We really don't hate you, we just want you to assimilate yourselves to America and come here legally if you come here at all.

We don't blame you for fleeing your "so-called" beloved Mexico, your country is beyond corrupt and poor.

It's not race we discriminate against and Arizona isn't discriminating against you, it's discrimination against being an illegal (that means "criminal") that is our problem.

Yes, America is a melting pot of immigrants and that's ok. enjoy and cherish your culture but please do it with those of your own kind and culture without forcing it on those of us of a different culture then you.

It's not your language we hate either. It's the fact that English speaking Americans should not be forced to speak your language or learn your language unless we want to do so.

LOS ANGELES AMONG FORBES’ ‘TOP 10 U.S. CITIES IN FREEFALL’


Forbes has released its list of 'Top 10 U.S. Cities In Freefall', and California has the dubious distinction of appearing thrice. The greater Los Angeles, Riverside and Sacramento areas all made the list, only Florida had more cities represented. In compiling the list, Forbes used six metrics, including the percent the median home price has fallen since its individual peak, how many people were moving in and out of these metros, and percent change in unemployment.
Of California's woes, Forbes writes:
Riverside, Los Angeles and Sacramento are suffering because of the knocks they took after their inflated housing markets began to plummet. Unemployment in the City of Angels has nearly tripled in three years, to 12%. Riverside's unemployment has also ballooned, to 15%. Meanwhile Sacramento saw a 75% drop in new building permits. These are troubling signs for Cali metros, but not surprising. The end of the state's home-price climb triggered more than just a housing slump.
"In California, so many jobs were concentrated in construction," says Michael Fratantoni, vice president of research at the Mortgage Bankers Association, the professional association for real estate financiers. "Jobs building single family homes wound up not being sustainable, and there were a lot of job losses."
The Forbes report comes on the heels of California's most recent jobless report, which put the state's unemployment rate at a record 12.6% for March. However, in what might be an encouraging sign for the region, KPCC reports today that foreclosures in LA County are down 43.5% for the first quarter of 2010 compared to last year.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

I find this bill will actually create equality for all.

At present Americans citizens are who commit misdemenor crimes and are found guilty go to jail and pay a fine. It is illegal to come to America without proper documentation; however, the status quo doesn't punish these criminals and have unfairly allowed this crime to go without punishment. All-the-while Americans criminals are punished? These universal pracitce is discriminatory toward Americans Citizens because they have proper documentation. On the hand, has been favorable to undocumented illegal because they do not have the same?

The status quo practice of enforcement of Americans who commit crimes and lack of enforcement of illegals who come to America without proper documentation is unconscionable--there the something seriously wrong with this picture. Clealy there are two set of law enforcement at play here. Illegal immigrants argue the law is unconstitutional when in fact it is not. The truth of the matter is that AZ SB 1070 immigration bill has turned the tables right side up creating eqaulity for all persons in America who commit a crime will face jail time, a fine and hopefully will be rehabilitated.

What is and has been discriminatory is the fact that illegal immigrants have and still are rewarded with benefits for their criminal acts, while American Citizens are punished?

Most of the post I am reading do not want Amnesty for illegals. Further Americans are tired of waiting on Washington while they can't even get a dishwasher minimum wage job.
American's are tired of waiting for Washington to act. Some even say 30 years is way to long to enforce immigration laws and plan on sueing Washington for inaction and enforcement.
Even better one person wrote that their father sits in jail for a misdemenor while illegal aliens get a free pass with benefits, doesn't have to pay taxes. Where does the yellow brick road end for illegal aliens and where does it state for citizens. Everything is upside down inside out. What is illegal is legal and what is legal is illegal??

Common sense has been distored by Washington preying on the hopes that someday they can give illegal immigrants the amnesty in which them the right to vote for them who preyed on them. Washington uses them and someday may have them rise against American to fight their civil war. See Americans follow the law and illegals immigrants don't have to. The promise of someday you will be free if you fight is a political stratigy Washington keeps up their sleeve. Keep a group of unlawful persons around to fight and die is not new to overcome those who will fight and those who one once they do the dirty deed are soon the ones who will be oppressed.

