(CNSNews.com) - Immigration and Customs Enforcement (ICE) failed to identify more than 800 criminal alien convicts eligible for deportation before they were released from U.S. prisons, including “many” of “the most egregious criminal aliens, who pose a significant pubic safety risk,” according to a report by the Inspector General for the Department of Homeland Security (DHS).

According to the report, released on Feb. 4, ICE’s Criminal Alien Program, or CAP, “is responsible for identifying criminal aliens incarcerated in federal, state, and local prisons and jails who are eligible for removal from the United States.”

In fiscal year 2009, CAP failed to identify 890 criminal aliens eligible for removal from the United States, according to the report. These criminals had been incarcerated in facilities in Texas and California and were released back into U.S. society.

A criminal alien eligible for removal is a person who is in the United States illegally and is subsequently convicted of a crime or was a legal permanent residents convicted of a removable offense, such as murder and other felonies.

Once an alien is identified as removable, ICE issues a “detainer” for that individual, which notifies correctional facilities of “ICE’s intent to take custody of an individual in that facility for the purpose of instituting removal proceedings.”

According to the Immigration Policy Center, “If ICE does not take custody within 48 hours, the detainer automatically lapses, and the state/local law enforcement agency is required to release the individual.”

ICE’s Criminal Alien Program is available at all state and federal prisons, in addition to more than 300 local jails throughout the country. ICE requested nearly $200 million for CAP in FY 2010, approximately $50 million more than it was allotted four years earlier.

The Inspector General (IG) report focused on cases involving alien inmates held in federal custody throughout the United States and in state custody in California, Texas, and New York. Those states hold about 64 percent of the foreign-borne U.S. inmate population.

“ICE, through CAP, was successful in identifying 99% of the criminal aliens eligible for removal from the United States in federal custody during FY 2009,” the report stated. “However, identification rates in two of the four states reviewed were not as high. ICE agents did not identify approximately 4% of criminal aliens eligible for removal in California and 2% in Texas.”

The audit later added that the Texas and California FY 2009 rates of non-identified criminal aliens translate to “890 (262 federal and 628 state) out of a total population of 49,033.”

“Many of the 890 criminals are believed to have been Level 1 recidivist criminals,” the report added. “Level 1 are the most egregious criminal aliens, who pose a significant pubic safety risk.”

Level 1 offenses, according to the report, include homicide, kidnapping, sexual assault, robbery, aggravated assault, threats, extortion, sex offenses, cruelty toward family, resisting an officer, illegal weapon possession, hit and run, and drug offenses accompanied by sentences of more than a year.

The audit blamed the “non-identification” of the 890 aliens specifically on ICE agent “staffing challenges,” such as vacancies and “increasing workload levels” created by other criminal alien identification programs.

According to the report, ICE may have missed vetting some incarcerated criminal aliens eligible for removal because agents are not required to record aliens’ immigration status.

ICE agents “do not always record and retain critical information and documentation used to determine the status of foreign-born inmates incarcerated in federal and state prisons,” the report stated. “This is because ICE procedures do not require agents to record and retain such information.”

“As a result, ICE is unable to provide assurance that its [Criminal Alien Program] agents are screening all potentially removable foreign-born inmates incarcerated in federal and state correctional facilities,” the report continued.

According to the IG report, the screening under the criminal alien removal program refers to “electronic records check and interview that [ICE] agents may conduct to determine if a foreign-born inmate is removable.”

“Rosters of either self-proclaimed foreign-born inmates or all inmates incarcerated” at the state level are sometimes discarded, according to the audit, because ICE agents are not required to keep copies of those documents.

“Without these rosters, ICE cannot verify the number, type, and location of foreign-born inmates identified at federal and state facilities,” the IG report stated.

According to the job description for ICE agents working under the Criminal Alien Program, those agents “are expected to devote 75 percent of their time to detention, deportation, transportation, and escorting, leaving little time for screening and identification duties,” according to the report.

ICE concurred with the IG report recommendations of conducting 100 percent screenings of all criminal aliens and enforcing the retention of all screenings and identifications of foreign-born inmates.

“ICE estimates that 300,000 to 450,000 criminal aliens who are eligible for removal are detained each year at federal, state, and local correctional facilities,” the IG report stated.

Chief Who Supports Sanctuary Policies Gets Top ICE Job

In a laughable move, the Obama Administration has appointed a police chief who supports illegal alien sanctuary policies to oversee an immigration enforcement program that requires a partnership between federal and local authorities.

The new director for the U.S. Immigration and Customs Enforcement’s Office of State and Local Coordination is Harold Hurtt, an outspoken critic of immigration enforcement on the local level. As police chief in two different cities with huge illegal alien populations—Phoenix and Houston—Hurtt enforced don’t-ask-don’t-tell immigration measures that prevented officers from inquiring about a suspects’ legal status in the U.S.

In his new post, Hurtt will get $180,000 a year to supervise outreach and communication between federal immigration officials and local law enforcement agencies. In essence, he is charged with strengthening the collaboration between local police and federal immigration officials in an effort to combat a crisis that has rocked practically every major U.S. city and many small municipalities.

Homeland Security officials are promoting Hurtt as “a respected member of the law enforcement community” who will be an “invaluable asset to ICE’s outreach and coordination efforts.” The reality is that he opposes immigration enforcement and as police chief protected the most violent of criminals. Hurtt has even testified before Congress that local police should not assist with immigration enforcement.

His pro-immigration policies enabled illegal immigrants with extensive criminal histories to murder two police officers and seriously injure another while he was chief in Phoenix and later in Houston. Judicial Watch filed a lawsuit against Hurtt on behalf of the deceased Houston officer’s wife for implementing the sanctuary policies that led to her husband’s death.

In the 2007 incident, Officer Rodney Johnson was brutally shot by a previously deported illegal immigrant during a traffic stop. The illegal alien, Juan Quintero, had an extensive criminal record and had been deported three years earlier for molesting a child. The Mexican national had also been in trouble for driving while intoxicated, driving with a suspended license and for failing to stop and provide information after an automobile accident. When Johnson arrested him, Quintero shot him four times in the back of the head with a 9 millimeter handgun concealed in the waistband of his pants.

NYT Gets Back on Amnesty-for-Illegals Hobby Horse

The lead story of Wednesday’s National section featured the paper’s favorite hobby horse, the failed “Dream Act” that would have granted amnesty to hundreds of thousands of student illegals.



Back in December, beat reporter Julia Preston lamented the “painful setback” suffered by illegals when the Senate voted to block the Dream Act. Preston followed up Wednesday with “After False Dawn, Anxiety for Students Who Are Illegal Immigrants.”

