Pro-migration Democrats and business allies got President Joe Biden to quickly overrule a Friday announcement by his top staff that would have capped the 2021 inflow of refugees at 15,000.

“The President’s directive today has been the subject of some confusion,” White House press secretary Jen Psaki said in an afternoon statement. “We expect the President to set a final, increased refugee cap for the remainder of this fiscal year by May 15,” she added.

The Psaki announcement came a few hours after Jake Sullivan, Biden’s National Security Advisor, tweeted:

America needs to rebuild our refugee resettlement program. We will use all 15,000 slots under the new Determination and work with Congress on increasing admissions and building back to the numbers to which we’ve committed.

The scale of the reversal may not be known until May 15, when the final 2021 number is scheduled for release. But pro-migration groups are hoping that Biden will announce a 2021 goal of importing several tens-of-thousands of refugees before October, up from the 15,000 scheduled by former President Donald Trump.

The Washington Post reported late on Friday:

Late Friday, White House officials held a call with refugee advocates, during which deputy national security adviser Jon Finer said the cap would likely be lifted well before May 15, according to two people on the call. Finer also said that the administration would try to resettle refugees as soon as possible, rather than spreading out the admissions until Sept. 30, the people said. White House officials plan to hold another meeting with advocates next week, people with knowledge of the plans said.

Biden’s afternoon reversal came after a furious backlash by pro-migration advocates, including senior Democrats, far-left advocates, and business groups.

The morning statement setting the 15,000 level was slammed by Democrats, including Rep. Zoe Lofgren (D-CA),  Sen. Bob Menendez (D-NJ), and Rep. Alexandria Ocasio-Cortez (D-NY). “This is unacceptable,” said Sen. Dick Durbin, (D-IL), the second-ranking Democrat Senator.

The politicians’ protests were backed up by pro-migration advocates, including the FWD.us group of investors funded by Facebook founder Mark Zuckerberg.

“We strongly urge President Biden to reverse this decision and commit to his prior promises to rebuild America’s refugee program,” said a quick statement from the FWD.us group, which supports almost any increased inflow of workers, consumers, and renters into the American economy.

The tweeted statement by the wealthy investors suggested that Biden should overrule his top deputies, despite the polling crash caused by the pro-migration preferences of his appointee at the Department of Homeland Security:

At some of our best moments, America has been a beacon of hope and a nation that actively seeks to welcome those seeking refuge—and at some of our worst, we turned our back on those very people in their time of greatest need … today’s decision is not only morally wrong, but will make the forced migration situation from Central America worse.

We strongly urge President Biden to reverse this decision and commit to his prior promises to rebuild America’s refugee program.

The Zuckerberg group of investors is the leading funder and advocate for more migration into Americans’ communities and workplaces. Many other like-minded groups that have received funds from Zuckerberg joined in the backlash.

“Biden should revisit” the decision, said a tweet from Frank Sharry at the Zuckerberg-funded America’s Voice group. “This refugee decision [reeks] of politics. If that’s true, then it’s an unforced political error,” Sharry said in another tweet.

“This decision is bullshit,” Sharry continued in another tweet.

The National Immigration Forum — another recipient of Zuckerberg funds — joined in slamming the 15,000 announcement, saying:

On the day the Biden administration decides to maintain refugee resettlement historic lows, I think about the Afghans who helped our military and what they must be thinking.

Late on Friday, pro-migration advocates celebrated when Biden reversed the staff’s 15,000 decision.

“This is a testament to the power that people’s movements, community advocates, & progressive coalitions have built,” Ocasio-Cortez tweeted. “Thankful for that and the Biden admin’s decision to respond to organizers today. Now let’s get these families to their new homes here in the United States.”

The Biden reversal will likely worsen public worries about his immigration policies.

A White House official told the New York Times that the lower goal of 15,000 was picked because of public opposition to the border chaos:

A senior administration official, speaking on the condition of anonymity to discuss the decision-making, said the administration grew concerned that the surge of border crossings by unaccompanied minors was too much and had already overwhelmed the refugee branch of the Department of Health and Human Services.

The Washington Post reported April 16:

People close to the White House’s decision-making have said they detected political concerns about expanding the refugee program at a moment when there is increasing pressure on Biden to be tougher on immigration and border security. Biden is dealing with a surge in the number of migrants arriving on the southern border, which has caused policy and political worries about immigration inside the White House, according to people with knowledge of the situation.

