One Indictment Issued in ATF Operation That Allegedly Put Guns In the Hands of Mexican Criminals

(CNSNews.com) – One indictment has been issued in connection with the gun-tracing operation run by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), which allegedly allowed thousands of guns to be funneled to Mexican criminals.

With regard to the “Fast and Furious” operation, “there’s been one indictment at this time,” Scot Thomasson, the ATF's public affairs chief in Washington, D.C., told CNSNews.com.

“We don’t speak to open investigations, especially investigations that are under indictment,” said Thomasson. “I can tell you that an indictment was announced on January 25 against 20 defendants.”

A Mar. 9 letter to Attorney General Eric Holder signed by House Judiciary Committee Chairman Lamar Smith (R-Tex.) and 13 other members of that panel states, “Internal ATF documents show that ATF’s supervisors became increasingly concerned about the pace of the investigations” in connection with the “Fast and Furious” operation.

“There seems to have been little effective coordination between ATF and the [Justice] Department as a whole [in carrying out the operation],” states the letter. “While guns continued to cross the border, the Department was apparently slow to approve wiretaps and to bring prosecutions.”

“It was only this January, 15 months after ATF initiated the program and a month after [Customs and Border Protection] agent [Brian] Terry’s murder, that the [Justice] Department finally issued its first indictment on evidence from the program,” said the letter.

The ATF’s “Fast and Furious” program is based out of Phoenix, Ariz., and is part of the larger “Project Gunrunner.” The latter is being executed in an effort to stem the illegal flow of guns from the United States into Mexico.

GOP members of the House Judiciary Committee who sent the letter to Holder, who leads the Justice Department, demanded answers by March 18 to whistleblower allegations that the “Fast and Furious” operation “allowed straw buyers for criminal organizations to purchase thousands of guns so that ATF could track them across the border.”

On Thursday, Mar. 10, Holder told the Senate Appropriations Commerce, Justice, and Science subcommittee that he has "made it clear to people in the [Justice] Department that letting guns 'walk,' I guess that's the term people use, is not something that is acceptable. We cannot have a situation where guns are allowed to walk, and I've made that clear to the U.S. attorney, as well as the agents in charge of various ATF offices."

Holder’s comments were in response to a request by Sen. Kay Bailey Hutchison (R-Texas) for him to comment on “Project Gunrunner.”

According to the Center for Public Integrity (CPI), which first reported the whistleblower allegations on Mar. 3, the “Fast and Furious” operation started in October 2009.

The CPI revealed that about 1,998 firearms are involved in the investigation, including 797 that “were eventually recovered as a result of criminal activity on both sides of the border — including 195 from inside Mexico — after they were used in crimes, collected during arrests, or interdicted through other law enforcement operations.”

What is “worse,” according to the letter by House GOP members, is that “two guns from the [Fast and Furious] program were found at the murder scene of Customs and Border Protection Agent Brian Terry in December.”

“We find it ironic that the government allowed guns to be trafficked into Mexico as part of a program designed to stop guns from being trafficked into Mexico,” stated the letter. “We are also troubled that ATF engaged in activities that may have facilitated the transfer of guns to violent drug cartels while simultaneously attempting to restrict lawful firearms sales by border-area firearms dealers.”

According to CPI, the ATF’s “Feast and Furious” program “was met by strong objections from some front-line agents who feared they were allowing weapons like AK-47s to ‘walk’ into the hands of drug lords and gun runners, internal agency memos show.”

Furthermore, the GOP letter noted that the ATF carried out the operation despite the Justice Department Inspector General criticizing the agency’s ability to trace guns.

Following the CPI report about the controversial ATF operation, Attorney General Holder directed his department’s inspector general to look into U.S. efforts to go after gun traffickers along the southwest border.

The six questions the Republican committee members want the Justice Department to answer, as stated in the Mar. 9 letter, are as follows:

1. How many weapons have been allowed to pass to Mexico under the program knows as “Fast and Furious? Is the program still active?

2. Who at ATF Headquarters approved the program?

3. Who in the U.S. Attorney’s Office for the District of Arizona approved the program? On what authority did the Office approve the program?

4. Did ATF or the U.S. Attorney’s Office in Phoenix coordinate the “Fast and Furious” program with Department? Did the Department approve the strategy?

5. What changes or improvements has ATF made to its eTrace [electronic tracing] program and its ability to use intelligence to target gun trafficking organizations in general?

6. Does ATF view the “Fast and Furious” program as a success?

Reporting from Mexico City — A 14-year-old boy who says he's been killing or working for drug cartels since he was 11 has been captured by the Mexican army after a monthlong hunt, authorities said Friday.

