TIJUANA, Mexico (AP) — Mexican security forces are announcing the seizure of 105 tons of marijuana.
Army Gen. Alfonso Duarte Mujica says the pot was seized in 10,000 packages in the border city of Tijuana. He says 11 suspects have been arrested.

Average U.S. Hourly Wage Dropped in September, Has Been Virtually Flat for a Year, Says Labor Department

(CNSNews.com) - The inflation-adjusted average hourly earnings for all U.S. employees dropped in September by 0.1 percent, the Bureau of Labor Statistic (BLS) reported today.
In fiscal year 2010, the average hourly wage in the United States remained virtually flat, increasing by only one half of one percent from September 2009 to September 2010.
At the same time, according to the BLS, Americans earning an hourly wage worked, on average, 1.2 percent longer each week in September 2010 than they did in September 2009, managing by that means (combined with the 0.5 percent increase in their average hourly wage since September 2009) to increase their average weekly earnings by a total of 1.7 percent over the past year.

(CNSNews.com) -- The Department of Justice (DOJ) awarded $324 million in fiscal year 2010 to states and localities to help pay the salaries of corrections officers responsible for incarcerating criminal illegal immigrants. Those subsidies marked a decline of 18 percent from fiscal year 2009, when $394 million was distributed by the department.
The funds for those salaries are awarded through the State Criminal Alien Assistance Program (SCAAP), which is administered by the DOJ in conjunction with the Department of Homeland Security (DHS).
According to the Justice Department, the SCAAP program “provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens with at least one felony or two misdemeanor convictions for violations of state or local law, and incarcerated for at least 4 consecutive days during the reporting period.”
The DOJ also explained that “most jurisdictions use SCAAP funding to pay the salaries and overtime costs of their corrections officers, but many also use these funds to pay for training and technology.”
The SCAAP disbursements for fiscal year 2010 were released on Sept. 30. In the 2010 fiscal year, 865 awards were made, down from the 900 awards made in fiscal year 2009.
Starr Small, a spokesperson at DOJ, told CNSNews.com that SCAAP only covers a fraction of a correctional officer’s salary.
“Jurisdictions receive a percentage of the correctional officer salary costs through the SCAAP award program,” said Small.
Michael Dino, assistant director of homeland security and justice issues at the Government Accountability Office, told CNSNews.com that the four states and four localities that housed the most criminal aliens in 2003 (latest data available from GAO) saw only 25 percent of their overall incarceration costs, not just correctional officer salary cost, covered through the SCAAP.
The four states in question were California, New York, Florida and Arizona. The four localities were Los Angeles County, New York City, Orange County (Calif.), and Maricopa County (Ariz.).
The Congressional Research Service (CRS) also reported in September 2009 that “SCAAP funds do not cover all of the costs for incarcerating immigrants or foreign nationals.”
Any state or locality that incurred costs for incarcerating undocumented criminal aliens is able to apply for SCAAP money. In FY
2010, applicants included all 50 states, the District of Columbia, Guam, Puerto Rico, the U.S. Virgin Islands and some counties and cities.
Historically, the state of California has received the most funding. This did not change in 2010. The state correctional system alone in California -- not including local and city jails -- was awarded $88.2 million, which is 27 percent of the total $324 million awarded by SCAAP.
The New York state correctional system, also excluding county and city jails, received the second most funding through SCAAP at about $18 million, followed by the Texas state correctional facility which received $16 million.

In its FY2010 budget proposal, the Obama administration called for eliminating the SCAAP program, saying termination of the program would save $400 million in federal revenue, i.e., taxpayer money.
The proposal said, “The Administration recognizes the financial burden that the current immigration system places on States and localities, and is committed to reducing illegal immigration. However, SCAAP resources can be better used to enhance Federal enforcement efforts.”
Nevertheless, the administration did not proceed in eliminating SCAAP and in its FY2011 budget, , it allotted $330 million for the program.
“The Budget also provides $330 million for the State Criminal Alien Assistance Program to assist States and localities in the identification, status determination and conduct of removal proceedings of incarcerated illegal aliens,” stated the 2011 budget proposal.
In an October 6 report, the Department of Homeland Security (DHS) Inspector General’s Office estimated that there are approximately 300,000 to 450,000 criminal undocumented aliens in local, county, state, and federal prisons who are eligible to be removed from the United States.

