Mexican mayor fears massacre of 16 was random

CIUDAD JUAREZ, Mexico – The mayor of a violent Mexican border city said Monday he fears a shooting that killed 16 people in a working class neighborhood may have been random because many of the victims were "good kids" with no apparent ties to drug gangs.

The dead included at least eight teenagers, the youngest a 13-year-old girl.

Mayor Jose Reyes Ferriz said police were pursuing all lines of investigation. But he said none of the victims of the attack Saturday night had criminal records, and the teenagers were "good kids, students, athletes."

He said he feared violence was reaching levels of brutality shocking even for Ciudad Juarez, which faces El Paso, Texas, and has become one of the world's deadliest cities amid rampant battles between drug gangs fighting for turf and smuggling routes north.

"There is no logical explanation, a concrete reason for this event. This is something that worries us, gratuitous or random criminal acts," Reyes told MVS Radio. "It goes way beyond what had been happening and puts Ciudad Juarez in even greater danger."

Witnesses and relatives said armed men in two trucks blocked off a dead end street in Villas de Salvarcar, a neighborhood of modest cinderblock homes partly surrounded by a fence topped by barbed wire. The gunmen opened fire at three houses, ending their rampage at one home where young people had been gathered for a party.

Ten people were found dead at the scene and six died at hospitals.

One father rushed into the third home after seeing the gunmen and warned the teenagers to flee, according to Mari Cruz, who lost a son and nephew in the attack, and who heard the details from a girl who survived by hiding in a closet. The father was shot at the entrance and the gunmen forced the young people into a corner of the house before shooting them.

She said her son, Jose Luis Aguilar Camargo, and his cousin, Alberto Soto Camargo, both 19, were students at the Autonomous University of Ciudad Juarez.

"Who did it? Why such hate?" Cruz wailed as tearful neighbors tried to comfort her outside her house. "They were just boys who were not in any gangs."

Next door, friends had made a makeshift altar for Jose Adrian Encina, a 17-year-old high school student. It included a collage of photos of the teenager, including one where he held up a sign reading, "Do you love me?"

Friends outside the home worked on a poster reading, "We will always remember you. You will always be in our hearts. You'll be an angel for all of us."

A girl who gave only her first name, Linda, out of fear for her safety, said Encina was her cousin. She described him as a good student who aspired to be a doctor and had received an academic recognition award from Chihuahua Gov. Jose Reyes Baez.

Three bloody shoes still lay outside the home where the party was held.

Authorities have offered a reward of 1 million pesos ($76,200) for information leading to the capture of the gunmen. Reyes said police have received five calls with tips that could be useful, but he did not elaborate.

"The people of Juarez must demand that this is investigated thoroughly and we must demand justice for such deplorable crimes," he said at a news conference later Monday.

In another attack in Ciudad Juarez on Monday, armed men burst into a bar around dawn and killed four men and a woman, said Arturo Sandoval, a spokesman for the regional prosecutors' office.

More than 2,600 people were killed last year alone in Ciudad Juarez, a city of 1.3 million people. Authorities say most of the dead have ties to drug gangs but civilians have been caught in the cross fire in increasing numbers. Among the dead last year were university professors and an honor student.

Elsewhere, gunmen killed 10 people and wounded 15 in a bar in Torreon, a city in the northern state of Coahuila.

Drug violence has surged in many parts of Mexico since President Felipe Calderon deployed thousands of troops in 2006 to crush powerful cartels. More than 15,000 people have been killed in gang violence since.

With the health-care battle still unfinished, the Obama administration has been laying plans to take up an issue that could prove even more divisive — a major overhaul of the nation's immigration system.

Senior White House aides privately have assured Latino activists that the president will back legislation next year to provide a path to citizenship for the estimated 12 million undocumented workers now living in the United States.

In addition to the citizenship provision, the emerging plan will stress efforts to secure U.S. borders against those trying to cross illegally. But that two-track approach was rejected repeatedly in the past by Republicans and other critics who insist a border crackdown must demonstrate its effectiveness before any action on citizenship is considered.

Whatever proposal Obama puts forward will likely be complicated by the calendar: Midterm elections are in November, and polls show the public is more worried about joblessness and the fragile economy than anything else.

The White House already has a packed agenda for 2010: economic recovery, global-warming legislation and tougher regulation of financial institutions.

In an effort to enlist the kind of business support that helped drive its health-care initiative, for example, administration officials have reached out to the National Restaurant Association, which represents an industry that employs thousands of immigrants. Earlier this year, the new head of the association, Dawn Sweeney, met with Cecilia Munoz, a White House aide involved in the issue, and expressed interest in cooperating.

"It's an extremely important issue for our members," said Sweeney, whose group could exert grass-roots pressure on lawmakers.

