The Times has strong feelings of sympathy toward the plight of illegal aliens, it comes as no surprise that your recent article covering Maricopa County Sheriff Joe Arpaio would portray him in a negative light.

Say what you want about the guy, but I love him. I wish he'd run for president. There must be other people who like him as well, because your article mentioned his reelection victory last year with 55% of the vote in Arizona's most populous county.

If this nation had about 500 more Joe Arpaios, the illegal alien problem, and its associated chaos, would be nonexistent. He's unique among politicians: one of those who refuses to have his better judgment clouded by political correctness and bleeding heart liberalism.

Maybe Lou Dobbs can be his running mate in 2012. They'll have my vote!

(12-14) 17:16 PST SAN FRANCISCO -- Courts on two fronts looked for boundaries Monday on an important question of federal immigration law: What crimes are so serious that they require deportation for any noncitizen who commits them?

A federal appeals court ruled in a case from Solano County that statutory rape doesn't always require deportation. The U.S. Supreme Court agreed to decide whether a legal immigrant in Texas must be deported because of a second misdemeanor conviction for drug possession.

Both cases involve a law signed by President Bill Clinton in 1996 that requires deportation of any immigrant, legal or illegal, who commits an "aggravated felony," a category of crimes that courts are still trying to define. It includes some drug and sex crimes that are misdemeanors - punishable by no more than a year in jail - rather than felonies.

If a noncitizen has committed such a crime, "the judge can't take into consideration (U.S.) military service, the effect on a U.S. citizen spouse, parent or kids, or how long (the immigrant has) been here," said Benita Jain of the Immigrant Defense Project, which filed arguments with the Supreme Court in the drug case.

Immigrants convicted of other crimes can be also be deported if a judge decides they are dangerous and do not qualify for exemptions based on such factors as family hardships.

The Solano County case involves Luis Pelayo-Garcia, 42, of Vacaville, who entered the United States illegally from Mexico in 1985 at age 17. He was on the verge of gaining legal residency in 1998 when officials learned that he had recently been convicted of statutory rape.

According to his lawyer, Gloria Martinez-Senftner, Pelayo was working at a restaurant and raising three young children after his wife left him, and took a co-worker into his home along with her husband and daughter.

At age 29, he became involved with the daughter and intended to marry her, believing she was 18, his lawyer said. But when the girl became pregnant, hospital employees learned she was only 15 and called police.

Immigration judges said Pelayo's crime was an aggravated felony and ordered him deported, but they were overruled Monday by the Ninth U.S. Circuit Court of Appeals in San Francisco.

The federal law defines "sexual abuse of a minor" as an aggravated felony. But California's statutory rape law, prohibiting anyone older than 21 from having sex with a person under 16, does not require proof of physical or psychological abuse for conviction, the court said in a 3-0 ruling.

The Supreme Court case involves Jose Carachuri-Rosendo, who entered the United States with his family as a child and has been a legal resident since 1993. He pleaded guilty in Texas to misdemeanor marijuana possession in 2004 and pleaded no contest a year later to misdemeanor possession of the anti-anxiety drug Xanax without a prescription.

A federal appeals court ordered Carachuri deported, citing a federal law that allows any repeat drug offender to be prosecuted as a recidivist, which is defined as an aggravated felony even if the crimes were misdemeanors.

Carachuri, who was not charged as a recidivist in Texas, appealed to the Supreme Court, which agreed to decide his case by June.

Study: Illegal alien population may be as high as 38 million A new report finds the Homeland Security Department "grossly underestimates" the number of illegal aliens living in the U.S. Homeland Security's Office of Immigration Studies released a report August 31 that estimates the number of illegal aliens residing in the U.S. is between 8 and 12 million. But the group Californians for Population Stabilization, or CAPS, has unveiled a report estimating the illegal population is actually between 20 and 38 million. Four experts, all of whom contributed to the study prepared by CAPS, discussed their findings at a news conference at the National Press Club in Washington Wednesday. James Walsh, a former associate general counsel of the Immigration and Naturalization Service, said he is "appalled" that the Bush administration, lawyers on the Senate Judiciary Committee, and every Democratic presidential candidate, with the exception of Joe Biden, have no problem with sanctuary cities for illegal aliens. "Ladies and gentlemen, the sanctuary cities and the people that support them are violating the laws of the United States of America. They're violating 8 USC section 1324 and 1325, which is a felony -- [it's] a felony to aid, support, transport, shield, harbor illegal aliens," Walsh stated. Walsh said his analysis indicating there are 38 million illegal aliens in the U.S. was calculated using the conservative estimate of three illegal immigrants entering the U.S. for each one apprehended. According to Walsh, "In the United States, immigration is in a state of anarchy -- not chaos, but anarchy."