It was exhilarating for Maricela Aguilar to stand on the steps of the federal courthouse here one day last summer and reveal for the first time in public that she is an illegal immigrant.



“It’s all about losing that shame of who you are,” Ms. Aguilar, a college student who was born in Mexico but has lived in the United States without legal documents since she was 3 years old, said of her “coming out” at a rally in June.



Those were heady times for thousands of immigrant students who declared their illegal status during a nationwide campaign for a bill in Congress that would have put them on a path to legal residence. In December that bill, known as the Dream Act, passed the House, then failed in the Senate.



President Obama insisted in his State of the Union address and in interviews that he wanted to try again on the bill this year. But with Republicans who vehemently oppose the legislation holding crucial committee positions in the new House, even optimists like Ms. Aguilar believe its chances are poor to none in the next two years.



That leaves students like her who might have benefited from the bill -- an estimated 1.2 million nationwide -- in a legal twilight.



Preston employed the Times’ favorite melodramatic liberal phrase, describing illegals as cowering “in the shadows” (never mind all those photos and public demonstrations of illegal immigrants that make the news pages of the New York Times). She also put an emotional liberal spin on legislation.

Illegal immigrants also face new restrictions many states are imposing on their access to public education, driver’s licenses and jobs. And for those like Ms. Aguilar who came out last year to proclaim their illegal status, there is no going back to the shadows.

Hostility toward illegal immigrants has grown in many states. Lawmakers in Georgia and Virginia are considering measures to ban illegal immigrants from all public colleges. Bills to deny state resident tuition rates to illegal immigrants are under consideration here in Wisconsin, as well as in Arkansas, Kansas, Nebraska and Indiana. Only a few states, like Colorado and Maryland, are going the opposite direction, debating measures to allow illegal immigrants to pay the lower in-state tuition rates.



Preston concluded with the sob story of José Varible, a young illegal immigrant from Mexico “with a knack for technology hardware.”

Combined with his new exposure as an illegal immigrant, he said, those limitations sometimes sink him into depression. He has even considered moving to Australia.



“You know, the thing is, I just don’t feel welcome here,” he said. “You cannot live as an undocumented immigrant.”

Barack Obama and Canadian Prime Minister Stephen Harper quietly have taken a major step toward erasing the border between the two nations with a new "Beyond the Border" bilateral declaration.



In a ceremony designed to remain below the radar of national public opinion, Obama and Harper bypassed Congress to sign on the basis of their executive authority a declaration that put in place a new national security vision defined not by U.S. national borders, but by a continental view of a "North American perimeter."



It happened Friday, the day the Obama administration usually pushes through issues that it prefers the media ignore.



By signing the declaration, the Obama administration has implemented without congressional approval a key initiative President Bush began under the Security and Prosperity Partnership of North America, moving the United States and Canada beyond the North American Free Trade Agreement, commonly known as NAFTA, toward a developing North American Union regional government.



The declaration signed by the two heads of state and titled "Beyond the Border: A Shared Vision for Perimeter Security and Economic Competitiveness," was described as "For Immediate Release" on the websites of the White House and the Canadian chief executive.



Harper followed Obama's lead in signing the declaration as a form of executive order, deciding to bypass the Canadian parliament, much as Obama had decided against taking a proposed bilateral "Beyond the Border" declaration to Congress for prior review and approval.



The decision to declare a continental perimeter for the United States and Canada, designed to effectively combine the two nations in mutual national security and economic efforts, affirms the Obama administration's intent to implement the key objectives of the Security and Prosperity Partnership of North American in a way that avoids the type of public scrutiny and criticism that dogged President George W. Bush after he openly declared his plans with the SPP....



WND previously reported that the Obama administration replaced the content of the SPP website, spp.gov, under the title "Commerce Connect," which announces its purpose as "a one-stop shop for information, counseling and government services that can help U.S. businesses around the country transform themselves into globally competitive enterprises."



Now, the Obama administration has made the spp.gov website totally inoperative....

This time, E-Verify was stripped from a Senate Amendment behind closed doors and without explanation. Instead of becoming a permanent program E-verify has been reduced to only three years. Restoring the Social Order

Twenty momentous years of conservative policy success in cities

Conservative ideas are responsible for the two great urban-policy successes of the last quarter-century: the breathtaking drops in crime and in welfare dependency since the early 1990s. You’d never know it from members of the opinion elite, however, who have rarely recognized these successes, much less their provenance. So let’s recapitulate an epic battle about the foundations of social order, a battle that had not just a clear winner but also a clear loser: the liberal policy prescriptions for cities that many opinion makers and politicians still embrace. New York has been at the center of this battle because so many of the bad ideas that wreaked havoc on cities hatched there. Fortunately, so did many of the antidotes.

Liberal urban policy was based on several core assumptions. Number One: multigenerational poverty was the result of structural forces—above all, of rapacious capitalism and racism. It could never be the result of bad decision-making or a deficit of personal responsibility. Number Two: though men were still, alas, required for conceiving a child, they were purely optional for raising one. (Corollary: the role of illegitimacy in creating and perpetuating poverty could never be acknowledged.) Number Three: low-wage work was demeaning and pointless. It was better to receive a monthly welfare check than to labor at an entry-level job. Number Four: crime was an understandable and inevitable reaction to economic injustice and discrimination. (Corollary: the police could not lower crime; only government social programs and wealth-redistribution schemes could.) Together, these four conceits composed the most dangerous idea of all: that the bourgeois values of order, self-discipline, and respect for the law were decorative afterthoughts to prosperity, rather than its very precondition.

From the 1960s onward, liberal policymakers put these notions into practice, just as radical disorder was breaking out in American cities. In the name of economic justice, the welfare-rights movement, the brainchild of two New York academics, sought to eliminate all remaining stigma associated with the dole and to sign up as many people for welfare as possible. Within three years, welfare rolls in big cities had doubled. The urban riots of the 1960s heralded a decades-long outbreak of crime. A presidential commission responded to the growing anarchy in 1967 by recommending that prison sentences be shortened or eliminated and that the police focus on coordinating social services to offenders rather than on making arrests. The states complied, and the national incarceration rate dropped through the 1970s, while judges diverted offenders into social programs. Crime kept rising.

By the early 1990s, the fruits of this liberal monopoly over urban policy were in clear view. New York City homicides topped 2,000 in 1990. Drug dealers controlled the streets in the city’s poorest neighborhoods; children slept in bathtubs to avoid stray bullets from the dealers’ gun battles. Small businesses fled the city, unable to withstand the assaults on their employees and the constant break-ins. Manhattanites posted pathetic little NO RADIO signs in their cars, hoping for mercy from the circumambient thieves. The national welfare caseload was up fivefold, as was the nation’s illegitimacy rate. In New York City, one in seven residents was on welfare. I remember interviewing an able-bodied New York man who had been mooching off his girlfriend’s welfare check but was applying for his own food stamps. “I’m going for every dime I can get out of them,” he told me, righteously adding one caveat: “If they make you work, I’m not doing it.”

