NAPOLITANO PRONOUNCES U.S. BORDER “MORE” SECURE NOW….

WASHINGTON (AP) — The Obama administration has met many of the border security benchmarks Congress set in 2007 as a prerequisite to immigration reform and now it's time to change the law, Homeland Security Secretary Janet Napolitano said Friday.
Napolitano, designated by President Barack Obama to lead the administration's immigration reform efforts, said many members of Congress had said they could support immigration reform, but only after border security improved, Napolitano said.
"Fast forward to today, and many of the benchmarks these members of Congress set in 2007 have been met," she said in a speech to the Center for American Progress, a liberal think tank.
She cited construction of 600 miles of border fence and the hiring of more than 20,000 Border Patrol agents. Illegal immigration has also fallen sharply because of better enforcement and the economy.

"I've been dealing hands-on with immigration issues since 1993, so trust me: I know a major shift when I see one, and what I have seen makes reform far more attainable this time around," Napolitano said.

Napolitano said the immigration and border security improvements are not enough. "The laws themselves need to be reformed," she said.

Obama has repeatedly said immigration reform is a priority, although it has been pushed further down the list as he has taken on the economy and health care reform.

Friends of Arizona Businesses with Illegal Workers Take E-Verify Law to Supreme Court (see the list)

In a last ditch effort to undermine Arizona’s mandatory E-Verify law for employers, the U.S. Chamber of Commerce and a coalition of business and open-border groups have asked the U.S. Supreme Court to determine whether Arizona’s law is preempted by federal law. The case (Chamber of Commerce of the U.S. of Am. v. Candelaria, U.S.) is an appeal of a Ninth Circuit Court of Appeals decision that upheld Arizona’s law. The Supreme Court this week asked the U.S. Solicitor General for an opinion on the preemption question.

Take a look at the list of petitioners to overturn the E-Verify law. Many of them are organizations that represent businesses known to make use of illegal-alien labor as well as others that advocate on behalf of illegal aliens.

Petitioners in their brief to the Court argue that the case involves "a question of exceptional national importance: whether state legislatures and municipal governments may override Congress's judgment concerning United States immigration policy." They say that the Supreme Court must take up the case now because the "crazy-quilt of state and local immigration statutes will continue to expand, multiplying burdens on employers and unfairness to employees" and result in a "flood of lawsuits, years of litigation, and an unnecessary waste of judicial, legislative, and executive resources."

The petitioners also argue the case should be heard because lower court decisions on the preemption issue have been inconsistent. The Ninth Circuit held that Arizona’s statute was not preempted by federal immigration law, and a similar decision was reached in by the Eighth Circuit Court of Appeals concerning a Valley Park, Missouri ordinance. However, a District Court in Pennsylvania held that Hazleton, Pennsylvania ordinance was preempted and an Oklahoma district court granted a preliminary injunction against a state law.

Defending its law, Arizona filed a brief with the Court arguing that the decisions were not inconsistent because the lower courts correctly addressed the narrow issues presented in the cases before them. The State also argued that Arizona law does not impose new obligations on employers beyond those already existing in federal law; it "merely establishes state sanctions for that illegal conduct, as Congress specifically permits states to do."

It will be interesting to see how the Obama Administration, as represented by the Solicitor General, weighs in. The Administration has often stated its interest in amnesty for illegal aliens, and said that enforcement is necessary so that the problem does not return. A number of states have stepped up to the plate to help enforce immigration laws. Will the Administration support their efforts or give in to latest ploy by business and other open-border groups to undermine them? Time will tell, but this case is one to watch because a lot of strong state and local enforcement laws could be affirmed or undercut

White House to Begin Push on Immigration Overhaul in 2010

The Obama administration will insist on measures to give legal status to an estimated 12 million illegal immigrants as it pushes early next year for legislation to overhaul the immigration system, Homeland Security Secretary Janet Napolitano said on Friday.
In an address at the Center for American Progress, a liberal policy group in Washington, Ms. Napolitano sought to dispel any notion that the administration — with health care, energy and other major issues crowding its agenda — might postpone the most contentious piece of an immigration overhaul until after midterm elections next November.
Laying out the administration’s bottom line, she said it will argue for a “three-legged stool” that includes enacting tougher enforcement laws against illegal immigrants and the people who hire them, and streamlining the system for legal immigration, but also what she called a “tough and fair pathway to earned legal status.”
With unemployment surging over 10 percent and Congress wrestling with health care, advocates on all sides of the immigration debate had started to doubt that President Obama would keep to his pledge to take on the divisive issue of illegal immigration in the first months of 2010.
Congress should be ready to move forward on immigration, Ms. Napolitano said, because the administration had made a “fundamental change” in security at the border and in cracking down on employers hiring illegal immigrants. She said that the Border Patrol had increased its forces by more than 20,000 officers, and that more than 600 miles of border fence had been completed, both milestones set by Congress.
“Let me emphasize this,” she said. “We will never have fully effective law enforcement or national security as long as so many millions remain in the shadows.”
Under the administration’s plan, illegal immigrants would have to register, pay fines and all taxes they owe, pass a criminal background check and learn English.

Senate Immigration Bill Would Allow 100 Million New Legal Immigrants over the Next Twenty Years

If enacted, the Comprehensive Immigration Reform Act (CIRA, S.2611) would be the most dramatic change in immigration law in 80 years, allowing an estimated 103 million persons to legally immigrate to the U.S. over the next 20 years—fully one-third of the current population of the United States.

Much attention has been given to the fact that the bill grants amnesty to some 10 million illegal immigrants. Little or no attention has been given to the fact that the bill would quintuple the rate of legal immigration into the United States, raising, over time, the inflow of legal immigrants from around one million per year to over five million per year. The impact of this increase in legal immigration dwarfs the magnitude of the amnesty provisions.

