Pakistani Court Rules 14-Year-Old Christian Girl Must Remain Married to Muslim Kidnapper

A court in Pakistan ruled on Tuesday that 14-year-old Christian girl Maira Shahbaz voluntarily converted to Islam and is legally married to an older Muslim man named Mohamad Nakash, even though Maira and her family say Nakash kidnapped her at gunpoint with two accomplices during the coronavirus lockdown in April.

If the ruling stands, Maira will be forced to return from the shelter where she is staying to the home where she was held hostage.

Witnesses say Maira was walking home on April 28 in the town of Madina when Nakash and two accomplices forced her into a car, fired several gunshots into the air, and sped away. 

When her family reported the kidnapping, Nakash produced a “marriage certificate” that listed the girl’s age as 19, even though her family has a birth certificate proving she is only 14. The certificate listed the date of the marriage as last October, six months before Nakash abducted Maira. The Muslim cleric who ostensibly signed the birth certificate denied any involvement in the “marriage” when questioned.

In July, the Shahbaz family prevailed upon the top cleric of a local mosque to issue a fatwa (religious edict) that Nakash’s marriage certificate was invalid. Human rights activists supported the family by pointing out that not only was the imam’s signature on the document fraudulent, but Nakash was already married to another woman not mentioned on the document. 

Polygamy is legal but regulated in Pakistan, and one of the regulations is that existing wives must give written approval for additional marriages.

Marriage to girls under the age of 16 is technically illegal, but activists complain the Child Marriage Restraint Act is not vigorously enforced and often set aside in favor of Islamic sharia, which allows girls to be married off once they experience their first menstrual cycle. The United Nations rates Pakistan as one of the worst countries in the world for child brides, with some 3 percent of girls wedded before the age of 15.

Pakistan has a law against forced religious conversion that stipulates a minimum age of 18 for changing religions without parental consent. This law also encounters resistance from Islamists who cite sharia and Muslim historical precedents for young children converting to Islam.

Despite the family’s efforts, it was not until the end of July that a district court ruled Maira could leave Mohamad Nakash’s custody and move to a shelter for women, pending the outcome of her case. 

Stunned witnesses to Tuesday’s ruling in Lahore High Court said Maira was present and wept when the verdict was announced. Judge Raja Muhammad Shahid Abbasi overturned last week’s ruling, ruled both Maira’s conversion to Islam and her marriage to Nakash were valid, and ordered her returned to his custody.

“It is unbelievable. What we have seen today is an Islamic judgement. The arguments we put forward were very strong and cogent,” said Maira’s lawyer Khalil Tahir Sandhu.

“I became so upset as the proceedings went on, I feared I might be asked to leave the courtroom,” he added, vowing to appeal the decision all the way to the Supreme Court of Pakistan.

Sandhu, himself a Christian, was formerly Punjab’s minister for human rights and minority affairs. When he filed his appeal to the Lahore High Court in June, he said he would bring the Maira Shahbaz case before the Punjab Assembly.

“What motivates me is my faith in Jesus and I am reminded of the Gospel passage where Christ reveals how he has been sent to set the captives free,” he said at the time.

The Shahbaz family has reportedly had little contact with Maira since she was kidnapped. According to Sandhu, Maira’s mother Nighat Shahbaz collapsed and was treated to a heart attack when seeing her for the first time since her abduction at a May court hearing. Nighat Shahbaz refused to speak with reporters after the Lahore High Court ruling.

“Around 1,000 Christian and Hindu women are abducted each year in Pakistan and typically forced to convert to Islam,” the UK Telegraph said on Wednesday, quoting the Movement for Solidarity and Peace. Christians make up about two percent of Pakistan’s population.

Just as the crowd of recovered Covid-19 patients takes a position for a picture, as victors who defeated the virus, a six-year-old among them jumps in joy, sloganeering, “Hum Modi ko Marenge.” It translates as, “We will kill Modi.”

Narendra Modi is the sitting Prime Minister of India. He was elected democratically in 2014, and again, in 2019. Being the non-conventional Prime Minister who didn’t emerge from the leftist coterie and didn’t pander to Islamists in the name of secularism, Modi was never a favorite of the liberals. His sentiments toward Muslims was no secret either. In the past six years, the silent majority learned to live with their elected chief being disparaged by the self-declared flagbearers of morality, who, claiming higher moral ground, had wished death upon the Prime Minister multiple times.

Up came a case that was a little different, though not unexpected. A six-year-old Muslim child’s entire family had tested positive for Covid-19 and were linked with the group Tabligi Jamaat that acted as super-spreaders in the initial stages of the pandemic in India.

After the members of this Muslim family were discharged from Index Hospital in Indore, India, they lined up for a photo-op. Since having recovered, they have become a success story. Doctors, nurses, hospital staff, and political leaders joined the family to congratulate them on their recovery.

While the burqa-clad women and men in skull caps prepared for their picture, the six-year-old child jumped in glory, announcing his ambition to assassinate the sitting Prime Minister of the country. Curiously, his family members didn’t reprimand him. Instead, they laughed encouragingly -- according to a local political leader present at the occasion.