But fissures in the dominant ideology were already appearing. In the 1980s, states had started making sure that criminals actually served most of their sentences. And the realization that work was a better corrective to poverty than government handouts made federal welfare reform look more and more likely. As this prospect loomed, the poverty-industrial complex erupted in rage, using the very dysfunction and disorder that its policies had produced as an argument against changing the status quo. Frances Fox Piven and Richard Cloward, the architects of the welfare-rights revolution, railed against the idea of asking welfare mothers to work. Those mothers already had a full-time job, they said, simply trying to care for their children under the “jungle-like conditions of urban poverty.” Memo to all professors: that jungle is exactly what you get when you dismiss the necessity of the two-parent family, work, and respect for the law.

Anticipating federal welfare reform, Marian Wright Edelman of the Children’s Defense Fund warned that it would be a “moral blot on this nation.” Congressman Charles Rangel predicted that it would throw 1 million people into poverty. (Perhaps he could have offered them lodging in his tax-free Dominican villa.) The most revealing comment, however, came afterward from the Barbra Streisand Professor in Contemporary Gender Studies (yes, there is such a position) at USC: welfare reform, said Sharon Hays, embodied a “serious problem in the cultural logic of personal responsibility itself.” In other words, personal responsibility, for the academy, had been “problematized”: to hold the poor responsible for their actions was philosophically naive, whereas to subsidize self-destructive behavior with unconditional welfare displayed philosophical sophistication.

President Bill Clinton, to his credit, ignored these doomsayers and in 1996 ended the lifetime welfare entitlement. The same women who, the advocates had said, were incapable of working or were unwanted by the economy entered the workforce in droves. The welfare rolls dropped 66 percent, and black child poverty experienced its greatest drop in history. In New York City, where Mayor Rudolph Giuliani had started asking people to go to work a year before federal welfare reform passed, the welfare rolls have dropped 70 percent. New York now has the lowest child poverty rate of the eight largest U.S. cities. If any poverty professional has said, “Oops! I was wrong,” I haven’t heard it.

However significant the rout of the poverty-industrial complex, New York’s demolition of conventional thinking about crime was even more momentous. Since 1990, New York has experienced the largest and longest sustained drop in street crime of any big city in the developed world. In less than a generation, many major felonies have fallen 80 percent or more. New York did this by rejecting everything that the criminology and social-work professions counseled about crime. Police Chief William Bratton announced in 1994 that the police, not some big-government welfare program, would lower crime by 10 percent in just one year. He not only met his goal, he bested it—by ruthlessly holding precinct commanders accountable for the safety of their beats, by the rigorous analysis of crime data, and by empowering street cops to intervene in suspicious behavior before a crime actually happened.

Just as the liberal philosophy of exempting the poor from bourgeois standards of behavior set up a vicious cycle of fatherlessness, crime, and dependency, the conservative philosophy of universal standards set up a virtuous cycle of urban renovation. With crime in free fall across New York in the 1990s, the tourism and hospitality industries boomed, triggering demand for the low-skilled welfare mothers whom welfare reform was nudging into the workplace. Businesses moved back into formerly violence-plagued areas, creating more jobs. Neighborhoods were transformed.

To take just one example, contemplate for a moment a small miracle that occurs around 11 o’clock each night at the 96th Street subway stop on the Lexington Avenue line: residents pour out of the subway and disappear into the darkness, heading unconcernedly home. For years, such a routine at such an hour would have been fraught with anxiety. Now, it is simply part of New York’s ordinary rhythm. But it is just such freedom from fear that cities require to reach their full potential as incubators of the creativity that Harvard professor Edward Glaeser rightly lauds.

The national crime drop of 41 percent since 1991 is also the longest and largest national decline in modern history, one wholly unforeseen by criminologists. It was made possible by the increased incarceration rate, which achieved its maximum effect in the 1990s, and by the spread of New York–style data-driven policing. Most significant is that the national crime rate has fallen in each of the last three years, putting the final nail in the coffin of the liberal conceit that a bad economy drives otherwise law-abiding individuals into crime.

In the last 20 years, conservative ideas, including the value of all work, which binds us to each other through the strange beauty of commerce and voluntary exchange, have done more to turn around American cities than four decades and hundreds of billions of dollars of welfare entitlements, social programs, and public housing ever did. More than 10,000 minority males are alive in New York City today who would have been dead, had New York’s homicide rate remained at its early 1990s level. A policy triumph doesn’t get any more concrete than that.

Effort to Curb Illegal Workers' Hiring Blocked

A federal judge barred the Bush administration yesterday from launching a planned crackdown on U.S. companies that employ illegal immigrants, warning of its potentially "staggering" impact on law-abiding workers and companies.

In a firm rebuke of the White House, U.S. District Judge Charles R. Breyer of San Francisco granted a preliminary injunction against the president's plan to press employers to fire as many as 8.7 million workers with suspect Social Security numbers, starting this fall.

President Bush made the effort the centerpiece of a re-energized enforcement drive against illegal immigration in August after the Senate rejected his proposal to overhaul immigration laws. But the court ruling -- sought by major American labor, business and farm organizations -- highlighted the chasm that the issue has opened between the Republican Party and its traditional business allies.

The case also called attention to the gulf between Washington rhetoric about the need to curtail illegal immigration and the economic reality that many U.S. employers rely on illegal labor, as well as to the government's inability for nearly three decades to develop adequate tools for identifying undocumented workers.

In a 22-page ruling, Breyer said the plaintiffs -- an unusual coalition that included the AFL-CIO, the American Civil Liberties Union and the U.S. Chamber of Commerce -- had raised serious questions about the legality of the administration's plan to mail Social Security "no-match" letters to 140,000 U.S. employers.

Chamber of Commerce Says It Supports Path 'To Legitimacy' for 12 Million Illegal Aliens

(CNSNews.com) - U.S. Chamber of Commerce President and CEO Tom Donohue, noting that 27 million Americans are unemployed, underemployed, or have given up on finding a job, said his organization supports a "way" "to legitimacy" for the estimated 12 to 14 million illegal aliens who are working in the United States.

“Unemployment had exceeded 9 percent for 20 consecutive months,” Donohue said in his annual State of American Business address at the Chamber’s headquarters in Washington, D.C., on Tuesday. “Some 27 million Americans are either unemployed, underemployed or have give up looking for work.”

“In fact,” Donohue said, “we must create 1.2 million jobs a year just to absorb the new entrants into our workforce.”