Declaring that insulation is "sexy," President Obama today pushed Congress to create a program giving homeowners cash incentives to improve their energy efficiency by replacing windows, caulking leaks and modernizing heaters and air conditioners.

He traveled to a Home Depot store in Alexandria, Va., to pitch a job-creation plan some have dubbed "cash for caulkers" -- government incentives given directly to consumers to spur economic activity, similar to the popular "cash for clunkers" rebates that spurred a surge in auto sales last summer. Obama also held a roundtable at the store that included the chief executive of insulation-maker Owens Corning and a 23-year-old local contractor.

"I know the idea may not be very glamorous, although I get really excited about it. We were at the roundtable and somebody said, 'Insulation's not sexy.' I disagree," Obama told an audience that included Home Depot Chief Executive Frank Blake and workers from the Laborers' International Union of North America. "Here's what's sexy about it: saving money."

He said homes built in the first half of the 20th century use about 50% more energy than those built today. Much of the energy is wasted through leaky roofs and windows. Making homes more energy efficient not only will help the environment, but also will help homeowners save money and boost the economy.

"If you saw 20-dollar bills just sort of floating through the window up into the atmosphere, you'd try to figure out how you were going to keep that," Obama said. "But that's exactly what's happening because of the lack of efficiency in our buildings.

MEXICO CITY (AP) — Mexico's National Human Rights Commission says 56 journalists have been killed in the past nine years and most of the slayings remain unsolved.
It says eight reporters went missing and seven newspaper offices were attacked with explosives over the same period.

The commission said in a news release Tuesday that authorities have been negligent in investigating and prosecuting the attacks.

It didn't say who is believed to be behind the attacks on journalists, but news media have been frequent targets of Mexico's drug cartels. Some of the slain journalists were investigating drug trafficking, crime or corruption.

Several international media watchdog groups have named Mexico the most dangerous country in the Americas for journalists.

According to the Los Angeles Times, 29% of inmates in federal prisons are illegal aliens, 75% of the people on the Los Angeles most wanted list are illegal aliens, and 95% of warrants for murders in Los Angeles are for illegal aliens. The Federal Bureau of Investigation reports that half of all gang members in Los Angeles are likely illegal aliens. These statistics are just the tip of the iceberg.

Latino leaders' silence is killing blacks
L.A. is headed for a racial meltdown unless the two groups form a coalition.

I WILL SAY PUBLICLY what many people are whispering privately in barbershops, soul food restaurants and church parking lots in South Los Angeles. If relations don't improve between African Americans and Latinos in Southern California, we are headed for a major racial conflict.

Sure, this is multicultural Southern California, where coalition politics is supposed to rule. However, anyone paying attention to what is happening here knows the accuracy of this assessment. Why are Latinos committing violent crimes targeted against African Americans — especially in one neighborhood in the Harbor Gateway area — and why aren't Latino leaders speaking out against them?

According to The Times, police statistics show that from 1994 to 2005, there were nearly five times as many homicides, assaults and other violent crimes committed by Latinos against African Americans in Harbor Gateway as by African Americans against Latinos.

One example of how out of control race relations have been in Harbor Gateway is the case of the 19-year-old African American man with no known gang affiliation who was killed by a Latino member of the 204th Street gang because the gang member was upset that an African American had defeated a Latino in a boxing match.

Three Los Angeles members of a Latino gang known as the Avenues were convicted and sentenced to life in prison in November for hate crime violations, including killing African Americans in an effort to run them out of predominantly Latino neighborhoods.

This escalating violence between Latinos and African Americans defies logic in so many ways. The two racial groups have had many similar struggles in Southern California and have coalesced around issues such as affirmative action, livable wages, justice for janitors and police misconduct.