In contrast to the 103 million immigrants permitted under CIRA, current law allows 19 million legal immigrants over the next twenty years. Relative to current law, then, CIRA would add an extra 84 million legal immigrants to the nation’s population.

The figure of 103 million legal immigrants is a reasonable estimate of the actual immigration inflow under the bill and not the maximum number that would be legally permitted to enter. The maximum number that could legally enter would be almost 200 million over twenty years—over 180 million more legal immigrants than current law permits.

Immigration Status
To understand the provisions of CIRA, largely based on a compromise by Senators Chuck Hagel (R–Nebraska) and Mel Martinez (R–Florida), it is useful to distinguish between the three legal statuses that a legal immigrant might hold:

1. Temporary Status: Persons in this category enter the U.S. temporarily and are required to leave after a period of time.

2. Near-Permanent, Convertible Status: Persons in this category enter the U.S. and are given the opportunity to “adjust” or convert to legal permanent residence after a few years.

3. Legal Permanent Residence (LPR): Persons in this category have the right to remain in the United States for their entire lives. After five years, they have the right to naturalize and become citizens. As naturalized citizens, they have the constitutional rights to vote and to receive any government benefits given to native-born citizens.
A key feature of CIRA is that most immigrants identified as “temporary” are, in fact, given convertible status with a virtually unrestricted opportunity to become legal permanent residents and then citizens.

Another important feature of both CIRA and existing immigration law is that immigrants in convertible or LPR status have the right to bring spouses and minor children into the country. Spouses and dependent children will be granted permanent residence along with the primary immigrant and may also become citizens. In addition, after naturalizing, an immigrant has the right to bring his parents into the U.S. as permanent residents with the opportunity for citizenship. There are no numeric limits on the number of spouses, dependent children, and parents of naturalized citizens that may be brought into the country. Additionally, the siblings and adult children (along with their families) of naturalized citizens and the adult children (and their families) of legal permanent residents are given preference in future admission but are subject to numeric caps.

Key Provisions of CIRA
Four key provisions of CIRA would result in an explosive increase in legal immigration.

Amnesty for Current Illegal Immigrants: CIRA offers amnesty and citizenship to 85 percent of the nation’s current 11.9 million illegal immigrants. Under the plan, illegal immigrants who have been in the U.S. for five years or more (60 percent of illegals) would be granted immediate amnesty. Illegal immigrants who have been in the country between two and five years (25 percent of illegals) could travel to one of 16 “ports of entry,” where they would receive amnesty and lawful work permits.[1] In total, the bill would grant amnesty to 85 percent of the current illegal immigrant population, or some 10 million individuals.

After receiving amnesty, illegal immigrants would spend six years in a provisional status before attaining LPR status. After five years in LPR status, they would have the opportunity to become naturalized citizens and vote in U.S. elections. As well, the spouses and dependent children of current illegal immigrants would have the right to enter the U.S. and become citizens.[2] There would be no numeric limit on the number of illegal immigrants, spouses, and dependents receiving LPR status; under the amnesty provision, such individuals would not be counted against any other cap or limit in immigration law.[3]

The New “Temporary Guest Worker” Program: CIRA creates an entirely new “temporary guest worker” (H-2C) program. There is nothing temporary about this program; nearly all “guest workers” would have the right to become permanent residents and then citizens.

Foreign workers could enter the U.S. as guest workers if they have a job offer from a U.S. employer. In practical terms, U.S. companies would recruit foreign workers to enter the guest worker program and immigrate to the U.S. Most likely, intermediate employment firms would specialize in recruiting foreign labor for U.S. employers.

Guest workers would be allowed to remain in the U.S. for six years.[4] However, in the fourth year, the guest worker could ask for LPR status and would receive it if he has learned English or is enrolled in an English class.[5] There are no numeric limits on the number of guest workers who could receive LPR status. Upon receiving LPR status, the guest worker could remain in the country permanently. He could become a U.S. citizen and vote in U.S. elections after just five more years.

The spouses and minor children of guest workers would also be permitted to immigrate to the U.S.[6] When guest workers petition for LPR status, their spouses and children would receive it as well. Five years after obtaining LPR status, these spouses could become naturalized citizens. The bill sets no limit on the number of spouses and children who could immigrate under the guest worker program. After workers and their spouses have obtained citizenship, they would be able to bring in their parents as legal permanent residents.

The bill does provide numeric limits on the number of guest workers who can enter the country each year, but the number starts high and then grows exponentially. In the first year, 325,000 H-2C visas would be given out, but if employer demand for guest workers is high, that number could be boosted by an extra 65,000 in the next year. If employer demand for H-2C workers continues to be high, the number of H-2C visas could be raised by up to 20 percent in each subsequent year.

The 20 percent exponential escalator provision allows the number of H-2C immigrants to climb steeply in future years. If the H-2C cap were increased by 20 percent each year, within twenty years the annual inflow of workers would reach 12 million. At this 20 percent growth rate, a total of 70 million guest workers would enter the U.S. over the next two decades and none would be required to leave. While it is unlikely that so many workers would enter, the program does have the potential to bring ten of millions of immigrants to the U.S.

The “guest worker” program, then, is an open door program, based on the demands of U.S. business, that would allow an almost unlimited number of workers and dependents to enter the U.S. from anywhere in world and become citizens. It is essentially an “open border” provision.

Additional Permanent Visas for Siblings, Adult Children, and their Families: The permanent entry of non-immediate relatives—such as brothers, sisters, and adult children—is currently subject to a cap of 480,000 per year minus the number of immediate relatives (the parents, spouses, and minor children of U.S. citizens) admitted in the prior year. CIRA eliminates the deduction for immediate relatives from the cap.[7] This effectively increases the number of non-immediate relatives who could attain LPR status by 254,000 per year.