Edgar Jimenez Lugo, who authorities said was born in San Diego, was wanted on suspicion of killing rivals — allegedly beheading some of them — as part of his work for an especially violent drug-trafficking cartel.



Jimenez was attempting to board a flight for Tijuana with two sisters Thursday night when authorities detained him in Morelos state south of Mexico City. They were apparently planning to flee the country after the boy's alleged exploits made headlines last month.

"I've killed four people by chopping off their heads," the boy reportedly said after his capture. "I just cut off their heads; I never went and hung the bodies from bridges or anything like that."

Jimenez, alias El Ponchis, was quoted in media reports as saying he had been forced to work for a faction of the Beltran Leyva drug cartel under pain of death ever since henchmen from the group kidnapped him three years ago. He said he was usually high on drugs as he killed.

Marco Antonio Adame, the governor of Morelos, said in a news conference that Jimenez was a U.S. citizen by virtue of his San Diego birth.

The story of the boy had become something of a cause celebre here when it first emerged several weeks ago. Rumors abounded that he was a ruthless decapitator and that some of his work had been videotaped. (Initial reports erroneously put his age at 12.) Mexican media immediately dubbed him "the boy killer" and "the hit boy."

Photographs from Morelos on Friday showed a skinny Jimenez, dressed in baggy cargo pants and a black sweatshirt, standing between two well-armed soldiers in camouflage. His hands are stuck in his pockets and his head barely clears their shoulders.

The drug gang he allegedly worked for, the so-called South Pacific Cartel, has been locked in deadly battle with another Beltran Leyva faction for control of the city of Cuernavaca and other parts of Morelos — a dispute that erupted following the killing of drug boss Arturo Beltran Leyva by Mexican forces a year ago. More than 300 people have been killed in the conflict.

Jimenez reportedly ran with a group of boys and men ages 12 to 23 and represents a trend of ever younger Mexicans working for the cartels as killers, mules and enforcers and in other capacities. If judged guilty, the boy would be the youngest cartel killer known to be in prison.

His age poses a legal dilemma for Mexican authorities, who on Friday were scrambling to figure out which laws and agencies would handle a minor suspected of such egregious crimes.

Also Friday, in another setback for Mexican attempts to put away drug traffickers, a judge acquitted the nicknamed "Queen of the Pacific" of numerous drug-related charges. Illegal Immigration and Crime

Immigrant criminality represents perhaps the worst abuse of the liberty aliens enjoy in the United States. Increasingly, the government closest to the people either finds its hands tied or cravenly abrogates its responsibility to fellow Americans within its jurisdiction. Moreover, the illegal element exacerbates the economic and other burdens caused by legal immigration.

The current high rate of sustained, mass immigration—more than one million legal immigrants plus half a million illegal aliens every year—forces many states and localities into turmoil. The illegals certainly live outside the obligations that those who live under the "consent of the governed" owe to each other: While the principles of the Declaration of Independence guarantee all human beings certain natural and unalienable rights, only parties who have consented to our government deserve the full rights of citizenship. Illegal immigrants are not part of the social contract giving legitimacy to this government. American citizens have not given their consent to higher taxes, crowded schools, jammed emergency rooms, clogged roads, unlawful turning of single-family homes into hotels or apartments into tenements, forced multicultural amenities such as bilingual education and multilingual ballots, or welfare and other services subsidizing poverty-prone immigrants. Above all, they never consented to higher crime rates.



While anyone who decries illegal immigration is required to distinguish it from legal immigration, the effects of legal immigration should first be noted. Robert Samuelson recently wrote in his Washington Post column that "Hispanics account for most of the increase in poverty" since 1990. "Compared with 1990, there were actually 700,000 fewer non-Hispanic whites in poverty last year . . . . Meanwhile, the number of poor Hispanics is up by 3 million since 1990. The health insurance story is similar. Last year 13 million Hispanics lacked insurance. They're 60 percent of the rise since 1990." And of course a growing proportion of the Hispanic population is immigrants poorer than their predecessors. Samuelson remarks that the black poverty rate in this period has actually dropped, from 32 to 24 percent.

To add to Samuelson's observations, consider the reports from the Center for Immigration Studies by its Steven Camarota and Harvard's George Borjas detailing the negative economic impact of recent immigrants on native-born wages and employment. Illegal immigrants impose an even greater burden, because they pay few taxes and they drain public services such as health care, education, and other benefits of the welfare state. While many federal programs deny assistance to illegals, many state and local programs and privileges are open to them. The National Academy of Sciences found in a 1997 landmark study that immigrantheaded households in 1994-1995 placed a net annual fiscal burden on California native-born residents of $1,178 per native household.That is, each American family in California subsidized that state's immigrant population by nearly $1,200 a year.

