What Arizona's immigration law really says

It's not about racial profiling; it's about upholding the law.

"As we exercise the right to advocate our views, and as we animate our supporters, we must all assume responsibility for our words and actions before they enter a vast echo chamber and reach those both serious and delirious, connected and unhinged." Those words were written by former President Clinton in a New York Times op-ed marking the 15th anniversary of the Oklahoma City bombing.

While Clinton's finger-wagging was directed at critics of the Obama administration, his caution against overblown rhetoric might also be heeded by the vast echo chamber bent on whipping up hysteria in response to a recently passed Arizona law designed to effectively address illegal immigration.

Arizonans have endured decades of federal neglect of immigration enforcement. Half of illegal border crossings now occur in Arizona, and our study found that state taxpayers spend more than $2 billion a year on education and healthcare for illegal immigrants and their children. The porous border is virtually a welcome mat for criminal organizations that run drugs and other contraband through the state. Kidnappings in Phoenix are at an all-time high, and the killing last month of rancher Robert Krentz -- police suspect by an illegal immigrant -- is only the latest graphic example of the impact that rampant illegal immigration has on ordinary Arizonans.

Faced with an ongoing crisis and little help from Washington, Arizona has been forced to respond to protect its residents and its financial resources. This month, the legislature passed and Gov. Jan Brewer signed SB 1070. Among other things, this law requires all law enforcement officers in Arizona to act on reasonable suspicion that an individual is in the country illegally.

The reaction from advocates for illegal immigrants to SB 1070 -- which, according to opinion polls, is supported by some 70% of Arizonans -- can only be described as incendiary and irresponsible, not to mention patently inaccurate. Los Angeles Cardinal Roger Mahony invoked images of Nazi Germany and Soviet totalitarianism. Reform Immigration for America, an umbrella coalition of pro-amnesty groups, warned ominously that "it's racial profiling, and it encapsulates the hatred we are fighting." ACORN's Bertha Lewis declared, "If this bill passes, Arizona is declaring itself an apartheid state."

SB 1070 is not a mandate for Arizona police to seek out illegal immigrants. It conforms fully with the Constitution's 4th Amendment protections against unreasonable search and seizure. Under the law, Arizona police are prohibited from racially profiling or stopping anybody merely because of appearance or ethnicity. They may inquire about immigration status only if there is justification for the stop under the Constitution -- such as investigating a possible crime -- and there is reasonable suspicion that the individual is in the U.S. illegally.

And what is reasonable suspicion? Reasonable suspicion might include the lack of any sort of valid U.S. identification documents that police officers routinely request from anyone who is lawfully stopped. The law expressly states that race, color or ethnicity does not constitute reasonable suspicion of illegal presence in the U.S. In reality, SB 1070 does nothing more than require police in Arizona to protect the citizenry and uphold responsibilities abrogated by the federal government.

A ruling by the U.S. 1st Circuit Court of Appeals this year provides firm legal footing for Arizona's law. In Estrada vs. Rhode Island, the court affirmed that the failure of an alien to possess alien registration documents represents probable cause for state or local police to arrest the person for a federal misdemeanor committed in the officer's presence, or detain that person until the individual's status can be verified.

Predictably, those who have consistently opposed all efforts to enforce U.S. immigration laws are resorting to a campaign of lies and distortions to fight implementation of the law.

SB 1070, plain and simple, will allow police to identify and detain people because of the laws they violate, not because they happen to meet a particular racial or ethnic profile. What it demands is that state law enforcement officers no longer turn a blind eye in situations in which they reasonably suspect that an individual they have encountered is violating U.S. immigration laws.

