U.S.’s Toughest Immigration Law Is Signed in Arizona

PHOENIX — Gov. Jan Brewer of Arizona signed the toughest illegal immigration law in the country on Friday, aimed at identifying, prosecuting and deporting illegal immigrants. The governor’s move unleashed immediate protests and reignited the divisive battle over immigration reform nationally.

Even before Governor Brewer signed the law at a 4:30 p.m. news conference here, President Obama strongly criticized it.

Speaking at a naturalization ceremony for 24 active-duty service members in the Rose Garden, Mr. Obama called for a federal overhaul of immigration laws — an overhaul that Congressional leaders signaled they were preparing to take up soon.

He said the failure of officials in Washington to act on immigration would open the door to “irresponsibility by others.” He said the Arizona bill threatened “to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and our communities that is so crucial to keeping us safe.”

The law, which opponents and critics alike said was the broadest and strictest immigration measure in the country in generations, would make the failure to carry immigration documents a crime. It would also give the police broad power to detain anyone suspected of being in the country illegally. Opponents have decried it as an open invitation for harassment and discrimination against Hispanics regardless of their citizenship status.

The political debate leading up to Governor Brewer’s decision, and Mr. Obama’s criticism of the law — presidents very rarely weigh in on state legislation — underscored the power of the immigration debate in states along the Mexican border. It presaged the polarizing arguments that await the president and Congress as they take up the issue nationally.

Governor Brewer said the law “represents another tool for our state to use as we work to solve a crisis we did not create and the federal government has refused to fix.”

The law would take effect in August. Court challenges are expected immediately.

Hispanics, not long ago courted by the Republican Party as a swing voting bloc, in particular railed against the law as a recipe for racial and ethnic profiling that would recharge voter registration drives.

The Catholic archbishop of Los Angeles called the authorities’ ability to demand documents Nazism. While police demands of documents are common on subways, highways and in public places in some countries, including France, Arizona is the first state to demand that immigrants meet federal requirements to carry identity documents legitimizing their presence on American soil.

Governor Brewer acknowledged critics’ concerns but sided with arguments from the law’s sponsors that it provides an indepensible tool for the local police in a border state that is a leading magnet of illegal immigration.

President George W. Bush had attempted comprehensive reform but failed when his own party split over the issue. Once again, Republicans facing primary challenges from the right, including Governor Brewer and Sen. John McCain of Arizona, have come under tremendous pressure to support the Arizona law, known as SB 1070. Mr. McCain, locked in a competitive primary with a challenger campaigning on immigration, only came out in support of the law hours before the state senate passed it Monday afternoon. Governor Brewer, even after the senate had passed the bill, had been silent on whether she would sign it. Though she was widely expected to, given her primary challenge, she refused to give her position on it even at a dinner on Thursday for a Hispanic social service organization, Chicanos Por La Causa, where several audience members called out “Veto!”

Among other things, the Arizona measure is an extraordinary rebuke to Janet Napolitano, who had vetoed similar legislation repeatedly as a Democratic governor before she was appointed homeland security secretary by Mr. Obama. Her successor, Governor Brewer, is a Republican.

The law opened a deep fissure in Arizona, with a majority of the thousands of callers to the governor’s office urging her to reject the law.

In the days leading up to Governor Brewer’s decision, Representative Raúl M. Grijalva, a Democrat, called for a convention boycott of his state.

SB 1070, sponsored by state senator Russell Pearce, a firebrand on immigration issues, has several provisions.

It requires the police “when practicable” to detain people they reasonably suspect are in the country without authorization and verify their status with federal officials, unless doing so would hinder an investigation or emergency medical treatment.

It also makes it a state crime, a misdemeanor, to fail to carry immigration papers. To thwart the common practice of hiring day laborers at street corners and roadsides, it makes it a crime to do so if it interferes with traffic. It also allows people to sue local governments or agencies if they are failing to enforce federal or state immigration law.

States across the country have proposed or enacted hundreds of bills addressing immigration since 2007, the last time a federal effort to reform immigration law collapsed. Last year, there were a record number of laws enacted (222) and resolutions (131) in 48 states, according to the National Conference of State Legislatures.

