always or usually" live paycheck to paycheck, which was up from 49 percent in 2008 and 43 percent in 2007.

• 66 percent of the income growth between 2001 and 2007 went to the top 1% of all Americans.

• 36 percent of Americans say that they don't contribute anything to retirement savings.

• A staggering 43 percent of Americans have less than $10,000 saved up for retirement.

• 24 percent of American workers say that they have postponed their planned retirement age in the past year.

• Over 1.4 million Americans filed for personal bankruptcy in 2009, which represented a 32 percent increase over 2008.

• Only the top 5 percent of U.S. households have earned enough additional income to match the rise in housing costs since 1975.

• For the first time in U.S. history, banks own a greater share of residential housing net worth in the United States than all individual Americans put together.

• In 1950, the ratio of the average executive's paycheck to the average worker's paycheck was about 30 to 1. Since the year 2000, that ratio has exploded to between 300 to 500 to one.

• As of 2007, the bottom 80 percent of American households held about 7% of the liquid financial assets.

• The bottom 50 percent of income earners in the United States now collectively own less than 1 percent of the nation’s wealth.

• Average Wall Street bonuses for 2009 were up 17 percent when compared with 2008.

• In the United States, the average federal worker now earns 60% MORE than the average worker in the private sector.

• The top 1 percent of U.S. households own nearly twice as much of America's corporate wealth as they did just 15 years ago.

• In America today, the average time needed to find a job has risen to a record 35.2 weeks.

• More than 40 percent of Americans who actually are employed are now working in service jobs, which are often very low paying.

• or the first time in U.S. history, more than 40 million Americans are on food stamps, and the U.S. Department of Agriculture projects that number will go up to 43 million Americans in 2011.

• This is what American workers now must compete against: in China a garment worker makes approximately 86 cents an hour and in Cambodia a garment worker makes approximately 22 cents an hour.

• Approximately 21 percent of all children in the United States are living below the poverty line in 2010 - the highest rate in 20 years.

• Despite the financial crisis, the number of millionaires in the United States rose a whopping 16 percent to 7.8 million in 2009.

• The top 10 percent of Americans now earn around 50 percent of our national income.

The reality is that no matter how smart, how strong, how educated or how hard working American workers are, they just cannot compete with people who are desperate to put in 10 to 12 hour days at less than a dollar an hour on the other side of the world. After all, what corporation in their right mind is going to pay an American worker 10 times more (plus benefits) to do the same job? The world is fundamentally changing. Wealth and power are rapidly becoming concentrated at the top and the big global corporations are making massive amounts of money. Meanwhile, the American middle class is being systematically wiped out of existence as U.S. workers are slowly being merged into the new "global" labor pool.

What do most Americans have to offer in the marketplace other than their labor? Not much. The truth is that most Americans are absolutely dependent on someone else giving them a job. But today, U.S. workers are "less attractive" than ever. Compared to the rest of the world, American workers are extremely expensive, and the government keeps passing more rules and regulations seemingly on a monthly basis that makes it even more difficult to conduct business in the United States.

So corporations are moving operations out of the U.S. at breathtaking speed. Since the U.S. government does not penalize them for doing so, there really is no incentive for them to stay.

What has developed is a situation where the people at the top are doing quite well, while most Americans are finding it increasingly difficult to make it. There are now about six unemployed Americans for every new job opening in the United States, and the number of "chronically unemployed" is absolutely soaring. There simply are not nearly enough jobs for everyone.

Many of those who are able to get jobs are finding that they are making less money than they used to. In fact, an increasingly large percentage of Americans are working at low wage retail and service jobs.

But you can't raise a family on what you make flipping burgers at McDonald's or on what you bring in from greeting customers down at the local Wal-Mart.

The truth is that the middle class in America is dying -- and once it is gone it will be incredibly

Illegal alien migration into the United States costs American taxpayers $346 billion annually reported by the National Research Council. While employers of illegal aliens rake-in billions of dollars, the US citizens subsidize what may be called organized "Slavery in 21st Century America."