Arizona has suffered more than most. More people and drugs come illegally through the Sonoran Desert that straddles northern Mexico and southern Arizona, from Nogales, Mexico, west to Yuma, Ariz., than through any other border state. Phoenix and Tucson, especially southernmost Tucson, are cities which feel themselves to be virtually under siege.

"There is a sense of strong anger at not being able to contain and put an end to this invasion of America," Martha L. Day, a hospital systems consultant who calls herself a liberal-leaning independent and lives in Phoenix, told me. "My friends really feel inadequate in their ability to protect themselves and their families against the continual threat of violence. Most carry weapons. There are bars on the windows of homes in regular neighborhoods, border patrol and police are all over the place . . . everything seems to be bolted down so it can't be stolen and sold."

She went on to enumerate the economic and social problems illegal immigrants bring to the state. "One in five prisoners in Arizona jails is an illegal immigrant who committed a felony crossing over; schools are filled to the brim with their children using up resources of the already depleted education system; hospital systems are inundated and have to care for these illegals and absorb their expenses, expenses that will not go away with the national health care change because these folks are not citizens; and huge numbers are needed in police forces for safety and to control the growing number of people coming across the border.''

Another left-leaning independent, Matt Hardin, a window-and-door salesman who lives in Tucson, said, "We need to create a situation where it is simply not worth the risk to come here illegally. In addition, we need to institute policies that make taking the legal route toward citizenship a more attractive option than the illegal option."
Both Hardin and Day see themselves as tolerant, reasonable Obama supporters. Yet on this one issue, at this one place, they've become convinced that something radical has got to be done. Day, referring to the burdens of illegal immigration, said, "These things really fuel the fire of anger and make folks want to do a clean sweep and clean Arizona of the folks from the south. I can see why Arizonans are looking to repeal the concealed weapons permit requirement, why guns are now allowed to be carried into bars, and why the anti-immigration law has been proposed."

And so in Arizona, the anger, the frustration, and the fear have built up over time and spread like wildfire, threatening to consume nearly everything and everyone in its path.

After conducting a 12 month in-depth study of illegal immigrants who committed sex crimes and murders for the time period of January 1999 through April 2006 , it is clear that the U.S. public faces a dangerous threat from sex predators who cross the U.S. borders illegally.

There were 1500 cases analyzed in depth. They included: serial rapes, serial murders, sexual homicides, and child molestation committed by illegal immigrants. Police reports, public records, interviews with police, and media accounts were all included. Offenders were located in 36 states, but it is clear, that the most of the offenders were located in states with the highest numbers of illegal immigrants. California was number one, followed by Texas, Arizona, New Jersey, New York, and Florida.

Based on population numbers of 12,000,000 illegal immigrants and the fact that young males make up more of this population than the general U.S. population, sex offenders in the illegal immigrant group make up a higher percentage. When examining ICE reports and public records, it is consistent to find sex offenders comprising 2% of illegals apprehended. Based on this 2% figure, which is conservative, there are approximately 240,000 illegal immigrant sex offenders in the United States.

This translates to 93 sex offenders and 12 serial sexual offenders coming across U.S. borders illegally per day. The 1500 offenders in this study had a total of 5,999 victims. Each sex offender averaged 4 victims. This places the estimate for victimization numbers around 960,000 for the 88 months examined in this study.

Conclusions:
Illegal immigrants who commit sex crimes first cross the U.S. border illegally. Then they gradually commit worse crimes and are continually released back into society or deported. Those who were deported simply returned illegally again. Only 2% of the offenders in this study has no history of criminal behavior, beyond crossing the border illegally. There is a clear pattern of criminal escalation. From misdemeanors such as assault or DUI, to drug offenses, illegal immigrants who commit sex crimes break U.S. laws repeatedly. They are highly mobile, work in low skilled jobs with their hands, use drugs and alcohol, are generally promiscuous, have little family stability, and choose victims who are easy to attack. Their attacks are particularly brutal, and they use a hands-on method of controlling and/or killing their victims.

Perhaps our focus should turn to crimes committed by illegal immigrants, before we take away constitutional rights of American citizens !

