Supreme Court Hears Challenge to Arizona Immigration Law -- The One Signed by Former Gov. Janet Napolitano

(CNSNews.com) – Arizona’s Republican Gov. Jan Brewer came to the U.S. Supreme Court on Wednesday to hear arguments on an Arizona immigration law signed in 2007 by then-Arizona Gov. Janet Napolitano, a Democrat.
Both governors signed laws that the Obama administration opposes. Napolitano is now part of the Obama administration, serving as Homeland Security Secretary.
The law signed by Napolitano in 2007 (HB 2745) sanctions employers who knowingly hire illegal aliens, and it also requires employers doing business with the state of Arizona to use the federal government’s E-Verify database to confirm the legal status of workers.
Napolitano called the bill “flawed” but signed it anyway on July 2, 2007 because – as she said at the time – “It is now abundantly clear that Congress finds itself incapable of coping with the comprehensive immigration reforms our country needs.” In the same 2007 statement, Napolitano said the flow of illegal immigrants into Arizona was “due to the constant demand of some employers for cheap, undocumented labor.”
Gov. Brewer told CNSNews.com on Wednesday that the “moccasin” is on the other foot now that Napolitano is President Obama’s Homeland Security Secretary: “When she was governor, she made it very clear that she signed the bill because the federal government was not doing their job, and that’s exactly what the problem and issue is,” Brewer said. “I guess it all…depends on where your moccasins are setting (as) to what your reasoning is.”
Brewer said she’s confident that the Supreme Court will rule in Arizona’s favor, and she said a ruling upholding the 2007 law could be a harbinger for the future of SB 1070, the immigration bill that Brewer signed and which the U.S. Justice Department has challenged.
“I believe the (2007) employer-sanction bill will set a trend or position for states rights, and so I think that if we do win this case, then we will be further ahead with Senate Bill 1070,” Brewer said. “I believe we’re moving in the right direction for Arizona, and I believe we’re moving in the right direction for America.”
SB 1070 allows law enforcement officials who are investigating criminal activities to verify an individual’s legal status if they have probable cause to suspect that individual may be in the United States illegally.
The Justice Department’s case against SB 1070 claims that the Arizona law preempts the federal government’s right to enforce federal immigration law – and the same argument is being used to challenge the 2007 law signed by Napolitano.
The 2007 Legal Arizona Workers Act calls for employers who knowingly or intentionally employ illegal aliens to be fined for the first violation and to have their license suspended or revoked for a second violation.
The U.S. Chamber of Commerce and labor and civil rights groups, including the American Civil Liberties Union, filed suit against Arizona, arguing that the law would be a “death sentence” for businesses.
In arguments before the Supreme Court Wednesday, the plaintiffs not only said the Arizona law preempts the federal government’s right to enforce immigration law, they also argued that the law is not consistent with the federal government’s stance that state participation in the E-Verify program is voluntary. (The federal government does require some employers to use E-Verify, including those who seek federal contracts.)
The Obama administration has assigned one of its top litigators to help the plaintiffs’ attorney argue the case.
In defending the 2007 law, Mary R. O’Grady, solicitor general for the state of Arizona, argued on Wednesday that the 1986 Immigration Reform and Control Act – which made it a federal offense to hire and employ illegal aliens -- reserved the right for states to deal with businesses that operate within that state, including the revocation of business licenses.
O’Grady argued that the E-Verify portion of the law reflects the federal government’s policy of helping states enforce federal immigration law.
A number of conservative groups are backing Arizona’s right to enforce laws that control illegal immigration, including the Eagle Forum Education and Legal Defense Fund and the American Center for Law and Justice (ACLJ).
“The issues at the center of this argument are crucial: whether states can take legislative action to protect their borders and citizens – without being trumped by the federal government,” the ACLJ said of the amicus brief it filed in the case. “The Arizona law complements federal law, and we’re hopeful that the high court will permit Arizona to take the legislative action it desires and its citizens deserve.
“In our amicus brief, we contend the Arizona law is a valid exercise of Arizona’s police powers,” that ACLJ said in its statement on the case. “State laws, like the Legal Arizona Workers Act, that mirror federal immigration provisions and incorporate federal standards promote national policy and should not be preempted.”
The ACLJ, contending that illegal immigration is a serious problem, also argued that the federal government “has proved inadequate to the tasks of enforcing current immigration laws and building consensus toward needed immigration reform.” The federal government has left the states to “cope on their own,” the ACLJ says.
A decision on the Napolitano-signed 2007 law is expected in June.

