John Durham Filing Suggests Clinton Operatives Spied on Trump in 2016 and in White House

Special Counsel John Durham filed a motion in federal court in Washington, DC, on Friday alleging that Hillary Clinton’s political allies paid a contractor to spy on Donald Trump — both as a candidate, and as president — using cell phone data.

The motion was filed in the case of former Clinton Campaign lawyer Michael Sussmann, who is charged with lying to the FBI about whether he was working for the campaign when he told the FBI about a false link between Trump and Russia.

Sussmann was a partner at Perkins Coie, which often represents Democrats and which hired Fusion GPS to produce the false Russia “dossier” on then-candidate Trump, at the behest of the Clinton campaign and the Democratic National Committee.

Durham’s filing deals with a potential conflict of interest involving Sussmann’s legal representation from Latham & Watkins LLP, which also represented others in the investigation “whose interests may conflict with those of the defendant.” These, the Techno Fog blog notes, include Perkins Coie, former Perkins Coie lawyer Marc Elias, and the Hillary Clinton campaign. If they are also charged or exposed to criminal liability, the firm might face a conflict of interest among the various defendants.

The filing then reveals that Sussmann was involved in an effort to mine data from a project run by the Defense Advanced Research Projects Agency (DARPA) at a U.S. university (identified in previous reports as Georgia Tech) to spy on Trump and his associates — at Trump Tower, at Trump’s private residence, and at the Executive Office of the Presidency once Trump took office int the White House. Their goal was to dig up damaging information that could then be used to build the “Russia collusion” narrative against Trump.

As Durham notes in the filing:

The Indictment also alleges that, beginning in approximately July 2016, Tech Executive-1 had worked with the defendant, a U.S. investigative firm retained by Law Firm-1 on behalf of the Clinton Campaign, numerous cyber researchers, and employees at multiple Internet companies to assemble the purported data and white papers. In connection with these efforts, Tech Executive-1 exploited his access to non-public and/or proprietary Internet data. Tech Executive-1 also enlisted the assistance of researchers at a U.S.-based university who were receiving and analyzing large amounts of Internet data in connection with a pending federal government cybersecurity research contract. Tech Executive-1 tasked these researchers to mine Internet data to establish “an inference” and “narrative” tying then-candidate Trump to Russia. In doing so, Tech Executive-1 indicated that he was seeking to please certain “VIPs,” referring to individuals at Law Firm-1 and the Clinton Campaign.

The Government’s evidence at trial will also establish that among the Internet data Tech Executive-1 and his associates exploited was domain name system (“DNS”) Internet traffic pertaining to (i) a particular healthcare provider, (ii) Trump Tower, (iii) Donald Trump’s Central Park West apartment building, and (iv) the Executive Office of the President of the United States (“EOP”). (Tech Executive-1’s employer, Internet Company-1, had come to access and maintain dedicated servers for the EOP as part of a sensitive arrangement whereby it provided DNS resolution services to the EOP. Tech Executive-1 and his associates exploited this arrangement by mining the EOP’s DNS traffic and other data for the purpose of gathering derogatory information about Donald Trump.)

The filing further explains that claims of collusion involving were based on supposed hookups from these targeted sites with a Russian mobile phone provider, but failed to note that these connections were common in the U.S. and had begun in 2014 — i.e. during the Obama administration, long before Trump.

The revelations in Durham’s filing are already being compared to Watergate, which began when Republican operatives broke into the offices of the Democratic National Committee during the 1972 presidential campaign. In this case, however, the alleged spying was not confined to the campaign but continued after the election, once Trump was already the president.

July 2016 also marks the point at which the Obama administration launched its investigation into supposed links between Trump and Russia, after Trump joked at a press conference about Russia looking for Hillary Clinton’s missing emails.

In March 2017, after radio host Mark Levin noted evidence in the public domain that investigators had used wiretaps to eavesdrop on Trump associates, Trump claimed the government had his “wires tapped” and was attacked by the media.

Fox News quoted former Trump aides reacting to the news of Durham’s filing, claiming it vindicated their suspicions:

Former chief investigator of the Trump-Russia probe for the House Intelligence Committee under then-Rep. Devin Nunes, R-Calif., Kash Patel, said the filing “definitively shows that the Hillary Clinton campaign directly funded and ordered its lawyers at Perkins Coie to orchestrate a criminal enterprise to fabricate a connection between President Trump and Russia.”