Nationally, 60% Favor Letting Local Police Stop and Verify Immigration Status

Arizona Governor Jan Brewer last week signed a new law into effect that authorizes local police to stop and verify the immigration status of anyone they suspect of being an illegal immigrant. A new Rasmussen Reports telephone survey finds that 60% of voters nationwide favor such a law, while 31% are opposed.
Seventy-seven percent (77%) of Republicans support the law along with 62% of voters not affiliated with either major party. Democratic voters are evenly divided on the measure.
At the same time, however, 58% of all voters are at least somewhat concerned that “efforts to identify and deport illegal immigrants will also end up violating the civil rights of some U.S. citizens.” That figure includes 29% who are Very Concerned about possible civil rights violations.
Voter support for empowering local police comes at a time when most voters (56%) believe it is unlikely Congress will take action to gain control of the border. Only 31% say Congress is even somewhat likely to take such an action. That figure includes just 10% who believe Congress is Very Likely to act.
President Obama has denounced the Arizona law, and he and other critics of the measure see it as an incentive to push new national immigration reform legislation to supersede it.
Not surprisingly, support for the law authorizing local police to arrest illegal immigrants is a bit higher in Arizona than it is nationwide. As one of the states most impacted by illegal immigration, 70% of voters statewide favor the new law.


Brewer signed the new law in the midst of a tough Republican Primary campaign. She antagonized many Republicans early on by supporting a statewide tax increase. More recently, she has pleased many voters by finding a way for the state to sue the federal government over the new health care reform law. Eighty-three percent (83%) of Arizona voters say a candidate's position on immigration is an important factor in how they will vote, including 51% who say it’s very important.

The measure is also having an impact on this year’s Arizona Senate race. Senator John McCain, who narrowly leads conservative challenger J.D. Hayworth in Arizona’s hotly contested GOP Senate Primary race, has come out strongly in support of the new law.
Democratic strategist Susan Estrich notes that “the federal government is supposed to secure the border. Its failure to do so effectively … invites measures like Arizona's. … In the final analysis, the greatest threat to the rule of law is the lawlessness that leaves both desperate immigrants and desperate citizens vulnerable and afraid.”

This national telephone survey of 1,000 Likely Voters was conducted on April 22 and 23, 2010 by Rasmussen Reports. The margin of sampling error is +/- 3 percentage points with a 95% level of confidence. Field work for all Rasmussen Reports surveys is conducted by Pulse Opinion Research, LLC. See methodology.

The new survey results are consistent with findings conducted over many years. Three-out-of-four voters believe that the federal government is not doing enough to secure the nation’s borders. In fact, 56% believe that the policies of the federal government encourage illegal immigration. Among voters who are angry about immigration, 83% are angry at the federal government. Only 12% direct their anger at the immigrants
The biggest point of disconnect between voters and the conventional wisdom in Washington, D.C. has to do with priorities. Almost always in Washington, the debate begins with a focus on how to address the status of illegal immigrants. To voters, that is a secondary concern. Controlling the borders is the top concern. That hasn’t changes since the 2006 immigration legislation collapsed when the U.S. Senate surrendered to public opinion. During that debate, a New York Times/CBS poll found that 69% believed illegal immigrants should be prosecuted and deported.
Other surveys have found that 73% of voters want cops to check the immigration status of all offenders during traffic stops. Sixty-seven percent (67%) also say that if law enforcement officers know of places where immigrants gather to find work, they should sometimes conduct surprise raids to identify and deport those who are here illegally.
Sixty-eight percent (68%) of voters nationwide say that those who knowingly hire illegal immigrants should be punished. By a 48% to 36% margin, voters say the same about landlords who rent to illegal immigrants. Additionally, 77% of voters nationwide oppose drivers’ licenses for undocumented immigrants. That topic tripped up Hillary Clinton in a debate during the race for the Democratic presidential nomination.
Joe Arpaio, the sheriff of Maricopa County in Arizona, created a national controversy by aggressively enforcing national immigration laws. While his efforts prompted a U.S. Justice Department civil rights investigation, the sheriff remains popular in his home state. Most Arizona voters not only support his policies, but 58% say he has been good for the state’s image. On a personal basis, Arpaio is viewed favorably by 68% of Arizona voters.