While in Congress, she opposed strengthening the border fence, supported expansion of illegal alien benefits (including driver's licenses and in–state tuition discounts), embraced sanctuary cities that refused to cooperate with federal homeland security officials to enforce immigration laws, and aggressively championed a mass amnesty. Solis was steeped in the pro–illegal alien worker organizing movement in Southern California and was buoyed by amnesty–supporting Big Labor groups led by the Service Employees International Union. She has now caused a Capitol Hill firestorm over her new taxpayer–funded advertising and outreach campaign to illegal aliens regarding fair wages:
"I'm here to tell you that your president, your secretary of labor and this department will not allow anyone to be denied his or her rightful pay –– especially when so many in our nation are working long, hard and often dangerous hours," Solis says in the video pitch. "We can help, and we will help. If you work in this country, you are protected by our laws. And you can count on the U.S. Department of Labor to see to it that those protections work for you."
To be sure, no one should be scammed out of "fair wages." Employers that hire and exploit illegal immigrant workers deserve full sanctions and punishment. But it's the timing, tone–deafness and underlying blanket amnesty agenda of Solis' illegal alien outreach that has so many American workers and their representatives on Capitol Hill rightly upset.

With double–digit unemployment and a growing nationwide revolt over Washington's border security failures, why has Solis chosen now to hire 250 new government field investigators to bolster her illegal alien workers' rights campaign? (Hint: Leftists unhappy with Obama's lack of progress on "comprehensive immigration reform" need appeasing. This is a quick bone to distract them.)
Unfortunately, the federal government is not alone in lavishing attention and resources on workers who shouldn't be here in the first place. As of 2008, California, Florida, Nevada, New York, Texas and Utah all expressly included illegal aliens in their state workers' compensation plans –– and more than a dozen other states implicitly cover them.
Solis' public service announcement comes on the heels of little–noticed but far more troubling comments encouraging illegal alien workers in the Gulf Coast. Earlier this month, in the aftermath of the BP oil spill, according to Spanish language publication El Diario La Prensa, Solis signaled that her department was going out of its way to shield illegal immigrant laborers involved in cleanup efforts. "My purpose is to assist the workers with respect to safety and protection," she said. "We're protecting all workers regardless of migration status because that's the federal law." She told reporters that her department was in talks with local Immigration and Customs Enforcement (ICE) officials who had visited coastal worksites to try to verify that workers were legal.
No word yet on whether she gave ICE her "we are all Americans, whether you are legalized or not" lecture. But it's a safe bet.

County Spends $600 Mil On Welfare For Illegal Immigrants

For the second consecutive year taxpayers in a single U.S. county will dish out more than half a billion dollars just to cover the welfare and food-stamp costs of illegal immigrants.
Los Angeles County, the nation’s most populous, may be in the midst of a dire financial crisis but somehow there are plenty of funds for illegal aliens. In January alone, anchor babies born to the county’s illegal immigrants collected more than $50 million in welfare benefits. At that rate the cash-strapped county will pay around $600 million this year to provide illegal aliens’ offspring with food stamps and other welfare perks.

THE EXORBITANT FIGURE DOES NOT INCLUDE THE ENORMOUS COST OF EDUCATING, MEDICALLY TREATING, OR INCARCERATING ILLEGALS ALIENS. THIS COSTS THE COUNTY AN ADDITIONAL ONE BILLION DOLLARS.

The exorbitant figure, revealed this week by a county supervisor, doesn’t even include the enormous cost of educating, medically treating or incarcerating illegal aliens in the sprawling county of about 10 million residents. Los Angeles County annually spends more than $1 billion for those combined services, including $500 million for healthcare and $350 million for public safety.
About a quarter of the county’s welfare and food stamp issuances go to parents who reside in the United States illegally and collect benefits for their anchor babies, according to the figures from the county’s Department of Social Services. In 2009 the tab ran $570 million and this year’s figure is expected to increase by several million dollars.
Illegal immigration continues to have a “catastrophic impact on Los Angeles County taxpayers,” the veteran county supervisor (Michael Antonovich) who revealed the information has said. The former fifth-grade history teacher has repeatedly come under fire from his liberal counterparts for publicizing statistics that confirm the devastation illegal immigration has had on the region. Antonovich, who has served on the board for nearly three decades, represents a portion of the county that is roughly twice the size of Rhode Island and has about 2 million residents.
His district is simply a snippet of a larger crisis. Nationwide, Americans pay around $22 billion annually to provide illegal immigrants with welfare benefits that include food assistance programs such as free school lunches in public schools, food stamps and a nutritional program (known as WIC) for low-income women and their children. Tens of billions more are spent on other social services, medical care, public education and legal costs such as incarceration and public defenders.

Anchor Babies Grab One Quarter of Welfare Dollars in LA Co

The anchor baby scam has proven lucrative for illegal aliens in Los Angeles County, at considerable cost to our own poor and downtrodden legal citizenry.