Additional Permanent Employment Visas: The U.S. currently issues around 140,000 employment-based visas each year. Under CIRA, the U.S. would issue 450,000 employment-based green cards per year between 2007 and 2016.[8] After 2016, the number would fall to 290,000 per year.[9] Under current law, LPR visas going to the spouses and children of workers with employment-based visas are counted against the cap. Under CIRA, these spouses and children would be removed from the cap and given legal permanent residence without numeric limits.[10] Historically, 1.2 dependent relatives have entered the U.S. for each worker under employment-based immigration programs.[11] This means that some 990,000 persons per year would be granted LPR status until 2016 and, after that, 638,000 per year.

Estimating Future Immigration Under CIRA
Most provisions of CIRA are straightforward; in many categories, the number of future immigrants allowed is either directly stated or can be easily calculated from the law’s provisions. In some areas, however, the law’s impact is uncertain. To estimate future legal immigration under the bill, three assumptions have been used in this paper:

• Spouses and children of workers: Dependent spouses and children represent a major component of current immigration. In the current employment-based visa program, 1.2 dependents enter for each incoming worker.[12] This paper assumes this ratio will continue in the employment-based program and will also apply to those entering under the new guest worker program. This is a conservative assumption: guest workers are likely to have lower education levels and thus to have larger families. Finally, many current illegal immigrants who would receive amnesty under the bill already have families in the U.S.; therefore the ratio of incoming spouses and children to amnesty recipients is assumed to be only 0.6, or half the ratio of the employment-based program.

• Parents of naturalized citizens: Parents of naturalized citizens currently make up eight percent of all new legal immigrants. This paper assumes that half of all adult immigrants will naturalize after five years of LPR status and that 30 percent of the parents of these naturalized citizens will immigrate in the three years after their children’s naturalization.

• Growth in the guest worker program: The number of immigrants in the guest worker program will be driven by employer demand. The bill allows the number of H-2C visas to increase by 20 percent per year; this level of growth would result in an extraordinary 60 million guest workers in the U.S. over the next twenty years. This paper assumes that the number of immigrants in the guest worker program would increase at a more moderate rate of 10 percent per year. Alternative estimates for 20 percent growth and zero growth in the program are also presented.[13]
A Flood of Legal Immigrants
Under CIRA, immigrants could enter the country or attain lawful status within the country through eight channels. In each channel, immigrants would be granted permanent residence and the right to become citizens. The first channel represents immigrants who would have entered under current law; the second channel represents illegal immigrants who are currently in the country and would be given legal permanent residence under the bill. The other six channels represent new inflows of legal immigrants that would occur as a result of the bill. The total number of new legal immigrants over a twenty year period would be as follows: (See Charts 1 and 2.)


1. Visas under current law: Roughly 950,000 persons receive permanent residence visas under current law each year. Over 20 years, the inflow of immigrants through this channel would be 19 million. This represents the status quo under existing law.

2. Amnesty: The bill would grant amnesty to roughly 10 million illegal immigrants. These individuals are currently living in the U.S.; amnesty would allow them to remain legally and to become U.S. citizens.

3. Expanded family chain migration: The number of family-sponsored visas for secondary family members, such as adult brothers and sisters, is currently limited to 480,000 per year minus the number of visas given to immediate family members (spouses, minor children, and parents of U.S. citizens). The bill changes the law so that the total quota on secondary family members would be 480,000 without deductions for immediate family members. The net increase in the number of immigrants under this provision would be around 254,000 per year, or 5.1 million over 20 years.[14]

4. Employment-based green cards: The bill would increase the number of employment-based visas from 140,000 to 450,000 per year. For the first time, it would also exempt the spouses and children of workers from the cap. Total annual immigration under this provision is likely to be 450,000 workers plus 540,000 family members annually. The net increase above current law over 20 years would be around 13.5 million persons.[15]

5. The guest worker (H-2C) program: CIRA would allow 325,000 persons to participate in the guest worker program in the first year. This number could rise by 65,000 in the next year and then by 20 percent per year. Assuming 10 percent annual growth in the annual number of guest workers entering the country (well below the bill’s maximum), the total inflow of workers under this program would be 20 million over 20 years.

6. Spouses and children of guest workers: Guest workers could bring their spouses and children to the U.S. as permanent residents; the added number of entrants would be 24 million over 20 years.

7. Spouses and children of illegal immigrants given amnesty: Illegal immigrants who received amnesty could bring their spouses and children into the U.S. as legal permanent residents with the opportunity for full citizenship. The number of spouses and children who would enter the U.S. as a result of amnesty would be at least six million.

8. Parents of naturalized citizens. The bill would substantially increase the number of naturalized citizens. Naturalized citizens would have an unlimited right to bring their parents into the U.S. as legal permanent residents. Over twenty years, the number of parents who would enter the U.S. as permanent legal residents as a result of CIRA would be around five million.
Overall, the bill would allow some 103 million persons to legally immigrate over the next twenty years. This is roughly one-third of the current population of the United States. All of these new entrants would be permanent residents and would have the right to become citizens. This would be a 84 million person net increase over current law.

Legal Flow Compared to Illegal Immigration
All of the immigration discussed to this point would be legal immigration. If illegal immigration continued after enactment of S.2611, the inflow of immigrants would be even greater. Although illegal immigration is considered a major problem, the proposed legal immigration under CIRA would dwarf it numerically. The net inflow of illegal immigrants into the U.S. population is around 700,000 per year.[16] Legal immigration under CIRA would exceed five million per year, seven times the rate of the current illegal immigration flow. Annual legal and illegal immigration together now equals about 1.7 million; future legal immigration alone under CIRA would be three times this amount.