“Per Durham, this arrangement was put in motion in July of 2016, meaning the Hillary Clinton campaign and her lawyers masterminded the most intricate and coordinated conspiracy against Trump when he was both a candidate and later President of the United States while simultaneously perpetuating the bogus Steele Dossier hoax,” Patel told Fox News, adding that the lawyers worked to “infiltrate” Trump Tower and White House servers.

Former President Trump also issued a statement:

The latest pleading from Special Counsel Robert Durham provides indisputable evidence that my campaign and presidency were spied on by operatives paid by the Hillary Clinton Campaign in an effort to develop a completely fabricated connection to Russia. This is a scandal far greater in scope and magnitude than Watergate and those who were involved in and knew about this spying operation should be subject to criminal prosecution. In a stronger period of time in our country, this crime would have been punishable by death. In addition, reparations should be paid to those in our country who have been damaged by this.

Sussmann has pleaded not guilty in the case.

Durham makes allegations that make Watergate look like small potatoes

On Friday, Special Counsel John Durham filed with the D.C. Federal District Court a what should have been a boring conflict of interest motion, but it hid a surprise: The Clinton campaign, through Perkins Coie, spied on Trump both before and after he was president. The following is an plain English-language summary of relevant parts of the motion:

Michael Sussman was a partner at Law Firm-1 (i.e., Perkins Coie). He met with the FBI General Counsel (i.e., James Baker), and offered data and “white papers” purporting to show that Trump was communicating covertly with a Russia-based bank (i.e., Alfa-Bank). Mueller, incidentally, had to admit this was untrue.

Durham indicted Sussman because he allegedly told Baker that he was not divulging this information for a client. In fact, he was acting for at least two clients: the Clinton campaign and “Tech Executive-1” (i.e., Rodney Joffe), who worked at a “U.S.-based internet company” (i.e., Neustar Inc., a federal contractor).

As part of his work on the Clinton campaign, Sussman repeatedly met and communicated both with Joffe and with “another law partner” who was “Campaign Lawyer-1.” (I guess we can await that indictment soon....)

Beginning in July 2016, Joffe began to work with (1) Sussman, (2) an investigation firm that Perkins Coie hired for the Clinton campaign, (3) cyber researchers, and (4) “employees at multiple Internet companies” to assemble the data handed to James Baker. To do so, Joffe exploited access to private and/or proprietary internet data. He even coopted researchers at a U.S. university who were receiving lots of internet data as part of a cybersecurity research contract that was pending with the feds. (The Conservative Treehouse says the university is Georgia Tech and it was a DARPA contract.)

Durham alleges that Joffe was accessing internet traffic for “a particular healthcare provider” (speculated to be Spectrum Health), Trump Tower, Donald Trumps Central Park West apartment building, and “the Executive Office of the President of the United States (‘EOP’).” (Emphasis mine.)

Joffe had a very specific assignment for the people working for him: He wanted them to mine internet data (and again, this was not public data) to “establish ‘an inference’ and ‘narrative’” that would tie then-candidate Trump to Russia. He told people that he was “seeking to please certain ‘VIPs,” meaning both Perkins Coie and the Hillary campaign.

Much of the motion is concerned with allegations already familiar to you from the indictment against Sussman. Thus, after talking to Baker, Sussman also talked to another government agency, telling its employees that DNS data (that is “Domain Name System” info, which is like an internet telephone director) revealed that Trump or his team had looked up Russian contacts millions of times.

Sussman neglected to add that these DNS lookups were for Trump Tower as a whole, which is a massive business center. More importantly, when reporting about lookups from the “EOP” (that is, the White House server), Sussman didn’t mention that many of those DNS lookups went back to 2014—that is, when Obama was in the White House.

So again: Durham just let everyone know that the Hillary campaign, acting through Perkins Coie and its attorneys, engaged a tech-savvy executive to spy on Trump internet searches. This executive exploited his connections to obtain private and proprietary data (including federal government data) to review internet searches originating in Trump Tower, Trump’s home, and the White House. Moreover, this spying, which began when Trump was still a candidate, continued once he became president.

Trump, obviously, trumpeted the fact that he was right all along, as well as making clear the enormity of what happened:

Obviously, it’s nice to be proven correct. However, I agree with Conservative Treehouse that there are a few glaring problems here. Preliminarily,

The obvious question is: If Rodney Joffe is spying on the office of the president, why hasn’t he been indicted?