Mexico acknowledges migrant abuse, pledges changes

MEXICO CITY – Amnesty International called the abuse of migrants in Mexico a major human rights crisis Wednesday, and accused some officials of turning a blind eye or even participating in the kidnapping, rape and murder of migrants.
The group's report comes at a sensitive time for Mexico, which is protesting the passage of a law in Arizona that criminalizes undocumented migrants.
The Interior Department acknowledged in a statement that the mainly Central American migrants who pass through Mexico on their way to the United States suffer abuses, but attributed the problem to criminal gangs branching out into kidnapping and extortion of migrants.
Rupert Knox, Amnesty's Mexico researcher, said in the report that the failure by authorities to tackle abuses against migrants has made their trip through Mexico one of the most dangerous in the world.
"Migrants in Mexico are facing a major human rights crisis leaving them with virtually no access to justice, fearing reprisals and deportation if they complain of abuses," Knox said.
Central American migrants are frequently pulled off trains, kidnapped en masse, held at gang hideouts and forced to call relatives in the U.S. to pay off the kidnappers. Such kidnappings affect thousands of migrants each year in Mexico, the report says.
Many are beaten, raped or killed in the process.
One of the main issues, Amnesty says, is that migrants fear they will be deported if they complain to Mexican authorities about abuses.
At present, Article 67 of Mexico's Population Law says, "Authorities, whether federal, state or municipal ... are required to demand that foreigners prove their legal presence in the country, before attending to any issues."
The Interior Department said the government has taken some steps to combat abuses and Mexico's legislature is working to repeal Article 67 "so that no one can deny or restrict foreigners' access to justice and human rights, whatever their migratory status."
The Amnesty report said one female migrant told researchers that Mexican federal police had forced her group off a train and stolen their belongings. Forced to walk, she said, she was subsequently attacked by a gang and raped.
The Interior Department said it shares Amnesty's concern, and called the report "a valuable contribution."
Mexico has long been offended by mistreatment of its own migrants in the United States.
The Arizona law — slated to take effect in late July or early August — makes it a state crime to be in the U.S. illegally and allows police to question anyone they suspect of being an illegal immigrant. Mexico has complained that the law would lend itself to racial profiling and discrimination.

Texas lawmakers want tough immigration bills

AUSTIN, Texas — Two Republican Texas lawmakers plan to introduce tough immigration measures similar to the new law in Arizona, a move state Democrats say would be a mistake.

Rep. Debbie Riddle of Tomball said she will push for the law in the January legislative session, the San Antonio Express-News and Houston Chronicle reported Wednesday. Rep. Leo Berman of Tyler told the Fort Worth Star-Telegram that he also plans to file similar legislation.
The Arizona law will require local and state law enforcement to question people about their immigration status — and make it a crime for immigrants to lack registration documents. The law is set to take effect later this summer.
"The first priority for any elected official is to make sure that the safety and security of Texans is well-established," said Riddle, who introduced a similar measure in 2009 that didn't get out of committee. "If our federal government did their job, then Arizona wouldn't have to take this action, and neither would Texas."
Berman said one of his bills would require presidential candidates to provide documented proof to the Texas Secretary of State that they were born in the U.S. in order to be listed on the Texas ballot.
Homeland Security Secretary Janet Napolitano told a U.S. Senate hearing Tuesday that a Justice Department review is under way to determine the Arizona law's constitutionality.
Texas state Sen. Leticia Van de Putte, a San Antonio Democrat and former president of the National Hispanic Caucus of State Legislators, called the law "extremely damaging and hateful."
Van de Putte predicted failure for any similar measures in Texas and said the GOP would suffer politically for such a move.
Asked about the Arizona law, GOP Gov. Rick Perry and his Democratic challenger, Bill White, emphasized through spokespeople that immigration is a federal responsibility.
Jim Harrington, of the Texas Civil Rights Project, predicted any similar effort in Texas would fail because Texas has "a different relationship with the Hispanic community."
"You can take the political temperature by just looking at Rick Perry being quiet," Harrington said.