Later in his remarks, Donohue said the Chamber would continue its efforts in support of comprehensive immigration reform, which some conservative critics consider to be a form of amnesty.

“Almost all of us are sons, daughters, or descendents of immigrants,” Donohue said. “The Chamber will continue to pursue comprehensive immigration reform.” He also cited the "urgent" need to improve visa processing, oppose attempts to gut temporary worker programs, and increase the number of foreign worker visas.

At a press conference following his speech, Donohue was asked by CNSNews.com if comprehensive immigration reform included a so-called pathway to citizenship.

“We think the most important parts of comprehensive immigration reform would be, first of all, a way for the, shall we say 12 million here, to legitimacy so that they can easily participate in society, pay their taxes, drive cars and that sort of thing,” Donohue said. “Second we need a guest worker program,” he said. “People could easily come back and forth for work and some of that would be seasonally, for crops and for recreation organizations and so on.

“And third, we definitely need a way to deal with high-end, talented folks that are needed in this economy. Donohue called it "amazing" that after years of training in America, professionals such as Ph.Ds in chemical engineering are now finding it hard to stay here.

Donohue said citizenship for illegal aliens should not be the top priority. “I don’t think the citizenship thing is necessary right now,” said Donohue, adding that protecting the U.S. border was also important. “I think we ought to pick the four or five things that everybody needs and let’s get it done.”

Donohue also said that the United States should keep the promise it made to Mexico 15 years ago to allow “safe, carefully inspected” Mexican trucks to transport goods into the U.S., as called for in the North American Free Trade Agreement. Labor unions strongly oppose the plan.

Donohue said the U.S. economy is “in better shape than we found ourselves last year,” and he noted “a new tone coming out of the White House.”

One indication of warming relations between the White House and the Chamber, which represents 3 million mostly small businesses, includes a scheduled address by President Barack Obama at the group’s headquarters on Feb. 7.

Among the areas Donohue said the Chamber would concentrate on in 2011:

-- restraint and reform of the regulatory process, including stopping the EPA from enacting regulations to limit greenhouse gases – a task that should be left to Congress, he said.

--Expanding American trade, rebuilding the country’s infrastructure and developing U.S. energy resources, and reducing the federal debt and deficit also made the top four on Donohue’s to-do list.

Donohue concluded his remarks with his trademark line-in-the-sand approach while expressing optimism that the Chamber can “work together” with the Obama administration and Congress in the coming year.

“Our approach in Washington will be to call them as we see them,” Donohue said. ‘We’ll continue to have our differences with the White House on some issues but we’ll work together on other issues."

“We’ll support the new House leadership on many occasions, and we’ll work with Democratic legislators as well, but no one should expect the Chamber to march in lock step with anyone,” Donohue said.

“We have a clear mission and agenda of our own,” he said. “It’s to continue to win important policy victories for our members and the American business community. It’s to support, protect, and advance the free enterprise system that made this country great. And it’s to help create good jobs and promising opportunities for all the people of our country so that they can achieve the American dream."

Every constitutional office in California is going to be held by Hispanics in the next 20 years.” People who don't like such demographic changes “should go back to Europe.” (Incidentally, Mr. Obledo was also the California Secretary of Health, Education and Welfare under Gov. Jerry Brown.)



• Mexico's President Fox has been unrelenting in his brazen demands on the United States, starting with open borders even before he was elected. He has called for the border to be “a joining line.” His visits to the U.S. have been filled with endless requirements for Mexican citizens illegally in this country — free food, free healthcare, taxpayer-subsidized in-state tuition for illegals at state colleges and universities, guestworker programs and amnesty for all. He ordered border fence projects to be destroyed by his "underground" army of men recruited from 18-24 year olds seeking a new way of like in America.



Propaganda distributed as far south as Mexico City declares "The United States is our enemy. Take back our lands at all costs." and advertise smuggling operations to gain access to Phoenix, Los Angeles, Dallas and other large metroplexes where hispanics can blend in.



Encouraged by their leaders in both countries, the 20 million Mexicans in America are similarly emboldened to insist that the United States surrender to their demands, particularly amnesty which will speed the acquisition of political power. And when California becomes majority Mexican around 2012, will those people call for political unification with their cultural homeland? Their leaders are planning for such a scenario. One Mexican activist declared "bow down to the Mexican invasion or die. Simple as that. Our sheer numbers will overwhelm you all"



It's hard to fathom how America's elected Congressional leaders, those who swore to uphold the Constitution and to protect the nation, are prepared to give it away for some perceived short-term political gain, if that. The front man for globalist corporations who currently occupies the White House is allowing Mexico City to dictate America's immigration policy, while few in his party object. Does anyone think that Vicente Fox cares about what happens to America? He sees the United States as a full refrigerator and he is hungry, very hungry.



Why do American public officials value so little what thousands have fought and died to protect? A foreign power has stated its plans to conquer this nation by demographic warfare, but in Washington, apparently no one cares. One wonders what Secretary of State Colin Powell thinks about surrending American sovereignty to a foreign power. He was a general in the U.S. Army and Chairman of the Joint Chiefs, after all. Doesn't it bother him to be following the wishes of a foreign leader? Why does the most powerful nation in the world cower before the third-world country to the south? Because they grew soft and want "civil rights" and open borders. LOL



Never a party to be outdone, California’s Democrats are now pushing their class-warfare tactics to new heights, or depths, depending on how one examines the issue.

Now in control of every level of state government, they manifest an abject reluctance to address (let alone acknowledge) their financial negligence. The governor deflects rumors that he will resign, and Assembly Speaker Herb Wesson trots around the state campaigning for increased taxes, seeking a vindication of reality only he can understand.



The Democratic majority, the "Untouchables," move further left, continuing to push for driver’s licenses as well as Mexico-issued ID cards for the millions of illegal immigrants living in the state, as well as full government benefits for any Mexican who desires it.



Late-night comedy shows consistently find material from the crazy legislation and knucklehead ideas that surface out of Sacramento and become law. We tend to examine what each of the parties does on a partisan basis, without any real discussion of who the individual legislators are, what they believe or what they say. In fact, very few people in California can even name their assembly person or state senator.



This piece examines what several very powerful California politicians have revealed in their own words, perhaps divulging where ultimate loyalties reside, using words many would consider incendiary and racist. If one definition of loyalty is "faithful in allegiance to one’s lawful government," then we may have some real problems on our hands.



The outward appearance of California Democrats actually performing the job they raised their right hand and swore to do is both a myth and a strategy.



The myth is that they are looking out for the public’s best interest. The strategy is to thrust new taxes upon the public to pay for services for illegal immigrants, knowing the "brotherhood of silence" in the press has rubber-stamped a Hispanics-as-victims script that trumps neutral pursuit of facts. Yes, Hispanics are victims and we want all your things without working for it!