Clearly, African Americans are committing violent crimes against Latinos as well, but there is little evidence that those crimes are based on race as much as they are for control of turf. And the notion that Latinos are killing blacks in an effort to "ethnically cleanse" their neighborhoods is extremely troubling. Many African Americans are especially perplexed because they remember that when we had the numerical advantage, African Americans did not target Latinos for murder to rid them from our neighborhoods. It would have been unthinkable.

African Americans throughout South Los Angeles have been asking: When are Latino political leaders going to speak out against these hate crimes? If a political coalition between Latinos and African Americans does exist, now's the time to show some muscle and make something happen. Yes, Mayor Antonio Villaraigosa went to Harbor Gateway and encouraged residents to get along, and he offered assistance from the city to help solve some of the socioeconomic problems that plague the area. And City Atty. Rocky Delgadillo proposed tougher penalties for gang members who commit hate crimes. But other Latino political leaders have been silent.

I suspect that if these hate crimes were being committed by the KKK against Latinos or African Americans, both communities would come together and condemn the violence as racist. Why not now?

Let's have House-Senate hearings sponsored by the Congressional Black and Hispanic caucuses, and special legislative hearings in Sacramento on the rise in targeted hate crimes. Let's have community meetings convened by the L.A. County Board of Supervisors, like those held about the crisis at the former King/Drew medical center. A few African American officials and some well-intentioned pastors and community activists cannot solve this problem; it also requires some heavy lifting by Latino political leadership. After all, what's the point in having a coalition if you can't coalesce and solve problems that are killing your constituent members?

Corrections officers are separating black and Latino detainees in the lockdown unit of the Prince George's County Detention Center in Upper Marlboro to try to prevent violence between members of the two groups, according to an internal memo and jail officials.
Escalating tensions between the detainees prompted the March 6 memo, which directed officers to keep Latinos' recreation time separate from that of other detainees. The memo, written by Acting Lt. Col. Jerome R. Smith, chief of security at the detention center, said a "recent escalation of gang violence" prompted the changes.
"Special precautions are to be taken when inmates are out for interviews," Smith wrote. "If a Latino inmate is being interviewed, no other inmates are to be out."
The lockdown unit is for detainees who are accused of an infraction -- such as fighting -- in other parts of the facility. Inmates in the unit are confined to their cells 23 hours a day. It is designed for 96 detainees and typically holds 50 to 60 inmates.
The separation is unusual inss Washington area jails. D.C. and Montgomery and Fairfax County corrections officials said this week that they do not separate their inmates by ethnicity or race.
The memo said nothing about whether black and Latino detainees should not be assigned to the same cell. However, corrections officers in the lockdown unit are assigning black and Latino detainees to separate cells, said a supervisor at the detention center, who asked not to be identified because he had not been given permission to be interviewed.
"There's too much conflict and fighting," the supervisor said. He said officers in the unit are adhering to "jailhouse law" -- assigning black detainees to the same cells as other blacks, Latinos with Latinos, and whites with whites. "It's nothing written, but you try to keep the calm," the supervisor said.
Vicki D. Duncan, a spokeswoman for the county Department of Corrections, confirmed the authenticity of the memo. She said corrections officers consider several factors when assigning cellmates, including tensions along racial or ethnic lines.
Douglas T. Lansing, a correctional consultant and former federal Bureau of Prisons official, said keeping detainees separate temporarily could be the right thing to do in the short term. "If there is something happening that threatens the safety of inmates, it may be a smart move," he said, emphasizing that he did not know the details in Prince George's.
But he added that officials who separate detainees by race must tread carefully. "Generally, you try not to give any one group recognition that gives it authority over another group, real or imagined," Lansing said. "You have to be careful to avoid the appearance of favoring or punishing any group."
The Prince George's detention facility is designed for 1,500 detainees and is often at capacity or overcrowded. About 80 percent of the inmates are awaiting trial; most of the rest are waiting for sentencing.
About 10 to 12 percent of the detainees in the jail are Latino. Almost all the rest are black, with a sprinkling of non-Latino whites, Asians and detainees of other ethnicities rounding out the population.
Black and Latino detainees have found themselves in conflict over relatively minor issues.
For example, on March 3, two black detainees and two Latino detainees in a medium- to maximum-security section of the jail had a shouting match over the use of a television. Two hours a day are allotted for detainees to watch Spanish-language programs, and the conflict started when black detainees who were watching videos brushed off a request by the two Latino detainees to watch a program in Spanish, the supervisor said.
In October, a dozen detainees -- six black, six Latino -- were sent to the lockdown unit after brawling. That fight began when a Latino detainee accused a black detainee of stealing food.
Although the number of Latino detainees is small, some of them -- specifically members of the violent street gang MS-13, or Mara Salvatrucha -- are well-organized, the detention facility supervisor said. Made up of immigrants from El Salvador, Honduras and other Latin American countries, MS-13 is believed to be responsible for dozens of homicides and other attacks in the Washington region in recent years.
In the Prince George's jail, as many as 70 percent of the Latino detainees who are teenagers or in their early to mid-20s are members of MS-13, while most of the older Latino detainees are not, the supervisor said.
Nonetheless, some black detainees believe that every Latino detainee is a member of MS-13, the supervisor said. Both MS-13 and black gangs, including the Bloods, recruit inside the jail.
Violent clashes between black and Latino detainees have broken out elsewhere in the United States.