(CNSNews.com) – The Department of Homeland Security (DHS) warned Arizona law enforcement officials in May that Mexican drug cartels were deploying assassins to kill bandits hijacking their drug loads in the Vekol Valley, 70 miles inside Arizona. Then the federal government set up signs in the region to warn American citizens away from this area of U.S. sovereign territory.
That local law enforcement would be left to confront agents of a foreign cartel coming across the international border of the United States to carry out a deadly drug war on U.S. soil is further evidence that the federal government is not doing its duty to secure the border, said Pinal County Sheriff Paul Babeu.
“This is confirmed intelligence that Mexican drug cartels are now working in concert to protect their drug loads in the United States, literally, to send well-armed, military trained--even with ballistic vests--up to my county,” Babeu told CNSNews.com.
“This clearly is no longer a public safety issue,” he said. “This is a national security issue. The violence is bleeding into America and we must stop it.”
The DHS sent an e-mail on May 13, 2010 to several law enforcement agencies warning that Mexican drug cartels were deploying “sicarios” (assassins) into the western part of Pinal County, Ariz., to “take out” bandits that were robbing drug smugglers who had entered the United States from Mexico through the Arizona desert.
The e-mail was sent on May 13, 2010, and made public this Friday, Oct. 15, after local media in Arizona obtained the e-mail and questioned local law enforcement about it.
Babeu said that until now the e-mail was kept private because it was considered “law enforcement sensitive.” But Babeu, a critic of the Obama administration’s handling of immigration and border security issues, said he released it today because it constitutes further evidence that the government is not protecting Americans from the threats posed by a porous border.
“This is unacceptable for our federal government not to secure the border and not to respond to these threats,” Babeu told CNSNews.com. “How has it become in America [that] local sheriffs and law enforcement have to go up onto hillsides and pull people out of caves and take lookouts and scouts, who have binoculars, and night vision, and communication devices which are encrypted and rolling – they said so, right in the memo.”
The May 13 e-mail reads, in part: “We just received information from a proven credible confidential source who reported that last weekend, a meeting was held in Puerto Penasco in which every smuggling organization who utilized the Vekol Valley was told to attend. This included rival groups within the Guzman cartel.
“It was decided that the cartel would send a group of fifteen, very well equipped and armed sicarios complete with bullet proof vests, into the Vekol Valley” the e-mail continues. “The Cartel has a map of where the most bandit activity has been occurring. The group will walk into the valley taking four days to get into LPOP positions and communicate back to Penasco. Penasco will then send groups of simulated backpackers carrying empty boxes covered with burlap into the Vekol Valley to draw out the bandits. Once the bandits have been identified, the sicarios will take out the bandits.”
“Incidentally” the e-mail continues,” the night of the Vekol Valley shooting, we received information from a source who reported that the scouts in the valley (the Cartel has 23 scout locations with rolling encryption) were reporting that bandits had shot two sheriff’s deputies and the area was covered with cops.”

The last portion of the e-mail apparently refers to the reported ambush of Pinal County Deputy Louie Puroll, who was shot while scouting the Vekol Valley area on April 30, two weeks before DHS sent the e-mail warning of drug cartel operations in the small location.
While Vekol Valley in southwest Arizona is about 70 miles north from the U.S.-Mexico border, Puerto Penasco – the site where DHS said the drug cartels were meeting to discuss the assassination plot – is a resort town on the Sea of Cortez in Mexico, a little more than 60 miles south from the border.
Babeu said despite the federal government’s intelligence, it failed to respond to its own warning, except to install 15 billboard-sized warning notices in the Vekol Valley area cited in the DHS e-mail. (See story.)
“It is right in that exact location,” Babeu said of the signs that were erected shortly after the e-mail was sent. “That’s why they put up these signs. They knew of this and the only thing they did was put up signs warning our citizens to stay out.”
Babeu said the federal government’s border security policy has failed and action should be taken immediately to stem further violence by Mexican drug cartels on U.S. soil.

Senate Rejects Efforts to Secure the Border
The Senate rejected three border security amendments that were offered last week to H.R. 4899, the Emergency Supplemental Appropriations bill. (Roll Call Vote No. 165, May 27, 2010; Roll Call Vote No. 166, May 27, 2010; Roll Call Vote No. 167, May 27, 2010). (The Washington Post, May 27, 2010). These critical amendments would have used unspent stimulus funds to provide funding and personnel to address the increasing violence and illegal immigration on the U.S.-Mexico border. Democrats managed to defeat all three measures proposed by border state senators, as they each fell short of the 60 votes required to overcome objections made against the amendments.
The first amendment (S.Amdt.4214), sponsored by Senator John McCain (R-Ariz.) and cosponsored by Senators Jon Kyl (R-Ariz.), John Cornyn (R-Tex.), and Kay Bailey Hutchison (R-Tex.), would have funded the deployment of 6,000 National Guard troops to support and secure the southern border of the United States. Arguing on behalf of his amendment, McCain stated, “Deploying the National Guard is essential to securing our U.S.-Mexico border. Families living in Arizona should not suffer from the daily threats caused by illegal immigration, drug trafficking, and human smuggling. It is the Federal government’s obligation to protect all Americans by securing the borders, and deploying 6,000 National Guard is a critical first step.” (McCain Press Release, May 27, 2010).
Senators Kyl and McCain also proposed an amendment (S.Amdt.4288) that would have provided $200 million for Operation Streamline, a program to prosecute illegal border crossers rather than release them. The program has been fully implemented in Del Rio, Texas, and Yuma, Arizona, and since its inception in 2005, has dramatically reduced the number of individuals illegally crossing the border in those sectors. Senator Cornyn’s amendment (S.Amdt.4202), cosponsored by Senators Kyl, Hutchison, and McCain, was a multi-agency border security measure that would have provided $3 billion for the federal, state, and local law enforcement officers who work on the frontlines of the U.S.-Mexico border. The amendment would have funded six important priorities involving border security, which include border security and technology, state and local law enforcement, southwest border taskforces, border enforcement personnel, detention and removal activities, and ports of entry. Speaking on the Senate floor in support of his amendment, Senator Cornyn said, “Our children are living in fear, but the Obama White House is living in denial…I urge my colleagues to support this amendment and help send a message to our border communities that the federal government accepts its responsibility to keep them safe.” (Cornyn Press Release, May 25, 2010).
Senator Kyl slammed the Senate’s rejection of efforts to secure the nation’s border: “On the heels of the President’s ‘announcement’ to send National Guard troops to the border, it’s unfortunate to once again see actions not matching up with words. What happened today in the Senate once again demonstrates the federal government’s failure, and apparent unwillingness, to do what is necessary to secure the border.” (Kyl Press Release, May 27,