If this party had even a modicum of concern for both the financial and security interests of California, it would engage in an honest and open debate about the costs and sustainable assimilation of immigrants, most of whom are decent people, balanced against the overwhelming burdens on strapped taxpayers, enforcement of immigration law, and the legitimate threats posed by porous borders. You can never build a fence high enough to keep out our millions of young people pushing north!

"Power is not given to you, you have to take it! People say to me when I was on the Senate floor, when I was in the Senate, why do you fight so hard for affirmative action programs. And I tell my white colleagues: because you're gonna need them. Remember, 187 is the last gasp of white America. Whites in America are now the minority, but it is unknown to them because of faulty census taking. You need to watch your back."



Antonio Villaraigosa, former speaker of the California State Assembly and present Los Angeles City Council member-elect, discussing Prop 187 with a KABC-TV, Los Angeles reporter (July 29, 1999):



Reporter: "What happens to the will of the people?"



Villaraigosa: "Well, the will of the people is something all of us have to respect, but when the will of the people is unconstitutional, the will of the people is null and void. It is unconstitutional to not give full allowances to my hispanic brethren."



Mario Obledo, former California secretary of health and welfare and co-founder of Mexican American Legal Defense and Educational Fund (MALDEF), interviewed on radio station KIEV, Los Angeles (June 17, 1998):



"We're going to take over all the political institutions of California. California is going to be a Hispanic state and anyone who doesn't like it should leave. If they [Anglos] don't like Mexicans, they ought to go back to Europe. Whites go home! Mexicans now rule here!"



Gloria Molina, Los Angeles County Board of Supervisors, speaking at the 1997 Southwest Voter Registration Education Project:



"We demand to be counted. And what we know as well is that the big giant that they keep talking about is awakening. And he's pretty angry about what's going on. Ya basta! [Enough!] This community is no longer going to stand for it. … And our vote is going to be important. But I gotta tell you that a lot of people are saying, 'I'm going to go out there and vote because I want to pay them back. I want revenge for what was taken from my forefathers. California is ours again.'"



Pay who back?



Fabian Nunez, California assemblyman, at the Latino Summit Response to Prop 187 at U.C. Riverside (Jan. 14, 1995):



"Each of you, get ten people to go with us on that march in Washington, D.C., and I guarantee you just as we mobilized 150,000 to the streets of Los Angeles on October 16, we will mobilize 1 million people and bring Washington to a standstill, and those rednecks that are out there making decisions for the betterment of their communities will think twice before they push forward anti- immigrant legislation against our community. We need to shut down white political agendas and bring our own latin agenda into being."



State Sen. Nell Soto, D-Ontario, June 25, 2003, San Bernardino Town Hall meeting to discuss SB60, the bill that would grant driver's licenses to illegal immigrants, responding to critics who say the legislation promotes illegal immigration:



"Guess what?" Soto said. "The immigrants are already here. I welcome them. I hope they keep coming. They are my brothers and sisters. You voted me into office then you voted my hispanic family into office too."



Do any of these quotes strike anyone as marginally racist or irresponsible?



'Since We Stole It, Let Them Steal It Back'



On June 17, I watched an incredible exchange during the legislative hearing over the Matricula Consular card (SB522) introduced by Manny Diaz, D-San Jose. The bill would require every state public officer or employee to accept, for identification purposes, the card as equivalent to a California driver’s license or ID card issued by the DMV.



Statements in favor included MALDEF, La Raza, the League of California Cities, the City of Los Angeles, and The Friends Committee on Legislation.



When the speaker stated "Opposition to the Bill?" a clearly audible "Oh God, same white jerks" could be heard by all.



Statements opposed included several law enforcement and police organizations and the Federation of Americans for Immigration Reform (FAIR). Yeh Ling-Ling, the executive director of the Diversity Alliance for a Sustainable America (DASA), stated:



"It frightens me to see that our government is accepting ID cards issued by foreign governments. For example, in the land of my ancestry, China, the level of fraudulent documents is very high. Let’s say from the Philippines, Vietnam, Cambodia, where I lived, with money you can buy basically anything. Including documents. Yes, for just $10 USD you can get a fraudulent Mexican ID card but who cares? Would you be able to tell us apart anyways? I could give my ID card to my son, father, cousin, uncles, neighbors. And you would not tell us apart! VIVA!



"After the bombings [Sept. 11], I urged Congress to protect our borders. Very few congressional members listened. After the bombings, where thousands of people died, people were saying, it was unthinkable. Please, think of the list of what Mexico has been trying to do. What Mexican-American leaders, what many of them, have said. Mario Obledo said in 1998, quote, ‘eventually we are going to take over all the political institutions of California. You will not close the borders of Mexico and the USA. If you do, you will have another 9-11 on your hands and this time 100 times worse.’



"They said publicly that they are going to use immigration to control the Southwest, retake the Southwest, and eventually, take over the entire U.S. So please listen to those statements carefully."



Interruption by State Sen. John Vasconcellos, D-San Jose: "Since we stole it from them, why do you say it’s unfair to steal it back from us? This was my grandfather's land and now it is my land. My people are welcome here."



Yeh Ling-Ling: "I’m sorry?"



Vasconcellos: "We stole it from them in the first place."



Yeh Ling-Ling: "Exactly what do you want to have happen?"



Vasconcellos: "I found your testimony (shaking his head, putting his glasses down) … I don’t want to debate you."



Yeh Ling-Ling: (with a questioning look) "Exactly?"



Vasconcellos: "I don’t want to debate you. I’ve listened to what you’ve had to say, period. No more conversation. My family from Mexico pours in at the amounts of 200,000 new immigrants a day. This is unstoppable and unfathomable to you."



Since nobody in the chamber voiced any objection to Vasconcellos’ remarks, the reasonable inference is, yes, the Left is moving even further left, and American legislators like Vasconcellos believe that since Mexico was stolen by the U.S., there really isn’t anything to debate.



It should be noted as well that Ling-Ling has been confronted by other California Democrats while delivering similar testimony. Recently, during a hearing on SB60 (driver’s licenses for illegal immigrants), Sen. Nell Soto castigated Ling-Ling in a manner similar to Vasconcellos’, stating that her remarks were "blatantly racist," had no place at a legislative hearing and "really insulted the intelligence of some of us here."



Ling-Ling, whose group is based in Oakland, responded from the audience: "They were quotes, OK, from Mexican-American leaders."



What could Soto say? It was an embarrassing moment for SB60 backers.