Using drug and racketeering statutes and extradition agreements, federal prosecutors are sending a steady parade of Mexican drug lords into U.S. prisons. Although that is having a chilling effect on the smuggling cartels, there is no sign that the convictions are breaking the organizations, which are growing more violent, according to U.S. officials and other experts.

Ten cartel leaders from Mexico have been convicted in U.S. courts in the last two years, while three in Chicago and a fourth in Brooklyn, N.Y., have been indicted in major drug racketeering operations involving tons of heroin, cocaine and marijuana.

In the last few weeks in San Diego alone, four cartel figures were convicted of leading organizations that smuggled tons of the drugs into the U.S., carried out assassinations and spent millions of dollars bribing Mexican authorities. The men were given sentences ranging from 30 years to life in prison with no chance of parole.

It was hoped that the prospect of U.S. prison time would begin deterring drug violence along the border. U.S. officials say it is having some effect, citing drug lords still at large who admit to being frightened at the prospect of extradition to the U.S. They also say the tactic disrupts the cartels' activities.

But authorities on both sides of the border acknowledge that the cartels have simply promoted lieutenants to the vacant leadership positions and that the violence, especially in the last two years, has turned uglier — in the streets and within the cartels, where junior members are fighting one another for control.

"In Mexico, there are hundreds of thousands of young men who are in organized crime and are … ready to step up when a leader at any level is captured and taken prisoner," said Tony Payan, a political science professor at the University of Texas-El Paso, who for a decade has studied border violence.

"While it is good to catch one of these guys, in the end it's a little like winning a battle even if you're losing the war. To me it's a little bit like tilting at windmills."

R. Gil Kerlikowske, director of the White House Office of National Drug Control Policy, agreed in a separate interview that the convictions were not breaking the cartels. "I don't think there's any doubt there are people who will replace those folks," he said. "But it is the disruption of the cartels that is helpful, and the chilling effect it causes."

Justice Department spokeswoman Laura Sweeney said the convictions had helped federal agents and prosecutors gather valuable intelligence on the inner workings of the cartels. She added, "The strongest message we send is the one sent jointly by Mexico and the United States each and every time an individual is extradited to either country to face justice, leaving no safe haven on either side of our border."

The U.S. prosecutions are having some effect. This month, Ismael Zambada, known as "El Mayo," a leader in the Sinaloa cartel, told a Mexican journalist he was worried about his son Vicente Zambada, who was extradited to Chicago in February in the racketeering case there.

Ismael Zambada has been indicted in that case too. He conceded that he might be arrested "at any moment, or never." He would consider suicide over the rest of his life in a U.S. prison. "I don't know if I would have the guts to kill myself," he said. "I want to think that yes, I would."

U.S. District Judge Larry A. Burns in San Diego has handed down stiff sentences. Once these prisoners were millionaires and lived in fortified Mexican villas. Now they come into his courtroom in orange jail jumpsuits and are marched away in handcuffs.

In November 2007, Francisco Javier Arellano Felix, one of the leaders of the Arellano Felix drug trafficking organization, who pleaded guilty to money laundering and running a criminal enterprise, asked for "forgiveness from all those people on both sides of the border who I have affected by my wrongful decisions and criminal conduct. Please forgive me."

"If I had the power to change and undo the things that I have done," he said in a letter written in Spanish and translated by his attorney, "I would."

Burns was not in the least moved. "Your name will live in infamy associated with all these terrible things," he said. "It is a record of callousness. It's a record of cruelty. … All of the mayhem and the murder and the intimidation, all of that has happened, and today is the day of accounting."

He gave the 37-year-old life in prison, and then tacked on another 20 years.

Jorge Aureliano Felix (unrelated to Arellano), 57, a former Mexican police official who provided security for drug loads to pass through Baja California, had spent 41/2 years in a Mexican prison before being extradited to face charges of racketeering and drug smuggling in Burns' courtroom. On March 29, as he heard Burns describe allegations of "torture and murder," he suddenly had to be escorted out of the courtroom so he could vomit. When he was returned, Burns sentenced him to 30 years in prison, followed by deportation to Mexico if he lived that long.