As a candidate, Obama vowed to take up immigration during his first year in office. That deadline will come and go. Further delay could anger Latino voters, who came out in force for the president and congressional Democrats in 2008.

"The bulk of the people needing immigration reform are Latino," said Rep. Raul M. Grijalva, D-Ariz. "There's a level of disenchantment about where we're going. ... And if you don't give the Latino community a reason to participate (in the elections) you weaken your base even more."

For an immigration bill to have a realistic shot of passing next year, political analysts said, the particulars would have to be agreed upon by the spring. Delay would increase the likelihood of the issue being derailed by the November elections.

An immigration bill was introduced in the House earlier in the month, and Sen. Charles E. Schumer, D-N.Y., who chairs a subcommittee on immigration, is heading the effort to cobble together a bipartisan coalition in the Senate.

But Democrats may not have a lock on one prominent Republican who has worked in the past to revamp the immigration system: Arizona Sen. John McCain.

McCain backed George W. Bush's failed attempt to overhaul immigration in his second term. But he has not committed to supporting the Obama bill, saying he worried the president would not endorse a temporary guest-worker program.

Organized labor, an important part of the Democratic base, has voiced opposition to a guest-worker program under which more immigrants could enter the country on a temporary basis. The White House would not reveal its position on guest-worker issue.

Tijuana reels amid a surge of violence
After some gains in Mexico's drug war in 2009, Tijuana has had a bloody turn of events in the new year. More than a dozen people, four of them students, were reported slain in the last week.

It's been a bloody new year so far in this violence-racked city, leaving authorities stunned and apparently speechless. Three teenagers in school uniforms were mowed down by automatic-weapons fire Wednesday. Another youth was shot multiple times last week as he sat in his car outside his parents' upscale home.

Four people were decapitated, at least 10 people were killed in drive-by attacks, and five people were kidnapped, including two security guards and a prominent businessman.

Just a few months ago, Tijuana was hailed by some as a success story in Mexico's war on drug cartels. Top officials from the U.S. and Mexico, including President Felipe Calderon, praised the city's efforts as a model for the rest of the country.

The city's leading crime fighters -- Army Gen. Alfonso Duarte Mugica and Secretary of Public Security Julian Leyzaola -- were named "men of the year" by Baja California's leading news weekly. Authorities boasted that they were closing in on the city's notorious crime boss, Teodoro Garcia Simental.

Now the bodies are piling up at the morgue again, and authorities appear dispirited by the turn of events. After the drive-by shooting of the three teenagers -- two boys and a girl -- outside their high school, authorities didn't even hold a news conference.

"What are they going to say? They have no answers," said Vicente Calderon, a veteran journalist who runs the local news website Tijuanapress.com.

Narco-violence has flared regularly since early 2008, when war broke out between rival factions of the Arellano Felix drug cartel. That year, the city's homicide toll peaked at 844.

By the middle of 2009, however, the crime rate had receded as the warring gangs were believed to have reached a truce. Mugica, the military commander, paraded captured crime bosses through the Morelos military base downtown, and Leyzaola continued his purge of corrupt officers from the police force.

Mayor Jorge Ramos' "state of the city" speech in November emphasized Tijuana's progress against organized crime and the presentation included video of favorable comments from U.S. Ambassador Carlos Pascual and San Diego Mayor Jerry Sanders.

Since December, however, the violence has surged. The rival gangs appear to have broken their truce and are, at times, employing different and deadlier tactics.

Attackers have firebombed police cars and a funeral home with Molotov cocktails. They've shot up a hospital. Women are increasingly targeted. At least two of the recent beheading victims were women, one of whom was left naked outside a cemetery, a narco-message left between her legs.

Although most of the victims remain young men -- typically foot soldiers or drug dealers -- gunmen seem more willing, perhaps deliberately, to kill anyone associated with their targets.

"These acts of violence appear more and more like narco-terrorism," said Victor Clark, the director of the Binational Center for Human Rights in Tijuana.

In late December, the government seemed to score a major victory. Gilbert Sanchez Guerrero, a former police officer and top lieutenant for crime boss Garcia, was arrested in an early morning raid at his upscale condominium in Ensenada.

His apprehension led to the arrests of at least seven more Tijuana police officers suspected of corruption.

But, as in so many cases in Mexico's battle with organized crime, the blow was followed by another round of bloodshed, including an attack on New Year's Eve, when gunmen broke into a home and killed an elderly couple and two other people.

Last week, 17-year-old Jose Fernando Labastida Fimbres, the grandson of a supermarket magnate, was shot as he sat in his Audi outside his home in a hillside neighborhood. A student at Mater Dei Catholic High School in Chula Vista, a San Diego suburb, the youth was memorialized by hundreds at a local church.