That’s just one question, though. The real problem, which Sundance places at the head of his post, is this:

CTH begins every outline of the ongoing Durham investigation with the following disclaimer: How is John Durham going to reveal everything that is possible about the deep state Trump targeting operation, and simultaneously handle the involvement of Robert Mueller, Andrew Weissmann and the Special Counsel team who were specifically appointed to cover it up?

The short answer is, Durham can’t. The ramifications would collapse the U.S. government; yes, all three collaborating branches.

As a consequence, some of these revelations are only valuable insofar as they will be needed by historians who look upon the scattered rubble of this once great republic and seek to explain to future generations how it all went wrong.

In other words, the Durham investigation is almost certainly just another cover-up. The Russia Hoax is a huge infection in the American body politic. It was Mueller’s responsibility, and it’s now Durham’s, to hide that infection. To that end, Durham is going to focus America’s attention on a few hangnails and scratches, in the hope it deflects us from the fact that the American political system is dying from sepsis. I would love to see Durham expose the whole festering mess, and I’d happily eat my words, but I don’t see that happening.

Failed presidential candidate Hillary Clinton will reportedly reenter the political sphere by speaking at the New York state Democrat Convention in late February.

Hillary will attend the convention at the Sheraton hotel in Times Square, CNBC reported, sparking “new speculation that she could run for the nation’s highest office again.”

A source told CNBC Hillary’s popularity is greater than President Biden’s, and suggested that speaking at the event will be useful to her, as it puts her in the spotlight.

“She’s beloved by the mainstream members of the Democratic Party and her popularity is likely higher than that of President Biden. It’s good for her because it keeps her relevant and her appearance is likely meant to galvanize the party and the audience,” the source said.

When Biden visited Georgia in January to speak about federalizing elections, gubernatorial candidate Stacey Abrams did not attend his event due to a scheduling conflict. Gubernatorial candidate Beto O’Rourke stated last week he is “not interested” in help from Biden during his Texas campaign.

Pennsylvania Democrats John Fetterman and Josh Shapiro on Thursday cited conflicts in their schedules for their absence during Biden’s visit to Pennsylvania.

Democrat candidates in Iowa and North Carolina have even stopped talking or tweeting about Biden. Moreover, Democrat Governors Association chair and North Carolina Gov. Roy Cooper (D) completely avoided the question when asked about Biden’s role in the governors’ campaigns.

If Hillary is thinking about running in 2024, she will have to raise money. She has been advertising a hat for $30 and coffee mugs for $20.

“Take a sip from your new mug as you read the news…,” Hillary tweeted a photo of the mug and a headline that slammed Donald Trump.

In the days of the Cold War, the narrative of the arch-reactionaries and anticommunists revolved around a conspiracy theory according to which the United States had been infiltrated at the highest levels by agents of the Soviet Union.

In the early 1950s, Wisconsin Senator Joseph McCarthy led the anti-Soviet campaign, alleging that Russian spies occupied top positions in the government, in universities, in Hollywood and even in the military. According to McCarthy, “a conspiracy so immense and an infamy so black as to dwarf any previous venture in the history of man” implicated not only the Soviet Union but was also responsible for the “loss of China” in the 1949 Chinese Revolution.

The “Red Menace” was the pretext for attacking and delegitimizing all manifestations of social and political opposition, including the Civil Rights movement, as the work of “outside agitators” who received their orders from Moscow. It was Martin Dies, the Democratic congressman from Texas and initiator of the witch-hunting House Un-American Activities Committee, who declared in his 1940 book The Trojan Horse in America that Moscow had “envisioned an unusual opportunity to create racial hatred between the white and Negro citizens of the United States.”

In the late 1950s, after the heyday of McCarthy, the political thread was taken up by the John Birch Society, founded in 1958 by Massachusetts businessman Robert Welch, who notoriously declared that President Dwight D. Eisenhower was a “dedicated, conscious agent of the Communist conspiracy.”

In 1964, Welch backed the ultra-right Republican candidate Barry Goldwater, whose failed presidential campaign was heavily influenced by John Stormer’s book None Dare Call It Treason. “Will America continue to aid the communist enemy,” Stormer asked, “to disarm in the face of danger, to bow before communist dictators in every corner of the earth? The decision is yours.”

Nothing is dead in politics. The legacy of McCarthyism is now being revived by the campaign led by the Democratic Party and summed up in a hysterical screed published Wednesday in the Washington Post by Hillary Clinton, the self-professed former “Goldwater girl,” under the headline, “Mueller documented a serious crime against all Americans. Here’s how to respond.”