The numbers show that more than $50 million in CalWORKS benefits and food stamps for January went to children born in the United States whose parents are in the country without documentation. This represents approximately 23 percent of the total benefits under the state welfare and food stamp programs, Antonovich said.

"When you add this to $350 million for public safety and nearly $500 million for health care, the total cost for illegal immigrants to county taxpayers far exceeds $1 billion a year -- not including the millions of dollars for education," Antonovich said.

I love children and I'm all for compassion -- smart, teach-them-to-fish compassion. But when laws, the Constitution, and enforcement allow illegal aliens (the operative word here being "illegal") to insinuate themselves into our nation and bleed us of our precious financial resources, then laws, the Constitution and enforcement need to be changed.

Trust Republicans to go too far. They take a good idea -- such as the notion that the federal government should enforce immigration laws, and states should be able to help -- and then drive it into the fringes. Witness a Fox News interview in which Sen. Lindsey Graham, R-S.C., declared, "We should change our Constitution and say if you come here illegally, and you have a child, that child is automatically not a citizen."
Graham has supported a pathway to citizenship for illegal immigrants. He opposed the new Arizona immigration law. So why would he advocate repealing part of the 14th Amendment -- which, by the way, exists because the Grand Old Party wanted to stop efforts to keep freed slaves from becoming citizens?
Graham's right about this much: Illegal immigrants have taken advantage of the law. The Dallas Morning News reported Sunday that 60,000 babies are born annually in Texas to illegal immigrants. Last year, these "anchor babies" accounted for 16 percent of the state's births.
But it's not clear how many illegal immigrants are coming here to have babies as opposed to having babies in America because they are here.
Then there's the recent Washington Post story about "birth tourism" and affluent expectant mothers paying offshore consultants a $14,750 fee to obtain tourism visas that allow them to give birth in the United States and win U.S. citizenship for their babies.
No one likes to see adults game the system. In June, pollster Scott Rasmussen found that 58 percent of voters say a child born to an illegal immigrant should not automatically become a citizen of the United States.
But there are better ways to deal with those abuses. Direct the State Department to deny visas to would-be birth tourists. Keep the heat on employers who knowingly hire illegal workers. The new Arizona immigration law is designed to achieve "attrition through enforcement." Deport more adults who, unlike children, knowingly break the law.
But some Republicans want to keep going. Rep. Lamar Smith, R-Texas, is arguing that the 14th Amendment does not and never did confer automatic birthright citizenship.
Section One states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
"There are two elements, birth and subject to the jurisdiction," Chapman University Law School Dean John C. Eastman told me. "For about 50 years, we've just assumed birth was all you needed." But a review of the original debates and early court cases demonstrates a recognition that parents had to "show allegiance." If they broke federal law, they "never qualified" as being under U.S. jurisdiction.
This is where the argument gets dicey. Eastman has argued that a child born to a Saudi in the United States on a temporary student visa was not under U.S. jurisdiction, as the father had not declared allegiance to America. Eastman's answer is to let people come here to study or work, but as something less than guests.
This path could turn a melting pot nation into an empire of the native born and law-abiding foreign workers who never have a chance to belong. Think Old Europe. Think Saudi Arabia.

House Backs Legal Status for Many Young Immigrants

A bill to grant legal status to hundreds of thousands of illegal immigrant students passed the House of Representatives late Wednesday, giving President Obama an unexpected although largely symbolic victory in the final days of Democratic control of Congress on an issue he has called a top priority.
The bill, known as the Dream Act, passed the House by a vote of 216 to 198. But a vote in the Senate on opening debate on the bill was scheduled for Thursday, and the measure seemed likely to fail there.
Still, Democratic leaders celebrated the House vote, which gave them a triumph in the final days of the Congressional session before they yield the majority next year to Republicans. It also gave them something to show Hispanic voters, who strongly support the measure and could play a pivotal role in the 2012 presidential election.
The measure was supported by eight Republicans, including three Cuban-American representatives from South Florida, Lincoln and Mario Diaz-Balart and Ileana Ros-Lehtinen. Thirty-eight Democrats voted against it.
Democrats supported it as a way to help young immigrants who were brought here illegally as children by their parents and have seen their lives stall after they graduate from high school because they lack legal status.
“They are American in everything but a piece of paper,” said Representative Luis V. Gutierrez, Democrat of Illinois, perhaps the bill’s most fervent champion.
Republicans said the bill was amnesty for lawbreakers that would lead to a new wave of illegal immigration. They objected to expedited procedures Democratic leaders used to bring it to a vote with only one day’s notice.
Lamar Smith, Republican of Texas, said the bill “encourages fraud and more illegal immigration on a massive scale.” He said the rush to a vote was “a desecration of the democratic process.”
The House passage drew cheers from illegal immigrant students, who have shown support in marches, sit-in protests and hunger strikes, even sending their blood to lawmakers.
With Republicans holding a majority in the House and added strength in the Senate in the new Congress, the chances for any legislation legalizing illegal immigrants are dim.
In a last-minute press, President Obama made calls this week to undecided lawmakers from both parties, White House officials said. Homeland Security Secretary Janet Napolitano, Education Secretary Arne Duncan, Labor Secretary Hilda Solis and senior Pentagon officials spoke publicly to argue that the bill would create new taxpayers and help military readiness.
The bill, whose lead sponsor was Representative Howard L. Berman, Democrat of California, would give conditional legal status to illegal immigrants who came to the United States before they were 16, have been here for five years, have graduated from high school and have no criminal record, if they attend college or serve in the military for two years.