• "Arizona's approach is the wrong one," ACLU attorney says

(CNN) -- Now that Arizona lawmakers have passed what's considered some of the toughest immigration legislation in the country, other states are watching to see whether they should follow in the state's footsteps or stand back.
Arizona's bill orders immigrants to carry their alien registration documents at all times and requires police to question people if there's reason to suspect they're in the United States illegally. It also targets those who hire illegal immigrant day laborers or knowingly transport them.
Critics, including immigrant advocates and the American Civil Liberties Union of Arizona, are concerned that the legislation will foster racial profiling, arguing that most police officers don't have enough training to look past race while investigating a person's legal status.
The bill made it through the state Senate on Monday after it was passed by the state House last week. It's now awaiting the signature of Republican Gov. Jan Brewer. Supporters of the measure expect her to sign it. Latino members of Congress are calling on Brewer to veto it.
Michael Hethmon, general counsel for the Immigration Reform Law Institute, helped draft the language of the Arizona bill. The institute is the legal affiliate of the Federation for American Immigration Reform.
On the heels of the Arizona initiative, Hethmon said he has been approached by lawmakers from four other states who have asked for advice on how they can do the same thing where they live. He declined to identify the states, citing attorney-client privilege.
"Arizona was meant to be the leading edge," Hethmon said. "If you are going to work on developing a state-based response to this enormous problem -- the lack of a national immigration policy -- Arizona is the place to do it."
Hethmon pointed to Arizona's history of citizen ballot initiatives in support of immigration reform, noting that "what's happening in Arizona just didn't pop out of nowhere. It's the latest step in a fairly deliberate process."
Republican State Rep. Russell Pearce, who sponsored the legislation in Arizona, said the four initiatives he put on the 2006 ballot regarding illegal immigrants passed by an average of 75 percent.
State laws relating to immigration have increased in recent years, according to numbers from the National Conference of State Legislatures.
In 2005, 300 bills were introduced. The next year, that number nearly doubled, and in 2007, more than 1,500 bills were introduced. Another 1,305 were introduced in 2008, and about 1,500 were considered in 2009.
About 15 percent of those were enacted, dealing with issues such as driver's licenses, health and education.
About1,000 bills have been brought up so far this year.
Hethmon cited the election year, the Democratic leadership's position on the issue and the tough economic times as catalysts for introducing legislation.
"Historically, not only in the U.S. but in virtually all industrialized nations, when the unemployment rates go up ... the public becomes much less sympathetic toward programs which bring in large numbers of foreigners as workers and economic players," he said.
Whether Arizona becomes the standard-bearer on illegal immigration depends on the fate of the legislation, said Ann Morse, the program director of the National Conference of State Legislatures' Immigrant Policy Project.
"Certainly states will look at it, but not in a rush," she said. With court challenges promised from opponents, states will be watching to see if the legislation is deemed constitutional and if it's costly, Morse said.
Omar Jadwat, the staff attorney with the ACLU's Immigrants Rights' Project, said following in Arizona's footsteps would take states in the wrong direction.
"Although we are aware that people are trying to convince other legislatures to go down this path, I think it's clear that both as a policy matter and a legal matter, that Arizona's approach is the wrong one," he said.
Isabel Garcia, a legal defender in Arizona's Pima County, blasted the bill as "the most dangerous precedent in this country, violating all of our due process rights."
"We have not seen this kind of legislation since the Jim Crow laws. And targeting our communities, it is the single most largest attack on our communities," she said.
Pearce brushed off her criticism, saying, " 'Illegal' is not a race, it's a crime."
"We do not tolerate those who break into our country, just like we don't tolerate those who break into our homes," he said.
Hethmon praised the legislation as "the most cost-effective and the most humane way to deal with the illegal immigration problem."
"Every time you convince an illegal alien to self-deport, you bypass having to resort to direct physical deportation," he said.
In addition to providing a model for other states, Hethmon said the legislation in Arizona and other bills in the works in other states also provide an example on the national level.
"The states are laboratories for democracy. The federal government is in gridlock," he said. "We're providing models for the day when the ice breaks up on the Hill and the legislative waters flow and the country decides to confront this problem in a realistic way."

Chief Beck: L.A. won't be guided by Arizona immigration rules

With as many as 100,000 people expected to convene downtown Saturday to rally in support of immigrant rights, Los Angeles Police Chief Charlie Beck went out of his way to make clear that his officers are guided by a different set of rules than the controversial state law recently passed in neighboring Arizona.

"Because of the ongoing issues in Arizona, I wanted to make something perfectly clear," Beck said. "Special Order 40 is the mandate of this department. …That is how I will police this city as long as I am the chief of police."

Beck was referring to the agency's long-standing policy that prohibits officers from initiating contact with someone solely to determine whether he or she is in the country legally. It has drawn the periodic ire of critics who argue for a tougher stance against undocumented immigrants.

Beck and other chiefs before him, however, have said the policy is an important tool, as it encourages illegal immigrants who witness crimes to assist police without fear of being deported.