Biden’s half-open, half-closed border has created chaos and has deeply damaged Biden’s poll numbers. Breitbart News reported April 15:

Biden’s policies have gotten him 64 percent disapproval among independents, and 55 percent disapproval among Latinos, according to a Quinnipiac poll of 1,237 adults, conducted April 8-12.

Just 22 percent of swing-voting independents and 27 percent of Latinos support Biden’s policy to extricate hundreds of thousands of migrants from their countries into a Hunger Games-style obstacle course, so they can be used in the U.S. economy.

GOP voters strongly oppose these policies, so the Quinnipiac numbers translate into a national disapproval rate of 55 percent, with just 29 percent approval for Biden’s immigration policy.

The refugee programs are unpopular among ordinary Americans because they shift elite attention from Americans’ concerns by pushing foreign migrants into Americans’ towns. That population shift helps to push down wages, raise rents, crowd schools, fracture stable communities, shrivel investment in labor-saving machinery, and redirect corporate investment to the coastal states.

The programs are supported by low-wage employers, university leftists, landlords, retailers, and organizations that receive taxpayer dollars to settle the refugees.

Most refugees settle in coastal states, pushing up rents and capping wages for nearby Americans, such as those living in Ocasio-Cortez’s district. That skew hides much of the program’s damaging impact. But people in heartland states also lose when refugees settle in coastal states because the arrival of foreign labor allows coastal investors to focus their job-creating investments near their coastal homes, not in the interior states, such as West Virginia, Ohio, and Kentucky.

Refugees are put on a fast-track to citizenship and can import additional family members via chain migration. The growing population of Democrat-voting Somalis in the United States is the most obvious impact of the nation’s expensive refugee program.

If each migrant brings in just five relatives, then a 2021 goal of 30,000 refugees will eventually deliver 180,000 refugees. The New York Times sketched the chain-migration process:

Asende Ecasa, 33, packed her belongings and left the Nyarugusu refugee camp in Tanzania last month expecting to arrive in the United States on March 4. After Mr. Biden delayed the admissions designation, Ms. Ecasa’s flight was canceled. The medical screening she got to ensure her travel has expired.

Her cousin Alex Majaliwa, who lives in Grand Rapids, Mich., now has no idea when Ms. Ecasa will be allowed into the country.

“If possible, the president can really hear our suffering because we want to come to the nation to find our life, to improve our lives,” Mr. Majaliwa said. It took him years to be approved for resettlement in America.

Chomsky: GOP ‘Dedicated with Passion to Ensuring that the Survival of Organized Human Society Will Be Impossible’

Ahead of this week’s planned virtual Earth Day Summit, leftist political activist Noam Chomsky slammed the modern GOP’s stance on climate change. Chomsky, in the past, has railed against the Trump administration for its lack of action addressing climate change, calling former President Donald Trump worse than Adolf Hitler.

According to the MIT professor, the Republican Party is “dedicated with passion to ensuring that the survival of organized human society will be impossible.” He said the GOP is the “only organization in human history” that has acted that way.

“They are the only organization in human history that is dedicated with passion to ensuring that … the survival of organized human society will be impossible,” Chomsky said Sunday on MSNBC’s “The Mehdi Hasan Show.” “That’s exactly their program since 2009 when they shifted to a denialist position under the impact of the Koch brothers’ juggernaut. Before that, when McCain was running, there was a moderate limited climate program.”

“The denialism — there’s nothing like that in human history,” he added. “It’s clear what is going to happen.”

George W. Bush Digs up ‘Any Willing Worker’ Cheap Labor Plan

Former President George W. Bush is still urging Congress to import more cheap and compliant visa workers — and even more legal immigrants — 17 years after he pushed Congress to adopt his very unpopular “Any Willing Worker” cheap labor law.

“Increased legal immigration, focused on employment and skills, is also a choice that both parties should be able to get behind,” Bush wrote in an op-ed for Jeff Bezos’ Washington Post.  He continued:

The United States is better off when talented people bring their ideas and aspirations here. We could also improve our temporary entry program, so that seasonal and other short-term jobs can more readily be filled by guest workers who help our economy, support their families and then return home.

Bush “is a decent man, but he has no understanding of the country’s political situation,” said a tweeted response from Mark Krikorian, director of the Center for Immigration Studies. He “has zero credibility, with anyone, on immigration,” Krikorian added. 