Obama Urges Fix to ‘Broken’ Immigration System

WASHINGTON — President Obama pressed Congress on Thursday to pass comprehensive immigration legislation to fix a “fundamentally broken” system by toughening enforcement of existing laws while creating a path to citizenship for many of the 11 million people in the United States illegally.
In his first speech devoted entirely to the hotly disputed issue since taking office, Mr. Obama tried to navigate between what he called the two extremes of the immigration debate, defending his efforts to strengthen border security while rejecting the idea of mass deportations as “logistically impossible and wildly expensive.” But he said change could not wait, despite the political risks.
“In sum, the system is broken and everybody knows it,” he told an audience of lawmakers, activists, business executives and labor leaders at the American University in Washington. “Unfortunately, reform has been held hostage to political posturing, special-interest wrangling and to the pervasive sentiment in Washington that tackling such a thorny and emotional issue is inherently bad politics.”
Embracing legislation drafted by Senators Charles E. Schumer, a New York Democrat, and Lindsey Graham, a South Carolina Republican, Mr. Obama said the solution was to take a “practical, common-sense approach” and put the onus on Republicans to step up and join him. He noted that some of the Senate Republicans who voted for immigration legislation when President George W. Bush was in office have backed off, and he attributed their shift to the politics of the moment.
“I’m ready to move forward, the majority of Democrats are ready to move forward and I believe the majority of Americans are waiting to move forward,” he said. “But the fact is, without the bipartisan support that we had just a few years ago, we cannot solve this problem.”
Several Republican lawmakers fired back, arguing that the real problem is an administration that does not do enough to enforce laws already on the books. Moreover, they said, with 10 percent unemployment, this is the wrong time to be loosening the laws on illegal workers.

The president’s speech, along with high-profile meetings earlier in the week with advocates for immigrants and members of the Congressional Hispanic Caucus, was more about politics than legislation at least in the near term. Neither the White House nor the Democratic leadership in Congress has any expectation of trying to actually push through a law this year, given the major issues already on their plate, like financial regulation and energy.
But Mr. Obama’s public focus on the issue appeared aimed at framing the debate for the approaching midterm elections, when the Hispanic vote could be critical in several important states. Mr. Obama also used the opportunity to repeat his opposition to Arizona’s new law requiring law enforcement officers to question the immigration status of anyone they stop for other reasons if they suspect that they are in the country illegally, calling it “ill conceived” and “divisive.” But he did not announce the lawsuit that the Justice Department is preparing to challenge it.
“We face the prospect that different rules for immigration will apply in different parts of the country, a patchwork of different immigration rules where we all know one clear national standard is needed,” he said. “Our task then is to make our national laws actually work, to shape a system that reflects our values as a nation of laws and as a nation of immigrants.”
Senator Jon Kyl of Arizona, the Republican minority whip, said the state’s law was a response to Washington’s failure to deal with the problem: “All Americans would be better served if this administration focused on implementing proven border security solutions rather than engaging in demagoguery and criticizing states that have been left to enforce immigration law because of the federal government’s unwillingness to do so.”
Mr. Schumer and Mr. Graham have proposed a plan to require Social Security cards with biometric data — like fingerprints or retinal patterns — to ensure that illegal workers cannot get jobs. They say the plan would also strengthen border security and interior enforcement, create a process for admitting temporary workers and establish a “tough but fair path to legalization” for those already here.
Under their plan, illegal immigrants would be required to admit that they broke the law and to pay fines and back taxes, pass background checks and prove that they can speak English before going to the back of the line of prospective immigrants seeking permanent legal residency and citizenship.
Republican critics said that still amounted to amnesty for millions of people who broke the law and would only encourage continued illegal migration.
“Part of the reason why we have been so successful in this country is because we live by the rule of law,” Representative Eric Cantor of Virginia, the second-ranking House Republican, said before the president’s speech. “We do live by its enforcement and transparency in our judiciary. And I think some of the ire right now surrounding the immigration issue is having to do with the illegal immigration and, frankly, the flouting of the law.”