Range of Estimates
The figure of 103 million new legal immigrants is based on the assumption that immigration under the guest worker program would grow at 10 percent per year. If guest-worker immigration grows at the maximum rate permitted by the bill, 20 percent per year, the total number of new immigrants coming to the U.S. over the next twenty years would be 193 million. On the other hand, if immigration under the H-2C program did not increase at all for two decades but remained fixed at the initial level of 325,000 per year, total legal immigration under CIRA would be 72 million over twenty years, or more than three times the level that would occur under current law. (See Chart 3.)

The tables in the Appendix show annual inflows of total legal immigrants in each of the eight channels mentioned above over the next twenty years. The tables show the estimated yearly rate of immigration under three scenarios for the H-2C program: zero growth, ten percent growth, and twenty percent growth.

Dwarfing the Great Migration
Between 1870 and 1920, the U.S. experienced a massive flow of immigration known as the “great migration”. During this period, foreign born persons hovered between 13 and 15 percent of the population.[17]In 1924, Congress passed major legislation greatly reducing future immigration. By 1970, foreign born persons had fallen to 5 percent of the population.

In the last three decades, immigration has increased sharply. The foreign born now comprise around 12 percent of the population, approaching the levels of the early 1900’s. However, if CIRA were enacted, and 100 million new immigrants entered the country over the next twenty years, foreign born persons would rise to over one quarter of the U.S. population.[18] There is no precedent for that level of immigration at any time in U.S. history.

Conclusion
If enacted, CIRA would be the most dramatic change in immigration law in 80 years. In its overall impact on the nation, the bill would rival other historic milestones, such as the creation of Social Security or Medicare.

The bill would give amnesty to 10 million illegal immigrants and quintuple the rate of legal immigration into the U.S. Under the bill, the annual inflow of immigrants with the option of becoming legal permanent residents would rise from the current level of one million per year to more than five million per year. Within a few years, the annual inflow of new immigrants would exceed one percent of the current U.S. population. This would be the highest immigration rate in U.S. history.

Within 20 years, some 103 million new immigrants would enter the U.S. This number is about one-third of the current U.S. population. All of these immigrants would be permanent residents with the right to become citizens and vote in U.S. elections. CIRA would transform the United States socially, economically, and politically. Within two decades, the character of the nation would differ dramatically from what exists today.

Major U.S. County Passes Illegal Alien Sanctuary Law

A major U.S. county that has long offered illegal immigrants sanctuary and taxpayer-financed services formalized its policy this week by passing a law that prohibits public agencies and employees from asking a person’s immigration status.

With a 5-4 vote, lawmakers in Washington’s King County approved the measure to officially make it an illegal immigrant sanctuary. The largely upscale Seattle-area county of about 2 million residents has long offered illegal aliens public services, including medical care at county-run clinics, and the sheriff’s department has a don’t-ask-don’t-tell immigration policy.

But lawmakers wanted bona fide legislation in the county books to prevent future administrations from violating the unwritten sanctuary policy. The councilman (Larry Gossett) who sponsored the sanctuary law said it’s intended to discourage racial profiling and “ratchet down the fear level” when illegal immigrants seek public health services or deal with law enforcement officers.

King County public clinics have offered illegal immigrants free medical care since 1992 and the county’s Public Health Director says “denying access to care because of citizenship status is not good medicine…” A councilwoman (Julia Patterson) who voted for the sanctuary law insists she does not condone illegal immigration but says she supported the measure because she’s in favor of “humane treatment and care” for the people in her community.

Hundreds of municipalities nationwide provide illegal immigrants with sanctuary and dozens have passed legislation to make it official. Among them are practically every city in California, New Haven Connecticut, Denver Colorado, Chicago Illinois, Cambridge Massachusetts, practically the entire state of New Jersey, Washington D.C. and all of Oregon, to name a few.

Another Illegal Immigrant Sues U.S. For Rights Violations

In what appears to be a growing trend among those who live in the U.S. illegally, another undocumented alien has sued an American law enforcement agency for violating her constitutional rights by arresting her.
Roxana Santos, an illegal immigrant from El Salvador, claims in a federal lawsuit that sheriff deputies in Maryland’s Frederick County unlawfully and unconstitutionally detained and interrogated her based solely on her race or ethnicity. By doing so the officers violated the Fourth and 14th Amendments to the U.S. Constitution as well as the Civil Rights Act of 1964, according to the complaint.
Santos was approached by deputies about a year ago as she sat on a curb behind a food co-op during a lunch break. When the officers asked for identification she initially said she had none but subsequently provided a Salvadoran national identification card which is not valid in the U.S. Deputies booked her and she was later transferred to a Maryland immigration detention center.
Santos was granted supervised release for “humanitarian purposes” and lives at an “undisclosed location in the United States” with her family. She seeks at least $1 million in damages and asserts that federal law does not allow state or local police to enforce immigration laws. The complaint also names the Frederick Board of County Commissioners and federal immigration officials as defendants.
Less than a month ago a group of illegal immigrants in Connecticut sued the federal agents that arrested them, claiming their constitutional rights were violated in the raids that led to their apprehension. A judge had previously blocked their deportation, ruling that their constitutional rights were “egregiously violated” because immigration agents entered their apartments without a warrant, probable cause or consent. Now they stand to get money from the government.
Just last week five Muslim illegal immigrants detained in New York after Middle Eastern terrorists attacked the area won $1.26 million from the U.S. government to settle a lawsuit accusing federal authorities of violating their rights. The illegal aliens were among 170 Arab and Muslim men jailed for immigration law violations in New York during post 9/11 roundups and most have been deported.
A few years ago hundreds of illegal immigrants, represented by a nonprofit agency largely funded by American taxpayers, sued the U.S. government following a raid at a Massachusetts factory. The illegal aliens accused the government of acting in bad faith by moving them to Texas and denying them adequate access to lawyers.