Arizona's tough new legislation makes it a state crime to be in Arizona illegally and requires police to check suspects for immigration paperwork.

The legislation also bars people from soliciting work or hiring day laborers off the street.

Anger over the law has inflamed passions on both sides of the immigration debate and caused LAPD officials to increase their predictions for the number of people expected to turnout for the annual demonstration.

ARIZONA POLICE LAUNCH FIRST IMMIGRATION CRACKDOWN AFTER LAW’S PASSAGE

PHOENIX -- Maricopa County Sheriff Joe Arpaio launched his latest crime and immigration sweep Thursday, arresting 89 people, with 61 suspected of being undocumented immigrants.
Arpaio, whose tough crackdowns have made him a hero in the anti-illegal immigration community, has conducted 14 of the sweeps since 2008. Critics allege Arpaio's deputies racially profiled Hispanics during the sweeps, but Arpaio says people were approached because deputies had probable cause to believe they had committed crimes.
"We do not go on the street corner and grab people because they look like they're from another country," the self-styled "toughest sheriff in America" told the local ABC affiliate.
The sheriff claimed Wednesday that this latest crime sweep was scheduled weeks ago and was unrelated to Arizona's new anti-immigration law.
Arpaio has lauded the new law, however, saying it gives him new authority to detain undocumented migrants who aren't accused of committing any other crimes.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

The Administration's Phantom Immigration Enforcement Policy
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

If you’ve been following the news from Arizona in recent days, you’ve probably heard that the state’s Republican governor, Jan Brewer, has just signed into law a “racist” bill that will punish Hispanics, stamp out civil rights, create a police state – and trample on the Constitution for good measure. You also may have heard that the Arizona law will “undermine basic notions of fairness,” at least according to President Obama, who has called the law “misguided” and ordered the Justice Department to find some way to challenge its standing.
Apocalyptic rhetoric notwithstanding, the Arizona law is not at all controversial in substance. All it does is deputize state police to determine whether people are in the country legally and to question them if there is reasonable suspicion that they’re not. Of course, that function should properly be handled by the federal government. But because the government has made so little effort to enforce immigration laws, border states that bear the brunt of illegal immigration – an estimated 460,000 illegal immigrants call Arizona home – have been forced to take action on their own terms.
The concept behind the immigration law is straightforward: If you enforce laws against illegal immigration, you will have less of it. That was also the idea behind Arizona’s Legal Arizona Workers Act, which required the state’s employers to verify the immigration status of new hires using the federal government’s E-Verify program. Businesses eager to avoid the burdens of verification and pro-illegal immigration groups also opposed that measure, filing suit to prevent its passage, but emerging evidence seems to suggest that it had the desired effect: Since being implemented in January 2008, the LAWA has resulted in a substantial decrease of illegal immigration.
The new law seeks to continue that progress. It does so mostly by making state crimes what are already federal crimes. For instance, the Arizona law makes it a crime to be in the country illegally – in other words, it enforces the national law. The Arizona law also requires police to question people about their immigration status if they have reasonable cause to suspect that they’re illegal immigrants. To prevent abuse or racial discrimination, the law also includes provisions banning racial profiling, and the measure itself has nothing to do with race or ethnicity, as the bill’s foes claim. Still, given that the majority of the state’s illegal immigrants are from neighboring Mexico, it is inevitable that the majority of those targeted by the law will be Hispanic. That says more about the demographics of illegal immigration than the allegedly discriminatory agenda of Arizona authorities.
Concerns about the abuse of civil liberties are similarly overblown. The Arizona law will require anyone arrested for a crime to have their immigration status established before their release. In theory, this should already be the law of the land; but so-called “sanctuary city” laws enacted by cities and municipalities across the country have prevented police from enforcing immigration laws. Such laws certainly benefit felons who escape deportation. How they profit the country at large is less apparent. The Arizona law also requires residents to carry ID or immigration registration documents at all times. That too is reasonable. A valid ID is already required to qualify for government and public assistance programs available to citizens and requiring one form of valid ID – whether a drivers license a government-issue ID — hardly marks the onset of Nazi Germany. Indeed, no less than President Obama has previously expressed support for a national ID card.
While some have criticized Arizona for taking the initiative against illegal immigration, it’s hard to find fault with the state’s sense of urgency. Last month’s murder of Arizona cattle rancher Rob Krentz was just example of the crime problem that unchecked illegal immigration has helped create and the problems its poses for American justice. Although Kentz was known for providing illegals with food and water, police found tracks at the murder scene leading to the Mexican border. They made no arrests in the case. In that climate of lawlessness, the state cannot be blamed for passing a law that may help offer a solution. Moreover, with the Obama administration and Congressional Democrats threatening to take up immigration reform – that is, amnesty for the 11-million plus illegal immigrants in this country unmatched by serious enforcement measures going forward – states like Arizona are left with a choice of doing something to combat the problem or leaving it to the federal government to make it worse.

