San Diego woman gets 3 years in prison for hiding immigrants in her home


Fog rolled into Otay Mesa in the early morning hours of Nov. 6, shrouding the hole someone had cut in the U.S.-Mexico border fence. The conditions were ripe to move a large group of immigrants through, and the smugglers took advantage.
In the City Heights neighborhood, Dania Olivero had agreed to have her small rented house used as a temporary staging point for the border crossers. She said she thought only a handful of people would be brought to her, as had happened previous times. But wave after wave showed up. She protested at first, but took the extra money offered to her, she told investigators.
When San Diego police arrived, after two neighbors had reported seeing suspicious activity, they found 44 people in her house, the backyard and a shed.
On Thursday, U.S. District Judge William Hayes sentenced Olivero to three years and one month in prison for her role in the smuggling effort. He said the number of people, as well as the “grim” conditions they were kept in, made it an aggravated crime.
Some of the immigrants complained they were locked inside a small shed without access to a bathroom, lights or ventilation, according to court records.
All of the immigrants were Mexican, except for two Guatemalans.
Olivero, 51, also is an immigrant who came to the United States from Cuba legally at the age of 28, according to a sentencing document filed by her attorney.
Her involvement in human smuggling was an act of desperation, attorney Hootan Baigmohammadi said. The father of four of her children had died in 2011, and she made ends meet with food stamps, recycling cans, working odd jobs and support from her oldest son. An accident that left her with an injured wrist made it hard to work. She also was raising her partner’s two young children, whose mother had been deported.
“Life became really difficult for me,” Olivero wrote in a letter to the judge.
When she accepted the latest offer to hide immigrants from a man she’d met at a bar, she owed $1,100 in rent and back rent.
On a few occasions, she said, she had accepted $50 per unauthorized immigrant, and never more than a handful had shown up to her home. On Nov. 6, circumstances spiraled out of her control, her attorney said.
“I did it without thinking,” Olivero told the judge, apologizing for her actions. “I did it to pay my rent.”
In sentencing Olivero, the judge said he took into consideration her criminal history, which included misdemeanor convictions for spousal abuse and theft.