While Congress facilitates outsourcing, insourcing and offshoring of American jobs by the thousands weekly, that same Congress imports 182,000 legal immigrant monthly who need jobs. Another estimated 100,000 illegal aliens arrive each month without jobs. All those immigrants seize jobs from American citizens at slave wages.

County’s Monthly Welfare Tab For Illegal Aliens $52 Million

As the mainstream media focuses on a study that reveals a sharp decline in the nation’s illegal immigrant population, monthly welfare payments to children of undocumented aliens increased to $52 million in one U.S. county alone.

The hoopla surrounding last week’s news that the annual flow of illegal immigrants into the U.S. dropped by two-thirds in the past decade overlooked an important matter; the cost of educating, incarcerating and medically treating illegal aliens hasn’t decreased along with it, but rather skyrocketed to the tune of tens of billions of dollars annually.

Those figures don’t even include the extra millions that local municipalities dish out on welfare payments to the U.S.-born children of illegal immigrants, commonly known as anchor babies. In Los Angeles County alone that figure increased by nearly $4 million in the last year, sticking taxpayers with a whopping $52 million tab to provide illegal immigrants’ offspring with food stamps and other welfare benefits for just one month.

That means the nation’s most populous county, in the midst of a dire financial crisis, will spend more than $600 million this year to provide families headed by illegal immigrants with welfare benefits. In each of the past two years Los Angeles County taxpayers have spent about half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants. Additionally, the county spends $550 million on public safety and nearly $500 million on healthcare for illegal aliens.

About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from L.A. County’s Department of Social Services. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare perks that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children.

Massive drug tunnel with rail system discovered in pot bust at San Diego border

A major drug tunnel has been discovered under the San Diego-Tijuana border, a roughly 1,800-foot passageway discovered in a warehouse in Otay Mesa where U.S. authorities seized more than 20 tons of marijuana, according to U.S. and Mexican officials.



In Mexico, army troops raided a warehouse in an industrial area that concealed the tunnel entrance and seized four more tons of dope.



The back-to-back raids occurred Tuesday night and Wednesday morning in a light industrial area with a long history of tunnel activity.



The passageway, equipped with lighting, ventilation and a rail system, is one of the few unearthed in recent years that appears to have been fully operational.



About 75 tunnels along the U.S-Mexico border have been unearthed in the last four years, most of them in various states of construction. The discovery comes two weeks after the Mexican military in Tijuana seized a record 134 tons of marijuana.



That dope was seized in a nearby area of eastern Tijuana, but it's not clear if the two incidents are connected.



The Mexican military said no one had been arrested on the Mexican side. It's not clear if arrests were made in San Diego. More details are expected to be provided at an afternoon news conference.

The real motivation for the Justice Department's lawsuit against Arizona's new immigration statute was the only one not mentioned in the department's brief: The Obama administration has no intention of enforcing the immigration laws against the majority of illegal aliens already in the country.

It is that policy alone which conflicts with SB 1070: Arizona wants to enforce the law; the Obama administration does not. Reasonable minds can differ on whether that conflict puts Arizona in violation of the Constitution's Supremacy Clause.

But what is indisputable is that the failure of the federal government to openly acknowledge the real ground for its opposition to SB 1070 has rendered incoherent not just its own public arguments against the law, but the judicial ruling which largely rubber stamps those arguments as well.

The Arizona statute affirms the power of a local police officer or sheriff's deputy to inquire into someone's immigration status, if the officer has reasonable suspicion that the person is in the country illegally, and if doing so is practicable. Under SB 1070, such an inquiry may occur only during a lawful stop to investigate a non-immigration offense.

Both the Justice Department and U.S. District Judge Susan Bolton, in striking down most of SB 1070, couched their opposition to the statute exclusively in terms of its effect on legal, as opposed to illegal, aliens. SB 1070, Judge Bolton wrote, would impermissibly burden legal immigrants already in the country by subjecting them to unwarranted immigration checks.