Obama Proposes Cuts to Important Immigration Enforcement Programs
On February 1, President Obama released the details of his Fiscal Year (FY) 2011 Budget Request, which seeks to cut funding for important immigration enforcement programs. (See The President’s Budget Message, February 1, 2010). Specifically, the president’s budget would slash funding for the Secure Border Initiative; cut funding for US-VISIT; and cut 180 agents from the Border Patrol. The president’s proposed budget also proposes to merely maintain funding for the critically underfunded State Criminal Alien Assistance Program (SCAAP).
The Secure Border Initiative (SBI) “is a comprehensive, multi-year plan to help secure America’s borders” through fencing, infrastructure, and technology. (CBP Factsheet). SBI is a critical element of the larger DHS-CBP effort to increase border security, which includes construction of the border fence. Last year, Congress approved $800 million to fund SBI through FY2010. President Obama is requesting only $574 million for this program in his FY2011 budget, a $226 million cut. (FY2011 Budget Request Appendix: DHS).
US-VISIT, or United States Visitor and Immigrant Status Indicator Technology, is an entry-exit tracking program that collects information, including biometric identifiers, on foreign nationals attempting when they enter the United States. This information is then used to, among other things, determine whether foreign nationals should be denied entry and whether exiting aliens have overstayed or otherwise violated the terms of their admission. According to a Government Accountability Office (GAO) report released in November 2009, the Department of Homeland Security (DHS) does not have a unified schedule to completely implement a comprehensive exit function for US-VISIT, and it is difficult to determine when and how US-VISIT will be completed. (GAO Report, November 2009). Despite this failure to complete implementation, President Obama has proposed a $39 million cut to US-VISIT, from $374 million in FY2010 to $335 million in FY2011. (FY2011 Budget Request Appendix: DHS).
In addition, President Obama’s budget provides for a reduction of 180 Border Patrol agents. According to Acting DHS Chief Financial Officer Peggy Sherry, the administration does “not believe the 180 personnel reduction will in any way reduce the overall operating effectiveness of the Border Patrol because over the past five years, the Border Patrol has doubled in size.” Sherry continued: “A lot of the agent workforce, the substantial portion of it, has only a couple of years experience. As they become more seasoned and more mature in their jobs, their effectiveness will increase.” (See DHS Conference Call Transcript).
The administration has also requested only $330 million for SCAAP – a federal program administered through the Department of Justice that helps states pay for the incarceration of criminal aliens. (FY2011 Budget Request: DOJ). Congress recently cut the annual funding level for SCAAP from $400 million in FY2009 to $330 million in FY2010. (See FAIR’s Legislative Update, December 22, 2009). This cut drew significant criticism from border state Governors Rick Perry (R-TX) and Arnold Schwarzenegger (R-CA), yet through his request, President Obama suggests that he wants to make it permanent. (Id.).
Although President Obama’s budget is a significant barometer reflecting his policies and priorities, it represents simply a funding request to Congress. Congress has the true power to appropriate money and can choose to wholesale adopt, modify, or reject the President’s budget request. As Congress and the administration negotiate the complicated budgeting and appropriations process over the coming months, stay tuned to FAIR for in-depth analyses of important immigration-related funding decisions.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Senate Democrats Block DeMint’s Effort to Finish the Fence
As FAIR reported last week, Senator Jim DeMint (R-SC) introduced an amendment to the financial regulation bill (S. 3217) that would require the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border within one year. (FAIR’s Legislative Update, May 10, 2010; DeMint Press Release, May 5, 2010). DeMint attached his amendment to an amendment authored by Senator Ron Wyden (D-Ore.) that would restrict secret holds in the Senate. (Roll Call, May 13, 2010). This ensured that the Senate would have to vote on the border fence amendment before turning to Wyden’s amendment.
Senate Democrats, however, chose to block consideration of DeMint’s amendment by having Wyden withdraw his amendment. Wyden called the DeMint Amendment “very controversial,” but the very same amendment passed last year by a bipartisan 54-44 vote when Senator DeMint offered it to the FY2010 Homeland Security Appropriations bill. (Roll Call Vote No. 220, July 8, 2009). In the end, Senator DeMint offered Democrats a chance to make good on their numerous pledges to address border security, but to no avail. The Obama administration will sue Arizona for trying to help Washington enforce federal immigration laws, but flatly rejects the notion of suing sanctuary cities that blatantly defy those same laws. That announcement two weeks ago revealed the hypocrisy and utter contempt for the rule of law rampant in Eric Holder’s Justice Department.
It was the latest example of the Department letting partisan politics, rather than the interests of justice and the impartial enforcement of the law, drive its legal decisions. In this instance, it both threatens national security and undermines public confidence in our legal system.
Holder’s refusal to sue sanctuary cities is an abrogation of his responsibility as the nation’s chief federal law enforcement officer. Unlike Arizona, many of these cities have policies that violate federal law.
The Obama administration claims Arizona’s law will “disrupt federal immigration enforcement.” But the only thing it could possibly disrupt is federal non-enforcement. As the elections approach, Holder’s suit may help gin up enthusiasm among the president’s more radical political allies, such as La Raza. But using the law enforcement powers of the federal government to achieve political ends is a dangerous abuse of power.

Sonoma County Sheriff Bill Cogbill said Friday he wants to clear the air over a key local issue expected to turn out thousands of Latino immigrants and their supporters to a march and rally in downtown Santa Rosa on Sunday.