This is not an isolated incident of a Muslim child planning the Indian leader’s assassination. In January, a Muslim mother-daughter duo from Kerala posted a video clip on the popular video-sharing site Tik-Tok from the mother’s handle @Shaikha350. Discussing the supposedly planned assassination of the Prime Minister, the mother asked her daughter, “What should be done to save India?” The daughter—about five or six years old, responded, “Modi needs to be killed.” The mother quizzes: “and who will kill him?” The child responds: “you will.”

The video went viral, leaving netizens stunned, leading to massive outrage against the mother who was deemed to be a national threat by many. She was compelled to take the video down, but her intentions surely remained intact.

I will give one more example before discussing the root cause of the harrowing radicalization we see among children of a particular community.

For the first time in 70 years after being partitioned from India, the government of Islamic Pakistan spared a thought for the perennially persecuted minorities of the country. It decided on giving the handful of Hindus in Pakistan a Hindu temple dedicated to the Hindu deity, Krishna. The construction had hardly commenced when Islamists attacked and vandalized the structure in progress. Numerous Pakistanis expressed their abject objection toward the sole Hindu temple being built, and fatwas were issued against its construction; but what drew the media’s attention to this part of the world (not the liberal print houses with a selective conscience) was a video posted by a Pakistani father featuring his two toddlers vowing to kill all Hindus if a Hindu temple was erected in Islamabad.

In the video, the Pakistani father greets fellow Pakistanis as "brothers and sisters" and introduces his two sons-- aged no more than four years old. The camera focuses on the children, and the older one proclaims, “Mr. Imran Khan, if a temple is constructed in Islamabad, and then remember, I will kill all Hindus one by one. Understand? Allah Hafiz.” The younger one chimes in with an excited nod, the proud father then throws a challenge to the country chieftain, “See, now it is up to you.”

These are not mere children displaying their innocence to the world; they are future citizens, being raised with hate and bigotry. Their malleable minds are being criminalized from tender years, and they are being systematically conditioned to grow into adults with alarming instincts.  

Conditioning children to act with vehement disregard for non-Muslims is nothing new among Islamists. This practice is found across Asian countries with a thriving Muslim population and it's being introduced to the West, step-by-step.

The connection between terror groups and Madrassas has been studied in-depth and established by several scholars worldwide. In the report, “Madrasas and Recruitment of Child Soldiers: The Scenario in Afghanistanauthors Ghulam Mohammad Qane and Mohammad Naqib Ishan Jan investigate the role of madrasas (religious schools) in the recruitment and training of child soldiers.  Western audiences are well aware of the Taliban, but many do not know that the very word “Taliban” translates to “student” in the local dialect.

The Islamic State, according to research by Ghulam Mohammad Qane, Mohammad Naqib Ishan Jan, prefers recruits with exceptional religious knowledge. They write:

“The founders and leaders of Taliban are almost invariably madrasa graduates and students, and they have time and again turned to madrasas under their control for new recruits.”  

Mufti Jafar Hussain, who formed the Tehrik-e-Nifaz-e-Fiqa-e-Jafaria, had received an education from Madaris in Lucknow. The Sipah-e-Sahaba Pakistan was established by a Darul Ulum Eidgah Kabirwala disciple, Maulana Haq Nawaz Jhangvi. And notorious Islamist and terrorist Masood Azhar, chief of the Pakistan-based terror-organization Jaish-e-Mohammad, is a religious scholar trained in Islamic education at Jamia Ulum Al-Islamia, Banuri Town, Karachi.

In 2018, India Today carried out a sting operation on Kerala’s Madrassas and the findings exposed the seminaries programming impressionable minds with the objectives of ISIS. Their dream was to establish a universal caliphate, which they were determined to realize through a worldwide war. India Today quoted the joint secretary of a madrasa funded by a local trust:

“It's there in our hearts. We share this with the children bit by bit. There's no rush. A caliphate is not built in a day.”

Kerala supplies the maximum number of new recruits to ISIS from India.

Many madrasas take their terror training to the next level. Two were found to be training women in the art of bomb-making during the investigation of a series of bomb-blasts in Burdwan, West Bengal, India. The students of such institutions are radicalized to such extremes that when a local madrasa teacher in the state was arrested for possessing crude bombs and other weapons illegally, his students descended in large numbers and blocked major roads, fracturing the transportation system. In another incident, 32-bore pistols with tons of bullets were recovered from the Darul Quran Hamidia madarsa, Uttar Pradesh, India when the police, prompted by a tip-off, carried out a raid at the institution of Islamic religious studies.

Now you may feel relieved that this is a headache restricted to the governments and people living in south Asian countries. Think again. Back in 2011, CNN, a media house as leftist as it gets, spearheaded an investigation on what was being taught in Madrasas. What they discovered was disturbing. Kids were being trained to hate the Western world, the UK, and the Americas, and aspired to live the legacy of Osama Bin Laden. Usman Khan, the London Bridge attacker who was shot dead on November 29, 2019, aspired to start a Madrasa and terror training camp on his family-owned land in Pakistan-occupied Kashmir and raise a fresh crop of jihadis.

While some children have their own families planting the seed of hate in their hearts, others develop this seed through their “schools.” Surrounded by and indoctrinated with hate, these youngsters' futures are choreographed for violence and terror. Westerners need to know a lot more about the madrasas operating within their communities -- and what these Islamic religious schools are filling children's minds with and the dark journeys they're setting them out on.