There are two problems with this line of argument: First, it ignores the fact that Congress has already anticipated and approved precisely the sort of local immigration inquiries that Judge Bolton now finds unconstitutional. Second, the argument would make all immigration enforcement impossible.

In 1996, Congress banned so-called sanctuary policies, by which cities and states prohibit their employees from working with federal immigration authorities regarding illegal aliens. It was in the federal interest, Congress declared, that local and federal authorities cooperate in the "apprehension, detention or removal of [illegal] aliens."

In pursuance of that mandate, the federal government operates an immigration clearinghouse, the Law Enforcement Support Center (LESC), to provide just the sort of immigration-status information to local and state law-enforcement officials that SB 1070 seeks.

It is therefore absurd to now claim, as Judge Bolton and the Obama Administration do, that such local inquiries conflict with the federal immigration scheme. It is even more absurd to argue that the risk that a legal alien will be questioned about his immigration status makes the alleged conflict unconstitutional.

Any immigration enforcement carries the possibility that a legal alien or U.S. citizen will be stopped and questioned. The only way to guarantee that legal aliens are never asked to present their immigration papers is to suspend immigration enforcement entirely. (The same possibility of stopping innocent people for questioning applies to law enforcement generally; that possibility has never been held to invalidate the police investigative power.)

If Congress intended to create such a blanket ban on asking legal aliens for proof of legal residency, it could have revoked the 1952 law requiring aliens to carry their certificate of alien registration. Such a requirement makes sense only on the assumption that legal aliens will upon occasion be asked to prove their legal status.

Such unpersuasive reasoning suggests that something else is going on. That something is the fact that SB 1070 would have put the Obama administration in the uncomfortable position of repeatedly telling Arizona's law enforcement officers that it is not interested in detaining or deporting the illegal aliens that they have encountered in the course of their duties; the law, in other words, would have exposed the administration's de facto amnesty policy.

And SB 1070 would have shown that immigration-law enforcement can work simply by creating a deterrent to illegal entry and presence. Even before it went into operation, the Arizona law was already inducing illegal aliens to leave the state, according to news reports.

Illegal aliens are virtually absent from the Justice Department's brief or from Judge Bolton's opinion. Despite this studied avoidance, it's time to have a public debate about how much immigration enforcement this country wants and which enforcement policies--the administration's or Arizona's -- best represent the public will.

Mexican drug gangs 'spread to every region of US'



Mexican heroin production is growing

Mexican drug gangs have expanded their activities in the US with heroin production doubling in 2008, the US justice department says in a report.

Despite US funding for the war on drugs, trade in marijuana, ecstasy and methamphetamine also grew, the National Drug Threat Assessment said.

The report found that Mexican groups were active in every region of the US.

Gangs were moving an estimated $40bn (£27bn) in cash back into Mexico across the border each year, it added.

Mexico has long been the main conduit for illicit drugs smuggled into the US but this report suggests that the efforts to halt the flow on both sides of the border have had only a limited impact, the BBC's Richard Lister reports from Washington.

In 2007 the US pledged $1.4bn (£0.9bn) over three years to fight the drugs cartels but the following year heroin production in Mexico rose from 17 to 38 metric tons.

This, the report says, led to lower heroin prices and more overdose deaths in the US.

Network growth

The report found that Mexican heroin was poised to take a "more significant share" of the market in US cities where South American heroin has traditionally dominated.

For Asian heroin, the US continued to be a secondary market, it said.

The assessment says that Mexican drug suppliers have increased their co-operation with American street and prison gangs to expand their distribution networks.

Speaking in Mexico City earlier this week, US Secretary of State Hillary Clinton called for more efforts to tackle the social issues such as poverty that fuel the drugs trade.

Mexico, which has some 50,000 troops engaged against the cartels, has suggested that American money and equipment has not arrived quickly enough.