According to Clinton, “Our election was corrupted, our democracy assaulted, our sovereignty and security violated. This is the definitive conclusion of special counsel Robert S. Mueller III’s report.” The perpetrator again is Russia, which Clinton, citing the Mueller report, claims has carried out a “sweeping and systematic” attack on the United States.

The Clinton narrative, which is the official line of the Democratic Party, is a monumental lie. Responsibility for Clinton’s defeat in the 2016 elections is attributed entirely to the operations of Russian bots and “Guccifer 2.0,” the persona of the individual who supposedly hacked Democratic Party emails. Her campaign, Clinton writes, was the “target of a Russian plot,” directed by President Vladimir Putin, who “seeks to weaken our country.”

And what did this new “conspiracy so immense” actually involve? According to the Mueller report itself, organizations associated with Russia allegedly spent $100,000 on Facebook ads. This is 0.12 percent of the $81 million spent by the Democratic and Republican election campaigns themselves on Facebook ads, in a campaign dominated by the $5 billion spent by the billionaire backers of the two parties to buy the election.

As for the release of Democratic Party emails, even if one accepts the unsubstantiated claim that it was Russian operatives who turned them over to WikiLeaks, what the emails revealed were true facts about the operations of Clinton and the Democratic National Committee (DNC)—facts that the electorate had every right to know. Among the documents released were Clinton’s speeches to Goldman Sachs and other banks, for which she was paid hundreds of thousands of dollars. Other leaked emails exposed the corrupt efforts of the DNC to rig the primaries against Bernie Sanders.

Clinton lost in the 2016 elections because the Democratic Party, in line with the class interests it represents, made a calculated decision not to raise any social issues or make any appeal to the working class in its campaign against Trump. Do Clinton and company really expect the public to believe that Facebook ads put out by Russian agents were behind the collapse in voter turnout in working-class areas of Michigan, Wisconsin and other states?

The victory of the billionaire demagogue Trump was the result of widespread disillusionment with the Democratic Party after eight years of the Obama administration, which broke every campaign promise and exposed as lies the empty prattle about “hope” and “change.” Obama focused his energies on bailing out Wall Street and shoring up the wealth of the corporate and financial elite.

In her column, Clinton goes on to call for an alliance between the Democratic Party and the Republicans. The situation calls for “clear-eyed patriotism, not reflexive partisanship,” she writes. She urges Republicans to work with Democrats in an intensified campaign against Russia—with or without the Trump administration. She writes: “It’s up to members of both parties to see where that road map [provided by the Mueller report] leads—to the eventual filing of articles of impeachment, or not. Either way, the nation’s interests will be best served by putting party and political considerations aside and being deliberate, fair and fearless.”

Clinton wants a bipartisan foreign policy that is “fearless” in its aggression against not only Russia, but also China. “Unless checked, the Russians will interfere again in 2020, and possibly other adversaries, such as China or North Korea, will as well,” she warns. Unless Trump is “held accountable, the president will likely redouble his efforts to advance Putin’s agenda, including rolling back sanctions, weakening NATO and undermining the European Union.”

Changing what needs to be changed, such words could have been penned by Robert Welch himself. Confronting a fascistic president, the Democrats have managed to frame their entire opposition around a right-wing narrative. If the Democrats had their way and Trump were removed—to be replaced, don’t forget, by the ultra-right Vice President Mike Pence—it is almost certain that the immediate consequence would be war with nuclear-armed Russia.

Inextricably connected to the conflicts over foreign policy is the escalation of the attack on democratic rights within the United States. Reprising the ravings of Dies, social discontent is attributed to the nefarious efforts of Russia to “sow discord” within the United States.

Significantly, Clinton cites as a model the actions of the ruling class after the September 11, 2001 attacks, when “Congress established an independent, bipartisan commission to recommend steps that would help guard against future attacks.” She concludes, “We need a similar commission to help protect our elections.”

The September 11 attacks—a terrorist atrocity that killed nearly 3,000 people—were followed by the Patriot Act, the Homeland Security Department, the Northern Command, domestic spying, Guantanamo Bay, the institution of torture and drone assassinations as government policy, and other crimes. The campaign of the Democrats over the Russian “attack”—a lie fashioned from whole cloth—has been accompanied by far-reaching moves to censor the internet under the guise of combating “fake news.”

The Democrats’ warmongering and attack on democratic rights come together in the persecution of WikiLeaks and its founder Julian Assange, whose enduring contribution to the population of the world was the exposure of the crimes of American imperialism. For this, Assange is currently imprisoned in Britain, facing imminent rendition to the United States. The courageous whistleblower Chelsea Manning is in jail for refusing to testify against him.