"As we exercise the right to advocate our views, and as we animate our supporters, we must all assume responsibility for our words and actions before they enter a vast echo chamber and reach those both serious and delirious, connected and unhinged." Those words were written by former President Clinton in a New York Times op-ed marking the 15th anniversary of the Oklahoma City bombing.

While Clinton's finger-wagging was directed at critics of the Obama administration, his caution against overblown rhetoric might also be heeded by the vast echo chamber bent on whipping up hysteria in response to a recently passed Arizona law designed to effectively address illegal immigration.

Arizonans have endured decades of federal neglect of immigration enforcement. Half of illegal border crossings now occur in Arizona, and our study found that state taxpayers spend more than $2 billion a year on education and healthcare for illegal immigrants and their children. The porous border is virtually a welcome mat for criminal organizations that run drugs and other contraband through the state. Kidnappings in Phoenix are at an all-time high, and the killing last month of rancher Robert Krentz -- police suspect by an illegal immigrant -- is only the latest graphic example of the impact that rampant illegal immigration has on ordinary Arizonans.

Faced with an ongoing crisis and little help from Washington, Arizona has been forced to respond to protect its residents and its financial resources. This month, the legislature passed and Gov. Jan Brewer signed SB 1070. Among other things, this law requires all law enforcement officers in Arizona to act on reasonable suspicion that an individual is in the country illegally.

The reaction from advocates for illegal immigrants to SB 1070 -- which, according to opinion polls, is supported by some 70% of Arizonans -- can only be described as incendiary and irresponsible, not to mention patently inaccurate. Los Angeles Cardinal Roger Mahony invoked images of Nazi Germany and Soviet totalitarianism. Reform Immigration for America, an umbrella coalition of pro-amnesty groups, warned ominously that "it's racial profiling, and it encapsulates the hatred we are fighting." ACORN's Bertha Lewis declared, "If this bill passes, Arizona is declaring itself an apartheid state."

SB 1070 is not a mandate for Arizona police to seek out illegal immigrants. It conforms fully with the Constitution's 4th Amendment protections against unreasonable search and seizure. Under the law, Arizona police are prohibited from racially profiling or stopping anybody merely because of appearance or ethnicity. They may inquire about immigration status only if there is justification for the stop under the Constitution -- such as investigating a possible crime -- and there is reasonable suspicion that the individual is in the U.S. illegally.

And what is reasonable suspicion? Reasonable suspicion might include the lack of any sort of valid U.S. identification documents that police officers routinely request from anyone who is lawfully stopped. The law expressly states that race, color or ethnicity does not constitute reasonable suspicion of illegal presence in the U.S. In reality, SB 1070 does nothing more than require police in Arizona to protect the citizenry and uphold responsibilities abrogated by the federal government.

A ruling by the U.S. 1st Circuit Court of Appeals this year provides firm legal footing for Arizona's law. In Estrada vs. Rhode Island, the court affirmed that the failure of an alien to possess alien registration documents represents probable cause for state or local police to arrest the person for a federal misdemeanor committed in the officer's presence, or detain that person until the individual's status can be verified.

Predictably, those who have consistently opposed all efforts to enforce U.S. immigration laws are resorting to a campaign of lies and distortions to fight implementation of the law.

SB 1070, plain and simple, will allow police to identify and detain people because of the laws they violate, not because they happen to meet a particular racial or ethnic profile. What it demands is that state law enforcement officers no longer turn a blind eye in situations in which they reasonably suspect that an individual they have encountered is violating U.S. immigration laws.