Two days later, gunmen wielding AK-47s shot dead the three teenagers, who had just finished final exams at Ricardo Flores High School.

Scores of students witnessed the gunmen's car creep up on the teenagers' vehicle and open fire, sending their Jeep Cherokee into an electrical pole as nearby students scrambled for safety.

Though media reports, citing anonymous sources, say Labastida Fimbres and one of the other teens may have had links to organized crime, authorities have made no statements on the motives.

Officials at Ricardo Flores High School, located in a tough east Tijuana neighborhood, do random drug tests and searches of students' backpacks, but teenagers said those precautions aren't enough anymore.

As students lingered outside school last week, many said they choose their friends with great care now and don't get into a car unless they know the person driving it.

"We're scared it could happen again," said Myra Zamudio Guzman, a 17-year-old who saw the shooting.

Through all the recent violence, law enforcement officials have been mostly silent. To some observers, their reticence betrays a sense of impotence. It's as if authorities have exhausted their tough rhetoric, they say.

One of the few government officials who made a public appearance last week was Baja California's secretary of tourism. Oscar Escobedo Carignan announced a public relations initiative to improve the city's image.

The negative portrayals are unfair, he said, blaming the media and citing per-capita crime figures that he said supported his case:

"We [Tijuana] finish with 20 homicides per 100,000 people. Brazil gets 150 homicides, and they get the Olympics."

La Raza’s doctrine is that the American middle class should be Mexico’s welfare system. We pay for the free delivery of millions of illegals (now 1 in 5 in Los Angeles), educate their children, pay out welfare, which in Los Angeles County is 40 million per month, and house their criminal drug gangs in the largest prison system in the United States. The cost of depressed wages for Americans from the Mexican invasion and occupation is calculated to be 200 billion annually.

Mexico is listed by the Christian Science Monitor as one of the most corrupt nations in the world with more billionaires than even Saudi Arabia. To maintain the oligarchy’s control on their economy’s monopolies, they must dump their poor, pregnant and criminal classes over our border so we pick up their welfare and education costs. An example of Mexican economics is Carlos Slim. Slim controls Mexico’s phone monopoly. Mexicans pay the highest phone rates in the hemisphere. Carlos Slim has assets of over $70 billion.

While we are Mexico’s welfare system, the second biggest stream of money Mexico takes in is transfers from illegals working in the United States back to Mexico. This is another reason Bank of America and Wells Fargo violate Federal laws and illegally open bank accounts using fraudulent ID’s. The transfer fees are a huge cash cow for these La Raza donors. The government of Narco-Mex had set up nearly 50 Mexican consulates (compare to the UK which has 8) to hand out their phony consulate ID’s the banks are happy to pretend are legit.

THE MEXICAN FASCIST POLITICAL PARTY OF LA RAZA… “THE (MEXICAN) RACE”

LA RAZA OPERATES FOR THE EVER EXPANSION OF THE MEXICAN WELFARE STATE, OPEN BORDERS, GRINGOS PAY FOR BIRHTHING, WELFARE, AND MAKE UP FOR THE ENORMOUS MEXICAN “TAX FREE” UNDERGROUND ECONOMY, WHICH IN LOS ANGELES ALONE, IS MORE THAN $2 BILION PER YEAR.

THIS IS LA RAZA:

The National Council of La Raza (NCLR) is not only one of the wealthiest and most politically powerful militant organizations in the country, it is also notoriously racist and subversive. The group's name, "La Raza," means "The Race," by which they are referring to ethnic Mexicans, or more broadly to "hispanics" or "latinos." And it is quite clear from their decades of vitriolic rhetoric — both spoken and written — that the La Raza activists are trying to engender not only race consciousness amongst hispanic U.S. citizens and Mexican migrants, but also racial militancy and animosity toward "Gringo America."

The NCLR grew out of the La Raza Unida (The Race United) Party and the Southwest Council of La Raza in the late 1960s and early 1970s. The key leaders were Marxist-Leninist followers of Fidel Castro and Che Guevarra.

In 1970, the California Senate Fact-Finding Subcommittee on Un-American Activities said this about La Raza Unida: "Its president is Maclovio Barraza. Mr. Barraza has been identified by the Subversive Activities Control Board as a member of the Communist Party, and presides over the Council which recently received a grant of $1,300,000 from the Ford Foundation."