The NAS report also said fiscal impacts tend to benefit the federal government and drain state and local government resources. "Much like anyone else in the population, immigrants use services that are costly to provide, or that others can use less freely—so-called congestion costs. Examples include services from roads, sewers, police and fire departments, libraries, airports, and foreign embassies." Therefore, having a much larger immigrant population (29 percent of the U.S. foreign-born, a fourth of the State's population) bloats California's budget significantly.

The national government has exclusive power over immigration, and it has mandated certain public benefits for immigrants, legal or illegal, such as public education (see the 1982 Supreme Court case, Plyler v. Doe). States and localities then bear the costs and consequences of all immigration.And they respond differently, with differing consequences for their people.

The Florida legislature rejected a bill issuing driver's licenses to illegal aliens. Kansas state legislators voted to give illegal aliens instate college tuition. Alabama and Florida state police work closely with federal immigration enforcers. New York, Los Angeles, and Chicago have "sanctuary" policies that keep city employees, even police, from asking about immigration status. An Idaho county commissioner billed Mexico for the $2 million illegal aliens owe for county services.

The impact is seen particularly in crime: Record-high auto thefts in Arizona, drug trafficking in Salt Lake City, human smuggling rings in Los Angeles, D.C. sniper Lee Malvo, money laundering, prostitution, gang murders, and even slavery. Immigration authorities estimate that 84,000 state inmates are aliens, though state and local figures on foreign-born prisoners are hard to come by. At least three quarters of these immigrant state inmates are in Arizona, California, Florida, Illinois, New Jersey, New York, and Texas—the top immigrant destinations.

Police officers at the local or state level are the law enforcement officials most likely to encounter illegal aliens. Local residents are the crime victims of these aliens. Local, county, or state jails house many of the foreign criminals. Local, county, or state criminal justice systems try these lawbreakers. And local, county, and state taxpayers pay the costs of law enforcement and criminal justice associated with the crimes that immigrants, legal and illegal, commit.

Figures for 1999 State Criminal Alien Assistance Program compensation show claims of $1.5 billion in documented costs incurred by state corrections and local jails for covered aliens. County governments face a special burden, a 2001 report by 24 Southwestern border counties calculated. They spent, from general funds, $894 million on law enforcement and criminal justice in fiscal year 1999. Many of the costs that criminal aliens impose on all state, county, and municipal jurisdictions are not represented in such figures. To cite just one California example, San Diego now spends $50 million a year to handle illegal criminal aliens.

The underworld network built up by millions of alien lawbreakers, who by and large have no fear of capture or of being held accountable, enabled the September 11 terrorists to operate undetected. Latino illegal aliens in Northern Virginia helpfully showed several of the terrorists the ropes on how to secure Virginia driver's licenses fraudulently.

The advancement of "political correctness" and multiculturalism has caused politicians to be less willing to challenge limitations on their authority over resources. Local and state politicians in heavy immigrant-receiving areas have instead expanded immigrant eligibility for public benefits, welfare, assistance programs, health care programs for those without private insurance, and driver's and other licenses. Some states and localities have begun to accept the Mexican matricula consular ID card, though it has been determined to pose a great risk to U.S. national security. Even before the recently reported crossing of 25 Chechens into Arizona, authorities knew that the illegal aliens pose a national security problem.

Dealing with current levels and quality of legal immigration is an immense problem by itself. But it is clear that until alien criminality of every kind is punished, swiftly and surely, Americans who must live with the consequences will continue to suffer higher taxes, lower quality of life, higher threat and fear levels, and less actual safety.

State Legislatures Slow on Immigration Measures

Under newly fortified Republican control, many state governments started the year pledging forceful action to crack down on illegal immigration, saying they would fill a void left by the stalemate in Washington over the issue.

Now, with some legislatures winding down their sessions, the lack of consensus that has immobilized Congress has shown up in the legislatures as well, and has slowed — but not stopped — the advance of bills to penalize illegal immigrants.

No state has passed a law that replicates the one adopted last April in Arizona, which greatly expanded the powers of police officers to question the immigration status of people they stop.

Still, immigrant advocates in many states say the debate has clearly shifted in favor of tougher enforcement. They say they have had to fight just to hold the line on immigration issues that they thought were long settled.