After he pushed his plans for amnesty, more immigration, and more visa workers in 2006 and 2007, Bush’s poll ratings fell to roughly 33 percent in 2008. In 2016, Donald Trump pulverized Bush’s expected successor, Jeb Bush, and helped the party adopt immigration policies favored by voters. Over the next four years, Trump helped push up Americans’ wages and forced companies to invest in wealth-producing, labor-saving machinery. 

In his new op-ed. Bush’s mention of a claimed “temporary entry program” refers to the visa programs which import massive numbers of blue-collar and white-collar workers for jobs that can be performed by Americans.

Each year, the nation’s employers import roughly at least 500,000 foreigners for blue-collar jobs by using the H-A2, H-2B, and J-1 visas programs. The programs hold down wages for all American and legal immigrant blue-collar workers in the U.S. companies and also minimize management hiring headaches.

In addition, Fortune 500 companies and universities employ at least 1.5 million white-collar temporary workers in jobs needed by American graduates. These white-collar workers are imported via the H-1B, L-1, J-1, OPT, and CPT programs. The white-collar workers cut salaries for American college-graduates, exclude Americans from growth careers, transfer good jobs to the coasts, and also help the Fortune 500 block Americans from creating new rival technologies.

These visa programs serve a similar role to the “Any Willing Worker” program that Bush tried to create in 2004.

Bush’s “Any Willing Worker” program would have allowed employers to hire foreigners at very low wages once Americans declined the offered wage. Once the program was widely used, it would have pressured Americans to accept whatever wage was good enough for foreigners, such as an Indonesian fisherman, a Bolivian mother, a Chinese engineer, or an Egyptian fruit-picker.

The foreigners would have been eager to take low wages for the U.S. jobs, in part because they would also get the colossal, government-granted prize of U.S. citizenship for themselves and their chain-migration relatives by simply offering to work longer hours for less money.

“New immigration laws should serve the economic needs of our country,” Bush announced on January 7, 2004. “If an American employer is offering a job that American citizens are not willing to take, we ought to welcome into our country a person who will fill that job,” he said, adding:

I propose a new temporary worker program that will match willing foreign workers with willing American employers, when no Americans can be found to fill the jobs. This program will offer legal status, as temporary workers, to the millions of undocumented men and women now employed in the United States, and to those in foreign countries who seek to participate in the program and have been offered employment here. This new system should be clear and efficient, so employers are able to find workers quickly and simply.

“Some temporary workers will make the decision to pursue American citizenship,” Bush added. ” Those who make this choice will be allowed to apply in the normal way.”

The New York Timereported January 7, 2004:

The president’s proposals were designed to appeal to Hispanic groups, a constituency that the White House is focusing on as Mr. Bush seeks re-election this year. The proposals are expected to be embraced by President Vicente Fox of Mexico, who has been lobbying for them for the past three years.

In his new Washington Post op-ed. Bush noted that immigrants are likely to be grateful workers — without mentioning that Americans must pressure their employers to pay the salaries they need for their families, homes, and children:

The backgrounds [of legal immigrants] are varied, but readers won’t have to search hard for a common theme. It’s gratitude. So many immigrants are filled with appreciation, a spirit nicely summed up by a Cuban American friend who said: “If I live for a hundred years, I could never repay what this country has done for me.”

But in the White House, Bush support for migrants allowed his GOP deputies to look down on ordinary Americans, according to an April 15 op-ed by Peggy Noonan, a columnist at the Wall Street Journal:

During the Bush immigration debates, when the base of the party rebelled against his comprehensive reform bill, a mostly unspoken accusation emanated from the president’s operatives. It was that the new Americans, including illegal immigrants, were kind of better than the existing American working class, harder-working. This was situational snobbery: The operatives themselves had left the working class behind, but daily rubbed shoulders with newer Americans at home and at the club. That snobbery helped break the party […] the working and middle class of all colors. Workers already here need backup. It’s better to lose campaign contributions than voters.

Bush’s push for cheap labor comes as Democrats join with billionaires — including Mark Zuckerberg’s FWD.us advocacy group– — to push for a dramatic new rush of migrants, including an unlimited infl0w of foreign college graduates.

Bush’s new Washington Post op-ed was covered by several journalists, none of whom mentioned Bush’s long history of using immigration to cut wages and so boost the stock market.