Napolitano: DHS Taking “Unprecedented Action” to Enforce Immigration Laws
On Wednesday, December 9, Secretary of Homeland Security Janet Napolitano appeared before the Senate Judiciary Committee as part of a Department of Homeland Security (DHS) oversight hearing. Napolitano – who President Obama has designated as his “point person” on amnesty legislation – used the hearing to make the argument that the Obama administration has been tough with respect to immigration enforcement. True immigration reformers, however, remain unconvinced.
Judiciary Committee Chairman Sen. Patrick Leahy (D-VT) opened the hearing by noting that past opposition to amnesty legislation was related to the federal government’s failure to secure our borders. “We often hear we can’t begin comprehensive reform of our immigration laws until we’ve won control of our borders,” he said. Incredibly, Leahy then went on to argue that DHS has actually achieved this “control”: “[S]ince the Senate last considered immigration reform…most of the enforcement benchmarks and triggers included in prior legislation have been substantially met.” (Sen. Leahy’s Testimony, December 9, 2009).
Following Leahy’s statement, the Committee’s Ranking Member – Senator Jeff Sessions (R-AL) – disagreed with the Chairman’s assertion that immigration enforcement has improved “substantially” since amnesty was last considered. Speaking to Secretary Napolitano, Sessions said, “I am disappointed by some of the actions that you've taken that I think undermine the enforcement measures for those in the country now illegally.” Sessions continued: “At a time where the unemployment rate is 10 percent, I believe it's not responsible to invite or allow illegal workers to take jobs that should be available to American citizens and legal immigrants.” (CQ Congressional Transcripts, December 9, 2009).
To underscore his critique, Sessions pointed to data recently released by DHS’ Bureau of Immigration and Customs Enforcement (ICE) that show that during Fiscal Year 2009 administrative arrests pursuant to worksite enforcement fell 68 percent; criminal arrests fell 60 percent; criminal indictments fell 58 percent; and criminal convictions fell 63 percent. (Id.; For more on these ICE statistics, see FAIR’s Legislative Update, November 23, 2009; See also House Judiciary Committee – Minority Press Release, November 18, 2009).
Napolitano began her opening statement by claiming that “[o]ver the past year [DHS has] taken unprecedented actions to achieve our goals.” (Secretary Napolitano’s Testimony, December 9, 2009). Napolitano highlighted how DHS has changed the 287(g) program and sought to expand Secure Communities, policy decisions that, in actuality, indicate that the Obama administration is abandoning immigration enforcement in all but the most serious criminal cases. (See FAIR’s Legislative Updates from May 26, 2009 and July 13, 2009). Napolitano claimed that her Department has “enhanced and expanded” E-Verify – the online, electronically operated system that allows employers to quickly and easily ensure that their new hires are legally authorized to work and not illegal aliens. However, Napolitano failed to mention that the Obama administration had delayed the implementation of a federal regulation requiring federal contractors to use E-Verify on three separate occasions before finally relenting and allowing the rule to take effect in September of this year. (See FAIR’s Legislative Update, June 8, 2009).
The Secretary’s testimony also highlighted two other steps that DHS has taken to undermine immigration enforcement, including (1) reforming the immigrant detention system in such a way that will almost certainly lead to an increase in the number of illegal aliens who abscond while under ICE custody (See FAIR’s Legislative Update, October 13, 2009) and (2) advocating for passage of legislation that would gut security standards related to State-issued driver’s licenses and identification cards. (See FAIR’s Legislative Update, June 22, 2009). Policy decisions such as these reflect how the Obama administration has taken numerous steps to weaken immigration enforcement over the past year. In fact, FAIR has recently released a comprehensive assessment that details the numerous steps the Obama administration has taken to undermine the enforcement of U.S. immigration laws. Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