The prospect of plunging into a national immigration debate this year is being increasingly talked about on Capitol Hill, spurred in part by recent statements by Senator Harry Reid of Nevada, the majority leader, that he intends to bring legislation to the floor of the Senate sometime after Memorial Day.

Senator Charles E. Schumer, Democrat of New York, has been meeting with lawmakers and interest groups to try to draft a measure in concert with Senator Lindsey Graham, Republican of South Carolina.

But the outlook is mixed. While an immigration debate could help energize Hispanic voters and provide political benefits to embattled Democrats who are seeking re-election in November — like Mr. Reid — it could also energize conservative voters. The issue makes many House and Senate Democrats nervous.

It could also take time and attention from other Democratic priorities, including an energy measure that Nancy Pelosi, the Speaker of the House, has described as her flagship issue.

Mr. Reid declined on Thursday to say that immigration would take precedence over an energy measure, which he has pledged to finish this year. But he called immigration an imperative that needed attention: “The system is broken,” he said.

He noted that in addition to energy and immigration, the Senate would also be dealing with confirmation proceedings this summer for a Supreme Court nominee.

Ms. Pelosi and Representative Steny H. Hoyer of Maryland, the majority leader, have said in recent days that the House would be willing to take up immigration policy only if the Senate produces a bill first; otherwise they are not inclined to move ahead.

“If the Senate is ready with an immigration bill, we don’t want anybody holding it up for any reason, and we’d be pleased to welcome it to the House,” Ms. Pelosi said on Thursday. “Send it to us.”

PHOENIX — President Barack Obama called an Arizona immigration bill "misguided" Friday and said it could violate people's civil rights, intensifying pressure on the state's Republican governor to veto the nation's toughest legislation against illegal immigration.
Obama said he's instructed the Justice Department to examine the Arizona bill to see if it's legal, and said the federal government must enact immigration reform at the national level – or leave the door open to "irresponsibility by others."
"That includes, for example, the recent efforts in Arizona, which threaten to undermine basic notions of fairness that we cherish as Americans, as well as the trust between police and their communities that is so crucial to keeping us safe," Obama said.
Arizona Gov. Jan Brewer, who faces a tough re-election battle and growing anger in the state over illegal immigrants, is nearing a deadline to act on the sweeping measure, which would make it a crime under state law to be in the country illegally. It would also require local police officers to question people about their immigration status if there is reason to suspect they are illegally.
Brewer has until Saturday to decide whether to sign the measure, veto it or allow it to become law without her signature. She's under intense pressure from anti-immigration groups and lawmakers in her own party to sign the bill, but has given no indication what she will do.
Civil rights activists have said the bill would lead to racial profiling and deter Hispanics from reporting crimes. Hundreds of Hispanics protested the legislation at the State Capitol complex on Thursday.
The bill's sponsor, Republican Sen. Russell Pearce of Mesa, said it would remove "political handcuffs" from police and help drive illegal immigrants from the state.
"Illegal is illegal," said Pearce, a driving force on the issue in Arizona. "We'll have less crime. We'll have lower taxes. We'll have safer neighborhoods. We'll have shorter lines in the emergency rooms. We'll have smaller classrooms."
Arizona has an estimated 460,000 illegal immigrants and is the state with the most illegal border crossings, with the harsh, remote desert serving as the gateway for thousands of Mexicans and Central Americans.