Matthew Brown at USAToday, for example, mentioned Bush’s presidential support for “temporary worker visa programs” but included no description of the “Any Willing Worker” program.

The voter opposition to elite-backed economic migration coexists with support for legal immigrants and some sympathy for illegal migrants. But only a minority of Americans — mostly Leftists — embrace the many skewed polls and articles pushing the 1950’s corporate “Nation of Immigrants” claim.

The deep public opposition to labor migration is built on the widespread recognition that migration moves money away from most Americans’ pocketbooks and families. It moves money from employees to employers, from families to investors, from young to old, from children to their parents, from homebuyers to real estate investors, from red states to blue states, and from the central states to the coastal states such as New York.


GOP Memo: Joe Biden Has Opened Borders to Help Donors and CEOs

The Republican Study Committee has posted talking points for GOP legislators to help them focus public opposition against the mass migration caused by pro-migration zealots in President Joe Biden’s administration.

“The Biden Immigration Agenda sacrifices the interests of the American People in order to serve the interests of foreign citizens, criminal cartels, and ultra-wealthy multinational corporations,” says the April 12 memo from Rep. Jim Banks (R-IN). The memo continued:

Biden’s agenda rejects responsible limits and controls on the number of people entering the country.

It’s as if the Biden Administration recognizes no borders at all.

President Biden’s policy is not liberal, or even merely left-wing — it is radical, extreme and beyond the bounds of rational thought.

While Biden reshapes our immigration system to serve rich donors and giant corporations, we believe it must serve the interests of American citizens, families and workers.

“Trump FIXED it, Biden BROKE it. It’s just that simple,” the memo says.

The memo would help GOP legislators reframe the debate around Americans’ concerns, and away from the focus on migrants’ desires that pro-migration groups and most of the nation’s media tout.
For example, Mark Zuckerberg’s FWD.us advocacy group funded a polling memo which warned pro-amnesty legislators to avoid talking about jobs and wages and to instead focus their pitch on the worries and concerns of foreign migrants:

It is better to focus on all of the aforementioned sympathetic details of those affected [by an amnesty] than to make economic arguments, including arguments about wages or demand for labor. As we have seen in the past, talking about immigrants doing jobs Americans won’t do is not a helpful frame, and other economic arguments are less effective than what is recommended above.

The migrant-first framing is pushed by establishment media outlets — such as The Washington Post — and by politicians who have decided to support an amnesty. “This is basically for the children,” Sen. Joe Manchin (D-WV) said April 1 after endorsing a 2021 amnesty that would reward investors and CEOs to hire foreign migrants instead of recruiting West Virginia’s adults and graduates.

The new GOP memo also shifts the Party’s message towards pro-American solutions and away from vague, donor-approved complaints about socialism, welfare, and security. A polling memo released March 24 by the billionaire-funded, pro-migration Immigration Hub group spotlighted the weakness of GOP messaging that avoids positive proposals:

In message-testing, Republicans’ greatest vulnerability on immigration is their refusal to work with Biden on solutions to the problem — instead opting to score political points. When presented with a range of criticisms of Republicans’ approach to the southern border, the following item is most concerning:

That Republicans in Congress refuse to work with President Biden on solutions to address what’s happening at the border, instead opting to block everything Biden is doing on immigration to score political points.

Banks wrote his memo after leading a delegation of GOP representatives to the border:

In the matter of mere weeks, the Biden Administration has transformed President Trump’s secured Southern Border into the sprawling site of an unmitigated and rapidly worsening disaster.

As we could clearly see with our own eyes what the Biden Administration desperately wants to hide from the American public: the situation is devolving and deteriorating by the day. When we met with local sheriffs, mayors and judges at the border, they told us in no uncertain terms that this is an indisputable crisis. They also told us they don’t have time for Congress to drag its feet and pass laws — they need help now. And they need it fast.

President Biden must not be allowed to hide behind the liberal media’s smoke screen. We must urge he and Vice President Harris to visit the border and see the crisis they created firsthand. It is incumbent upon all of us to ensure that he is held accountable to the American public for his massive failure.

Banks’ memo suggests four ways for GOP legislators to talk about Biden’s cheap-labor economic policy at the border:

1. National Security: Immigration policy should protect our national security by protecting the American people from terrorism, cartels, and other threats to their safety;
2. America First: Immigration policy should prioritize American workers first, help grow our middle class, raise wages, and enhance economic opportunity for all lawful residents well;
3. Rule of Law: Immigration policy should respect the rule of law, along with immigrants that honor our legal immigration processes, rather than incentivize law breaking;
4. Patriotic Assimilation: Immigration policy should aim to assimilate legal immigrants into the American family so they too can take pride in our values, history, and heritage.