U.S. arrests 2,000 in Mexican drug trafficking probe

Law enforcement agencies have arrested more than 2,000 people in a 22-month investigation targeting Mexican drug trafficking organizations in the United States.



The probe, called Project Deliverance, focused on the transportation of methamphetamine, cocaine, heroin and marijuana along the Southwest border.



Over 400 of the 2,000 arrests were made Wednesday. Atty. Gen. Eric Holder is scheduled to hold a news conference on the operation Thursday.



The Drug Enforcement Administration, the FBI and Immigration and Customs Enforcement worked on the effort with state and local law enforcement agencies.

The Mississippi Pardons

Gov. Haley Barbour of Mississippi has to decide whether to show mercy to two sisters, Jamie and Gladys Scott, who are each serving double consecutive life sentences in state prison for a robbery in which no one was injured and only $11 was taken.

This should be an easy call for a law-and-order governor who has, nevertheless, displayed a willingness to set free individuals convicted of far more serious crimes. Mr. Barbour has already pardoned four killers and suspended the life sentence of a fifth.

The Scott sisters have been in prison for 16 years. Jamie, now 38, is seriously ill. Both of her kidneys have failed. Keeping the two of them locked up any longer is unconscionable, grotesquely inhumane.

The sisters were accused of luring two men to a spot outside the rural town of Forest, Miss., in 1993, where the men were robbed by three teenagers, one of whom had a shotgun. The Scott sisters knew the teens. The evidence of the sisters’ involvement has always been ambiguous, at best. The teenagers pleaded guilty to the crime, served two years in prison and were released. All were obliged by the authorities, as part of their plea deals, to implicate the sisters.

No explanation has ever emerged as to why Jamie and Gladys Scott were treated so severely.

In contrast, Governor Barbour has been quite willing to hand get-out-of-jail-free cards to men who unquestionably committed shockingly brutal crimes. The Jackson Free Press, an alternative weekly, and Slate Magazine have catalogued these interventions by Mr. Barbour. Some Mississippi observers have characterized the governor’s moves as acts of mercy; others have called them dangerous abuses of executive power.

The Mississippi Department of Corrections confirmed Governor Barbour’s role in the five cases, noting that the specific orders were signed July 16, 2008:

• Bobby Hays Clark was pardoned by the governor. He was serving a long sentence for manslaughter and aggravated assault, having shot and killed a former girlfriend and badly beaten her boyfriend.

• Michael David Graham had his life sentence for murder suspended by Governor Barbour. Graham had stalked his ex-wife, Adrienne Klasky, for years before shooting her to death as she waited for a traffic light in downtown Pascagoula.

• Clarence Jones was pardoned by the governor. He had murdered his former girlfriend in 1992, stabbing her 22 times. He had already had his life sentence suspended by a previous governor, Ronnie Musgrove.

• Paul Joseph Warnock was pardoned by Governor Barbour. He was serving life for the murder of his girlfriend in 1989. According to Slate, Warnock shot his girlfriend in the back of the head while she was sleeping.

• William James Kimble was pardoned by Governor Barbour. He was serving life for the murder and robbery of an elderly man in 1991.

Radley Balko, in an article for Slate, noted that none of the five men were given relief because of concerns that they had been unfairly treated by the criminal justice system. There were no questions about their guilt or the fairness of the proceedings against them. But they did have one thing in common. All, as Mr. Balko pointed out, had been enrolled in a special prison program “that had them doing odd jobs around the Mississippi governor’s mansion.”

The idea that those men could be freed from prison and allowed to pursue whatever kind of lives they might wish while the Scott sisters are kept locked up, presumably for the rest of their lives, is beyond disturbing.

Supporters of the Scott sisters, including their attorney, Chokwe Lumumba, and Ben Jealous of the N.A.A.C.P., have asked Governor Barbour to intervene, to use his executive power to free the women from prison.