Maclovio Barraza was the NCLR Board of Directors' founding Chairperson, and the NCLR continues to honor this hardcore Marxist by awarding the Moclavio Barraza Award to its top activist each year.
One of the early founders of La Raza was Professor Jose Angel Gutierrez, whose violent, extremist rhetoric has caused NCLR some public relations problems. Back in 1969, Gutierrez said: "We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him." He has continued to promote the same hateful "reconquista" ideology ever since. But that didn't stop NCLR from bestowing on him their "Hero Award" in 1994.
The radical student group MEChA (Moviemento Estudiantil Chicano de Aztlan), with which NCLR has been closely allied for several decades, is even more explicitly and militantly, having adopted the slogan, "Por La Raza Todo, Fuera de La Raza Nada," which translated means: "For the Race, Everything; Outside the Race, Nothing."
MEChA's founding documents and literature are replete with appeals to "La Raza de Bronce" (The Bronze Race) and condemnation of the "brutal gringo." MEChA, as its name suggests, is also a leading promoter of the radical "reconquista" (reconquest) movement, a plan of to take over the states of California, Arizona, New Mexico, Colorado, and Texas — a region they refer to as "Aztlan" — which they claim was stolen from the "Aztecan" peoples. NCLR provides major financial support to MEChA and many of NCLR's leaders were MEChA leaders in their college days.
NCLR: Agents for the Government of Mexico?
Especially troubling is NCLR's leading role in the Fundacion Solidaridad Mexicano Americana (Foundation for Mexican-American Solidarity, FSMA), an organization founded and funded by the government of Mexico and directed by the Mexican Ministry of Foreign Affairs and Ministry of Public Education. Both of these ministries have been engaged in efforts aimed at demanding full political rights for illegal aliens in the U.S. and indoctrinating America's Hispanic population in radical, racist La Raza ideology.
Top members of La Raza, MALDEF, the National Immigration Forum and other leading immigration activist organizations also serve on the Council of the FSMA. As such, they are acting as agents for a foreign power that is actively seeking to influence our national, state, and local laws and policies, in ways that are inimical to the interests of our nation and our citizens. NCLR and these other participating groups should be investigated by Congress to determine if they are breaking any laws, especially since these organizations and/or their affiliates not only enjoy tax-exempt status, but even receive millions of dollars from federal and state government agencies.

New Stealth Federal Funding Bill for La Raza
Which brings us to an extraordinary matter of some urgency. Several weeks before the White House and its Senate allies announced their big "breakthrough" legislation (S.1348), radicals in the House quietly introduced legislation to pump $5 million directly into La Raza next year — and $10 million per year for "each fiscal year thereafter."

H. R. 1999, entitled the Hope Fund Act of 2007, should truthfully be labeled the "Perpetual Funding of La Raza Radicals Act."
It is being sponsored by Rep. Ruben Hinojosa (D-Tex.) and Rep. Rick Renzi (R-Ariz.).
Since the bill [4] is rather short, we include the entire text below:

To authorize appropriations for assistance for the National Council of La Raza and the Raza Development Fund.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Hope Fund Act of 2007'.
SEC. 2. ASSISTANCE FOR NATIONAL COUNCIL OF LA RAZA AND RAZA DEVELOPMENT FUND.
(a) Use- The Secretary of Housing and Urban Development shall, to the extent amounts are made available pursuant to subsection (b), make a grant to the National Council of La Raza for the purpose of providing technical and financial assistance to local non-profit organizations to undertake community development and affordable housing projects and programs serving low- and moderate-income households, particularly through organizations located in neighborhoods with substantial populations of income-disadvantaged households of Hispanic origin. Assistance provided by the Secretary under this section may be used by the National Council of La Raza or the Raza Development Fund to--

(1) provide technical and financial assistance for site acquisition and development, construction financing, and short- and long-term financing for housing, community facilities, and economic development;
(2) leverage capital from private entities, including private financial institutions, insurance companies, and private philanthropic organizations;
(3) provide technical assistance, training, support, and advice to develop the management, financial, and administrative capabilities of housing development organizations serving low-income households, including Hispanic households; and
(4) conduct such other activities as may be determined by the Secretary and the National Council of La Raza.
(b) Authorization of Appropriations- There is authorized to be appropriated for grants under this section--
(1) $5,000,000 for fiscal year 2008; and
(2) $10,000,000 for each fiscal year thereafter.
Although S.1348, the immigration bill, is far more important and will have a much larger and more dramatically harmful impact than H.R. 1999, nevertheless, the La Raza funding bill is such blatant pork-barrel pandering to an extremist, racist lobbying group, that it sends an unmistakable message about what the "stakeholders" behind the Kennedy-Bush amnesty are really after: more money, more power, more revolution — and the complete destruction of our borders and security.
With millions more tax dollars in their political war chest, they would become even more brazen in their demands. They know that this is a volatile issue that could rouse the wrath of American voters. Which is why none of the sponsors of the legislation have mentioned H.R. 1999 on their House web sites, and why the NCLR has also kept mum about this planned political payoff.
But their dirty secret is out. If it is sufficiently exposed, it can stir enough opposition not only to stop H.R. 1999, but also to defeat S.1348 or any other amnesty "compromise" that comes out of the White House-Congress immigration wheeling and dealing.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third-nation neutral arbitration of ....disputes concerning immigration laws and their enforcement." We’ll have the story. Last year, Prince William County, Virginia passed an initiative to allow local police to check the immigration status of anyone in police custody. The county recently held its first immigration training session for local police officers. We’ll have a look inside the training. Mexican President Felipe Calderon is in New York today on the first leg his five-day tour across America to meddle in immigration issues in the United States. This is his first visit to the U.S. since he became President in 2006, but he will not meet with President Bush or any of the presidential candidates, who he has accused of spewing anti-immigrant rhetoric. Lou Dobbs says Mexican President Felipe Calderon is showing "blatant hypocrisy" on
immigration.

