Interior Enforcement Disintegrates Further in 2015
Year-end deportation statistics show continuing drop in deportations
WASHINGTON (December 22, 2015) – Immigration enforcement remains in a
state of collapse, according to the official statistics released by the
Department of Homeland Security (DHS) today.
- Total deportations by ICE (including both border and interior cases) declined 25% from last year, from 315,943 in 2014 to 235,413 in 2015.
- Interior deportations by ICE declined 31% from last year, from 100,114 in 2014 to 69,478 in 2015.
- Most concerning, deportations of criminal aliens from the interior declined 27% from last year, from 86,923 in 2014 to 63,127 in 2015.
The
number of interior deportations is now less than one-third of what it
was in 2011, before the Obama administration implemented policy changes
that greatly restricted the types of cases that ICE officers and agents
could pursue for deportation. The number of criminal alien deportations
from the interior is less than half of what it was in 2011.
ICE Director Sarah Saldana said that she was "proud of the numbers" when she testified at a Senate Judiciary Committee hearing on December 2, 2015.
In a press release announcing the numbers today, DHS falsely says "the number of convicted criminals removed from the interior continued to increase." In fact, only the share of deportations that are of criminals has increased – the actual number has fallen, as noted above.
CIS Director of Policy Studies Jessica Vaughan testified at the same Senate hearing as Saldana, and said this about the new statistics: "These abysmal deportation numbers are the result of deliberate policy choices made by President Obama to dismantle immigration enforcement, all the while telling Congress and the public that he was accomplishing "record" deportations. This willful neglect has imposed enormous costs on American communities. In addition to the distorted labor markets and higher tax bills for social welfare benefits that result from uncontrolled illegal immigration, the Obama administration's anti-enforcement policies represent a threat to public safety from criminal aliens that ICE officers are told to release instead of detain and remove. The administration's mandate that ICE focus only on the 'worst of the worst' convicted criminal aliens means that too many of 'the worst' deportable criminal aliens are still at large in our communities."
Vaughan also said, "We are likely to see a further drop in deportations in the coming year, following the implementation of the administration's Priority Enforcement Program. Known as PEP, this program further limits ICE officers, requiring them to ignore prior deportees and other deportable aliens who were formerly priorities, and explicitly allows state and local governments to obstruct enforcement with sanctuary policies."

Texas-Mexico Border Apprehensions
Dipped in 2015
The number of people apprehended by immigration agents while trying to enter Texas illegally dropped by more than 35 percent during the federal government’s 2015 fiscal year, according to Department of Homeland Security statistics released Tuesday.
U.S. Customs and Border Protection agents stopped some 210,470 people in Texas between October 2014 and September 2015, compared to 332,457 the previous year. On the entire southwestern border, 331,335 people were apprehended in the 2015 fiscal year, compared to 479,371 the year before.
Homeland security leaders attribute the dip to lower numbers of would-be illegal crossers and a ramped-up border security effort that has nearly doubled the number of agents on the southwestern border since 2001. The number of Mexican nationals apprehended decreased by 18 percent, they said; apprehensions of people from countries other than Mexico — mainly Central Americans — decreased by more than 65 percent.
The new data is not likely to allay the concerns of GOP state leaders, who argue the Obama administration is failing in its duty to secure the border and remove undocumented criminals already present in the country.
Last week, Gov. Greg Abbott announced that he'd be keeping National Guard troops on the state’s border with Mexico instead of sending them home as planned, the result of a spike in illegal crossings by minor children in the Rio Grande Valley in October and November of this year. The Guard is deployed to assist federal agents and state troopers in surveillance and border crossings but has no arresting or removal powers.
The downward trend in federal apprehensions wasn't just limited to the border; nationally, they decreased by about 30 percent between 2014 and 2015.
Immigration and Customs Enforcement also removed roughly 80,000 fewer undocumented people from the country — a total of 235,413 — in 2015 than the agency did the prior year.
During a conference call with reporters, homeland security officials said of Immigration and Customs Enforcement removals in 2015, about 86 percent were considered "Priority 1" — immigrants who pose a viable threat to national security, border security and public safety.
The 2015 totals also include roughly 40 percent fewer unaccompanied minors and family units.