Biden is also far from the mainstream, the memo says:

Americans regardless of party recognize the need to afford basic protections to U.S. workers in the job market. And voters throughout America recognize that we must first consider the social, economic and financial well-being of all American citizens and lawful residents here today. Biden has rejected this mainstream consensus and, with virtually no announcement or discussion, is sailing the United States deep into uncharted waters.

The mass employment of illegals by hundreds of businesses, though, continues to go largely ignored by the law, as only 11 employers and no businesses were federally prosecuted for hiring illegal aliens from 2018 to 2019. The number of federal prosecutions of employers who knowingly hire illegal aliens rarely exceeds 15 per year.  JOHN BINDER

The get-tough policy has brought complaints of abuse and harsh treatment, including charges that families have been unfairly separated after being caught in the nationwide dragnet.”

As Cecilia Muñoz, White House Director of Intergovernmental Affairs explained, “Even if the immigration law is executed with perfection, there will be parents separated from their children.” As it turns out, that separation policy was intentional, and the Obama administration deployed it to enrich cronies. 

“Texas-based Southwest Key Programs has taken in roughly $1 billion in federal contracts since the Obama administration,” Fox News reports, “and is expected to receive about $500 million this year to house and provide services for immigrant children.” Southwest Key holds a total of “more than 5,000 immigrant children, about 10 percent of whom are said to have been separated from their families since May, when the new policy was announced. Its shelters for immigrants minors are in Texas, Arizona and California.”

Southwest Key Programs also operates “the largest licensed shelter for immigrant children in the United States. A 250,000-square-foot facility at a former WalMart superstore in Brownsville, Texas, today houses some 1,500 boys between the ages of 10 and 17 who illegally entered the U.S.”  

According to a report by Drew Griffin of CNN, Southwest Key operates 83 detention centers across the country and has pulled in $1.5 billion in federal contracts. Southwest Key boss Juan Sanchez bags a cool $1.47 million a year “which makes him one of the highest paid charity CEOs in the country.” Mark Owen of the IRS told CNN Sanchez’s salary “extraordinarily high” and Sanchez’s wife grabs a salary of $262,000. The Southwest Key website does not feature management salary information. 

KXAN of Austin reports that Southwest Key has received $995 million in federal funds since 2015. Over a three-year period, Southwest Key had “more than 200 violations at its facilities,” including  a resident failing to receive proper care for a sexually transmitted disease (STD).

“La Raza was at the forefront of fighting for many issues of importance to Hispanics,” Fox News explains. “But it was also long criticized by those who charge that it is racist, and sympathetic to separatist ideology. The group rebranded, and changed its name in 2017 to UnidosUS.” Despite the name change, racism remains. 

Southwest Key boss Juan Sanchez served on the board of National Council of La Raza (NCLR), where Cecilia Muñoz served as senior vice president and immigration analyst before POTUS 44 tapped her for the White House job.  Southwest Key board member Anselmo Villarreal was also on the National Council of La Raza board from 2006 to 2012. 

He now runs La Casa de Esperanza, which provides services to immigrants at locations nationwide. As Fox reports, “Villarreal has taken high-profile positions against Trump immigration policies, and last month participated in a march against a Wisconsin county’s plans to work with federal immigration officials.”

“La Raza was at the forefront of fighting for many issues of importance to Hispanics,” Fox News explains. “But it was also long criticized by those who charge that it is racist, and sympathetic to separatist ideology. The group rebranded, and changed its name in 2017 to UnidosUS.” Despite the name change, racism remains. 

The primary source is La Raza Cosmica, by Mexican education minister and presidential candidate Jose Vasconcelos, republished in 1979 by the “Chicano Studies” department at Cal State LA. According to Vasconcelos, students from English, Dutch and Scandinavian backgrounds are “slower, almost dull,” compared to “mestizo children and youths from the south.” No scores but it’s something “any teacher can corroborate.” 

Blacks are “uglier stocks” and part of the “inferior races.” Halle Berry and Ben Carson might want to call their office. The Mongol, “with the mystery of his slanted eyes,” is part of an “exhausted people” that lacks the “boldness for new enterprises.” Apparently Xi Jinping and Shinzo Abe never got the memo.