In his state of the union address to the Mexican nation, Calderon established his imperialistic imperatives: "I have said that Mexico does not stop at its border, that wherever there is a Mexican, there is Mexico. And, for this reason, the government action on behalf of our countrymen is guided by principles, for the defense and protection of their rights."
Calderon protested the U.S. government's increased raids on illegal employers of illegal alien employees and work site enforcement. In what is little more than a faint nod to the Bush administration's responsibility to enforce U.S. immigration law, the Department of Homeland Security had planned to send out notices to employers from the Social Security Administration informing them of non-matching records between an employee's name and Social Security number. These employers would then be forced to resolve any discrepancy within 90 days or be required to dismiss the employee or face up to $10,000 in fines for knowingly hiring illegal immigrants.
But then, ethnocentric advocacy groups and some labor unions, trying to bolster their membership, sued to stop the crackdown on hiring illegal alien workers. A federal judge in California last week issued a temporary restraining order blocking the plan, giving a victory to the AFL-CIO, the American Civil Liberties Union and the National Immigration Law Center, all of which brought the suit alleging DHS exceeded its authority in making the rule.

That U.S. District Court judge ruled as if she were an employee of the Mexican government, rather than the U.S. government. Homeland Security was simply enforcing existing immigration laws. Are we not a nation that follows the rule of law? If not, we're no country at all.
Calderon must have been delighted by the judge's decision. Calderon, like his predecessors, Carlos Salinas and Vicente Fox, has failed miserably to establish policies that would create jobs for the Mexican people and to eliminate shameful, unchecked corruption and incompetence in the Mexican government.
Even by Mexico's standards, Calderon's blatant hypocrisy is breathtaking. Calderon told the Washington Post more than a year ago that he believes laws are not a relative concept, nor subject to a personal concept of justice. Calderon declared a big difference between himself and his rival for the Mexican presidency, Manuel Lopez Obrador, was this: "I believe in the rule of law." Obviously he does not believe in the rule of U.S. law on U.S. soil.
Calderon can't have it both ways. He cannot fail his citizens at home and then act as the Great Imperialist Protector of his citizens who are driven by poverty and corruption to enter the United States illegally. The United States provides Mexico with an annual surplus of $65 billion in trade, an estimated $25 billion in remittances from Mexican citizens living and working here illegally, and at least another $25 billion generated by the illegal drug trade across our southern border.
But it is President Bush and this Congress who should be most embarrassed, because they are failing to assert rights for Americans in their own country, rights far short of those demanded by Calderon for his citizens living illegally in our nation.