Arizona Punishes Zero Illegal Alien Employers

After investing millions of dollars to enforce the nation’s toughest law against businesses that hire illegal immigrants, Arizona has not punished one employer and a chunk the money remains largely unspent by counties throughout the state.
When legislators passed the Legal Arizona Workers Act two years ago with great fanfare, they allocated the sufficient funds (about $5 million) to enforce it. After all, the state is estimated to have nearly half a million undocumented workers and the landmark law allows authorities to severely punish—even revoke the license—of businesses caught hiring illegal aliens.
But two years later no one has been prosecuted and at least $1.44 million sits idle because authorities in nine of the state’s 15 counties say there have been few complaints about employers violating the law. In Maricopa County, Arizona’s largest, none of the 22 businesses that have been caught hiring illegal aliens have been punished, even though more than 300 employees have been arrested for identity theft and using fake identification to work.
Never the less, Maricopa County has spent nearly all of the $2.86 million provided under the sanction law to crack down on other crimes related to illegal immigration, such as identity theft and human smuggling. Some of the money went to the salaries of six sheriff deputies and a sergeant assigned to investigate employer sanction violations.
Some county prosecutors complain that the law is virtually impossible to enforce because it doesn’t give local authorities charged with pursuing violators civil subpoena power to examine personnel records that could prove illegal aliens were knowingly hired. Without it, authorities are forced to rely on the voluntary disclosure of crucial personnel records by the very businesses being investigated. Not surprisingly, all the accused have opted not to cooperate.
As a result dozens of investigations throughout the state have been shut because authorities can’t access crucial data that could prove wrongdoing. In Yavapai County for instance, crippled investigators have been forced to close 20 of their 23 probes into businesses that they say employ illegal immigrants.

Payback For Illegal Immigrant Medical Bills

A Democrat congressman from Ohio has introduced innovative legislation that would require foreign countries to reimburse American taxpayers for the exorbitant medical expenses of illegal immigrants.
Appropriately titled, PAYBACK Act (Preventing All Your Bucks from Aiding non-Citizens is Key), the measure would save the U.S. government billions of dollars annually and ensure that taxpayer dollars are not used to fund health care services for illegal immigrants, according to its author, U.S. Representative Zack Space.
Medical bills for illegal aliens would be passed along to their country of origin, according to the proposed law, which was introduced in the House this month. The government would mostly collect by deducting the cost of illegal immigrants’ healthcare from the foreign aid their home countries would normally get from the U.S.
If the U.S. does not offer foreign assistance the country would get billed for 110% of the medical costs. In the case where illegal immigrants are from nation’s to whom the U.S. owes money, the cost of medically treating their citizens would be reduced from the debt. The money would be applied to strengthening border security. “It is fundamentally unfair and outrageous to foot the bill for immigrants unlawfully in the United States,” said Space, who has represented Ohio’s 18th congressional district since 2007.
U.S. taxpayers spend tens of billions of dollars annually to provide free medical care for illegal immigrants with states that border Mexico taking the biggest hit. The expense has become so unbearable in California—long an illegal alien sanctuary—that several municipalities eliminated the perk this year to save tens of millions of dollars in the midst of the state’s dire financial crisis.
Adding to the problem is the fact that Mexico, the country that provides the largest amount of illegal immigrants in the U.S., has long promoted America’s generous public health centers. It even operates a Spanish-language program (Ventanillas de Salud, Health Windows) in about a dozen U.S. cities that refers its nationals—living in the country illegally—to clinics where they can get free medical care without being turned over to immigration authorities.

WASHINGTON - Some illegal immigrants are being released from prison only to be arrested on new charges despite government efforts to deport them and keep them out of the country.

The findings are part of an audit by Justice Department Inspector General Glenn Fine that suggest authorities are still struggling to deport illegal immigrants who commit crimes, even though most state and local authorities are notifying immigration authorities of the imminent release of prisoners.

Fine's office analyzed the cases of 100 immigrants who had served time in prison and found 73 of them were rearrested after being released.

On average, each immigrant was rearrested six times, ranging from traffic violations to assault.

Fine's office couldn't determine how many illegal immigrants had been rearrested overall because immigration authorities don't keep track.

If the sample was any indication, "The rate at which released criminal aliens are rearrested is extremely high," the report said.

Last year, Homeland Security's inspector general said immigration authorities expected that most of the 300,000 illegal and legal immigrants eligible to be deported would be released.

Federal officials said they would need 34,000 additional beds at a cost of $1.1 billion to detain and remove all of them.

Some Illegal Immigrants have been arrested and Re-Arrested 6 Times - Illegal Immigrants arrested for being in the United States illegally may have been charged up to six more times, for more serious crimes, after they were released by local authorities. Additionally, the number of illegal immigrants deported after being declared a felon is on the rise.

The Justice findings by department Inspector General Glenn A. Fine examined the criminal histories of 100 illegal immigrants arrested and then released by local and state authorities in 2004, the latest complete data available. Of the sample group of 100, according to the audit, 73 immigrants were later arrested a collective 429 times - on charges ranging from traffic tickets to weapons and drug charges.

The data suggest "the rate at which released criminal aliens are re-arrested is extremely high," the audit noted. The report, parts of which were redacted, was required by Congress in 2005 and looked at how local and state authorities that receive Justice Department funding are working with the Homeland Security Department.

For years, the government was forced to release thousands of illegal immigrants who were caught in the United States because of not enough jail space and other resources. But last fall, with immigration as a key election-year priority, Homeland Security declared it would detain 99 percent of non-Mexican illegal immigrants until they could be returned to their home nations. The policy generally does not apply to Mexicans, who are almost immediately returned to Mexico after being stopped by Border Patrol agents.