On the other hand, according to La Raza Cosmica, the fusion of Spaniards and Indians is a new race “infinitely superior to all that have previously existed.” That is the raza replacing those awful Yankee “Anglo-Saxons,” code for all non-raza peoples who speak English. The non-raza Yankees “are gradually becoming more a part of yesterday.” 

Mexican American communist Bert Corona found The Cosmic Race similar to “the kind of German racial superiority theory supported by Hitler.” Even so, razaismo is the driving force of current efforts to violate the border and colonize the United States. 

Consider, for example, Andrés Manuel López Obrador, former mayor of Mexico City and candidate for president in Mexico’s July 1 election. As the New York Times, explains, “Manuel López Obrador’s victory seems inevitable.” The only question is “the size of his victory.”

Sure-fire winner Obrador calls mass immigration to the United States a “human right” and says migrants “must leave their towns and find a life in the United States.” This razaista wants his lebensraum and he wants it right now. 

If Obrador wins, President Trump might get him up to speed on America’s experience with regimes like that. And he might broach the subject of the $26.1 billion in remittances, an amount impossible without the bilking of American taxpayers on a massive scale.   

Whoever wins, the migrants will be coming in force and the Mexican colonialists will find many collaborators among leftist Democrats, the establishment media, and the crony razaists ripping off kids and American taxpayers alike.

Only in America could critics of a group called "The Race" be labeled racists. Such is the triumph of left-wing identity chauvinists, whose aggressive activists and supine abettors have succeeded in redefining all opposition as "hate."

Both Barack Obama and John McCain will speak this week in San Diego at the annual conference of the National Council of La Raza, the Latino organization whose name is Spanish for, yes, "The Race." Can you imagine Obama and McCain paying homage to a group of white people who called themselves that? No matter. The presidential candidates and the media have legitimized "The Race" as a mainstream ethnic lobbying group and marginalized its critics as intolerant bigots. The unvarnished truth is that the group is a radical ethnic nationalist outfit that abuses your tax dollars and milks PC politics to undermine our sovereignty.

Here are 15 things you should know about "The Race":

15. "The Race" supports driver's licenses for illegal aliens.

"The Race" is currently leading a smear campaign against staunch immigration enforcement leaders and has called for TV and cable news networks to keep immigration enforcement proponents off the airwaves -- in addition to pushing for Fairness Doctrine policies to shut up their foes. The New York Times reported that current "Race" president Janet Murguia believes "hate speech" should "not be tolerated, even if such censorship were a violation of First Amendment rights."

3. "The Race" sponsors militant ethnic nationalist charter schools subsidized by your public tax dollars (at least $8 million in federal education grants). The schools include Aztlan Academy in Tucson, Ariz., the Mexicayotl Academy in Nogales, Ariz., Academia Cesar Chavez Charter School in St. Paul, Minn., and La Academia Semillas del Pueblo in Los Angeles, whose principal inveighed: "We don't want to drink from a White water fountain, we have our own wells and our natural reservoirs and our way of collecting rain in our aqueducts. We don't need a White water fountain … ultimately the White way, the American way, the neo liberal, capitalist way of life will eventually lead to our own destruction."

Judge whose sister heads La Raza rules 130-year law against encouraging illegal immigrants is unconstitutional

Imagine if Alexandria Ocasio-Cortez or Rashida Tlaib got to single-handedly veto sovereignty legislation dating back to the 1880s just like a president could veto a new bill passed by Congress this session. Imagine if they could unilaterally abolish ICE and declare open borders, except, unlike a president, they wouldn’t have to stand for re-election. Well, that is exactly the situation this week with a single federal judge. Thanks to Republicans agreeing to the notion that judges – even lower court judges – have direct veto power over legislation, a foundational immigration law has just been “vetoed.”

KCUR-FM reports that on Wednesday, Judge Carlos Murguia of the U.S. District Court of Kansas ruled, based on a Ninth Circuit opinion, that 8 U.S.C. §1324, the law prohibiting someone from “encouraging” or “inducing” illegal immigration, is an unconstitutional infringement upon the First Amendment. In doing so, Murguia vacated the convictions of two illegal aliens, Jose Felipe Hernandez-Calvillo and Mauro Papalotzi, who were convicted in August 2018 by a jury for conspiring to encourage illegal aliens to remain here through employment at a drywall company in Lawrence, Kansas. Four others were originally indicted by a grand jury in 2015.