Gutierrez to Introduce Amnesty Bill Tuesday
On Tuesday, December 15, open borders advocate Congressman Luis Gutierrez (D-IL) will introduce a bill in the U.S. House of Representatives that, if passed, would grant amnesty to millions of illegal aliens in the United States. (Rep. Gutierrez Press Release; National Council of La Raza (NCLR) Press Release, December 11, 2009). According to Gutierrez, his bill “will set a liberal standard in the [immigration] debate.” (Roll Call, December 7, 2009).
While the specifics of the legislation will not be clear until the text becomes available later this week, Gutierrez previously outlined a set of “Core Principles for a New Comprehensive Immigration Reform Bill.” (Rep. Gutierrez Press Release, October 13, 2009). These “principles” indicate that Gutierrez’ bill will include three amnesty programs, including:
• An amnesty for illegal alien “workers.” In Gutierrez’ own words: “We need a bill that says if you come here to hurt our communities, we will not support you. But if you are here to work hard – if you are here to make a better life for your family – you will have the opportunity to earn your citizenship.” (Gutierrez Press Release).
• The AgJOBS amnesty. (Id.). This legislation would grant amnesty to millions of illegal alien agricultural workers and “reform” the H-2A temporary agricultural worker program to allow employers easier access to cheap foreign labor. (See FAIR’s Legislative Analysis of AgJOBS, June 17, 2009).
• The DREAM Act amnesty. (Gutierrez Press Release). Although this legislation has varied a little over the years, in general the DREAM Act: (1) grants amnesty to illegal aliens who entered the U.S. before the age of 16, have lived in the U.S. for at least 5 years, and have met certain minimal educational requirements. The Dream Act also reverses current federal law to allow states to provide taxpayer-subsidized in-state tuition to illegal aliens. (See FAIR’s Legislative Analysis of the DREAM Act, March 2009).
FAIR has also learned that the Gutierrez amnesty bill will include at least a portion of the “Reuniting Families Act” (H.R. 2709), legislation sponsored by Rep. Mike Honda (D-CA). This legislation would dramatically increase legal immigration by providing for the “[r]ecapture” of what its proponents claim are “[u]nused” green cards from 1992 to date to bring in more family-based immigrants—all of whom will need jobs. The U.S. State Department has estimated that over 326,000 employment visas and more than 231,000 family visas would be made available under this provision. (U.S. State Department, Unused Family and Employment Preferences Numbers Available for Recapture, Fiscal Years 1992-2007).
The Reuniting Families Act would also provide for additional increases in legal immigration by:
• Changing the classification of children and spouses of lawful permanent residents so that they would be recognized as “immediate relatives.” (§102). This would allow lawful permanent resident spouses and children to immediately qualify for a visa. (Rep. Honda’s Press Release, June 2, 2009).
• Increasing the annual per country limits on family and employment-based visas from seven percent to ten percent. (§103). Under current law, each foreign country has a seven percent share of the total cap of visas that Congress allocates each year.
FAIR has recently released an updated report arguing that Congress has a responsibility to ensure that available jobs are filled by legal workers. With more than 15 million Americans out of work and a nationwide unemployment rate of ten percent (Bureau of Labor Statistics, December 4, 2009), passage of the Gutierrez amnesty bill – or any amnesty legislation for that matter – would constitute a failure by Congress to live up to its basic responsibilities to the American people.