The issue is a new system in which fingerprints taken from people booked in the county ail are sent electronically to U.S. Immigration and Customs Enforcement, or ICE, databases.
Cogbill said Friday the new program is not a local policy, nor is there any official agreement between the county and ICE, an agency of the U.S. Department of Homeland Security.
“We didn’t have a choice in it,” Cogbill said. “They came to us just to let us know this is happening.”
He said that even before the “biometric” fingerprinting program was launched in Sonoma County this month, fingerprints were routinely sent to the state Department of Justice, which would then have them checked for criminal history against databases maintained by the Federal Bureau of Investigation.
But under a new initiative being rolled out gradually across the country, the FBI now is sending fingerprints to ICE.
Cogbill said he personally approves of the program because it helps more effectively identify illegal immigrants with criminal backgrounds. But he stressed, “we’re not doing anything different from our end” and there’s no agreement between the Sheriff’s Office and ICE.
ICE spokeswoman Virginia Kice said the program, known as Secure Communities, is the latest tool being used to target illegal immigrants with dangerous criminal backgrounds, many of whom would otherwise “slip through the cracks.”
Top priority, she said, is illegal immigrants who commit crimes such as murder, rape, robbery, kidnap and drug offenses.
“Our desired outcome is to see that person removed from the United States,” Kice said.

But immigrant rights advocates say it’s not just people with serious criminal backgrounds that will be affected. Organizers of Sunday’s march charge that local jails hold illegal immigrants who have committed minor infractions, such as traffic violations.
“They’re not just taking cars, they’re putting people in jail,” said Alvarez.

He said he believes law enforcement officials are “profiling” immigrants based on their appearance, a claim Cogbill and other local law enforcement officials strongly reject.
Secure Communities, Kice said, recently has been expanded to Orange County, bringing the number of participating counties to 12. The others are Los Angeles, Ventura, San Diego, Imperial, Santa Barbara, San Luis Obispo, Sacramento, Solano, San Joaquin and Stanislaus counties.
There are 120 jurisdictions in 16 states now on board, she said. By next year, Secure Communities should be present in every state and should have nationwide coverage by 2013.

Since its inception, Kice wrote in an e-mail, the program has identified “more than 18,000 aliens charged with or convicted of Level 1 crimes, such as murder, rape and kidnapping — 4,000 of whom have already been removed from the United States.”
Most of those who have not yet been deported are completing their sentences, she said. An additional 25,000 illegal immigrants charged with “Level 2 and 3 crimes,” such as burglary and serious property crimes, have been deported. This latter category of crimes represents 90 percent of the crimes committed by illegal immigrants, she said.

The setting was not quite the flight deck of the U.S.S. Abraham Lincoln with a “Mission Accomplished” banner as the backdrop, but it was the next best thing. Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.
Arguing the Obama administration’s case for amnesty, Napolitano laid out what she described as the “three-legged stool” for immigration reform. As the administration views it, immigration reform must include “a commitment to serious and effective enforcement, improved legal flows for families and workers, and a firm but fair way to deal with those who are already here.”
Acknowledging that a lack of confidence in the government’s ability and commitment to effectively enforce the immigration laws it passes proved to be the Waterloo of previous efforts to gain amnesty for illegal aliens, Napolitano was quick to reassure the American public that those concerns could be put to rest.
“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.

Border: After suing Arizona to assert federal supremacy over states on immigration, it turns out that ICE, Washington's immigration cop on the beat, isn't enforcing the law at all. This is amnesty by another name.
Oh, what a hullabaloo the Justice Department made last month over Arizona's SB 1070, arguing before a federal district judge that the law must be struck down because the federal government has "pre-eminent authority to regulate immigration matters."
Arizona's effort was depicted as some sort of secessionist usurpation of federal prerogatives, despite the fact that SB 1070 mirrored federal law.
Incredibly, Judge Susan Bolton, an appointee of President Clinton, agreed and issued an injunction on those grounds.
In practical terms, her decision means that Arizona's 15,000 lawmen could not help federal agents enforce the law on America's largest and most dangerous immigrant-smuggling corridor.
Now it's obvious why: The Justice Department isn't interested in enforcing the law.
Last week, 259 representatives of the union that represents 7,000 Immigration and Customs Enforcement agents handed down a unanimous vote of "no confidence" in ICE leaders, whose policies keep them from doing their job.
Based on those policies, agents can no longer arrest illegal immigrants even if they announce their status on a sandwich board.
According to a June 29 memo from ICE Assistant Secretary John Morton, ICE must now "prioritize the apprehension and removal of aliens who only pose a threat to national security and/or public safety, such as criminals and terrorists."
Given that all police agencies look for such targets, such a premise is absurd. Oklahoma City bomber Timothy McVeigh, after all, was arrested by a traffic cop, not a fancy anti-terror strike force, in 1995.
And aside from wondering why terrorists are being released at all across a border they'll have no trouble recrossing, Morton's policy effectively means no one is looking for illegal immigrants once they make it past the Border Patrol.
This is taking pick-and-choose law enforcement to an extreme and runs counter to best police practices, such as James Q. Wilson's "broken window" theory of criminology. This holds that enforcement against minor crimes in an area helps prevent an escalation into more serious crime.
ICE's Morton claims the agency has limited resources, so it can deport only 400,000 illegal immigrants a year. From a government agency with a $2.6 billion detention and removal budget, that comes to about $6,500 per deportee, a de facto statement of government inefficiency and waste. And it affects only 4% of all illegal border-crossers.