Other provisions of the bill allow lawsuits against government agencies that hinder enforcement of immigration laws, and make it illegal to hire illegal immigrants for day labor or knowingly transport them.
The bill would take effect 90 days after the current legislative session ends if it becomes law.
Brewer faces a contested Aug. 24 Republican primary election, and one of her opponents, State Treasurer Dean Martin, has called on her to sign the legislation.
Also, the March 27 shooting death of rancher Bob Krentz on his property in southeastern Arizona has brought illegal immigration and border security into greater focus in the state. Authorities believe Krentz was killed by an illegal border crosser.
Since the shooting, Brewer and other officeholders and candidates have toured the state's border with Mexico. On Thursday, she ordered a reallocation of state National Guard and law enforcement resources and called on the federal government to deploy National Guard troops.
Arizona has previously passed a variety of get-tough measures dealing with illegal immigration.
Brewer's predecessor, Janet Napolitano, a Democrat who is now President Barack Obama's Homeland Security secretary, vetoed proposals similar to the bill just approved by the Legislature.
But she signed a 2007 law that imposes sanctions against employers who knowingly hire illegal immigrants. Other state laws make human smuggling a state crime and restrict illegal immigrants' eligibility for public services.
The Mexican-American Legal Defense and Education Fund said the bill before Brewer is unconstitutional because regulation of immigration is a federal responsibility.
Others urging Brewer to veto the bill include Catholic bishops, New Mexico Gov. Bill Richardson, a Democrat, and Arizona Attorney General Terry Goddard, the Democratic Party's presumptive nominee for governor. Mexico's embassy also has voiced concerns about racial profiling.
A Phoenix Law Enforcement Association representative acknowledged that racial profiling can occur but said fears associated with the bill are unfounded.
"We're not targeting any particular group," said Levi Bolton, a retired police detective. "Cops are not here to do these things to you."

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Arizona Bill Cracks Down on Illegal Immigration
Frustrated with the federal government’s failure to secure the border and combat illegal immigration, Arizona lawmakers passed one of the toughest immigration enforcement laws in the nation last week. Entitled the “Support Our Law Enforcement and Safe Neighborhoods Act,” SB 1070 passed the Arizona House on a 35-21 party-line vote last Tuesday after clearing the Senate in February. (FOX News, April 14, 2010). Governor Jan Brewer, who has argued for stringent immigration laws, is expected to sign the bill into law. (The Wall Street Journal, April 14, 2010).
SB 1070 gives Arizona law enforcement important tools to help fight illegal immigration. During lawful contact between an officer and an individual, the bill directs state and local officers to inquire into the immigration status of anyone who they reasonably suspect is in the country illegally. Under current law, officers can only inquire about someone’s immigration status if the person is suspected of another crime. (Los Angeles Times, April 13, 2010). Additionally, foreign nationals who fail to comply with federal laws that require them to carry proof of legal residency will be guilty of a state misdemeanor. (The Wall Street Journal, April 14, 2010). Arizona is the first state to make it a crime not to carry such documents. The bill also:
• Allows law enforcement officers to arrest aliens unable to provide documents showing they’re legally in the U.S.
• Prohibits local police agencies from adopting “sanctuary” policies that prevent law enforcement officers from checking the immigration status of people they stop or arrest.
• Makes it unlawful for a day laborer to solicit work in a public place.
• Prohibits would-be employers from blocking traffic when hiring laborers.
• Allows citizens to sue police agencies who do not comply with the law and government agencies that adopt policies that hinder the enforcement of immigration laws.
• Make it illegal for people to transport illegal aliens if the driver knows or recklessly disregards that the passengers are here illegally.
Amnesty forces are enraged by the new law, which they claim is fueled by “anti-immigrant hysteria.” (AZFamily News, April 13, 2010). Some went even further in their criticism, relying on hollow cries of racism to attack the enforcement measure. Chris Newman, legal director of the National Day Laborer Organizing Network, said, “Arizona has long been a laboratory for anti-immigrant experimentation, and its demagogue leaders have become folk heroes for white supremacists throughout the United States.” (The Associated Press, April 14, 2010).
However, Arizona State Senator Russell Pearce (R-Mesa), the bill’s sponsor, counters that law-abiding immigrants are not his target, “It’s the drug cartels, gang members.” Id. Arizona is directly in the crossfire of the violent drug wars waging in Mexico and the state is the most popular point of entry for illegal aliens who come into the United States. (Los Angeles Times, April 13, 2010). Rep. John Kavanagh (R-Fountain Hills), a co-sponsor of the bill, stated, “Illegal immigration brings crime, kidnapping, drugs – drains our government services. Nobody can stand on the sidelines and not take part in this battle.” Id. Kavanagh said the legislation “gives our local police officers the tools they need to combat illegal immigration, while protecting the civil rights of citizens and legal residents.” (The Wall Street Journal, April 14, 2010). The legislation is especially timely in light of the escalating violence along Arizona’s border with Mexico and the recent gunning down of a rancher and his dog by a suspected illegal alien. (See FAIR’s Legislative Update, April 12, 2010; Legislative Update, April 5, 2010).
Perhaps the most outrageous claim amnesty advocates have made about SB 1070 is that it “mandates racial profiling of Latinos.” (Los Angeles Times, April 13, 2010). Pearce, a former cop known as a true immigration reformer, has heard this accusation before, and explains that the bill explicitly states officers “may not solely consider race, color or national origin” in forming a reasonable suspicion. (Arizona SB 1070). “You have to have lawful contact, reason to believe, and then can only arrest based on probable cause,” says Pearce. (AZFamily News, April 13, 2010). The bill simply “takes the handcuffs off of law enforcement and lets them do their job.” (Los Angeles Times, April 13, 2010). Police agencies are split over the bill; the Arizona Association of Chiefs of Police – made up of police chiefs who are politically appointed – is against it, while police unions support it. (KPHO Phoenix, April 15, 2010). Maricopa County Sheriff Joe Arpaio, known for his aggressive enforcement of immigration laws, supports it, “Anybody we come across that is here illegally, pursuant to this new law especially, they’re going to jail.” Id.
The American Civil Liberties Union (ACLU) and other groups have already pledged to sue to block the bill from taking effect if Governor Brewer signs it into law. (Los Angeles Times, April 13, 2010). According to these special interest groups, only the federal government has the authority to enforce immigration laws. Id. But these arguments ignore the fact that other state laws (with which FAIR and its legal affiliate IRLI have assisted), including Arizona’s 2008 law mandating the use of E-Verify, have withstood legal scrutiny. Through the enactment of this legislation, Arizona lawmakers are sending a clear message that they will not wait any longer for the federal government to take action. Speaker of the Arizona House Kirk Adams observed, “This is not a comprehensive solution. That’s not going to occur until the federal government takes up its responsibility to protect Arizona. But that doesn’t mean we should wait until then.” (The New York Times, April 14, 2010).