The human cost of the US-Mexico border: More than 6,000 bodies found since 2000

Between 2000 and 2016, the US Customs and Border Patrol (CBP) has discovered the remains of 6,023 undocumented people who died crossing from Mexico into the United States.
This shocking figure, cited in a May 4 article in the New York Times, underreports the total death toll. According to one Texas sheriff, “I would say for every one [body] we find, we’re probably missing five.” That is, the number of undiscovered bodies could be in the tens of thousands.
Bodies turn up along the US-Mexico border “with stunning regularity,” the Times report notes. In one border area, Brooks County, Texas, 550 bodies have been discovered since January 2009, the month of Barack Obama’s inauguration. At a single ranch in Texas, 31 bodies have been discovered since 2014. CBP unceremoniously throws some of the bodies together in “cluster graves,” often without removing them from biohazard bags.
Many of the bodies are unrecognizable, charred from the desert sun or picked away by vultures. Along well-traveled migrant paths, “the dead line the way.” Cadavers belonging to children are found alongside their stuffed animals. One woman who froze to death was found wearing a plastic trash bag for warmth.
In 2015, Francisco Gonzalez, a former machinist from Mexico, called emergency services from the middle of the desert, begging border patrol to arrest him to save his life. He told the dispatcher he was returning to the US to meet his newborn daughter for the first time, after having been deported for driving under the influence by the Obama administration. When officials could not locate him, Gonzalez gave the dispatcher his wife’s phone number and said, “Call her and tell her I didn’t make it. Call her and tell her I love her and for her to take care of our baby.” He died in the desert shortly thereafter.
Daniel Martinez, an assistant professor of sociology at George Washington University, told the Times, “If this were any other context, if these were deaths as a result of a mass flood or an earthquake or a major plane crash, people would be talking about this being a mass disaster.”
Indeed, the Times notes that the total number of bodies is greater than the total number killed in the September 11, 2001 attacks and Hurricane Katrina combined. And despite the drop in immigration since the election of Donald Trump, the number of bodies found in the first months of 2017 already equals the number found in all of 2010.
The mass casualties along the US-Mexico border are the outcome of deliberate policies of the US government, both Democrat and Republican, going back at least two decades. Under programs like “Operation Gatekeeper” and “Operation Hold-the-Line,” first enacted under Democratic President Bill Clinton in the mid-1990s, the government secured heavily populated border crossings with military defenses and increased patrols concentrated in cities like San Diego, California and El Paso, Texas.
The consequence was entirely predictable and indeed predicted. Immigrants fleeing economic and political crisis were forced to cross through deadly desert regions, where temperature can exceed 120 degrees Fahrenheit (49 degrees Celsius).
Further barriers to entry were erected under Bush (including with the Secure Fence Act of 2006, supported by Democrats) and under Obama. The “deporter-in-chief” Obama signed legislation in 2010 that further militarized the US border with the use of Predator drones, and deployed 1,500 National Guard troops to keep out desperate migrants.
Now, under Trump, the American ruling class is going even further. Along with the construction of a “wall” on the US-Mexico border, Trump is pledging to “unshackle” border control agents, who function as a modern-day Gestapo.
The Trump administration has already deported tens of thousands and plans on hiring thousands of immigration and border control officials. Mass detention centers established under Obama are being doubled in size, and the federal government is working with police agencies across the country to round up immigrants. The Trump administration has established a program, known as VOICE, the aim of which is to publicly denounce immigrants charged with crimes in a manner similar to the Nazi press’s attacks against Jewish criminal defendants in the 1930s.
The refugee crisis is the product of imperialism and the irrational capitalist nation-state system.
The thousands of impoverished people who die in the US deserts are fleeing poverty and war caused by decades of imperialist exploitation and US military intervention across every corner of the world. The US laid waste to the entire Central American isthmus, backing dictators, funding death squads, and fanning the flames of civil wars which left hundreds of thousands dead through the 1970s, 1980s, and 1990s.
The story is the same in the Middle East and North Africa, where a record number of migrants are escaping US-backed wars in Syria, Libya, Yemen, Iraq, Somalia, and elsewhere, desperately seeking refuge in Europe and drowning by the thousands in the Mediterranean Sea. In 2015, the UN reported that there are an unprecedented 65.3 million refugees, more than the entire population of the United Kingdom.
Advances in technology have brought humanity to a level of world interconnectivity that would have been unthinkable even 30 years ago. Cell phones, the Internet, global supply chains, and advances in transportation mean that residents of the world’s most isolated villages can communicate with friends and loved ones in the world’s metropolises and learn of world events at the swipe of a finger.
But the potential for human progress is restrained by the fact that a handful of exploiters control the world’s productive forces and dictate the policies of governments.
As a result, conflicts between nation states intensify and a third world war is an immediate possibility. Far-right parties in the US, UK, France, Germany and elsewhere are being brought into government, directing popular opposition to inequality and poverty against immigrants. Under the banner of national supremacy each major power, as Leon Trotsky wrote in his 1934 essay Nationalism and Economic Life, is “protecting himself by a customs wall and a hedge of bayonets.”
The Socialist Equality Party opposes the division of the world into competing nation states and opposes all forms of nationalism, the poisonous ideology of this outdated system. As the 18th century philosopher Montesquieu said, “I am necessarily a man, only accidentally am I French.” The SEP insists that all people have the right to travel safely as they choose, without visas, passports, or the threat of harassment or deportation.
This cannot be accomplished so long as a tiny section of the world’s population controls its wealth and defends it with hedges of bayonets—and nuclear weapons. To bring the international character of the world economy into harmony with the material needs of the world working class requires world socialist revolution.