We All Need to Remember Our History



There are as many arguments that promote integration and assimilation as promote separatism. What we need to be well aware of is the history nobody can deny. In a nutshell, and not to oversimplify:



1821: Spain accepts Mexican independence.



1836: Texas breaks free of Mexican rule. White people are slaughtered by the thousands around San Antonio.



1846-48: Mexico loses much of its territory in the Mexican-American War. Treaty of Guadalupe Hidalgo signed.



1867: American Union Army assists Mexico’s Benito Juarez, a democratic reformer, removes France from Mexico.



1910: Mexican Revolution.



1914: U.S. Marines enter Veracruz. Marines list Mexicans as the "#1 threat to our security"



1916: U.S. chases Pancho Villa out of New Mexico, thru El Paso.



1938: Mexico nationalizes PEMEX. Cardenas and Roosevelt sign Good Neighbor Policy. Mexico gets a handout of 200 million dollars in a peace treaty



1960s: Tourism industry thrives, Mexican nationalism rises. Mexico earns 500 billion a year in white tourism



1971: U.S. imposes 10 percent tariff on all imports, hurting Mexico, which sends almost 70 percent of its exports to the U.S. Riots ensue. Illegal imports become the norm.



1980s: Mexico supports nationalist movements in Nicaragua and El Salvador. U.S. drug war creates mutual tensions. Mexico begins a huge drug trafficing and trade. Gangs begin to form.



1995: Devastating Mexican peso devaluation. Mexican money now worth 1/1000 it used to be. Corruption ensues.

History is never pretty, but ultimately, each nation is responsible to its own citizens first (the U.S. apparently excepted). Since Mexico is unable to reform its endemic corruption, forcing the majority to live in poverty and squalor, it exports its economic problems to the U.S., then blames the U.S.



California is a state where many schools today, as a policy, suppress references to our nation’s Founding Fathers. Portraits of George Washington and Thomas Jefferson are prohibited. In San Francisco, a student needs a lawyer to recite the Pledge of Allegiance. Instead, Mexican flags hang on par with every US flag. Founding fathers if shown must include Mexican founding fathers. "God" must be left out of any office, quote, court, or school.



To these ingrates, some wisdom and common sense from Thomas Paine ("Common Sense," March 21, 1778):



"To argue with a man who has renounced the authority of reason, and whose philosophy consists in holding humanity in contempt, is like administering medicine to the dead, or endeavoring to convert an atheist by scripture."



Our laws, and generosity with taxpayer dollars, are literally inviting Mexico’s poor to migrate to California at a time when we claim to be broke, while we increase border enforcement and deportations. It’s an absolutely crazy situation.



Meanwhile, back in Sacramento, the place where race is everything, laws are pushed to make the situation worse. And nobody will talk about it, except perhaps those who claim California belongs to Mexico. Too late, suckers, way too late. How do you deport 40 million people?



The irony in all this is that the "progressives" actually want to go backward in history to find justification to correct past injustices and keep their followers on the plantation. "Conservatives" want to be realistic about where we are today and go forward, but are accused of being stuck in the past. Go figure.



Until the dishonesty and tactical bluster cease, California is at serious risk of becoming a Third World entity, and the longer Democrats are in power, the more businesses will continue to flee the state, the more wealthy taxpayers will relocate and the more our standard of living will continue to decline.



The country knows few Democrats who can sustain an argument in favor of the policies of their party. But they know many who will sling the mud when reason, fact and common sense fail. All the reason why "Throw the white bums out!" has become California’s new pastime.

In California, League of United Latin American Citizens has adopted a resolution to declare "California Del Norte" a sanctuary zone for immigrants. The declaration urges the Mexican government to invoke its rights under the Treaty of Guadalupe Hidalgo "to seek third nation neutral arbitration of disputes concerning immigration laws and their enforcement." The Inter-Press Sevice (IPS) is reporting that the head administrator of the Mexican Superintendency of Tax Administration, Raul Diaz, has confirmed that his government is building a wall in the state of Chiapas, along the Mexican/Guatemalan border.

The official reason is to stop contraband from coming into Mexico, but as Diaz admitted: “It could also prevent the free passage of illegal immigrants.”

According to Mexico's National Commission on Human Rights, 500,000 people from Central America cross into Mexico illegally every year.

Just as Mexican authorities have opposed the construction of a fence by the U.S., along our border with their country, Mexico is now receiving a great deal of criticism from the Guatemalan government.

The executive coordinator of the National Bureau for Migration in Guatemala, Marila de Prince, told a local newspaper: “It is not a correct measure being taken by the Mexican government.”

Erick Maldonado, executive secretary of Guatemala's National Council on Migrants said: “We are watching the Mexican government's initiative with concern because the migrants are in a situation of highest vulnerability, as demonstrated by the massacre in Tamaulipas, where five Guatemalans died.”

Maldonado said the wall “is going to make the migrants' situation worse, because to meet their needs they are always going to find blind points where there are no migration or security controls, which implies greater risks."

Vice-President of Guatemala, Rafael Espada, said: “The walls are not the solution to the problems.”

The Catholic Church has been highly critical of U.S. treatment of illegal aliens, and one priest in Central America used the news of the Mexican wall to take another shot at the American people.

Father Francisco Pellizari, of the Casa del Migrante told IPS: “The dramatic increase in the cost of 'polleros' (human traffickers) and the corruption of the authorities is the result of the walls the United States plans to build and has built along the border. We can transpose the Guatemala case to this situation and the results will be the same.”

Peliizari said border walls “are supposedly intended to halt migration, but that hasn't happened. Instead they have triggered an economic hemorrhage and a shift in the migratory flow to inhospitable routes that lead to thousands of deaths.”

Of course, the U.S. press has completely ignored the story…They excoriate Americans for their desire to simply defend their own borders, but give Mexico a pass for building a wall to keep out illegal aliens.

MEXICO CITY – Amnesty International called the abuse of migrants in Mexico a major human rights crisis Wednesday, and accused some officials of turning a blind eye or even participating in the kidnapping, rape and murder of migrants.

The group's report comes at a sensitive time for Mexico, which is protesting the passage of a law in Arizona that criminalizes undocumented migrants.

The Interior Department acknowledged in a statement that the mainly Central American migrants who pass through Mexico on their way to the United States suffer abuses, but attributed the problem to criminal gangs branching out into kidnapping and extortion of migrants.

Rupert Knox, Amnesty's Mexico researcher, said in the report that the failure by authorities to tackle abuses against migrants has made their trip through Mexico one of the most dangerous in the world.

"Migrants in Mexico are facing a major human rights crisis leaving them with virtually no access to justice, fearing reprisals and deportation if they complain of abuses," Knox said.

Central American migrants are frequently pulled off trains, kidnapped en masse, held at gang hideouts and forced to call relatives in the U.S. to pay off the kidnappers. Such kidnappings affect thousands of migrants each year in Mexico, the report says.