Studies reveal Americans’ declining living standards and increasing anger

A series of recent studies conducted by the Pew Research Center shed new light on the scope of the economic crisis in the US and the level of hostility the majority of the American population holds for the US government.
Released in March, before the passage of the Obama administration’s health care legislation, a survey entitled “Health Care Reform—Can’t Live With It, or Without It” indicates that 92 percent of Americans give the national economy a negative rating. No fewer than 70 percent of the respondents report having suffered job-related and financial problems in the past year, an increase from 59 percent the year before. Fifty-four percent report someone in their home has been without a job and looking for work in the past year, up from 39 percent in 2009.
The poll saw an aggravation of conditions in every area of economic life studied the year before. Increasing numbers of people are reporting difficulty receiving or affording medical care (26 percent) or paying their rent or mortgage payments (24 percent). More Americans faced problems with collections and credit agencies (21 percent), or had mortgages, loans or credit card applications denied (19 percent).
As could be expected, the poorest Americans are suffering the most. Some 44 percent of those making $30,000 per year or less report difficulty obtaining medical care, compared to 11 percent of those making $75,000 per year or more. A similar gap can be found in the category of rents and mortgages, with 37 percent of those making $30,000 or less reporting difficulty making rent or mortgage payments, compared to 11 percent of those making $75,000 or more. However, the percentage of those facing difficulties paying rent has increased dramatically for both groups since 2009.
Large numbers of workers polled in the study say they have little confidence in job security and prospects for the future, with almost half (49 percent) saying it is “very or somewhat likely” they will suffer “job-related financial stress” in the next year. Twenty-five percent of workers say they expect to be forced to take a pay cut this year, while 24 percent expect to be laid off.
The Pew survey found that 85 percent of Americans reported difficulty finding jobs in their communities. This and other statistics revealing the increasingly dismal employment opportunities facing millions of Americans are provided context in another study released this month by the Pew Economic Policy Group.
“A Year or More: The High Cost of Long-Term Unemployment” reports that no fewer than 44 percent of unemployed Americans met or exceeded the standard measure of long-term unemployment (six months or more) in March 2010. This marks the highest rate for long-term unemployment levels since World War II.
In addition to this, the Pew study reports that “23 percent of the nearly 15 million Americans who are unemployed have been jobless for a year or more.” This translates to 3.4 million people, “roughly equivalent,” the study points out, “to the population of the state of Connecticut.”
These alarming numbers should be considered along with findings in another recent Pew research study entitled “The People and Their Government,” released April 18. This report finds that “by almost every conceivable measure Americans are less positive and more critical of government these days.”
ONLY 22 PERCENT OF AMERICAN SAYS THEIR GOVERNMENT CAN BE TRUSTED! HOW MANY WALL STREET BANKSTERS THINK THEIR GOVERNMENT CAN BE TRUSTED TO HAND OVER THE REST OF THE ECONOMY? NO STRINGS BAILOUTS? NO (REAL) REGULATION? NO PROSECUTION FOR THE STAGGERING DEVASTATION THEY ORCHESTRATED WITH THIS WHITE HOUSE, AND THE LAST TWO ON THE PEOPLE?