The Justice audit, however, only looked at immigrants who were arrested and released by local and state authorities before they could be turned over to Homeland Security to be detained or deported. In all, 752 cities, counties and states participating in the program received $287 million in 2005, the audit noted.

Five states - California, New York, Texas, Florida and Arizona - received the bulk of the money, together pulling in more than $184 million.

Assistant Attorney General Regina B. Schofield, who oversees the Office of Justice Programs that controlled the funding, declined comment on the audit, noting that it does not contain any recommendations.

A separate report by the Transactional Records Access Clearinghouse at Syracuse University showed that the number of immigrants who were deported as "aggravated felons" doubled over the last 15 years, from 10,303 in 1992 to an estimated 23,065 in 2006.

But TRAC, which obtained the data from the Justice Department's Executive Office of Immigration Review, noted concerns that some of those immigrants never committed felonies.

Sell crack and lie
When we last looked into San Francisco's infamous "sell crack or die'' case, Rigoberto Valle had been convicted and appeared to have a ticket for deportation without serving any more time behind bars, thanks to a judge who sympathized with the Honduran immigrant's tale of being victimized by human traffickers.
Valle, 23, had indeed spun quite a tale from the stand in September, recounting a harrowing journey by rail from Honduras and by foot across the desert into the United States.
Valle said he had been forced on pain of death to sell crack on the streets of San Francisco to pay off his human-trafficking debt. He was caught after five minutes his first day on the job, he said. The jury didn't buy it and convicted him of felony drug-dealing charges.
Judge Teri Jackson, however, seemed convinced that Valle was indeed a victim of human trafficking, and indicated she would sentence him to time served and probation. At that point, the feds would take over and start deportation proceedings.
However, things have changed a bit since then. It turns out Valle has been arrested numerous times in the United States dating back several years, and had been deported at least five times before being arrested in San Francisco.
He first came to the United States in 2000, when he was 14, but was sent home for being here illegally. Two years later, he was back and was arrested for a string of tresspassing crimes in Denver. He was convicted of a drug offense there in 2004 and was deported.
In 2005, Valle was caught trying to get across the border in Arizona, jailed for two months and deported.
He was caught again in 2006, allegedly trying to deliver heroin in Portland. Even though that case was not resolved, he was deported in 2007.
He was caught again and deported from Arizona in December 2008.
It was only a few months later, in June, that he was caught in San Francisco, dealing crack. He has been jailed ever since.
On Thursday, after citing what she called a "shocking" effort to mislead the court, Jackson told Valle she intends to sentence him to one year in County Jail on top of the five months he has already served, and put him on five years' probation. She said that if he returns to the United States after being deported, he will face five years in state prison.

The Associated Press has just reported that, after the Hispanic Caucus confronted Pres. Obama at the White House this afternoon, the chair of the House Rules Committee indicated she is giving the Caucus what it wants:

Rep. Louise Slaughter (D-N.Y.) indicated that the House will have to vote on a bill that allows illegal aliens to use the new health care "exchange" and that does not require verification to keep illegal aliens out of the other parts of the proposed new federal health care system.

As I reported in my blog earlier today, the Hispanic Caucus sent leaders to the White House to berate Pres. Obama for his insistence that illegal aliens not be included in any of the proposed health care.

The Hispanic Caucus was especially adamant that illegal immigrants be allowed to use their own money to purchase health coverage in a new government-run "exchange."

He listened to us. We listened to him," said Rep. Nydia Velazquez, D-N.Y., head of the Congressional Hispanic Caucus. "We made it very clear that 20 votes in the Hispanic caucus" depend on the language in the House bill.

Currently, there is no prohibition in the House bill against illegal aliens buying insurance in the exchange, but the White House backs such a ban and one exists in the Senate bill.

"I think that he got our message," Velazquez said.

Basically, Obama and Senate leaders are trying to fulfill Pres. Obama's promise to the American people that no illegal aliens will participate in any part of the new plan.

But the Hispanic Caucus is saying it will vote against any bill that does that. At the moment, Speaker Pelosi has no way to get 218 votes to pass the bill without the Hispanic Caucus. But -- as I described in my blog earlier today -- we must ensure that the bill would be killed by a sufficient number of moderate Democrats who will refuse to vote for the bill unless it has the bans on illegal aliens.

The Representatives drawing their line in the White House sand were Rep. Velazquez (D-N.Y.), Rep. Lucille Royal-Allard (D-Calif.), Rep. Charlie Gonzalez (D-Texas) and Rep. Xavier Becerra (D-Calif.)

This AP story that just came out contains this bombshell:

House Rules Committee Chairwoman Louise Slaughter, D-N.Y., said later that she did not believe there would be any change to the House bill on immigration.

There is a huge amount of implication in that sentence.

The bill as it now stands has gigantic loopholes that allow illegal aliens to use all parts of a new federal health care program.

If Chairwoman Slaughter is saying the Hispanic Caucus is getting its way and that no changes on immigration are being made, that means NumbersUSA will call on all Members of the U.S. House to vote NO on the rule on the bill, which would keep it from coming to the floor for a vote.

NumbersUSA deals only with immigration. We do not take any kind of position on the health care bill itself.

But if the bill comes to the floor with all these loopholes for illegal aliens, we most certainly are urging all Members to vote NO on the rule.

It utterly amazes me that these "so called Representatives" think that we (the American people) have no rights and they can dictate to us whatever "they decide" and we simply have to go along with it. They are too involved with themselves, or simply too arrogant or dense to realize that most of us would never ever think of voting for any of them ever again. The illegals are "illegal" - seems pretty simple to me. Many Americans have lost their jobs and yet no one helps them. And now Health Care should be available to illegals - ARE YOU KIDDING! Nancy Pelosi should be the poster child for term limits. They are putting this country at risk. I heard recently that they are waking up a sleeping giant - and they are. The American public have had it with all of them - enough is enough - and yet they still don't get it. I can't wait for the 2010 election - I will absolutely not vote for anyone that is in office and supports Pelosi and "her gang" ever again. This woman is so arrogant that she insults the American public every chance she gets. I recently changed my voter registration from Democrat to Independent. As of now, I doubt that I will ever vote for another Democrat ever again.