Former HPD police chief takes job with ICE

Former HPD Chief Harold Hurtt, 63, said Wednesday that he accepted the position as director of ICE's Office of State and Local Coordination.
Former Houston Police Chief Harold Hurtt, who has been a vocal critic of a controversial program at Immigration and Customs Enforcement, has taken a high-profile job at the federal agency.
At ICE, Hurtt will act as the new director in charge of outreach with local and state law enforcement and non-governmental organizations.
Hurtt, 63, said Wednesday that he accepted the position as director of ICE's Office of State and Local Coordination, which is primarily tasked with outreach efforts, not oversight of ICE's partnerships with local law enforcement. He will officially start the job, which he said pays about $180,000 a year, on July 6.
Hurtt, who served as chief in Houston until he resigned in December, criticized one of ICE's key programs involving local law enforcement during his tenure here and in his former role as head of the Major Cities Chiefs Association.
He said in his new role, he plans to focus on providing accurate information on illegal immigration to law enforcement partners to "avoid emotional responses" to the issue. He also said he hopes to create a stakeholder group to help improve ICE's outreach efforts.
Hurtt and former Mayor Bill White faced harsh criticism during their tenures over the city's role in immigration enforcement. Much of the conflict during the past year focused on HPD's participation — or lack thereof - in ICE's 287(g) program, which trains local law enforcement to assist ICE with immigration screening.

Backlash to policy
Hurtt and the former mayor announced in spring 2009 that the city would participate in 287(g), provided it was confined to the city's jails. Hurtt steadfastly opposed having Houston officers question people in the field about their immigration status.
That decision resulted in backlash from some members of the police union and anti-illegal immigrant advocates but won him praise of leaders in Houston's immigrant community.
Hurtt said Wednesday that his reluctance stemmed in part from HPD's "resource capabilities."
"I had concerns about officers in the field concentrating their efforts and resources on the enforcement of immigration," Hurtt said.
He also said he feared that having officers question suspects in the field could result in fewer members of immigrant communities coming forward to report crime.
"I think that was a legitimate concern and still is," Hurtt said.
The city eventually backed away from participating in 287(g) and instead chose another ICE partnership, called Secure Communities, which runs fingerprint-based immigration history checks on all suspects booked into the local jails and notifies ICE automatically of any "hits" in the system.
Hurtt said that in his new role, he will support local law enforcement agencies' decision to participate in any ICE program of their choosing, even if it involves questioning suspects on the street about their status.
"That's a decision that needs to be made at a local level," he said.

'Extremely hypocritical'
Curtis Collier, with the Spring-based U.S. Border Watch, said it was "extremely hypocritical" for Hurtt to take the position.
"There's no way you can head up an office if you don't believe in what the office is supposed to do," Collier said. "Immigration and Customs Enforcement's primary mission is to protect the American people. If this guy believes any of these programs should not be enforced, he's certainly going to be a very weak advocate for them."
Cesar Espinosa, a Houston immigrant advocate, said Hurtt was always "welcoming and open" to the concerns of immigrant advocates.
"We felt that as chief, he actually believed that the main focus of police should be to protect the community as a whole, regardless of immigration status," Espinosa said.
John Morton, Homeland Security assistant secretary for ICE, praised Hurtt's appointment.
"Chief Hurtt is a respected member of the law enforcement community and understands the concerns of local law enforcement leaders," Morton said.

“For starters, the security of the Southwest border has been transformed from where it was in 2007,” stated the secretary. Not only is the border locked up tight, she continued, but the situation is well in-hand in the interior of the country as well. “We’ve also shown that the government is serious and strategic in its approach to enforcement by making changes in how we enforce the law in the interior of the country and at worksites…Furthermore, we’ve transformed worksite enforcement to truly address the demand side of illegal immigration.”
If Rep. Joe Wilson had been in attendance to hear Secretary Napolitano’s CAP speech he might well have had a few choice comments to offer. But since he wasn’t, we will have to rely on the Department of Homeland Security’s own data to assess the veracity of Napolitano’s claims.
According to DHS’s own reports, very little of our nation’s borders (Southwestern or otherwise) are secure, and gaining control is not even a goal of the department. DHS claims to have “effective control” over just 894 miles of border. That’s 894 out of 8,607 miles they are charged with protecting. As for the other 7,713 miles? DHS’s stated border security goal for FY 2010 is the same 894 miles.
The administration’s strategic approach to interior and worksite enforcement is just as chimerical as its strategy at the border, unless one considers shuffling paper to be a strategy. DHS data, released November 18, show that administrative arrests of immigration law violators fell by 68 percent between 2008 and 2009. The department also carried out 60 percent fewer arrests for criminal violations of immigration laws, 58 percent fewer criminal indictments, and won 63 percent fewer convictions.
While the official unemployment rate has climbed from 7.6 percent when President Obama took office in January to 10 percent today, the administration’s worksite enforcement strategy has amounted to a bureaucratic game of musical chairs. The administration has all but ended worksite enforcement actions and replaced them with paperwork audits. When the audits determine that illegal aliens are on the payroll, employers are given the opportunity to fire them with little or no adverse consequence to the company, while no action is taken to remove the illegal workers from the country. The illegal workers simply acquire a new set of fraudulent documents and move on to the next employer seeking workers willing to accept substandard wages.
In Janet Napolitano’s alternative reality a mere 10 percent of our borders under “effective control” and sharp declines in arrests and prosecutions of immigration lawbreakers may be construed as confidence builders, but it is hard to imagine that the American public is going to see it that way. If anything, the administration’s record has left the public less confident that promises of future immigration enforcement would be worth the government paper they’re printed on.
As Americans scrutinize the administration’s plans to overhaul immigration policy, they are likely to find little in the “three-legged stool” being offered that they like or trust. The first leg – enforcement – the administration has all but sawed off. The second – increased admissions of extended family members and workers – makes little sense with some 25 million Americans either unemployed or relegated to part-time work. And the third – amnesty for millions of illegal aliens – is anathema to their sense of justice and fair play.
As Americans well know, declaring “Mission Accomplished” and actually accomplishing a mission are two completely different things. When it comes to enforcing immigration laws, the only message the public is receiving from this administration is “Mission Aborted.”