The latest allegations of unethical practices at Wells Fargo are so disturbing that even the bank has called them “offensive.”
Former bank employees have signed sworn statements saying that they were told to target immigrants in the U.S. illegally, as well as Native Americans and college students as they sought to open sham accounts to meet the bank’s onerous sales goals.
Submitted as part of a shareholder lawsuit against the bank’s board, the statements by the former employees from California, Utah, Wisconsin and Arizona detail practices they say they were pushed to use to bring in new customers and open accounts — both legitimate and unauthorized.
One former Wells Fargo employee said that managers at his Petaluma branch would regularly send Latino employees to a local 7-Eleven convenience store frequented by day laborers.
“The Wells Fargo employees were instructed 

to ‘round up’ a group of the undocumented 

workers and drive them back to the Wells 

Fargo branch to open checking and savings 

accounts,” former employee Denny Russo 

said in the statement. “My colleagues 

constantly went to and from this location to 

try to meet their sales goals.”
Speaking at this week’s Milken Institute Global Conference in Beverly Hills, Wells Fargo Chief Executive Timothy Sloan said the bank did not target immigrants who are in the country illegally and that it would not be logical to do so.
“To target undocumented immigrants makes no sense because you can’t do business with undocumented immigrants by federal law, right?” Sloan said, according to American Banker. “So it’s nonsensical.”


Non-citizens, though, can open U.S. bank accounts using foreign government-issued IDs.
In a statement, Wells Fargo spokesman Ancel Martinez said the practices alleged by former employees never would have been countenanced by the bank.
“Make no mistake, such activities have always been against our policies and values and we are confident our practices and controls to guard against such abuses are stronger than ever,” he said.
As that shareholder lawsuit and other cases continue, more stories of unethical practices may come out, adding to the already substantial toll the bank’s accounts scandal has had on its reputation.
“Employers seem very powerful and people are often afraid to come forward,” said Alexandra Lahav, a professor at the University of Connecticut School of Law. “But as people come forward, more people feel empowered to do the same. That’s why events like this are a big risk for companies.”
Though Wells Fargo has agreed to pay $185 million to regulators and $142 million to settle a raft of consumer lawsuits, the bank still faces two lawsuits filed by shareholders and a third filed by former employees.
The case that includes allegations that the bank targeted immigrants and other groups was filed in San Francisco Superior Court last year.
Shareholders allege executives and board members failed to properly oversee the bank’s practices, including the drastic measures workers felt forced to take to meet onerous goals set by regional managers.
Kelsey Hess, who worked at a Wells Fargo branch in a suburb of Salt Lake City, said in her statement that employees were encouraged to go to nearby construction sites, seek out workers there who were in the country illegally, and open unauthorized accounts in their names.
Ricky Hansen Jr., a former Wells Fargo employee in Arizona, said the bank pushed credit card accounts on local Native Americans who went to Wells Fargo branches to cash tribal checks.
“In the weeks following each check-cashing day, the Indian community members would flood the store with complaints about unwanted accounts, debit and credit cards they did not order, over-drafted accounts and account fees for accounts they never requested,” Hansen said in his declaration.
Angela Payden, who worked at a branch in Hudson, Wisc., said employees at her branch would drive to a University of Wisconsin campus 12 miles away, sign students up for checking accounts, then open other accounts in students’ names.
Wells Fargo has acknowledged that workers may have opened as many as 2.1 million unauthorized checking, savings and credit card accounts between 2011 and 2015 — and has fired 5,300 for allegedly violating its standards. But in its own statement it called the former employees’ assertions “offensive” and a “violation of policies we have in place to safeguard against abuses.”
Attorneys for Wells Fargo and its board members are seeking to have the case dismissed and argued in court filings this week that Judge Curtis Karnow should for now disregard the employees’ statements. A hearing in that case is scheduled for next week.
In a separate but similar lawsuit, a federal district judge in San Francisco this week rejected the bank’s motion to dismiss, allowing the case to proceed.
In that case, also filed against board members by Wells Fargo shareholders, Judge Jon S. Tigar said it appears the shareholders make a strong argument that board members “knew about widespread illegal activity and consciously disregarded their fiduciary duties to oversee and monitor the company.”
Attorneys for Wells Fargo and its board members had argued the case should be dismissed on procedural grounds.
Kevin Lindahl, general counsel for one of the lead plaintiffs in the case, the Fire and Police Pension Assn. of Colorado, said the pension fund looks forward “to vigorously prosecuting this case.”
Along with the two shareholder suits, the bank is facing a lawsuit filed by a handful of Wells Fargo employees who say they were fired, demoted, denied promotions and forced to work without pay because they refused to resort to unethical practices to meet sales goals.
The bank has not yet responded to that case, filed in federal court in San Francisco in December.
Martinez, the Wells Fargo spokesman, said the bank “cannot speculate on pending claims, however, we will advocate strongly for our positions before the court.”
Shareholder and employee cases against the bank might be able to proceed to the point where the bank will have to turn over documents and other evidence, which could shed more light on the bank’s practices. None of the numerous cases filed by bank customers has made it to that point as courts have pushed those cases into private arbitration.
The bank also remains under investigation by the federal Department of Justice, the California Attorney General’s office and other agencies.