A spokeswoman for the governor told me he has referred the matter to the state’s parole board. Under Mississippi law, the governor does not have to follow the recommendation of the board. He is free to act on his own. With Jamie Scott seriously ill (her sister and others have offered to donate a kidney for a transplant), the governor should move with dispatch.

The women’s mother, Evelyn Rasco, told The Clarion-Ledger of Jackson, Miss.: “I wish they would just hurry up and let them out. I hope that is where it is leading to. That would be the only justified thing to do.”

An affidavit submitted to the governor on behalf of the Scott sisters says: “Jamie and Gladys Scott respectfully pray that they each be granted a pardon or clemency of their sentences on the grounds that their sentences were too severe and they have been incarcerated for too long. If not released, Jamie Scott will probably die in prison.”

As they are both serving double life sentences, a refusal by the governor to intervene will most likely mean that both will die in prison.

Countrywide CEO Mozilo settles with SEC for $67.5M

Countrywide Financial Corp. co-founder Angelo Mozilo has agreed to a $67.5 million settlement to avoid trial on civil fraud and insider trading charges that alleged he profited from doling out risky mortgages while misleading investors about the risks.

Two other former Countrywide executives also settled before trial next week on charges filed by the Securities and Exchange Commission. But employment agreements that protect the men from lawsuits involving the failed lender mean Bank of America Corp., which bought Countrywide in July 2008, will pick up most of the tab.

The settlement announced Friday spares the executives the risk of a verdict that could have been used against them in lawsuits by shareholders, or by prosecutors if a criminal probe into their activities leads to charges.

It also gives the SEC the right to brag about what it said is the biggest financial penalty ever against a public company's senior executive. The agency has been criticized for doing little to prevent much of the risky behavior that led to the financial meltdown and for failing to detect Bernard Madoff's massive investment fraud.

"This settlement is a desirable result for all the parties," said Jacob Frenkel, a former SEC enforcement attorney now in private practice. "The SEC claims victory. The defendants get closure while preserving their ability to fight" lawsuits by shareholders.

The agreement requires Mozilo to repay $45 million in ill-gotten profits and $22.5 million in civil penalties. Former Countrywide President David Sambol owes $5 million in profits and $520,000 in civil penalties, and former Chief Financial Officer Eric P. Sieracki will pay $130,000 in civil penalties.

It's "the fitting outcome for a corporate executive who deliberately disregarded his duty to investors by hiding what he saw in the executive suite," SEC Enforcement Director Robert Khuzami said in a conference call with reporters.

But $25 million of Mozilo's restitution will come from an escrow fund the company set up to cover shareholder litigation and Mozilo has no obligation to pay the remaining amount, according to the settlement agreement.

Sambol's agreement stipulates that his entire $5 million forfeiture will come from the escrow fund.

The payments come on top of an $8.4 billion settlement Bank of America made with 12 states in 2008 over Countrywide's lending practices. The company also agreed in August to pay $600 million to end a class-action case from former Countrywide shareholders.

The penalty represents a striking turn for Mozilo, the son of a Bronx butcher who 41 years ago co-founded what grew into the nation's largest home loan originator. In 2006, Countrywide was writing one in six of the nation's mortgages, totaling more than $490 billion, court records showed.

The Calabasas, Calif.-based company spiraled into disaster as investors suddenly realized many homeowners wouldn't be able to repay mortgages that required no proof of income or down payment, and offered adjustable rates that quickly made monthly payments unaffordable.

Regulators portrayed Countrywide's massive size in court documents as the result of the three executives' single-minded pursuit of market dominance, even if it meant taking disastrous risks.

"The credit losses experienced by Countrywide in 2007 not only were foreseeable by the proposed defendants, they were in fact foreseen at least as early as September 2004," the SEC said in its filing.

The SEC accused the men of misleading shareholders about the quality of the loans on Countrywide's books. The civil complaint also accused Mozilo of acting on his inside knowledge of the company's precarious state when he sold shares between November 2006 and October 2007 ahead of its collapse, reaping more than $139 million.

Under the settlement, the three men did not admit wrongdoing.