Only 22 percent of Americans say their government can be trusted, according to the new survey. The report puts this among the lowest measures of trust in the government in half a century.

TO KEEP WALL STREET HAPPY AND GENEROUS, OBAMA HAS TURNED THE SO CALLED DEPT. HOMELAND SECURITY INTO THE “HOMELAND SECURITY = PATHWAY TO CITIZENSHIP” DEPT. TO ASSURE FLOODS OF ILLEGALS FROM MEXICO THAT THE AMERICAN MIDDLE CLASS WILL CONTINUE TO HAND OVER THEIR JOBS, WELFARE, SECURITY FROM GANGS FOR OBAMA’S “UNREGISTERED VOTERS”.
The study also shows across-the-board declines in approval ratings for numerous federal agencies, including the Department of Education, the Food and Drug Administration, the Social Security Administration, the Environmental Protection Agency, and the Centers for Disease Control and Prevention. Forty-three percent say the government has a negative effect on their daily life, up from 31 percent in 1997.
While approval ratings for the government are remarkably low, with 65 percent saying the federal government and congress have a negative impact “on the way things are going in the country,” the approval ratings for other major institutions are as low or lower. Sixty-nine percent of those surveyed say banks and other financial institutions have a negative impact on the way things are going in the country, while 64 percent say “large corporations” have a negative impact. Some 57 percent say the national news media has a negative impact, while 49 percent say labor unions have such an impact.

The report states that “more than six-in-ten (62%) say it is a major problem that government policies unfairly benefit some groups while nearly as many (56%) say that government does not do enough to help average Americans.”

Taken as a whole, the Pew studies from March and April offer additional insight into the growing social misery under conditions of the worst economic crisis since the Great Depression, and the outrage it is generating.
Wide layers of the population, who have seen trillions of dollars funneled from the public treasury into the coffers of Wall Street executives while their own living standards have been assaulted, their jobs slashed, their children’s schools closed, and vital social programs such as Medicare cut by billions of dollars, have no faith in the US government to secure their most basic social needs.
The corporate-controlled news media, along with the major institutions overseeing the nation’s educational needs and basic food and medical resources, are considered corrupt and untrustworthy, contributing to the suffering of millions.
President Barack Obama, continuing to pose as a populist man of the people when he finds it necessary or beneficial, stands exposed as the chief representative of the interests of the American ruling elite and the standard bearer in the assault on the working class.
The restructuring of society taking place, in the direct interests of the corporate-financial elite and at the expense of the working population, is not occurring unnoticed. The American and international working class will inevitably find itself drawn into struggle against the present, untenable form of social organization.