Bills similar to Arizona’s are advancing in Florida, Kansas, Oklahoma and South Carolina. In Kansas and Oklahoma, even though Republicans control the legislatures and the executive branch, immigration proposals have encountered unusually vocal opposition from business.

Arizona-style bills died early in Colorado, and Nebraska decided this month to end its debate on one. Arizona’s law requires state and local police officers to inquire about the immigration status of anyone they stop if they have a “reasonable suspicion” the person is an illegal immigrant.

States also wrestled with other kinds of immigration initiatives. In New Mexico and Washington, Democrats backed by immigrant advocates defeated efforts to repeal laws granting driver’s licenses to illegal immigrants. Those two states and Utah are the only ones that give licenses to illegal immigrants.

In New Mexico, the repeal effort was championed by Gov. Susana Martinez, a Republican and a Hispanic, who had promised such a move in her campaign last year. A bill she supported was defeated by the Democratic-controlled State Senate on Wednesday. Instead, it approved a bill that added requirements, including fingerprinting, for immigrants without a Social Security number who apply for licenses.

If that bill wins final approval and the governor’s signature, it will create a two-tiered system in which licenses issued to people without proof of legal residence will be distinctively marked. According to license authorities, about 83,000 illegal immigrants are driving in New Mexico.

Ms. Martinez vowed to continue to fight for the repeal, although this is the final week of the legislative session. She called the current law “dangerous” and accused Democrats of “partisan political gamesmanship” for blocking its repeal.

Marcela Díaz, executive director of Somos Un Pueblo Unido, a group that led the license fight, said, “It’s a good sign that we will be able to maintain licenses for folks who are living, working and paying taxes in our state, regardless of their immigration status.”

But, she said, “We don’t take anything for granted.”

In Washington State, the debate over driver’s license rules polarized a state that has been relatively tolerant of illegal immigrants, an important part of the work force that picks apples. Several Democrats joined Republicans in supporting a repeal of the license law.

State fiscal authorities estimated that the repeal would cost about $1.5 million a year in new verification technology and monitoring expenses. That swayed some budget-minded lawmakers, and the bill was killed Monday.

“We saw tremendous momentum against us,” said Pramila Jayapal, executive director of OneAmerica, an immigrant advocate group. “But there was a realization that the debate was very divisive, and it was not going to solve the immigration problem.”

In Utah, where the Legislature finished its session on Thursday, lawmakers passed a novel package of three immigration laws. One was a revised version of the Arizona bill, without the most controversial parts. It requires the police to verify the immigration status of people they arrest on suspicion of committing a felony or serious misdemeanor. It allows, but does not require, the police to inquire about the status of people booked for lesser crimes.

“My bill is quite different than Arizona’s,” said State Representative Stephen Sandstrom, a Republican who was the main author of the measure.

Another law authorized the creation of a state guest worker program by 2013, and instructed the governor and the state attorney general to negotiate with federal authorities for a waiver to allow Utah employers to hire illegal immigrants.

Mr. Sandstrom said he was “completely against” the guest worker bill, which he called “a tragedy for the state.” He said that the law was unconstitutional and unlikely to take effect, but that it would still lure illegal immigrants to Utah.

Utah’s attorney general, Mark Shurtleff, acknowledged that the proposed waiver does not exist in federal immigration law.

“It’s a federal crime to employ an illegal alien,” he said in an interview. “I don’t know how you get a waiver for a federal crime. I’m going to try. But it’s definitely an uphill battle.”

Those two measures venture into terrain generally reserved for federal immigration authorities and are likely to draw legal challenges from advocacy groups, although they appear less likely to be challenged by the Obama administration.

Utah’s third new immigration law creates a labor commission to work with Nuevo León State in Mexico to bring laborers to Utah through existing federal guest worker programs. Mr. Shurtleff, who is a Republican, was the force behind that law.

The initiatives had the support of Utah businesses and law enforcement agencies.

In a national meeting of attorneys general last week, Mr. Shurtleff unveiled a proposal for a “national compact” to serve as a model for immigration legislation in Congress, based on Utah’s approach of enforcement measures paired with an opening to legal status for illegal workers.

In Texas, the biggest news from the immigration debate was a bill by State Representative Debbie Riddle, a Republican. Her legislation would penalize employers hiring illegal immigrants, with an exception for family households employing baby sitters or gardeners.

Immigrant groups and Democrats accused Ms. Riddle of hypocrisy, saying she wanted to deport illegal immigrants, except for her friends’ nannies.