To Barbara first....I hope you don't mind if I correct your spelling of our great document which is constitution. I mean no disrespect and thought that correcting you would be better than having others think of you as less than the intelligent perso that you seem to be by the content of your comments.
Second and of most importance is our need to gather as much true info we can on our elected officials. If legal course is the way we need to go then we must look at our D.C. reps as we would if we were taking someone to court. I feel it is only a matter of a short time that an agenda to bring America to it's knees is what is going on in the background by people like George Soros. Money and power go together and the common American has neither.We need to continue the illegal immigration fight with Roy Beck's great website and research as much as possible to help a few trusted representatives to get the info to the proper people for future action from a legal standpoint. I found it ironic that there was talk of closing the borders because of the swinflu but we haven't been able to close the borders all these years to curtail the influx of illegals.

Could someone please tell me what the heck I am missing here!!!! These folks are ILLEGAL!! They have come into our country ILLEGALLY! Why is there any discussion as to whether or not they should have health care benefits? They don't belong here because they are ILLEGAL. How many times does that need to be said before someone smacks their forehead like in a V-8 commercial and says "THEY ARE ILLEGAL ALIENS and they don't get ANY benefits!" These folks should do things the right way. If they want to be Americans and live here, then follow the rules. I for one am sick of supporting folks that don't deserve it. I am struggling and I don't get any help. AND I WAS BORN HERE. As were my parents. It raises my blood pressure more than my football team, the Redskins!!!!

As a Mexican-American, those Hispanic representatives are NOT representing Americans but rather criminals. I pay my taxes, my parents pay taxes. My mother is Mexican-American, my father is an American citizen who followed the rules, filed paperwork and became an American citizen. To allow Illegals to have access is to spit in the faces of ALL immigrants who are have the integrity to follow the rules of this country.
I always suspect government officials who side with illegals because it clearly means that they have integrity issues. They probably don't pay their taxes, take illegal contributions, waste tax payer money. This is why they are soooooooo helpful to lawbreakers because they are probably one themselves.

I am an Hispanic, born and raised in NM and worked hard to make a decent living for forty one years. I agree with you that Velasquez, Royal, Becerra do not represent the majority of the legal immigrants and Hispanic population.The threat to The president is nothing short of blackmail. This country has enough law abiding citizens to take care of and cannot afford to feed,school and give health care to 12 million illegal immigrants. Enough is enough. Pelosi, Reid and their cronies need to be ousted out on their *##%#.

In a related bill, the Democrats defeated 60-30 a bill that would only include citizens in the census. Dems won't allow census takers to ask if people are citizens. In districts with huge numbers of illegals, new representatives will be added even thought the people counted are not citizens entitled to representations.

I spent several hours
I spent several hours earlier in the week trying to email 'Blue-Dog Democrats' (most of them won't accept emails from outside their district). For all my work I did little good. Frustrating. I have limited hours and can't use my phone for this.

My suggestion is that (while NumbersUSA speaks to 'illegal alienship'), a FAX be prepared and given to us specifically written to the Blue-Dog Dem's telling them that what is happening is definitely NOT in the interest of the United States. I'm hoping to soon see such a FAX from NumbersUSA reminding them that we are interested in seeing our laws enforced and illegals sent back to where they came from rather than 'assimilation', a 'path to citizenship', etc.

Moderator: We have been posting these faxes for members who live in the districts of Blue Dogs. You won't see the faxes if you do not live in those districts.

I have never seen so many people in America come together to voice their opposition to the direction their elected representatives in Washington have decided to pursue. My email list of friends who are spread around this great country are Democrat, Republican and Independent, and consist of several multi-ethnic backgrounds. My calculation shows that 90 % of my friends reflect an unheard of dissatisfaction level with their elected representatives and the direction in which they are trying to take this country.

I for one am already more deeply involved doing whatever I can to clean house and start anew with our elected representatives. Their arrogant attitude is reprehensible and certainly does not address the concerns that I have expressed to all of them. We’ve received responses agreeing with our concerns but that agreement is lost in the action being pursued.

One thing I am having a hard time accepting is how this country has systematically changed from the fundamentals in which it was founded.
We have evolved, in my lifetime, from a country of: "Over There","Give Em Hell Boys","I'm Proud to be an American","God Bless America" to a country of special interest groups, each having their own agenda. They all have THEIR RIGHTS each group has a shopping list too lengthy to mention. All of THEIR RIGHTS have been backed up by legislation written by these representatives (Lawyers)to make sure they are legally protected.
Our Representatives are elected to be the eyes, ears and voices of WE THE PEOPLE! That means all of "US" and checking your ethnic homeland at Ellis Island, JFK Airport, or any point of entry, and you go through the process of legally becoming becoming one of "US" (United States of America.

Becerra Democrat California all took oaths to uphold the laws of the United States of America and the Constitution, the act they just committed trying to blackmail the President of the United States to include illegal aliens in the healtcare bill should be grounds for impeachment, they have gone against their sworn duty.
It seems like Congress pays no attention to what their people do, breaking the laws of our land, going against their sworn duty to America, this has become a way of life for them, the Constitution and the peoples wishes amount to nothing anymore.
I know that like Gene Green in Texas and Pelosi in California and the above mentioned four would get re-elected no matter what they did, but some Democrats should be worried about 2010 and 2012.