In Houston in February, Osiel Cardenas Guillen, head of the Gulf cartel that pushes cocaine up through south Texas, was sentenced behind locked doors, with armed guards circling the courtroom of U.S. District Judge Hilda G. Tagle. Guillen had been convicted of drug dealing, money laundering, murder and assault.

"I apologize to my country, Mexico, to the United States of America, my family, to my wife especially, my children, for all the mistakes I made," he told the judge.

She gave Cardenas, 42, who reportedly is cooperating with U.S. law enforcement officials, 25 years in prison and ordered him to forfeit $50 million in assets. He already had served eight years in Mexico since his capture for running cocaine through his home state of Tamaulipas.

"Innocence lost — that is your legacy to your country, to our communities on both sides of the border and to society," the judge told him.

Next up is Efrain Perez, who appears before Burns on May 3 in San Diego. He pleaded guilty in October to cocaine and marijuana smuggling, and is looking at 30 years and a $250,000 fine. His life in the cartel is over.

"This is not a business you can retire from," said Payan, the El Paso professor. "Very few grow old in this business."

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Mexico hobbled in drug war by arrests that lead nowhere

URUAPAN, MEXICO -- When soldiers swarmed into city halls last year to arrest 10 mayors for alleged ties to an infamous drug cartel, Mexican authorities and their U.S. government allies boasted that the age of impunity for corrupt Mexican politicians was finally over.

The mass detentions of elected officials from bustling towns dominated the news in Mexico, and they were seen as a bold new thrust in a vicious drug war that has left more than 22,000 dead as increasingly powerful drug cartels challenge the authority of the state.

But one by one, the government of President Felipe CalderĂłn has quietly released the politicians as federal prosecutors dropped their cases and as judges ordered them set free for lack of evidence. U.S. diplomats who hailed the arrests now rarely mention them, except as a cautionary tale about how difficult it is to change Mexico's ineffective criminal-justice system.

The episode illustrates a central challenge faced by Mexico, where law enforcement authorities remain hard pressed to win major conspiracy cases, either because they arrest the wrong people or because prosecutors remain hobbled by incompetence.

It also suggests that despite CalderĂłn's pledges of sweeping reform, Mexico has a long way to go in rebuilding its corrupt and hapless police and judiciary.

Nine of the 10 mayors arrested last May in the western state of Michoacan are now free. The latest was released Friday after 11 months in prison. Most of them have returned to their duties at city hall, some after months of incarceration. Several mayors told The Washington Post that they were held in shackles for hours every day, kept in isolated units, and denied access to relatives and lawyers.

None of the cases went to trial. No explanation has been issued, no apologies given. Another two mayors from Michoacan were arrested more recently and remain in jail, their fates unknown.

"I confess that when they arrested the mayors, myself and many people thought, finally!" said Miguel Sarre, a lawyer and professor at the Autonomous Technological Institute of Mexico and a leading expert on the nation's judiciary. "But this shows that either the government was not capable of thorough investigation and making a strong case, or the arrests were politically motivated." He noted that the mayors were incarcerated on the eve of midterm elections.

It is common in Mexico for drug suspects to be arrested with fanfare -- and for their criminal cases to fall apart later. But the arrests of the mayors, all accused of working for a gang of methamphetamine manufacturers and assassins known as La Familia, was hailed by U.S. officials and others as evidence of a new resolve on the part of CalderĂłn's government. CalderĂłn and his drug warriors, observers hoped, would move quickly to other states and attack what U.S. and Mexican experts say is at the core of organized crime in Mexico -- a powerful nexus between corrupt politicians, crooked cops and millionaire criminals. CalderĂłn's government did not arrest politicians in other states.

"They claimed I had received funds during my election campaign from organized-crime groups and that in return I was providing with them protection," said José Cortés Ramos, the mayor of Aquila, Michoacan, who was released after a month in prison. He asked, "How could we offer protection?" His local police "don't even have the guns they need," he said.

"I think that the federal government's operations against organized crime aren't a bad thing," Cortés said. "They are good. But we don't see any results. We don't see any results because the number of violent shootouts and killings isn't going down. Just the opposite."