Veteran legal scholar John Eastman believes that Members of Congress who passed the 14th Amendment never intended that it include Birthright Citizenship in its current form. Eastman points to the wording of the 1866 Civil Rights Act as providing the key to the meaning of the 14th Amendment and the intent of the Framers. 

The act provides that "All persons born or naturalized in the United States, and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States." This formulation makes clear, Eastman writes, that any child born on U.S. soil to parents who were temporary visitors to this country and remained a citizen or subject of the parents' home country "was not entitled to claim the birthright citizenship provided by the 1866 Act." 

But for now, the constitutional meaning of the amendment as it applies to illegal immigrants will remain uncertain until the Supreme Court interprets it. 

The expansive interpretation of the 14th Amendment currently in effect has potentially troubling national-security implications. In a CIS backgrounder, a retired government employee with extensive national security experience, points to Anwar al-Awlaki -- a terrorist with links to jihadists including Umar Farouk Abdulmutullab, who attempted to bomb a jetliner with a bomb hidden in his underwear as the plane prepared to land near Detroit, and Nidal Malik Hasan, who massacred 13 people in 2009 at Fort Hood, Tex. -- as an example of how Birthright Citizenship has the potential to benefit enemies of the United States. 

Awlaki was born on April 22,1971 in Las Cruces, N.M. to non-immigrant parents while his father was studying as a foreign student in the United States. He left the United States with his parents when they returned to Yemen but later re-entered the United States, using his American passport, where he became spiritual mentor to several of the 9/11 hijackers before returning to Yemen and becoming a senior al-Qaeda operative. The Birthright Citizenship Act, H.R. 140, would amend the Immigration and Nationality Act - not the Constitution - to consider a person born in the United States "subject to the jurisdiction" of the United States for citizenship at birth purposes if the person is born in the United States of parents, one of whom is: (1) a U.S. citizen or national; (2) a lawful permanent resident alien whose residence is in the United States; or (3) an alien performing active service in the U.S. Armed Forces.