"Mr. Sambol has agreed to settle the SEC lawsuit and put the matter behind him for the benefit of his family and loved ones," Sambol's attorney Walter Brown said in a statement.

Sieracki's lawyer, Shirli Fabbri Weiss, said in a news release that all fraud-based claims against her client had been dropped and that his civil penalty was to settle negligence-based charges.

Mozilo, who was not in court when the settlement was announced, was the nation's highest-profile defendant yet to face trial for risky business practices leading to the housing collapse that sent the country into recession.

The SEC wanted to "put his head on a pike and parade it around," said Anthony Sabino, professor of law and business at St. John's University in New York.

Under the settlement, Mozilo agreed to never again serve as an officer or director of a publicly traded company. Sambol agreed not to do so for three years.

Mozilo lawyer David Siegel did not return a message seeking comment.

The settlement talks involving Mozilo were first reported by the Wall Street Journal after U.S. District Judge John F. Walter filed a notice Thursday for trial lawyers to attend a status conference Friday.

Countrywide's lending practices are reportedly also the subject of a criminal probe in Los Angeles. Thom Mrozek, a spokesman for the U.S. attorney's office, declined to comment about the situation.

Americans are being treated to welcome entertainment during the dog days of summer as we watch the Democrats wring their hands over Barack Obama's tone-deafness about political reality. Their despair about Obama is so painful that they are even calling on George W. Bush to come back and rescue Obama from his own mistakes.

Let's tick off the issues where Obama staked out his lonely position at the same time public opinion polls showed the majority of Americans lining up on the other side. Obama's determination to achieve "change" doesn't include obeying the wishes of We the People.



Take ObamaCare, for example. Ramming it through Congress, overriding regular legislative procedure and the opposition of the American public, he deluded himself into believing that once it became the law of the land, the people would dutifully support it.



But they didn't. Even after passage, the Rasmussen survey reports this month that 66% favor repeal of the Health Control Law, and 50% say repeal will benefit the economy.



On Aug. 3, 71% of voters in Missouri, the bellwether state, approved a referendum to invalidate any ObamaCare mandate to force individuals to buy health insurance. The same week, a federal judge ruled that Virginia may proceed with its lawsuit to overturn ObamaCare's mandate on individuals to buy insurance.



The Democrats had hoped they could postpone Obama's commitment to Hispanic voters until after the 2010 elections by tucking the contentious immigration issue under the rug this year. But then Obama brought the immigration issue front and center by filing suit against the Arizona law.



A CBS poll shows that 57% of Americans think Arizona's law is "about right," and a Rasmussen poll found that 65% of Arizonans support the law. Zogby found that 58% of Americans nationwide want their own state to adopt a law similar to Arizona's.



Then there's the matter of building the mosque on the ground near the 9/11 attack on New York City. Obama supports it, even though 61% of Americans are against it.



The mosque raises another festering issue. The Pew Research Center reports that 18% (one in five Americans) think Obama is a Muslim, and Time magazine puts that figure at 24%. The number of people who think Obama is a Christian is in a free fall, and 43% don't know his religion.



Obama's Arabic Accent



Rush Limbaugh reminded us of Obama's statement quoted in the New York Times that the Muslim call to prayer is "one of the prettiest sounds on Earth" and that he recited it with a first-rate Arabic accent. The translation of the prayer call is "Allah is supreme. Allah is supreme. Allah is supreme. I witness that there is no god but Allah."



Obama chose the most left-wing Supreme Court justice in history, Elena Kagan. He ignored the Gallup poll showing that 42% of Americans wanted a new Supreme Court justice who would move the court in the conservative direction, while only 27% wanted it to move more liberal.



Obama is even pressing for "card check," one of his many payoffs to the unions, even though 61% of Americans oppose this, according to Voter Consumer Research. Card check would make it easier for unions to organize workplaces by getting rid of the secret ballot.