The World Socialist Web Site interviewed workers and young people who participated in the March 12 demonstration and rally against utility shutoffs in Detroit. (See also, “Demonstration in Detroit demands end to utility shutoffs”.)





Pauline

Pauline, a senior at Central High School, is the friend of the daughter of Marvin Allen. Marvin was killed in the Dexter Avenue fire on January 5, 2010. “It was wrong that they didn’t give him more time to pay his bills,” she said. “He was a senior; he should have had a discount. They should have worked with him.”





“Utility shutoffs are very common in Detroit,” Pauline said. “They affect many people, including people you might not think are affected. Most people have either been cut off or are on the verge of being cut off. My mom is on a DTE budget plan. She is unemployed.



“I agreed that nobody should have their utilities cut off. If people have no job, they still have to pay their bills, but they have less money. They have to stretch what they have. Something has to give.”



Speaking about the fact that so little is done to help people, Pauline said, “Most politicians don’t care. They are looking out for themselves. The Republicans don’t worry about the more needy, but I don’t think the Democrats are any different. They are all the same, just with a different party name.”



Kevin Sanford was a neighbor of Marvin and Tyrone Allen. He said that he was awakened on January 5 by his wife, and “saw the house totally engulfed in flames.”



Sanford said, “Three people lost their lives that day because the government wants to look at utilities as a luxury, when they should be a considered a necessity like food and water. That’s why we are here marching today.



“There was a very good turnout for the march,” Allen added. “It was very successful if you ask me.”



Allen spoke about the transformation of the city over the past 50 years. “I lived have lived on Dexter since 1960. I was born and raised here. When you drove down Dexter Avenue there were so many trees, there was hardly any sunlight coming down. It was like driving through a tunnel. The city is not what it used to be. You only have a few people who own their homes and are really trying to maintain them. It’s like a jungle. There are no jobs.



“Heat and light, I rank it up there with oxygen—you are going to have it or you are going to die. It is as simple as that.”



Arkan, a retired small business owner from Sterling Heights, said, “My electricity was shut off because I didn’t make enough of a payment. It never happened before. I want to put in my voice so that it will be heard. We need more people to get involved.





Tim Merrick

“It looks like the rich all over the world are getting richer. Look at gas prices. They are up every day. It is not because of Libya. The oil companies are behind it.”





Tim Merrick, a young warehouse worker, said he was attending because he saw the demonstration “as a chance to be proactive in a cause that is new to me. I see that it is part of a bigger picture of exploitation.



“This is all new to me,” Tim said. “This past week I was reading articles on CAUS. It is infuriating how ineffective our say in the federal government is as far as putting pressure on these corporations. This seems like one case in many where people stand up against corporate oppression.”





Gregory Jones

Gregory Jones is retired from the military and is currently teaching in Lansing. He said, “I want to be supportive of equal opportunity of resources. I think that utilities and other essential resources should be fundamental human rights. I don’t believe that rich individuals should be able to monopolize gas and electricity. It should belong to the community.





“The situation in the United States reminds me of the revolutions in the Middle East. People there are fed up with Arab princes hogging all the resources as though they belong to them personally. The people say that the oil belongs to the whole nation, not just the princes. It is time for the resources to be spread equally.



“I never made over $100,000 a year, and that was enough to lead a comfortable middle class life. But you have people making millions. It is not even about money any more. It is about power. It is sociopathic behavior, where they don’t care about their fellow man suffering. They have contempt for everyone below. You see it here. They pit those who are working against those who are living in poverty. They try to get working people fighting against each other.



“I want to be part of any cause fighting for people’s rights,” Jones declared.



Doretha Chapman, a nurse, currently unemployed, said, “I sure hope we are effective today. It is sad to lose the lives of young kids due to utility shutoffs.



“I have not had my heating cut off, but I have lost my job. It’s like a treadmill. No one calls you. No one is hiring. All the hospitals are merging.





Luthereen Meoton

Speaking about the broader social crisis in the city, Chapman said, “I saw in Detroit, in Allen Park, they are laying off the firefighters. I am left almost speechless. The money is there. Maybe it’s not being put to good use or distributed where it would do the best. The United States can’t just be completely broke. But, when it comes to social programs, they are telling us there is no money.”





Luthereen Meoton, a 52-year-old disabled worker, said, “I know how it is to be cold at night, to have no heat or gas. I had to join with people who are standing for something that is right.”



“People are being cut off in the winter. They are forced to use electric heaters and such, and houses burn up.”





Meoton summed up the sentiment of many who attended the demonstration by concluding, “These things should be free. Heat and gas are necessities for life.”