Senators Ask Napolitano To Explain Backdoor Amnesty Plan

Members of the U.S. Senate committee that oversees immigration are calling on Homeland Security Secretary Janet Napolitano to answer questions about her agency’s “backdoor amnesty” plan for illegal aliens as well as its selective enforcement of existing laws.
Documented in a Homeland Security memorandum (Administrative Alternatives to Comprehensive Immigration Reform), the backup plan aims to legalize undocumented immigrants in case Congress doesn’t pass legislation to do it. High-ranking officials at U.S. Citizenship and Immigration Services (USCIS) are working to enact their own “meaningful immigration reform absent legislative action.”
The plan calls for “relief” to “reduce the threat of removal for certain individuals present in the United States without proper authorization” in the absence of congressional action on immigration reform. The agency “can extend benefits and/or protections” to many illegal aliens if federal lawmakers fail to act, according to the Homeland Security document.
This includes “deferred action” delaying deportation indefinitely, granting green cards, allowing illegal immigrants to remain in the U.S. indefinitely while they seek legal status (known as “parole in place”) and expanding the definition of “extreme hardships” so any illegal alien could meet the criteria and remain in the country.
Federal lawmakers have previously asked Napolitano to explain her agency’s covert amnesty agenda to no avail. This week they demanded answers in writing and expressed “growing concern” about the Department of Homeland Security’s execution of existing immigration laws.
In a letter to Napolitano, Republican members of the Senate Judiciary Committee, which has jurisdiction over immigration and naturalization matters, ask that she meet with them to explain a series of agency memos that propose to grant illegal immigrants benefits and relief barred by federal law. It is increasingly clear that the administration is “dramatically narrowing its efforts to remove whole classes of illegal immigrants,” the letter says.
It also points out the agency’s recently enacted policies of not deporting hundreds of thousands of illegal immigrant students and undocumented aliens discovered during the course of a traffic stop. The legislators ask Napolitnao to immediately explain to Congress her agency’s “administrative” methods for “immigration reform”, pointing out that the American people deserve to know.

Speaking at the Center for American Progress (CAP) on Nov. 13, Homeland Security Secretary Janet Napolitano declared victory over illegal immigration and announced that the Obama administration is ready to move forward with a mass amnesty for the millions of illegal aliens already living in the United States.