“We can make him disappear”
America’s secret prisons for undocumented immigrants

There are at least 186 secret detention centers maintained by the Immigration and Customs Enforcement agency (ICE) within the borders of the US, according to an article published in the Nation magazine in December. Drawing on a report by Amnesty International (AI) entitled “Jailed without Justice,” it estimates that 415,000 people have been held at these facilities, which are operated under the authority of the Department of Homeland Security as so-called “sub-field offices” of the ICE. Their purpose is to deny undocumented immigrants due process and any means by which they can effectively lobby for their rights.
“If you don’t have enough evidence to charge someone criminally but you think he’s illegal, we can make him disappear,” explained ICE Executive Director for the Office of State and Local Coordination James Pendergraph at an August 2008 police and sheriffs’ conference, according to the AI report.
In October 2009 an assistant to Secretary of Homeland Security Janet Napolitano first revealed the existence of the secret prisons to the secretary, without making the locations public. The author of the December 16 article in the Nation, Jacqueline Stevens, obtained “a partial list” of the secret facilities from an ICE officer.
These prisons include unmarked rooms without beds, showers, toilets, or windows in office parks and commercial building spaces. Stevens reports that some 84 percent of persons arrested by ICE are at first “housed” in such sub-field offices.
For example, according to her article and Ahilan Arulanantham, director of Immigrants’ Rights and National Security at the ACLU of Southern California, an underground parking ramp at a federal building in Los Angeles is called B18 and houses up to 100 immigrants a day without any hygiene, medical, or legal services.
Legal professionals struggling to assist these people found captives chained together. They are continuously rotated between the below-ground parking ramp detention pen and locals jails, to which they are transported in unlabeled and windowless vans. This makes it extremely difficult to establish the identity or whereabouts of those being held. Relatives and attorneys have searched for family members for weeks and months to no avail.
In her article, Stevens reviews the case of Mark Lyttle, who has bipolar disorder and a learning disability. He was 31 years old when he was held at a Cary, North Carolina in an unmarked “sub-field” office in “an office park adjacent to gated communities, large artificial ponds and an Oxford University Press production plant.” He had been snatched out of “the medical misdemeanor section of a nearby prison” by ICE agents and spent his time in detention begging officials not to ship him to Mexico.
The ICE file from the FBI reportedly identified Lyttle as a US citizen. He was initially denied a hearing before an immigration judge, until he landed in Lumpkin, Georgia, where agents arranged for him to appear before the court. He had no legal representation and the judge, a former ICE prosecutor, “ignored Lyttle’s pleas … and signed his removal orders.” His panicked mother and two brothers searched the Cary area obituary columns before they discovered that he was spending Christmas in “a shelter for los deportados (the deported)” in Mexico.
Conditions in the secret jails described in the AI report bear similarity to many of the illegal detention facilities maintained by the US overseas. Indeed, an attorney working for a detained immigrant compared the jails and the treatment of his client to Washington’s program of extraordinary rendition. “Jailed without Justice” identifies at least 90 people who have died in these facilities either due to abuse suffered while in captivity or medical conditions that were left unattended.
The following incident, which had initially been reported in May 2008 by the Washington Post, was recounted in the AI report.
“Geovanny Garcia-Mejia, 27, from Honduras, died on March 18, 2006. He was detained at the Newton County Correctional Center in Texas. He had been placed in a medical unit, where he was found writing on the floor with his blood, internal records show. But he was returned to the jail’s general population after a psychologist wrote in his chart, ‘No idea why he is in suicide cell.’ He hanged himself 12 days later, on his 27th birthday. The local sheriff concluded that guards who should have been checking him every 15 minutes ‘made no rounds through the night...’”
Mexico, El Salvador, Guatemala, the Philippines and China are the top five countries of origin for immigrants trapped in the ICE’s detention pens. Officials take advantage of individuals’ lack of English-language skills in order to deny them due process and/or terrorize them into accepting deportation. The mental anguish created by the conditions of detention drives many to despair.
“Jailed without Justice” told the story of a 34-year-old Mexican woman arrested in front of her home and in the presence of her autistic three-year old, US-born son on a petty theft charge by local police. She was jailed for 24 days. She spoke no English, and while being interviewed by an ICE official, was urged to promptly accept deportation. In the course of her detention, fearing permanent separation from her family and loss of her child, she attempted to hang herself.
For family members, efforts to secure the release of their loved ones and fight deportation often entail huge expenditures. For example, AI reported the story of an Indian man who fled to the US in 1999 after being imprisoned and tortured several times for “political activities.” In 2006 the ICE detained him and demanded a $15,000 bond for his release. His wife arranged the payment with a bondsman while her husband applied for asylum. Upon his release, he appeared, as required, at all his immigration hearings for over two years. After his final hearing, at which he testified as to the details of his torture, the ICE re-arrested the man and hauled him before a second immigration judge, who demanded another bond payment of $80,000. The man’s family and friends tapped their credit cards and mortgaged their homes in order to fork over this sum.
Immigrant incarceration in the US has risen dramatically in the last ten years, from a “daily detention capacity” of 10,000 in 1996 to over 30,000 presently. The Obama administration has continued the policy of its predecessors in this regard. The rise in immigrant incarceration over the past 15 years has been so dramatic that authorities have had to contract out the process to some 350 county and state jails.
AI estimates that about 67 percent of incarcerated detainees are jailed in these facilities, with the remainder put in the secret immigration pens and facilities run by for-profit contractors, whose reimbursement is said to be between $60-$90 per person a day.
The running of these facilities is increasingly becoming a source of revenue for cash-strapped local governments. As noted in an article in the Denver Post last April, “El Paso County Sheriff Terry Maketa has tapped a new source of revenue: illegal immigrants.” The sheriff is leasing jail space to ICE for an average of 150 immigrants a night. He has sent some 17 of his deputies to Pendergraph’s departmental training school to learn how to “initiate deportations without waiting for federal agents.” ICE is reportedly paying $62.40 per night per immigrant, plus transport mileage, netting the jail 10 percent of its annual budget and El Paso County $3.6 million.
The conditions in immigrant detention centers are leading to mounting anger and desperate actions inside the facilities. On January 19, ICE detainees at the Varick Federal Detention Center in Lower Manhattan went on a hunger strike. According to the New York Times, a Jamaican detainee in one dorm at Varick reported that “all hell broke loose” at the facility, with inmates refusing to follow scheduling protocols and passing out fliers protesting detention policies and practices. An ICE SWAT team arrived and used pepper spray and beatings to put an end to the protest, which apparently was inspired by inmates finding out about similar protests occurring at other facilities. Some people were put in isolation, while others were moved to detention centers in other states. The Department of Homeland Security issued its customary denial of detainee abuse.