Several of the arrested mayors belonged to CalderĂłn's own center-right National Action Party, and Michoacan is the state where CalderĂłn was born and raised, where he launched the military against the cartels in December 2006.

"There was immediately a perception that the arrests were politically motivated," said David A. Shirk, a specialist on Mexico's judiciary who directs the Trans-Border Institute at the University of San Diego. "It looked suspicious, coming right before the elections, but the government was given the benefit of the doubt, because of the level of threat they face from organized crime."

In 2008, at the urging of the United States, the Mexican legislature gave the government new legal tools to prosecute organized-crime cases, allowing the state to hold suspects for almost three months without charges and to use testimony from confidential informants and government wiretaps.

"But the fact that they couldn't build a case against the mayors, it looks bad," Shirk said. "It really shows the challenges Mexico faces, and how law enforcement has to become much better at what it does."

For its part, the U.S. government is spending $1.3 billion in its Merida Initiative aid package: attempting to bolster the rule of law in Mexico by employing FBI instructors to train federal police detectives at a new academy and by sending Mexican prosecutors to U.S. classrooms in hopes of transforming the judiciary. The Obama administration has asked Congress for another $310 million for 2011.

"The cartels never pressured me to cooperate. They never called me," said Antonio GonzĂĄlez, a Xerox dealer and mayor of Uruapan, a bustling city in the heart of Michoacan's avocado country.

During his eight months in jail, GonzĂĄlez said, investigators told him that they had been listening in on his phone calls for six months. "I kept waiting to see some evidence of my crime," said GonzĂĄlez, who spent the days jumping an imaginary rope and working on his memoirs.

GonzĂĄlez recalls being shoved by masked federal agents into helicopters and buses. " 'Here comes another package. Just another package,' they yelled. And in that moment I was no longer a person but a package," he said, "I wasn't Antonio GonzĂĄlez any longer. I was a package."

He said the accusations against him came from anonymous tips. "My lawyers told me: 'This is a joke. Any lawyer can see that they don't have any evidence against you. There's no way you'll even spend the 40 days here. You should be out in a couple of days,' " said GonzĂĄlez, who belongs to CalderĂłn's party.

He says he was interrogated by a prosecutor who badgered him to confess that he once had lunch with a cartel member named "Mr. GĂłmez," whom GonzĂĄlez says he does not remember.

"This was all based in rumors. Rumors and lies. They were looking for a scapegoat and people talk, perhaps for political reasons," GonzĂĄlez said. "It was a horrible experience, just horrible."

Mexican prosecutors declined to discuss the mayors' cases.

"The government is abusing its use of secrecy," said Arturo HernĂĄndez, the attorney for GonzĂĄlez. "This is a time in which we're seeing an excessive use of force by the authorities. There is an exaggerated psychological pressure on detainees: People are not allowed to speak to their families or attorneys. They pressure you to admit to the charges against you."

Leonel Godoy Rangel, governor of Michoacan, complained that the federal government treated the mayors like criminals but acted with little evidence; he said the mayors deserve an apology.

Interior Secretary Fernando GĂłmez-Mont said no apology will be forthcoming. The mayors were released because judges found insufficient evidence, he said, not because "their innocence has been proven."