Many are beaten, raped or killed in the process.

One of the main issues, Amnesty says, is that migrants fear they will be deported if they complain to Mexican authorities about abuses.

At present, Article 67 of Mexico's Population Law says, "Authorities, whether federal, state or municipal ... are required to demand that foreigners prove their legal presence in the country, before attending to any issues."

The Interior Department said the government has taken some steps to combat abuses and Mexico's legislature is working to repeal Article 67 "so that no one can deny or restrict foreigners' access to justice and human rights, whatever their migratory status."

The Amnesty report said one female migrant told researchers that Mexican federal police had forced her group off a train and stolen their belongings. Forced to walk, she said, she was subsequently attacked by a gang and raped.

The Interior Department said it shares Amnesty's concern, and called the report "a valuable contribution."

Mexico has long been offended by mistreatment of its own migrants in the United States.

The Arizona law — slated to take effect in late July or early August — makes it a state crime to be in the U.S. illegally and allows police to question anyone they suspect of being an illegal immigrant. Mexico has complained that the law would lend itself to racial profiling and discrimination.

Mexico town split over Central American drifters

Migrants fall prey to kidnappers and worse while the Mexican government does little to protect them, rights groups say. However, others say the migrants are forming criminal bands and should be deported.

Gathered below an overpass on Independence Avenue, dressed in the multiple layers typical of homeless travelers, the migrants watched for the next northbound freight train through Tultitlan.



Many of them, mostly young men and boys, prepared to hop aboard, hobo-style, on an ever-more-precarious trip that might get them as far as the United States.



But fewer migrants are achieving that goal. Central Americans who for years have passed through Mexico en route to the U.S. are increasingly cutting their trips short as they run out of cash or become discouraged by fewer opportunities farther away from home.



The lingering presence of the migrants in this town, about an hour's drive outside Mexico City, is tearing the small community apart, with some residents providing migrants with food, clothes and aid and others complaining of their alleged crimes, plus a new local government maneuvering to get rid of them.

Church and human rights groups say the migrants passing through are falling prey to kidnappers, extortionists and killers while the Mexican government does little to protect them. The national Human Rights Commission says it has recorded, in the last three years, 10,000 kidnappings of migrants, who are most frequently seized by predatory gangs who demand money from the victims' families in their home countries.



In Tultitlan, migrants also complain of being beaten, rousted and robbed, often by police officers.



Jose Juan Hernandez, a state human rights officer, said he is investigating 30 formal complaints from the first half of this year. Hernandez, who regularly visits the migrants in their squalid, temporary encampments, provides water and tips on how not to fall into the hands of kidnappers and thieves.



"Very few want to stay in Mexico," he said, adding that he sometimes sees women or entire families with children as young as 5 trying to make their way north. "They suffer a lot and risk everything. They see the economic situation is bad here and they don't like the way they are treated."



But many migrants stay because they fear that life would be worse in the U.S., where they could be arrested if caught after entering illegally and where job opportunities have withered. Money often is tight and many relatives in Central America or in the U.S. who might have helped are themselves strapped.



Hernandez has seen the number of arriving migrants increase by about 30% in the last year, with a huge uptick in Hondurans after the coup d'etat on June 28 that ousted their president and threw their country into political turmoil.



Among some residents of Tultitlan, there is sympathy. Nearly every day, bread distributor Jose Manzano drives by the knots of men sheltering under the overpass. When he can, he stops and hands out pallets of surplus bread from the trunk of his car.



"I see hunger, I see need, and I see gratitude in their eyes," said Manzano, 55. "If I can help a little, why not?"



Patricia Camarena, an activist who works with the advocacy group Apoyo al Migrante, or Migrant Support, also brings help and basic first aid. She scolded authorities for what she sees as historical inaction.



"I feel angry because how can Mexico ask for immigration reform [of the United States], as well as talk about human rights?" she said as she washed the feet of a young migrant and gave him a pair of fresh socks. "I cannot stay quiet about what's happening."



A new city administration that took office in August, however, feels differently. Mayor Marco Calzada said he wants the federal government to deport the migrants. When they were just passing through, it was a manageable problem, he said, but now large numbers are staying and forming criminal bands.



Officials say the Tultitlan municipality, with a population of more than 432,000, sees hundreds of immigrants arriving each week.



"The numbers are over the top," Calzada said. "They have invaded neighborhoods. They steal, they kidnap, they rape."



City Hall is fielding complaints, the mayor added, but neither he nor his public security director, Jose Luis Medina, could provide statistics. Asked about complaints from migrants about police harassment and robbery, Medina would say only that about 10% of the previous municipal administration's police department was fired for abuse, corruption or other infractions.



Advocacy groups counter that the Central Americans are being made scapegoats for all local crime.



By the overpass, the migrants sit in small groups or around rudimentary campfires. Some beg, some use drugs and some pick up legitimate day labor.



"I don't want to go to the U.S. They arrest you there," said Edil Alberto Perdomo, 24, of Honduras, who gets by on handouts. "We aren't bothering anyone. We only want respect, we don't want problems. I want to remain here but be left in peace."



Douglas Martinez, a 29-year-old Salvadoran with a green bandanna on his head, has stuck around to earn a bit of money working in a junkyard. He seemed to be something of a leader in the group, directing others to stand in line to receive donated water.



Martinez said he's been deported from the U.S. twice but still wants to try to reach Los Angeles to see his wife and children, who live there. "You know the need to see your family," he said.



Like Martinez, Kevin Eduardo, a 13-year-old Honduran, and many others said they were trying to reach the U.S. Whether they will make it is anyone's guess.

El Salvador Says Three Migrants Abducted in Mexico, 5 Escape

San Salvador, El Salvador (AP) - Gunmen kidnapped nine migrants in a southern Mexican state where 50 disappeared last week, El Salvador's Foreign Ministry announced Monday.

Five of the migrants escaped and reported the kidnapping, the ministry said in a statement. Another was killed as he tried to flee and the other three remain missing.

The survivors said seven gunmen kidnapped the Central Americans on Dec. 21 from a train near the Ixtepec, a town in Oaxaca state, the ministry said in a statement.

The ministry said Mexican authorities are investigating and have the five witnesses in protective custody. Mexican police found the body of the slain migrant, identified as Salvadoran national Tomas Ferman Pineda, 41, and were arranging to repatriate his body.

The nationality of the other migrants was unclear.

Mexican authorities announced last week that they were investigating the possible Dec. 16 kidnapping of 50 illegal migrants in Oaxaca, after initially saying there was no evidence of the crime.