WILLIAMSBURG, VA. - At the parleys this week with his US and Canadian counterparts in Cancún, Mexican President Vicente Fox will press for more opportunities for his countrymen north of the Rio Grande. Specifically, he will argue for additional visas for Mexicans to enter the United States and Canada, the expansion of guest-worker schemes, and the "regularization" of illegal immigrants who reside throughout the continent. In a recent interview with CNN, the Mexican chief executive excoriated as "undemocratic" the extension of a wall on the US-Mexico border and called for the "orderly, safe, and legal" northbound flow of Mexicans, many of whom come from his home state of Guanajuato. Mexican legislators share Mr. Fox's goals. Silvia Hernández Enriquez, head of the Senate Committee on Foreign Relations for North America, recently emphasized that the solution to the "structural phenomenon" of unlawful migration lies not with "walls or militarization" but with "understanding, cooperation, and joint responsibility." Such rhetoric would be more convincing if Mexican officials were making a good faith effort to uplift the 50 percent of their 106 million people who live in poverty. To his credit, Fox's "Opportunities" initiative has improved slightly the plight of the poorest of the poor. Still, neither he nor Mexico's lawmakers have advanced measures that would spur sustained growth, improve the quality of the workforce, curb unemployment, and obviate the flight of Mexicans abroad. Indeed, Mexico's leaders have turned hypocrisy from an art form into an exact science as they shirk their obligations to fellow citizens, while decrying efforts by the US senators and representatives to crack down on illegal immigration at the border and the workplace. Insufficient revenues mean that Mexico spends relatively little on two key elements of social mobility: Education commands just 5.3 percent of its GDP and healthcare only 6.10 percent, according to the World Bank's last comparative study. Transparency International, a nongovernmental organization, placed Mexico in a tie with Ghana, Panama, Peru, and Turkey for 65th among 158 countries surveyed for corruption. Geography, self-interests, and humanitarian concerns require North America's neighbors to cooperate on myriad issues, not the least of which is immigration. However, Mexico's power brokers have failed to make the difficult decisions necessary to use their nation's bountiful wealth to benefit the masses. Washington and Ottawa have every right to insist that Mexico's pampered elite act responsibly, rather than expecting US and Canadian taxpayers to shoulder burdens Mexico should assume.