Democrats embrace right-wing austerity policies

With only two weeks remaining in the 2010 election campaign, Democratic Party candidates in closely contested races for the Senate, the House of Representatives and many statewide offices are highlighting their right-wing policies and minimizing any differences with their Republican opponents.
Opinion polls and media analysts are generally forecasting a Republican takeover of the House of Representatives, now held by the Democrats by a margin of 255 to 178, and significant Republican gains in the Senate, where the Democrats hold 59 seats out of 100, counting two independents who vote with them.
Some 40 states are electing governors as well, with Republican candidates expected to sweep a belt of economically devastated industrial states—Pennsylvania, Ohio, Michigan, Illinois, Wisconsin—from the Atlantic to the Great Lakes. There are more closely contested gubernatorial races in three of the four largest states: Florida, Texas and California.
The right-wing policies of the Obama administration, above all its failure to take any significant measures to alleviate mass unemployment, have opened the doors for a revival of political influence for the Republican Party, which was thoroughly repudiated by the American people in the past two elections, losing control of both houses of Congress in 2006 and losing the White House in 2008.
The anticipated Republican victories are due mainly to a projected collapse in turnout by those who voted for Obama and other Democratic candidates in 2008, not to any great surge of popularity for the Republican candidates, many of them associated with the ultra-right Tea Party movement. An Associated Press-Knowledge Networks poll published over the weekend found that one-quarter of Obama voters were considering voting against the Democrats this year, and an even larger number were not planning to vote at all.
A Quinnipiac poll published in the Wall Street Journal last week detailed a major demographic shift in projected voter turnout in the state of Ohio, where as many as six incumbent Democratic House members could be turned out. In 2008, voters aged 18-29 and those aged 65 and older each comprised 17 percent of the electorate. The poll projected that in 2010, the youngest age group would be only 10 percent of likely voters, while those 65 and older would account for 25 percent.
Similar figures are reported for other states, reflecting the widespread disillusionment with the Obama administration among young people, who are the most opposed to the continuing war in Afghanistan, the most affected by the destruction of jobs, and the most alienated from the official two-party system.
The Obama White House, like the congressional Democratic leadership, has already begun planning for an expected Republican takeover of the House of Representatives, if not the Senate. Obama gave a lengthy interview to Peter Baker of the New York Times, published in the newspaper’s Sunday magazine, in which he suggested in broad strokes the coming shift further to the right.
Baker writes that according to Obama, “He let himself look too much like ‘the same old tax-and-spend liberal Democrat.’” Obama virtually parroted the right-wing rhetoric of the Republican election campaign, describing the response of “average Americans” to his administration in the following terms: “They started feeling like: Gosh, here we are tightening our belts, we’re cutting out restaurants, we’re cutting out our gym membership, in some cases we’re not buying new clothes for the kids. And here we’ve got these folks in Washington who just seem to be printing money and spending it like nobody’s business.”
This reinforces the myth promoted by the corporate-controlled media that concern over federal deficits—rather than anger over unemployment and the refusal of the Obama administration to do anything about it—is the driving force of the coming Democratic electoral defeat.
Obama promised to engage in a more intensive effort to win Republican congressional support during the next two years. The contours of “Obama 2.0,” as White House aides described it, include seeking even closer relations with corporate America, and working with the Republicans to cut federal spending, particularly through the bipartisan deficit reduction commission that is to issue its report in early December.
Asked to name Republicans on Capitol Hill with whom he could work, Obama singled out Senator Judd Gregg and Congressman Paul Ryan, both of them identified with plans to cut spending. Ryan, a member of the deficit reduction commission, has issued a plan to privatize Medicare, the federal program that underwrites medical care for the elderly.
Obama made it clear that he was prepared to ride roughshod over popular resistance to the destruction of social programs. “If the question is, Over the next two years do I take a pass on tough stuff,” he told Baker, “the answer is no.”
Congressional Democrats have responded to the polling numbers—and the flood of campaign cash into the coffers of the Republican Party, mainly from the wealthy and big business—in two ways: moving further to the right politically, and throwing in the towel outright in an increasing number of campaigns.
The Democrats have effectively conceded several Senate seats. Both the New York Times and the Washington Post ran profiles Sunday of the collapsing campaign of Senator Blanche Lincoln of Arkansas, who has been virtually abandoned by the national party and trails by 20 points to a Republican challenger.
Democratic candidates in North Dakota, Indiana, Ohio, North Carolina and Louisiana have also been largely written off, and in Florida, Democrat Kendrick Meek is denying reports that he will withdraw from the race and throw his support to Republican Governor Charlie Crist, who is running as an independent.
The triage process is more advanced in the House of Representatives, where as many as 100 of the 255 Democratic-held seats are believed to be at risk. Last week the Democratic Congressional Campaign Committee cut off further national funding for a dozen House campaigns, effectively conceding these districts to the Republicans. These include seats held by two incumbents in Ohio and one each in Pennsylvania, Florida, Colorado and Wisconsin, as well as open seats in Arkansas, Indiana, Kansas, Louisiana and Tennessee.
In the dozen or so Senate races still closely fought—New Hampshire, Connecticut, Delaware, Pennsylvania, West Virginia, Illinois, Wisconsin, Kentucky, Colorado, Nevada, California, Washington, Alaska—the contests between the Democratic and Republican candidates show a definite pattern.
Obama, Vice President Biden, and other national party spokesmen have adopted a bogus, pseudo-populist stance, seeking to motivate Democratic Party voters to turn out at the polls by bashing the Republicans as stooges of big business. But the Senate Democratic candidates have by and large refused to follow suit. They have focused instead on personal mudslinging, while distancing themselves from the Obama administration.
In West Virginia, for example, Democratic Governor Joe Manchin, who faces millionaire businessman John Raese for the seat vacated by the death of Robert Byrd, declared that he would support repeal of Obama’s healthcare legislation, at least in part, and trumpeted his opposition to any environmental restrictions on the coal industry.
In Kentucky, state attorney general Jack Conway faces Republican Rand Paul, son of the Libertarian former candidate for president and an extreme proponent of free-market policies. But Conway has declared his adamant opposition to government regulation of the coal industry, going so far as to file a suit against the federal Environmental Protection Agency.
In the only televised debate in the Delaware Senate race, Democrat Chris Coons avoided any serious discussion of the ultra-right politics of Republican Christine O’Donnell, the Tea Party candidate who upset the favored candidate of the Republican establishment. He presented himself as a responsible ally of the state’s business establishment, and responded defensively to O’Donnell’s description of him as a “bearded Marxist” in his college days, declaring himself to be “a clean-shaven capitalist.”
In a Senate debate in Illinois, Democrat Alexi Giannopoulos and Republican Mark Steven Kirk traded accusations of personal corruption and mendacity. The Democrat has been linked to corrupt practices that led to the collapse of the bank owned by his family, while the Republican is a former military intelligence officer who lied about his service record during the Iraq war.
Perhaps the clearest demonstration of the bankrupt and right-wing character of the Democratic Party election campaign came in the only debate in the Nevada Senate race, between Democratic Majority Leader Harry Reid ands his challenger Sharron Angle, a Tea Party favorite.
While Angle is an ultra-right, not to say bizarre, candidate—her political record includes support for indoctrination of state prison inmates by the Scientology cult, as well as abolition of the federal Department of Education—Reid was thrown on the defensive over his personal wealth and lavish lifestyle.
Reid was a multi-millionaire lawyer and property developer when he first won election to the Senate in 1992, and now enjoys a personal fortune estimated at $3.1 million to $6.7 million, according to documents he filed with the Senate. It was therefore difficult for him to posture as an advocate of working people against Angle, who is of modest personal means.
The Republican candidate supports draconian measures against undocumented immigrants, in a state with nearly a quarter of the population of Hispanic descent. She opposes requiring insurance companies to cover specific procedures and medical conditions, and has advocated privatization of Social Security.
But Reid did not press her on these issues, a performance that the Washington Post described as “remarkably restrained.” He also called former president George W. Bush a “friend” and praised right-wing Supreme Court Justice Antonin Scalia as a “masterful mind” on legal affairs.
In the contests for the House of Representatives, the most notable embrace of Republican talking points has been the slew of Democrats who have publicly repudiated Speaker Nancy Pelosi, one of the principal targets of Fox News/talk radio venom.
Several incumbent Democrats who voted for Pelosi as speaker in 2007 and 2009 have declared that they will not do so in 2011, when the next Congress convenes. A Mississippi Democrat boasted that in 1,466 votes over the past two years, “Nancy Pelosi agreed with my vote 34 times.”
One conservative southerner, Jim Marshall of Georgia, went so far as to run television commercials showing “hippies” in San Francisco—Pelosi’s district—with the narrator intoning, “Georgia is a long way from San Francisco. And Jim Marshall is a long way from Nancy Pelosi.”
Pelosi’s response has been characteristically cynical. “I just want them to win,” she told the PBS program “News Hour”. “They know their districts.”