Obama is still pushing cap-and-trade, which the voters have dubbed "cap and tax" because it will make electricity and all kinds of energy cost every American thousands of dollars a year. CNN reports that 51% of Americans oppose it, and Democratic congressional incumbents who voted for it in the House last year are finding it a big negative in their 2010 campaigns.



Obama is still unwilling to face up to the American people's opposition to his economic policies of big spending, higher deficits, staggering debt and redistribution of wealth. According to a Rasmussen survey, less than one in five voters are willing to pay more taxes to lower the federal deficit because they believe we are already overtaxed.



More than 8 in 10 Americans believe the deficit is the result of overspending, not a lack of tax revenue. And 58% believe that if Obama and Congress raise taxes to reduce the deficit, they will just spend the money on new government programs.



When Gallup asked Americans to name the greatest threat facing our country, the national debt tied with terrorism as the top choice. No wonder Zogby reports that 52% of Americans say Obama's change has made the country worse.

Obama Proposes Cuts to Important Immigration Enforcement Programs

On February 1, President Obama released the details of his Fiscal Year (FY) 2011 Budget Request, which seeks to cut funding for important immigration enforcement programs. (See The President’s Budget Message, February 1, 2010). Specifically, the president’s budget would slash funding for the Secure Border Initiative; cut funding for US-VISIT; and cut 180 agents from the Border Patrol. The president’s proposed budget also proposes to merely maintain funding for the critically underfunded State Criminal Alien Assistance Program (SCAAP).

The Secure Border Initiative (SBI) “is a comprehensive, multi-year plan to help secure America’s borders” through fencing, infrastructure, and technology. (CBP Factsheet). SBI is a critical element of the larger DHS-CBP effort to increase border security, which includes construction of the border fence. Last year, Congress approved $800 million to fund SBI through FY2010. President Obama is requesting only $574 million for this program in his FY2011 budget, a $226 million cut. (FY2011 Budget Request Appendix: DHS).

US-VISIT, or United States Visitor and Immigrant Status Indicator Technology, is an entry-exit tracking program that collects information, including biometric identifiers, on foreign nationals attempting when they enter the United States. This information is then used to, among other things, determine whether foreign nationals should be denied entry and whether exiting aliens have overstayed or otherwise violated the terms of their admission. According to a Government Accountability Office (GAO) report released in November 2009, the Department of Homeland Security (DHS) does not have a unified schedule to completely implement a comprehensive exit function for US-VISIT, and it is difficult to determine when and how US-VISIT will be completed. (GAO Report, November 2009). Despite this failure to complete implementation, President Obama has proposed a $39 million cut to US-VISIT, from $374 million in FY2010 to $335 million in FY2011. (FY2011 Budget Request Appendix: DHS).

In addition, President Obama’s budget provides for a reduction of 180 Border Patrol agents. According to Acting DHS Chief Financial Officer Peggy Sherry, the administration does “not believe the 180 personnel reduction will in any way reduce the overall operating effectiveness of the Border Patrol because over the past five years, the Border Patrol has doubled in size.” Sherry continued: “A lot of the agent workforce, the substantial portion of it, has only a couple of years experience. As they become more seasoned and more mature in their jobs, their effectiveness will increase.” (See DHS Conference Call Transcript).

The administration has also requested only $330 million for SCAAP – a federal program administered through the Department of Justice that helps states pay for the incarceration of criminal aliens. (FY2011 Budget Request: DOJ). Congress recently cut the annual funding level for SCAAP from $400 million in FY2009 to $330 million in FY2010. (See FAIR’s Legislative Update, December 22, 2009). This cut drew significant criticism from border state Governors Rick Perry (R-TX) and Arnold Schwarzenegger (R-CA), yet through his request, President Obama suggests that he wants to make it permanent. (Id.).

Although President Obama’s budget is a significant barometer reflecting his policies and priorities, it represents simply a funding request to Congress. Congress has the true power to appropriate money and can choose to wholesale adopt, modify, or reject the President’s budget request.