This paper focuses on the net fiscal effects of immigration with particular emphasis on the fiscal effects of low skill immigration. The fiscal effects of immigration are only one aspect of the impact of immigration. Immigration also has social, political, and economic effects. In particular, the economic effects of immigration have been heavily researched with differing results. These economic effects lie beyond the scope of this paper. Overall, immigration is a net fiscal positive to the government’s budget in the long run: the taxes immigrants pay exceed the costs of the services they receive. However, the fiscal impact of immigrants varies strongly according to immigrants’ education level. College-educated immigrants are likely to be strong contributors to the government’s finances, with their taxes exceeding the government’s costs. By contrast, immigrants with low education levels are likely to be a fiscal drain on other taxpayers. This is important because half of all adult illegal immigrants in the U.S. have less than a high school education. In addition, recent immigrants have high levels of out-of-wedlock childbearing, which increases welfare costs and poverty. An immigration plan proposed by Senators Mel Martinez (R-FL) and Chuck Hagel (R-NE) would provide amnesty to 9 to 10 million illegal immigrants and put them on a path to citizenship. Once these individuals become citizens, the net additional cost to the federal government of benefits for these individuals will be around $16 billion per year. Further, once an illegal immigrant becomes a citizen, he has the right to bring his parents to live in the U.S. The parents, in turn, may become citizens. The long-term cost of government benefits to the parents of 10 million recipients of amnesty could be $30 billion per year or more. In the long run, the Hagel/Martinez bill, if enacted, would be the largest expansion of the welfare state in 35 years. Immigration and Crime Historically, immigrant populations have had lower crime rates than native-born populations. For example, in 1991, the overall crime and incarceration rate for non-citizens was slightly lower than for citizens.[40] On the other hand, the crime rate among Hispanics in the U.S. is high. Age-specific incarceration rates (prisoners per 100,000 residents in the same age group in the general population) among Hispanics in federal and state prisons are two to two-and-a-half times higher than among non-Hispanic whites.[41] Relatively little of this difference appears to be due to immigration violations.[42] Illegal immigrants are overwhelmingly Hispanic. It is possible that, over time, Hispanic immigrants and their children may assimilate the higher crime rates that characterize the low-income Hispanic population in the U.S. as a whole.[43] If this were to occur, then policies that would give illegal immigrants permanent residence through amnesty, as well as policies which would permit a continuing influx of hundreds of thousands of illegal immigrants each year, would increase crime in the long term. The Fiscal Impact of Immigration One important question is the fiscal impact of immigration (both legal and illegal). Policymakers must ensure that the interaction of welfare and immigration policy does not expand the welfare-dependent popula_?tion, which would hinder rather than help immi_?grants and impose large costs on American society. This means that immigrants should be net contributors to government: the taxes they pay should exceed the cost of the benefits they receive. In calculating the fiscal impact of an individual or family, it is necessary to distinguish between public goods and private goods. Public goods do not require additional spending to accommodate new residents.[44] The clearest examples of government public goods are national defense and medical and scientific research. The entry of millions of immigrants will not raise costs or diminish the value of these public goods to the general population. Other government services are private goods; use of these by one person precludes or limits use by another. Government private goods include direct personal benefits such as welfare, Social Security benefits, Medicare, and education. Other government private goods are “congestible” goods.[45] These are services that must be expanded in proportion to the population. Government congestible goods include police and fire protection, roads and sewers, parks, libraries, and courts. If these services do not expand as the population expands, there will be a decrease in the quality of service. An individual makes a positive fiscal contribution when his total taxes paid exceed the direct benefits and congestible goods received by himself and his family.[46] The Cost of Amnesty Federal and state governments currently spend over $500 billion per year on means-tested welfare benefits.[57] Illegal aliens are ineligible for most federal welfare benefits but can receive some assistance through programs such as Medicaid, In addition, native-born children of illegal immigrant parents are citizens and are eligible for all relevant federal welfare benefits. Granting amnesty to illegal aliens would have two opposing fiscal effects. On the one hand, it may raise wages and taxes paid by broadening the labor market individuals compete in; it would also increase tax compliance and tax receipts as more work would be performed “on the books,”[58] On the other hand, amnesty would greatly increase the receipt of welfare, government benefits, and social services. Because illegal immigrant households tend to be low-skill and low-wage, the cost to government could be considerable. The Center for Immigration Studies (CIS) has performed a thorough study of the federal fiscal impacts of amnesty.[59] This study found that illegal immigrant households have low education levels and low wages and currently pay little in taxes. Illegal immigrant households also receive lower levels of federal government benefits. Nonetheless, the study also found that, on average, illegal immigrant families received more in federal benefits than they paid in taxes.[60] Granting amnesty would render illegal immigrants eligible for federal benefit programs. The CIS study estimated the additional taxes that would be paid and the additional government costs that would occur as a result of amnesty. It assumed that welfare utilization and tax payment among current illegal immigrants would rise to equal the levels among legally-admitted immigrants of similar national, educational, and demographic backgrounds. If all illegal immigrants were granted amnesty, federal tax payments would increase by some $3,000 per household, but federal benefits and social services would increase by $8,000 per household. Total federal welfare benefits would reach around $9,500 per household, or $35 billion per year total. The study estimates that the net cost to the federal government of granting amnesty to some 3.8 million illegal alien households would be around $5,000 per household, for a total federal fiscal cost of $19 billion per year.[61] Granting Amnesty is Likely to Further Increase Illegal Immigration The Immigration Reform and Control Act (IRCA) of 1986 granted amnesty to 2.7 million illegal aliens. The primary purpose of the act was to decrease the number of illegal immigrants by limiting their inflow and by legalizing the status of illegal immigrants already here.[63] In fact, the act did nothing to stem the tide of illegal entry. The number of illegal aliens entering the country increased five fold from around 140,000 per year in the 1980s to 700,000 per year today. Illegal entries increased dramatically shortly after IRCA went into effect. It seems plausible that the prospect of future amnesty and citizenship served as a magnet to draw even more illegal immigrants into the country. After all, if the nation granted amnesty once why wouldn’t it do so again? The Hagel/Martinez legislation would repeat IRCA on a much larger scale. This time, nine to ten million illegal immigrants would be granted amnesty. As with IRCA, the bill promises to reduce future illegal entry but contains little policy that would actually accomplish this. The granting of amnesty to 10 million illegal immigrants is likely to serve as a magnet pulling even greater numbers of aliens into the country in the future. If enacted, the legislation would spur further increases in the future flow of low-skill migrants.