Villaraigosa backs boycott of Arizona
The mayor also urges participation in Saturday’s immigrant and labor rights march downtown, which police say could lure 100,000 people.


Blasting Arizona's tough new immigration law as "unpatriotic and unconstitutional," Los Angeles Mayor Antonio Villaraigosa on Thursday backed a boycott of the state and urged Southern Californians to join an immigrant and labor rights march this weekend that police say could swell to 100,000 participants.

"The debate has caused a call to action," Villaraigosa said.

Organizers of the May Day march, scheduled for Saturday morning in downtown Los Angeles, say that the outcry over the Arizona law and the slow pace of congressional action on immigration reform have prompted renewed activism. The law, set to take effect in midsummer, makes it a state crime for illegal migrants to be in Arizona, requires police to check for legal status and prohibits people from hiring day laborers off the street.

Meanwhile, many immigrant-rights activists say they are losing patience with the Obama administration and Congress for not pressing comprehensive legislation that would legalize the nation's 11 million illegal immigrants and allow more family visas in addition to beefing up border enforcement. Although Sen. Charles Schumer (D-N.Y.) unveiled a 26-page "conceptual proposal" for a bill Thursday, activists remain dismayed that he continues to postpone introducing actual legislation.

The combination of those events — along with fear that several immigrant-friendly Democrats will suffer political defeat in November — has pushed the alarm button for many activists. For the first time since 2006, several immigrant rights coalitions have put aside their differences and are unifying behind a single march this year.

"Absent our unity, immigration reform will always be put off to another day," said Angelica Salas of the Coalition for Humane Immigrant Rights of Los Angeles. "We need to show a powerful force that we won't give up on immigration reform in 2010."

Salas said the Spanish-language media, which helped fuel a massive turnout of more than 500,000 marchers in 2006, have closely covered the Arizona law and are helping publicize Saturday's march.

The Korean community has also been galvanized, said Eun Sook Lee, executive director of the National Korean American Service and Education Consortium in Los Angeles. She said her center has received numerous phone calls from Koreans wanting to sign up for bus trips to Arizona to protest the law and to participate in the march. Several hundred are expected to turn out, including as many as 100 Korean drummers in colorful folk garb.

"Many people who may have been ambivalent in the past are outraged," Lee said. "This has sparked a national outcry."

Los Angeles Police Chief Charlie Beck said his department is expecting tens of thousands of participants in Saturday's rally but also a peaceful event.

"We have estimates as high as 100,000," he said. "That is a reasonable estimate. We are prepared to police that effectively."

Beck stressed that his officers would be guided by Special Order 40, the department's long-standing policy that prohibits officers from initiating contact with anyone for the sole purpose of determining whether they are in the country illegally.

At his news conference Thursday, Villaraigosa urged people to march with white shirts, U.S. flags and trash bags in a peaceful demonstration of immigrants' desires to work and participate in U.S. civic life.

Marchers will begin gathering at 10 a.m. at Olympic Boulevard and Broadway and will walk north on Broadway to City Hall. In addition to the downtown march, police are preparing for small gatherings in MacArthur Park and Westwood.

Planning for this year's march has been in the works for months, police said. With a tight budget the department had to ensure that a massive number of officers were available to work the May 1 rally. In this year's planning, march organizers and other groups have expressed concern about how the LAPD will approach the marchers, among whom would be illegal immigrants.

Feds Probe University’s Device To Help Illegal Border Crossers

Nearly half a year after a professor at a public university spent taxpayer dollars to create a tool that helps Mexicans enter the United States illegally, the area’s congressional delegation has finally decided to investigate the matter.
The activist Chicano professor (Ricardo Dominguez) at the University of California San Diego, a major public institution not far from the Mexican border, proudly announced his new invention—Transborder Immigrant Tool—in November without scrutiny from university officials or the feds. The idea is to help Mexicans enter the U.S. illegally by mapping the safest routes through the notoriously rigorous southern border desert.
The innovative technology is a simple mobile application —inserted into the cheapest available cell phone on the market—which guides illegal aliens through the least dangerous routes, areas with shelter, food, water and so-called Quaker help centers that provide medical attention and directions to the nearest major U.S. highway. The mobile program is touted as an “intelligent agent algorithm” that parses out the best routes and trails on a particular day and hour so that Mexicans can cross the “vertiginous landscape” as safely as possible.
Dominguez, a tenured visual arts professor, was inspired to create the technology by the thousands of Mexicans who have died on their journeys north because they got lost in the treacherous terrain. For months he boasted about his new Transborder Immigrant Tool, but the publicity campaign has come to a screeching halt and his tenure is at risk because federal lawmakers are finally looking into the matter.