 

This law has been on the books in some form for over 130 years, and numerous federal courts have upheld convictions based on §1324. Yet one judge, who worked for an open-borders group named El Centro Inc. and whose sister Janet Murguia is president of La Raza (now called UnidosUS), suddenly thinks conspiring to harbor and encourage illegal immigration violates the First Amendment. Carlos’ sister Mary (who is an identical twin to Janet) is a federal judge on the very Ninth Circuit Court from which he drew this opinion. Judge Mary Murguia once recused herself from a trial involving pro-enforcement Sheriff Joe Arpaio because of her sister’s leadership of La Raza. Carlos should have done the same thing this week in this case, which involves a law that directly conflicts with the work with the open-borders groups his family is associated with.

Rather than rule based on the law, he decided to adopt the ruling of the Ninth Circuit (which doesn’t have jurisdiction in Kansas), which ruled last December that §1324 is “unconstitutionally overbroad” because it “criminalizes a substantial amount of protected expression.” “The court adopts (the 9th Circuit’s) analysis in full and agrees that (the law) on its face is overbroad under the First Amendment,” said Murguia in a brief bench ruling first reported by KCUR-FM.

This assertion is ridiculous, because the law clearly refers to engaging in subversive and fraudulent activities to encourage or enable actual individual aliens to remain in the country, not mere political advocacy for liberal immigration policies in the abstract. It’s like saying that someone who hates high taxes or gun control laws and advocates against them is the same as a person who actively assists tax cheats and gun felons in achieving the end goal of the criminalized behavior.

The 1952 INA (8 U.S.C. § 1324(a)(1)(A)(iv)) calls for felony prosecution for anyone who “encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law.” Subsection (V)(I) prohibits “any conspiracy to commit any of the preceding acts.” The two defendants in this case were convicted on both counts. This law passed the Senate unanimously!

The forerunners to this law were the Contract Labor Law of 1885 and the 1891 Immigration Act. The 1885 law made it unlawful to “in any way assist or encourage the importation or migration of any alien” for the purpose of contract labor. Section 3 of the 1891 Immigration Act made it a felony to “assist or encourage the importation or migration of any alien by promise of employment” through advertisements.

Other circuits have long recognized this law as completely legitimate. “Harboring, within the meaning of §1324, encompasses conduct tending substantially to facilitate an alien’s remaining in the United States illegally and to prevent government authorities from detecting his unlawful presence,” wrote the Second Circuit in 1999. “Such facilitation may be attempted through a wide range of conduct.” (United States v. Kim, 193 F.3d 567, 574 (2d Cir. 1999).) The Fifth Circuit has ruled that Congress intended for §1324 to “broadly proscribe any knowing or willful conduct fairly within any of these terms that tends to substantially facilitate an alien’s remaining in the U.S. illegally.”

So how could a single judge who has a family history of open-borders activism be allowed to veto such long-standing and universal laws? The answer is that he has no such power other than what the other branches are willing to cede him.

The concern here is that this will not only protect employers who knowingly help illegal aliens get around our immigration laws, but it will also essentially legalize sanctuary cities. Throughout the county, sanctuary cities are taking active steps to thwart immigration law. We would never tolerate this for other federal laws concerning American criminals. Why should illegal aliens have special privileges?

Rather than shirking from §1324 prosecutions, Trump’s DOJ should aggressively go after sanctuary cities, especially in areas where there are saner federal judges. A judge has no power to “strike down” or veto statutes he or she believes are overly broad. If there is a case that concerns pure speech or advocacy without any conspiracy or action taken to encourage illegal immigration, then it is within the prerogative of a judge not to convict the person. That is judicial power. But judges have no ability to say that the statute can’t be applied even when an action is involved because, in their view, the text of the law might rope in speech in other cases. To believe otherwise is to concoct an entirely new level of judicial veto that our Founders explicitly rejected. This is the difference between judicial review and judicial supremacy.

Finally, it’s important to remember that this is yet another example of judges attempting to fully nullify long-standing immigration law. Some on the Right believe that Congress needs to pass new laws in order to end illegal immigration. It’s simply not true. We don’t have a law problem; we have a judicial supremacy problem. The only question is whether the other branches will give this fake power full effect.