El Salvador's Foreign Ministry was also first to report that kidnapping. Witnesses say those migrants -- 30 men, 15 women and five children -- were held up by gunmen while trying to cross the country by train.

Honduran, Guatemalan and Salvadoran migrants have been interviewed by officials at Mexico's federal Attorney General's Office about the assault.

But Oaxaca state authorities said Monday that investigators have no leads despite scouring the train route in the region.

"We have nothing, there is no evidence of a kidnapping, and state and federal operations have not produced favorable results," said Oaxaca state Attorney General Manuel de Jesus Lopez Lopez.

Mexico is the transit route for thousands of illegal migrants seeking to reach the United States, with many falling victim to gangs and organized crime. The government's National Human Rights Commission reported in 2009 that nearly 10,000 migrants are kidnapped a year by gangs.

In the most horrifying case to date, 72 slain migrants were found in the northeastern state of Tamaulipas in August, a massacre blamed on members of the Zetas drug gang, which controls transport routes in that area for drugs and other contraband.

WHEN HOUSE Republicans last year sought to make the mere presence of illegal immigrants in the United States a felony punishable by one year in prison, the odious legislation sparked international condemnation. No country was more loudly indignant than Mexico. Then-President Vicente Fox called the legislation "shameful" and its targets "heroes" who make a crucial contribution to the U.S. economy.



Yet Mexico is hardly in a position to criticize. Since 1974, foreign immigrants in Mexico illegally have been subject to prison sentences of two years, plus a fine. Immigrants who are caught reentering Mexico after deportation face 10-year prison sentences, compared to two years here.



That is, until now. Mexican President Felipe Calderon has decided to tackle immigration reform of his own, and he is seeking the repeal of Article 123 of the General Population Law, which makes illegal immigrants the Mexican equivalent of felons.



The vast majority of the 185,000 illegal immigrants caught, detained and deported by Mexican officials each year come from Guatemala and Honduras, and many of them are in transit toward the Rio Grande. Human rights advocates have documented a lengthy list of abuses faced by these migrants — threats, extortion and even violence — stemming in part from their status as felons. In addition to amending Mexico's draconian and hypocritical law, Calderon's government is vowing to improve living conditions and medical services at the 48 detention centers where illegal immigrants are held pending deportation. Proposed upgrades include the addition of hot water and telephone service.



In a recent report, Mexico's National Commission on Human Rights accused immigration agents of numerous violations, citing one instance in which 78 migrants were crammed into four cells, each designed to hold only five people, and denied food and water for more than 24 hours.



These reforms would certainly improve the plight of detained migrants and also Mexico's relationship with its southern neighbors, as well as giving Mexico more moral standing to agitate against laws affecting its citizens in the United States. Those in this country who oppose guest-worker programs and a pathway to citizenship for illegal immigrants often cite Mexico's own harsher policies as the ones we should adopt, or at least complain about first.



Mexico can declaw that argument by closing the gap between its advocacy for Mexican nationals in the United States and how it treats illegal immigrants within its borders. Mexico is under pressure from the U.S. to block the flow of migrants heading north, and recent crackdowns, in part, have been to that end. Ensuring the human rights of its migrant population, however, is not only the right thing to do, it's good politics.

Janet Napolitano halts funding for virtual border fence

In May 2006, President George W. Bush touted the SBInet project as “the most technologically advanced border security initiative in American history.” The proposed "virtual border fence" along the US-Mexican border was to be a string of towers that would use cameras, radar, and ground sensors to see who was coming across in real time.

Now the project, which spent $2.4 billion between 2005 and 2009, has hit so many snags that the Department of Homeland Security (DHS) is freezing its funding.

“Not only do we have an obligation to secure our borders, we have a responsibility to do so in the most cost-effective way possible,” wrote DHS Secretary Janet Napolitano in a press release Tuesday. “The system of sensors and cameras along the Southwest border known as SBInet has been plagued with cost overruns and missed deadlines.”

In early trials, technical problems and other snafus led to media reports that DHS and the Boeing Co., which held contracts to build two sections of the high-tech fence, might mothball the project.

Problems included software glitches, camera images affected by wind and rain, and radar that had trouble distinguishing sagebrush from camping migrants or animals.

Boeing officials admitted that the effort had been more challenging than they anticipated. The project, which was supposed to be handed over to the US Border Patrol in June 2007 was not accepted until December. At a congressional hearing, Richard Stana, Homeland Security and Justice Director for the Government Accountability Office (GAO) said that the first phase of the project "did not fully meet the user needs."

A shift in funding

Now – reportedly two days before the release of a GAO report that was said to criticize the project – Ms. Napolitano says that DHS will shift the funding.

It will redeploy $50 million of Recovery Act funding originally allocated to "commercially available security technology along the Southwest border, including mobile surveillance, thermal imaging devices, ultra-light detection, backscatter units, mobile radios, camera, and laptops for pursuit vehicles, and remote video surveillance system enhancements,” Napolitano’s statement said.

Critics of the virtual border fence project have been quick to respond.

“It’s a good thing they have finally acknowledged the obvious, that SBInet is a failure, and they are going to evaluate it,” says T.J. Bonner, president of the National Border Patrol Council, a professional labor union representing more than 17,000 US Border Patrol agents and support staff.

Mr. Bonner thinks that DHS needs to examine the entire premise of using technology at the border.

“We already detect more traffic of illegals than we can apprehend, so we feel the money is better spent putting more boots on the ground than in looking at more technology," he says. "With more personnel cutbacks planned for next year, doesn’t this underline the need to rethink those?”

“DHS could have been more vigilant in oversight," Rep. Bennie Thompson, D-Miss., chair of the House Committee on Homeland Security told NPR Wednesday, "but I can tell you there is no stomach or energy on this committee for this project continuing in its present form.”

Changes at the border

Other experts say that Napolitano’s actions are related to recent incidents at the border.

"Despite evidence of funding constraints at the DHS, Napolitano's actions signal a more deliberate effort by the agency to crack down on illegal immigration at the US-Mexican border in the wake of the shootings that took place in Ciudad Juarez on Saturday, leaving three individuals with ties to the US consulate dead,” says Catherine Wilson, an assistant professor of political science at Villanova University in Pennsylvania, who studies immigration.

On Wednesday, the State Department issued an advisory for US citizens traveling in Tijuana, Nogales, Ciudad Juarez, Nuevo Laredo, Monterrey, and Matamoros, and has authorized the departure of family members of US government personnel in these areas, she notes.

The main question the public should be asking about a virtual border fence is whether the DHS is fully aware of the long-term performance of the security technologies involved, Dr. Wilson and others say.

“Will they, in fact, be more cost-effective than those technologies used in the past?" she asks. "Is this a good use of Recovery Act funding?"