Referring to it as a “troubling use of taxpayer dollars,” the legislators point out that those who worked on the device may be committing a federal felony by encouraging illegal immigration.
Dominguez has dismissed the probe as a sort of witch hunt, assuring that he used less than $10,000 in taxpayer grants and suggesting the congressman should be more concerned about the cost of investigating him. That amount, the professor believes, will be much more than what he spent on the entire project to help illegal border crossers.

Democrats Outline Plans for Immigration

WASHINGTON — A coalition of top Senate Democrats laid out the contours of a proposed overhaul of immigration laws on Thursday — and appealed to Republicans to join them in pursuing it — even as doubts mounted about the prospects of winning approval of legislation this year.
Under the outline of immigration changes drawn up by Senator Charles E. Schumer of New York, the No. 3 Senate Democrat, the federal government would enhance border security and create a new fraud-resistant Social Security card.
Illegal immigrants who wish to remain in this country would have to admit they had broken the law, pay back taxes and fees, and pass a criminal background check to qualify for legal residency after eight years.
“Our immigration system is broken,” the majority leader, Senator Harry Reid of Nevada, said late Thursday afternoon at a packed news conference. “We’re offering this framework as an invitation, an invitation to our Republican colleagues to work with us to solve this problem that has plagued our country for too long.”
Even as the Democratic senators were still speaking, President Obama issued a statement praising the proposal as “an important step,” and he warned that lack of federal action would “leave the door open to a patchwork of actions at the state and local level that are inconsistent and, as we have seen recently, often misguided.”
Mr. Obama’s statement was a reference to the tough new law recently enacted in Arizona that many Democrats view as draconian and that helped prompt Democrats to take on the immigration issue sooner than some had planned.
“What has become increasingly clear,” Mr. Obama said, “is that we can no longer wait to fix our broken immigration system, which Democrats and Republicans alike agree doesn’t work.”
The statement contrasted with comments he made to reporters a day earlier on Air Force One, in which he suggested that Congress might not have the appetite for an immigration overhaul.
At the news conference, Democratic leaders said they were presenting the legislative framework in hopes of persuading Republicans to collaborate on the issue. They are also looking to sound out skeptical Democrats to gauge the prospects for support.
House Democrats have said they will not act unless the Senate moves first.
Mr. Reid, who is facing a difficult re-election fight back home, first put the issue back on the Congressional agenda a few weeks ago when he told a pro-immigration rally in Las Vegas that he intended to pursue legislation, a stance that caught many in Washington off guard.
Senator Lindsey Graham of South Carolina, the chief Republican negotiating with Democrats on the issue, dropped out of the talks, saying he was angry that Mr. Reid seemed to be giving immigration priority over a climate bill.
At the news conference Mr. Reid said it was “not logical to use immigration as an excuse to not help on energy.” But he also said Democrats were not directing their message at Mr. Graham.
“There are 40 other Republicans,” he said.

“There is not a chance that immigration is going to move through the Congress,” he said.
But Mr. Schumer, who is now chairman of a subcommittee on immigration long headed by the late Senator Edward M. Kennedy of Massachusetts, said he believed there was a possibility of success.
Mr. Schumer hailed his approach as a way to combine border security and improvements in the American work force while providing a chance for millions of people living illegally in the United States to gain legal status and pay taxes.
And Mr. Schumer, who is known for his ambition in both the political and policy arenas, drew loud laughter when he said that he would not have accepted the subcommittee gavel if he had thought otherwise.
“If I did not believe we could accomplish immigration reform, I never would have chosen to accept the immigration subcommittee chairmanship,” he said. “Committees of inaction and legislative backwaters are not places in which I thrive.”
Democrats acknowledge, however, facing a difficult task considering that President George W. Bush, was unable to persuade enough of his fellow Republicans to back immigration changes in 2007, and the effort collapsed.