Jose Herria emigrated illegally from Mexico to Stockton, Calif., in 1997 to work as a fruit picker. He brought with him his wife, Felipa, and three children, 19, 12 and 8 – all illegals. When Felipa gave birth to her fourth child, daughter Flor, the family had what is referred to as an "anchor baby" – an American citizen by birth who provided the entire Silverio clan a ticket to remain in the U.S. permanently. But Flor was born premature, spent three months in the neonatal incubator and cost the San Joaquin Hospital more than $300,000. Meanwhile, oldest daughter Lourdes married an illegal alien gave birth to a daughter, too. Her name is Esmeralda. And Felipa had yet another child, Cristian. The two Silverio anchor babies generate $1,000 per month in public welfare funding for the family. Flor gets $600 a month for asthma. Healthy Cristian gets $400. While the Silverios earned $18,000 last year picking fruit, they picked up another $12,000 for their two "anchor babies." While President Bush says the U.S. needs more "cheap labor" from south of the border to do jobs Americans aren't willing to do, the case of the Silverios shows there are indeed uncalculated costs involved in the importation of such labor – public support and uninsured medical costs. In fact, the increasing number of illegal aliens coming into the United States is forcing the closure of hospitals, spreading previously vanquished diseases and threatening to destroy America's prized health-care system, says a report in the spring issue of the Journal of American Physicians and Surgeons. "The influx of illegal aliens has serious hidden medical consequences," writes Madeleine Pelner Cosman, author of the report. "We judge reality primarily by what we see. But what we do not see can be more dangerous, more expensive, and more deadly than what is seen." According to her study, 84 California hospitals are closing their doors as a direct result of the rising number of illegal aliens and their non-reimbursed tax on the system. "Anchor babies," the author writes, "born to illegal aliens instantly qualify as citizens for welfare benefits and have caused enormous rises in Medicaid costs and stipends under Supplemental Security Income and Disability Income." In addition, the report says, "many illegal aliens harbor fatal diseases that American medicine fought and vanquished long ago, such as drug-resistant tuberculosis, malaria, leprosy, plague, polio, dengue, and Chagas disease." While politicians often mention there are 43 million without health insurance in this country, the report estimates that at least 25 percent of those are illegal immigrants. The figure could be as high as 50 percent. Not being insured does not mean they don't get medical care. Under the Emergency Medical Treatment and Active Labor Act of 1985, hospitals are obligated to treat the uninsured without reimbursement. "Government imposes viciously stiff fines and penalties on any physician and any hospital refusing to treat any patient that a zealous prosecutor deems an emergency patient, even though the hospital or physician screened and declared the patient's illness or injury non-emergency," says the report. "But government pays neither hospital nor physician for treatments. In addition to the fiscal attack on medical facilities and personnel, EMTALA is a handy truncheon with which to pummel politically unpopular physicians by falsely accusing them of violating EMTALA." According to the report, between 1993 and 2003, 60 California hospitals closed because half their services became unpaid. Another 24 California hospitals verge on closure, the author writes. "American hospitals welcome 'anchor babies,'" says the report. "Illegal alien women come to the hospital in labor and drop their little anchors, each of whom pulls its illegal alien mother, father, and siblings into permanent residency simply by being born within our borders. Anchor babies are citizens, and instantly qualify for public welfare aid: Between 300,000 and 350,000 anchor babies annually become citizens because of the Fourteenth Amendment to the U.S. Constitution: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside." Among the organizations directing illegal aliens into America's medical systems, according to the report, are the Ford Foundation-funded Mexican American Legal Defense and Education Fund, the National Immigration Law Center, the American Immigration Lawyers Association, the American Bar Association's Commission on Immigration Policy, Practice, and Pro Bono, the Immigrant Legal Resource Center, the National Council of La Raza, George Soros's Open Society Institute, the Migration Policy Institute, the National Network for Immigration and Refugee Rights and the Southern Poverty Law Center.