Such is Clinton’s defense of “our democracy.”

All of this further demonstrates that in the conflict between Trump and the Democratic Party there is no progressive or democratic faction. The anti-Russia narrative has not been challenged by any section of the Democratic Party, including Bernie Sanders, who is again seeking to cover up this warmongering party with a thin veneer of social reforms that it has no intention of implementing.

The conflict between the Democrats and the Trump administration is a conflict between two reactionary factions of the ruling class. All those political organizations and groups that are seeking to direct social opposition behind the Democratic Party are playing the most criminal role. They are no less terrified than Trump and the Democrats of the development of a genuine socialist movement of the working class, which will oppose American capitalism and its wars.

If you asked one hundred people what they think about when they hear the name Bill Clinton, a goodly number will say womanizer, cheater – a few will use the dreadful word rapist. And that number will increase. Time and neurology are working against the Clintons.

Most memory training programs are simply a matter of learning how to associate memories with emotionally charged ideas. This is because the brain is designed to remember where the dangers and the goodies lie and to forget the dry statistics. The brain is more inclined to remember Jennifer Flowers than the unemployment rate in 1996. This effect has tainted the collective memory of many presidents, for example, disclosures about the mistresses of Franklin Delano Roosevelt and John Kennedy. This effect will increase for Bill Clinton both because of the outrageous nature of his conduct and the way it has and will be reported.

 

People tend to cut quite a bit of slack for the weaknesses of the flesh because there’s a lot of that going around. But Hillary will gain no benefit from that latitude. Everyone knows she stood by her man, blamed his women, and perhaps was a psychological co-rapist for the sake of her political ambitions.  Before the next president is elected, Hillary will not only have an albatross around her neck, she will be covered with names like Wellstone, Broaddrick, Moffet, Ward Gracen, Brown, Dowdy, Jones, Ferguson, Zercher, Willey, and more. If you asked one hundred people what they think about when they hear the name Bill Clinton, a goodly number will say womanizer, cheater – a few will use the dreadful word rapist. And that number will increase. Time and neurology are working against the Clintons.

Most memory training programs are simply a matter of learning how to associate memories with emotionally charged ideas. This is because the brain is designed to remember where the dangers and the goodies lie and to forget the dry statistics. The brain is more inclined to remember Jennifer Flowers than the unemployment rate in 1996. This effect has tainted the collective memory of many presidents, for example, disclosures about the mistresses of Franklin Delano Roosevelt and John Kennedy. This effect will increase for Bill Clinton both because of the outrageous nature of his conduct and the way it has and will be reported.

People tend to cut quite a bit of slack for the weaknesses of the flesh because there’s a lot of that going around. But Hillary will gain no benefit from that latitude. Everyone knows she stood by her man, blamed his women, and perhaps was a psychological co-rapist for the sake of her political ambitions.  Before the next president is elected, Hillary will not only have an albatross around her neck, she will be covered with names like Wellstone, Broaddrick, Moffet, Ward Gracen, Brown, Dowdy, Jones, Ferguson, Zercher, Willey, and more. A majority of those one hundred people will remember the evil the Clintons did, and their legacy will be lost in the folds of tattered dresses and bleeding lips.

WikiLeaks' Assange shows pro-Republican view in reported leaks

In private chat conversations a year before Donald Trump was elected, the WikiLeaks founder criticized Hillary Clinton as a "sadistic sociopath," The Intercept reports.

Julian Assange, the WikiLeaks founder more accustomed to publishing others' secrets, has apparently become the subject of a new leak that shows him favoring the Republican Party a year before Donald Trump was elected.

In a private Twitter chat group, Assange called Democratic Party candidate Hillary Clinton a "bright, well-connected, sadistic sociopath" and said, "We believe it would be much better for the GOP to win," according to The Intercept. The authenticity of the 11,000-message conversation couldn't be verified, but The Intercept said it came from a former WikiLeaks supporter in the chat group and verified that the message group and its messages exist.

WikiLeaks didn't immediately respond to a request for comment.

WikiLeaks was involved in the controversial 2016 election, publishing alleged messages from Clinton campaign chief John Podesta and corresponding with Donald Trump Jr. before and after the election.

Assange has been holed up in a small room in the Ecuadorian Embassy in London for more than five years to avoid extradition for a rape charge in Sweden. The country dropped that charge but he's still facing a UK charge of skipping bail.