US corporate profits soar on layoffs, wage cuts

US corporate profits are soaring in the midst of the deepest economic slump since the Great Depression, on the basis of a ruthless policy of using mass unemployment to slash wages and heighten the exploitation of American workers. In order to make the impoverishment of the working class a permanent feature of American life, companies are hoarding vast amounts of cash rather than hiring workers and expanding output.
These are the conclusions that flow from a Wall Street Journal analysis of second-quarter 2010 corporate profits, reported in the newspaper’s Monday edition under the headline “Propelling the Profit Comeback: Retooling, Downsizing.” The article gives statistics showing that US corporate profits are surging despite stagnant and even falling revenue, sharply increasing the percentage of revenue represented by profit.
None of the other major industrialized nations has registered a rise in corporate profits in the aftermath of the financial panic of September 2008 comparable to that in the US. Not coincidentally, none has witnessed mass layoffs on the scale seen here.

This difference points to the critical role played by the Obama administration. Among the statistics reported by the Journal are the following:
• The Commerce Department estimates that for all US companies, second-quarter after-tax profits rose to an annual rate of $1.208 trillion, an increase of 3.9 percent from the first quarter and a 26.5 percent rise from a year earlier. This is the highest annual rate on record, although it does not take inflation into account. As a percentage of national income, after-tax profits were the third highest since 1947, surpassed only by two quarters in 2006, at the height of the last boom.
• Companies in the Standard & Poor’s 500 stock index reported second-quarter profits of $189 billion, 38 percent higher than a year earlier and their sixth highest quarterly total ever, without adjusting for inflation.
• This year’s second-quarter profits at S&P 500 companies were 10 percent higher than in the second quarter of 2008, prior to the financial panic, even though revenue was down by 6 percent. Out of every dollar of sales, companies kept nearly 8.4 cents as profit, up from 7 cents in the 2008 quarter.
• Cumulative profit at technology firms rose 33 percent in the second quarter compared with the same quarter in 2008, though revenue increased by only 7 percent.
• In the consumer discretionary category, which includes the finance and auto industries, net margin—the percentage of revenue that represents profit--more than tripled between the second quarter of 2008 and the corresponding period this year.
As the Journal notes, “To achieve that performance, companies laid off hundreds of thousands of workers, closed less profitable units, shifted work to cheaper regions and streamlined processes.”
The article singles out a number of companies that sharply increased their profits by means of cost-cutting and downsizing, including Texas Instruments, video game maker Electronic Arts Inc., Starbucks, Coca Cola, Ford Motor Co. and industrial parts maker Parker Hannifin. All reported higher profits despite flat or declining sales as compared with 2008, the newspaper notes.
“Despite the hefty profits,” the Journal says, “executives aren’t expected to boost spending on new employees, products and equipment anytime soon.”
John Riccitiello, chief executive of Electronic Arts, which slashed its video game releases by nearly half and laid off 2,000 of its 9,800 employees, is quoted as saying, “We’ve focused on permanent changes that won’t have to be undone as sales improve.”
At Parker Hannifin, profits more than quadrupled from a year earlier while sales grew only 25 percent. Its CEO is quoted as saying the firm plans no significant new hiring “for the foreseeable future,” and will instead stretch its work force by using part-timers and adding weekend shifts.
The turnaround at Ford is even more staggering. In the second quarter of 2008 the company posted an $8.7 billion loss. This year, even though sales remain 15 percent below 2008 levels, Ford reported a second-quarter profit of $2.6 billion, its fifth consecutive quarterly profit.
Far from this upsurge in profits arising from a general expansion of production and employment, it has been achieved almost entirely from the destruction of jobs and the use of mass unemployment to blackmail workers into accepting wage cuts and speedup.
As Financial Times commentator Tony Jackson writes in a column published Monday, “Among the many puzzling phenomena of the post-crisis world, one of the oddest is the astonishing rebound in American corporate profits.” Noting that US corporate profit as a proportion of total national output is “back at record levels in spite of the financial crisis,” Jackson attributes this fact to the “division of the pie between capital and labour.”
Also on Monday, the New York Times published a front-page article on the immense cash hoard being piled up by US corporations as a result of the Federal Reserve’s near-zero interest rate policy and the increase in profits. The estimated $1.6 trillion of cash in corporate coffers is not being used to hire more workers. To the extent that a portion of this money is being invested, it is largely going for such parasitic purposes as stock buy-backs (which drive up share values without producing any real value) and mergers and acquisitions, which inevitably result in more job-cutting and downsizing.
These statistics provide a only a pale indication of the human suffering and social devastation at one pole and ever more obscene enrichment of the financial aristocracy at the other resulting from the failure of the capitalist profit system and the drive by the ruling class, spearheaded by the Obama administration and backed by both big business parties, to impose the full brunt of the crisis on the working class.
What is involved here is not a temporary downturn, after which conditions will improve for the masses of people, but rather a fundamental realignment of class relations based on a drastic and permanent lowering of working class living standards.
To carry through this offensive, the ruling class relies on the collaboration of the trade unions to suppress working class opposition. In the United Auto Workers union and the AFL-CIO and Change to Win union federations the Obama administration and the corporate elite have accomplices whose only concern is to secure for the union bureaucracy a cut in the spoils of the class war being waged against working people.
The Socialist Equality Party urges workers to carry out a rebellion against these corrupt, right-wing organizations and establish independent and democratic rank-and-file action committees to fight against layoffs, plant closures and wage cuts. These committees should spearhead the struggle to unite all sections of workers and young people and mobilize the power of the working class.
This is a political fight against the Obama administration, both big business parties and the capitalist system which they defend.