We are confident that one can make the case that there are considerations on both the labor demand-side (whether US employers have a natural tendency to hire foreign-born workers is open to debate) as well as on the supply-side: it may be easier to obtain wage-equivalent welfare compensation for native-born Americans than for their foreign-born peers, forcing the latter group to be much more engaged and active in finding a wage-paying job.
However, the underlying economics of this trend are largely irrelevant: as the presidential primary race hits a crescendo all that will matter is the soundbite that over the past 8 years, 2.7 million foreign-born Americans have found a job compared to only 747,000 native-born. The result is a combustible mess that will lead to serious fireworks during each and every subsequent GOP primary debate, especially if Trump remains solidly in the lead.

It is clear that the overarching goal of a succession of administrations and many members of Congress, irrespective of political party affiliation, is to keep our borders open and take no meaningful action to stop that flow of aliens into the United States.

The obvious question is why the Visa Waiver Program is considered so sacrosanct that even though it defies the advice and findings of the 9/11 Commission no one has the moral fortitude to call for simply terminating this dangerous program.
The answer can be found in the incestuous relationship between the Chamber of Commerce and its subsidiary, the Corporation for Travel Promotion, now doing business as Brand USA.
The Chamber of Commerce has arguably been the strongest supporter of the Visa Waiver Program, which currently enables aliens from 38 countries to enter the United States without first obtaining a visa.

Incredibly, the official State Department website also provides a link, “Discover America,” on that website which relates to the website of The Corporation for Travel Promotion, which is affiliated with the travel industries that are a part of the “Discover America Partnership.”

A Pattern of Executive Overreach
Homeland security officials said their focus in 2016 would be "more interior enforcement" to return "convicted criminals" to their home countries.
Starting in 2010, the IRS, under pressure from congressional Democrats and the White House, engaged in blatant ideologically motivated discrimination against conservative organizations applying for non-profit status.
That the most feared bureaucracy in Washington was making decisions based on illegal political criteria should send a chill down the spine of any American who cares about the First Amendment and the rule of law.
Yet the Department of Justice has refused to indict even IRS official Lois Lerner, who invoked her Fifth Amendment right to silence to avoid incriminating herself in testimony before Congress.
Unfortunately, the failure to prosecute anyone responsible for abusing the IRS’s authority reflects the Obama administration’s broader contempt for the Constitution and the rule of law.
Consider just a few examples:
Presidents trying stretch their power as far as they can is hardly news. What is news, however, is that top Obama administration officials, including the president himself, see this not as something to be ashamed of, but as a desirable way of governing, something to brag about rather than do surreptitiously.
Obama behaves as if there is some inherent virtue in a president governing by decree and whim, as if promoting progressive political ends at the expense of the rule of law is proper not simply as a desperate last resort but as a matter of principle.
After all, Obama says, democracy is unduly “messy” and “complicated.” “We can’t wait,” the president intones, as he ignores the separation of powers again and again, ruling instead through executive order.
“Law is politics,” and only politics, according to a mantra popular on the legal left, and therefore the law should not be an independent constraint to doing the right thing politically. Obama seems to agree.
As Obama’s lawlessness has received increased attention from Congress, the (conservative) media, and the general public, the president has been defiant, even petulant. When confronted by allegations of lawlessness, Obama takes no responsibility, and doesn’t even bother to defend the legality of his actions.
Harry S. Truman famously said “the buck stops here.” Obama responds to serious concerns about his administration’s lawlessness with a derisive “so sue me.”
As George Washington University law professor Jonathan Turley writes, Obama “acts as if anything a court has not expressly forbidden is permissible.” And in many situations, no one has legal standing to challenge the president’s actions in court—which means that no judge can stop the administration’s lawbreaking.
So sue me? If only we could.