Obama preaches reconciliation with coal bosses

President Obama delivered a eulogy on Sunday for the 29 coal miners killed in the April 5 explosion at the Upper Big Branch Mine in Montcoal, West Virginia. The remarks, filled with religious and patriotic rhetoric, were aimed at concealing the criminal responsibility of the mine owners and the complicity of federal and state agencies that allowed miners to work in a deathtrap.
Some two thousand people—including co-workers, family members, friends and workers from other mines—came to the Beckley Convention Center, about 35 miles from the scene of the disaster, to honor their fallen loved ones and comrades. Obama and the state Democratic Party establishment, however, had other motives.
Billed as a service to promote “hope and healing,” the event was aimed at dissipating the anger of miners and their families against Massey Energy and other mine owners. The talk was of reconciliation and forgiveness. The miners, Obama declared, died in pursuit of the “American dream.”
“All of West Virginia is in pain and not without some anger,” US Senator Jay Rockefeller said before the president’s remarks, “But we will bind together as a community because that is what West Virginians do. We will find a way to go on.”
This was an unmistakable appeal to “bind together” with the coal bosses, including Massey Energy CEO Don Blankenship who rather than being tried and sentenced for the deaths of 52 miners at his operations over the last decade sat in the audience.
In addition to Rockefeller, US Senator Robert Byrd and Governor Joe Manchin, both Democrats, were also in attendance. The West Virginia Democrats, like their Republican counterparts, have long been in the pockets of Big Coal. If the miners were to conduct a mass struggle to defend themselves, these politicians would quickly shelve their sympathy for “hard-working miners” and dispatch the state police to arrest them.
In his remarks, President Obama repeated the self-serving theme stated over and over by the media to justify the continued carnage in the coalfields: that mining is a dangerous occupation and disasters are a just a normal part of life in the Appalachia coalfields.
“Most days, they would emerge from the dark mine, squinting at the light,” Obama said. “Most days, they would emerge, sweaty, dirty, dusted with coal. Most days, they would come home. Most days, but not that day.”
“They knew there were risks,” he said, “and so did their families. They knew their kids would say a prayer at night before they left. They knew their wives would wait for a call when their shift ended saying everything was ok.”
Such a presentation is designed to conceal the fact that there were real people responsible for the deadly conditions in the mines. Corporations look at the death of miners as little more than collateral damage in pursuit of ever greater levels of profit. For Obama, however, the miners died while trying to realize the “American Dream.”
“All the hard work. All the hardship. All the time spent underground. It was all for their families,” Obama said. “For a car in the driveway. For a roof overhead. For a chance to give their kids opportunities they never knew; and enjoy retirement with their wives. It was all in the hopes of something better. These miners lived—as they died—in pursuit of the American dream.”
It would be more honest to say they lived and died as part of the American nightmare. Miners in the area were forced to take their lives in their own hands in an effort to escape the poverty that prevails in West Virginia, the third poorest state in the nation, lagging only behind Mississippi and Louisiana.
In an interview with the New York Times, a foreman at the Upper Big Branch Mine described the brutal conditions workers faced in the mine, where each day methane levels were double or triple the allowable levels. “Have you ever been scared for your life, when you go to work in the morning—daily. That’s what went on down there. Daily. I’ve had guys come to me and cry. Grown men cried because they’re scared,” he said.
Describing Massey’ s top management, he added, “They don’t care about nobody down there. I heard them make a statement that a man is like a roof bolt. You bend him till he breaks, then you get another one.”
Miners and friends attending the service related similar experiences to the WSWS. The president made no reference to this damning evidence or the accumulated safety regulations that were ignored by Massey and not acted on by federal regulators. Knowing full well that these deadly conditions would continue not only at Massey but throughout the industry, he continued, “How can a nation that relies on its miners not do everything in its power to protect them? How can we let anyone in this country put their lives at risk by simply showing up to work? By simply pursuing the American dream?
“We cannot bring back the 29 men we lost,” he added. “They are with the Lord now. Our task, here on Earth, is to save lives from being lost in another such tragedy. To do what we must do, individually and collectively, to assure safe conditions underground. To treat our miners like they treat each other--like a family. Because we are all family and we are all Americans and we have to lean on each other.”
Miners have heard such pronouncements time and again. After the 2006 disaster at the Sago Mine that killed 12 West Virginia miners, Democratic and Republican politicians swore to improve safety conditions and hold the coal operators accountable. Instead, measures were taken that provided the owners a vast loophole to escape fines and continue operating their unsafe mines. Nothing of any substance has changed in the transition from a Republican to a Democratic administration.
Obama’s remarks make clear that there will be no attempt to hold accountable those responsible for the deaths of the 29 miners, including Massey Energy and its CEO Don Blankenship. The investigation launched by the federal government will merely be another whitewash.
While various politicians and the news media have attempted to present Massey as a “bad apple” in an otherwise safe and conscientious industry, deaths and injuries are occurring in other mines as well.
On Friday, a 28-year-old miner was killed just eight miles west of Beckley, in Eccles, West Virginia, when he was crushed between a continuous mining machine and the mine wall. The mine is owned by International Coal Group, which also owns the Sago Mine.