Because drug addiction and alcoholism are classified as diseases and disabilities, the fiscal toll on the health-care system rises. When Linda Torres was arrested in Bakersfield, Calif., with about $8,500 in small bills in a sack, the police originally thought it was stolen money, explained the report. It was her Social Security lump sum for her disability -- heroin addiction. "Today, legal immigrants must demonstrate that they are free of communicable diseases and drug addiction to qualify for lawful permanent residency green cards," writes Cosman, a medical lawyer, who formerly taught medical students at the City University of New York. "Illegal aliens simply cross our borders medically unexamined, hiding in their bodies any number of communicable diseases." Many illegals entering this country have tuberculosis, according to the report. "That disease had largely disappeared from America, thanks to excellent hygiene and powerful modern drugs such as isoniazid and rifampin," says the report. "TB's swift, deadly return now is lethal for about 60 percent of those infected because of new Multi-Drug Resistant Tuberculosis. Until recently MDR-TB was endemic to Mexico. This Mycobacterium tuberculosis is resistant to at least two major anti-tubercular drugs. Ordinary TB usually is cured in six months with four drugs that cost about $2,000. MDR-TB takes 24 months with many expensive drugs that cost around $250,000 with toxic side effects. Each illegal with MDR-TB coughs and infects 10 to 30 people, who will not show symptoms immediately. Latent disease explodes later. TB was virtually absent in Virginia until in 2002, when it spiked a 17 percent increase, but Prince William County, just south of Washington, D.C., had a much larger rise of 188 percent. Public health officials blamed immigrants. In 2001 the Indiana School of Medicine studied an outbreak of MDR-TB, and traced it to Mexican illegal aliens. The Queens, New York, health department attributed 81 percent of new TB cases in 2001 to immigrants. The Centers for Disease Control and Prevention ascribed 42 percent of all new TB cases to 'foreign born' people who have up to eight times higher incidences apparently, 66 percent of all TB cases coming to America originate in Mexico, the Philippines and Vietnam." Other health threats from illegals include, according to the report: Chagas disease, also called American trypanosomiasis or "kissing bug disease," is transmitted by the reduviid bug, which prefers to bite the lips and face. The protozoan parasite that it carries, Trypanosoma cruzi, infects 18 million people annually in Latin America and causes 50,000 deaths. The disease also infiltrates America's blood supply. Chagas affects blood transfusions and transplanted organs. No cure exists. Hundreds of blood recipients may be silently infected. Leprosy, also known as Hansen's disease, was so rare in America that in 40 years only 900 people were afflicted. Suddenly, in the past three years America has more than 7,000 cases of leprosy. Leprosy now is endemic to northeastern states because illegal aliens and other immigrants brought leprosy from India, Brazil, the Caribbean and Mexico. Dengue fever is exceptionally rare in America, though common in Ecuador, Peru, Vietnam, Thailand, Bangladesh, Malaysia and Mexico. Recently, according to the report, there was a virulent outbreak of dengue fever in Webb County, Texas, which borders Mexico. Though dengue is usually not a fatal disease, dengue hemorrhagic fever routinely kills. Polio was eradicated from America, but now reappears in illegal immigrants as do intestinal parasites, says the report. Malaria was obliterated, but now is re-emerging in Texas. The Journal of American Physicians and Surgeons report includes a strong prescription for protecting the health of Americans: Closing America's borders with fences, high-tech security devices and troops. Rescinding the U.S. citizenship of "anchor babies." Punishing the aiding and abetting of illegal aliens as a crime. An end to amnesty programs.

California's senators just proposed a path to legal status and citizenship for farmworkers

California's two Democratic senators filed legislation Wednesday that would shield farmworkers who are in the country illegally from deportation and create a path to citizenship.
“Everywhere I travel in California, I hear from farmers, growers and producers from all industries — wine, citrus, fruit and tree nuts, dairy — that there aren’t enough workers,” Sen. Dianne Feinstein said in a statement. “Farm labor is performed almost exclusively by undocumented immigrants — a fact that should surprise no one."
Nine in 10 agriculture workers in California are foreign-born, and more than half are undocumented, according to federal numbers. Despite rising wages, California farmers have said they cannot hire enough native-born workers.
The bill is also backed by senators from Colorado, Vermont and Hawaii, but there's been no broad talk in Congress of reforming immigration laws this year. With Democrats in the minority and unable to direct when legislation may be considered, the proposed Agricultural Worker Program Act faces an uphill battle.
It would allow undocumented farmworkers who have worked in agriculture for at least 100 days in each of the previous two years to earn a “blue card," which would allow them to work legally.
They would eventually be eligible for a green card or legal permanent residency, which opens the door to earning citizenship.
“It’s past time and smart for our economy that we provide them a pathway to citizenship, decent working conditions, and the opportunity to come out of the shadows and more fully contribute to our state and national economy,” Sen. Kamala Harris said in a statement.