If things here get bad enough, they are just going to crosss back across the border since they have NEVER given up their status as "Mexicans" or "Hondurans" or whatever! The truth is that what we are doing is secretly propping up countries like Mexico whose Governments' don't give a another damn about their citizens, especially the poor! It saves them money to have their poor citizens come here and they not care for them! Mexico's Government even sent out to its' citizens flyers on how to sneak into America and then as soon as you get across the border how to apply for assistance and where was the best places for the biggest payments, etc. Even those who apply for citizenship, many are frauds. In the oath to become a citizen of America you must swear alligence to this country alone and deny any connection to any "foreign powers" and yet many of these "new Americans", including non-hispanics, no longer see any problem with still retaining their connectiuon to their home country. For instance, Mexico has passed a law that "Mexican Citizens" retain their Mexican citizenship even if they emmigate and are living in another country and are citizens of another country. Now, just where do you think Mexico was targeting that bill about? I mean really, just where besides America are Mexicans going???? Yet our State Department never said a word about this in protest or was it a real "news" item for all Americans to hear about. Instead, our State Department has allowed Mexican politicians to come to America and campaign for election and the "Mexican-Americans" to vote in Mexico's elections!!!!! Why haven't you heard about this? Our Commie-Democrat run Government and news organizations don't want Americans to hear about it! How do I know this? I live in San Antonio, Texas and the local news covered the Mexican politicans campaigning here! What was their spin? How wonderful it is that we are all "working together" to ensure everyone gets to vote!!!! Do you know that we have right here in Texas several small towns aong the border with Mexico where the Mexicans have literally swamped the locals in their numbers residing in Texas. So their towns fly the Mexican flag over their town halls and conduct all their business in Spanish, and if you want to have the meeting translated into ENGLISH, you have to pay for the translation, and who knows if it is accurate! What do the State and Federal Officials do about this outrage! Nothing! When you call, because I have and asked, they tell you they aren't interested in this issue or are going to do anything about it, because they have "other business which is more important!" What is more important then defending America from foreign invasion, because that is what it is! Mexico has more than 10% of their Mexican population living in America, and that percentage may have gone up since eevery day we have smugglers bringing pregnant women across the border to have their babies at Anerican hospitals because ethey show up to the hospital's emergency in labor! Then, they have been told how to demand that the baby be given American citizenship because the birth occured on American soil, and then they go home to Mexico and collect welfare benefits and never pay the hospital bills! They had one woman on the local news that had 7 babies that way and she was not in the least shy about how she felt she had no need to pay her bills, and our officials are too chicken with P. C. training to do something that is clearly actions that are fraudulent and cost the U. S. taxpayer! That gives her a small fortune to live on by Mexican standards, at our expense!

So, maybe now you can understand better the illegal alien attitude towards the healthcare bill!

And why do you think the politicians care? There is hugh fraud in their districts where illegal aliens vote intheir districts every election because there is no attempt or law to require anyone to show an ID when they vote!

So I am one pissed off American and can nothing about it. My Congressional District is Charlie Gonzales' District, one of the Hispanic Caucus who went to the White House to demand illegal laien covergaee be retained in the Healthcare Bill! He is "safe" from any backlash because San Antonio is 57% Hispanic.

Just one more step toward the total collapse of our any resemblence to an immigration system. Something like "upon further evaluation,.......", "a good leader knows when he has erred and moves to correct that error" . and "even with the contrversal remarks of Senator Joe Wilson, I can not be deterred from making a correction to my earlier remarks and making a humane decesion" ......

Make up your own. Again, I am absolutely amazed at the Congressional Hispanic Caucus and other open border proponenets. Just six months ago, I would have found these actions totally impossible. I can't even imagine what their next steps that will be that once "totally shock" me. Perhaps a "temporary" suspension of our imigration en forcement laws or inclusion of illegal aliens in our equal opportunity and employment act. This has turned into an ethnic agenda to take over this country and it operation. I just can't imagine this is happening.

I'm tired of handouts and against the entire health care bill as it stands. I wonder though, if Hispanics or anyone else is left out of the plan, what happens when they show up at the hospital sick or ready to deliver. The hospital won't be able to turn them away and they can't pay. What's different from what we already have? More money for the same thing? With all the intelligent people we have can't anyone sit down and write a really good health care bill that isn't 2000 pages and cost us an arm and a leg?

They are still coming so you can see that even with no jobs they still think it is a great opportunity for them and a great loss to Americans! We need to vote all of the representatives that no longer care about their country and it's citizens! That is the only way to save our country from special interest groups who seem to have the ears
of congress. Most of the representatives are lawyers who
don't seem to honor the oath they took. I often wonder what the special interest groups are giving to Washington to get such devotion?

Michael, right you are. Because of our current laws, taxpayers will always be responsible. Our emphasis must be on jobs verification, and then consider making the last employer who hired the illegal responsible for any accessed health care. After all, they have saved a tremendous amount on wages, perhaps there is a responsibility that goes along with it. All this is mute when you can’t reach a congress person by phone.

I'd like to know what the Republican House bill says in regards to illegal's access to healthcare.

The Democrat's is supposed to add $1.2-trillion, but the Republican's is supposed to save 62 billion. If the Republican House bill only insures Americans, that would be the bill to urge Congress to support.

I think that blinders must be the new fashion statement in WA DC.
No one seems to see all of the Americans against this issue. What more can we do to get our voices heard and our protests acknowledged?

Joe Wilson should be receiving praises from the Republican Party. He hit the nail right on the head when he called our community organizer a liar. The Republican party needs to grow a back bone and stand up to the socialist/marxist party the Democrates have become. They are taking away our Freedoms, bank rupting the country and bowing down to the worlds dictators at an amazing rate.

They're illegal. This is our country and I want it back. My husband and I need healthcare and my husband needs a job. Let's take care of America FIRST before any of the other countries.
