A Democrat-nominated judge has unveiled a decision ordering the border agency to stop using the Title 42 anti-disease barrier to exclude wage-cutting economic migrants from the United States.
The White House — and Republican governor of Texas, Greg Abbott — may appeal the judgment to other judges and to Justice John Roberts on the Supreme Court.
The nation’s pro-migration border chief, Alejandro Mayorkas, has been reducing the use of the Title 42 barrier since he took over the nation’s borders in February 2021. In October, for example. 277,500 people arrived at the border, but Mayorkas excluded just one-third — 81,500 — under Title 42.

In the 12 months before October 2022, almost 2.7 million migrants were registered while crossing the border.
Mayorkas declined to use the Title 42 legal barrier to exclude 1.66 million of those migrants from the United States.
The elite-backed, multi-decade inflow of illegal migrants and legal migrants has imposed a huge cost on Americans by pressuring down their wages. It has also boosted rents and housing prices, and it has reduced ordinary, native-born Americans’ clout in local and national elections .
The inflow has also pushed many native-born Americans out of careers in a wide variety of fields and spiked the number of “Deaths of Despair.”
The border welcome offered by Mayorkas and Biden has also killed thousands of job-seeking migrants, both at the U.S.-Mexico border, and further south, especially in the Panamanian jungle.
However, Democrats are working with the GOP’s business wing to pressure the populist wing of the GOP into approving another citizenship-diluting amnesty and more wage-cutting migration.
Extraction Migration
Government officials try to grow the economy by raising exports, productivity, and the birth rate. Those strategies are difficult and slow, and so officials also try to expand the economy by extracting millions of migrants from poor countries to serve as extra workers, consumers, and renters.
This policy floods the labor market and so it shifts vast wealth from ordinary people to investors , billionaires , and Wall Street . It also makes it difficult for ordinary Americans to advance in their careers, get married, raise families, buy homes, or gain wealth .
Extraction migration slows innovation and shrinks Americans’ productivity . This happens because migration allows employers to boost stock prices by using stoop labor and disposable workers instead of the skilled American professionals and productivity-boosting technology that earlier allowed Americans and their communities to earn more money.
This migration policy also reduces exports because it minimizes shareholder pressure on C-suite executives to take a career risk by trying to grow exports to poor countries.
Migration undermines employees’ workplace rights, and it widens the regional economic gaps between the Democrats’ cheap-labor coastal states and the Republicans’ heartland and southern states.
An economy fueled by extraction migration also drains Americans’ political clout over elites and it alienates young people. It radicalizes Americans’ democratic civic culture because it gives a moral excuse and an economic tool to the wealthy elites and progressives who want to divorce outspoken Americans — and especially poor Americans at the bottom of society, such as drug addicts.
This diversify-and-rule investor strategy is enthusiastically pushed by progressives. They wish to transform the U.S. from a society governed by European-origin civic culture into an economic empire of jealous identity groups overseen by progressive hall monitors. “We’re trying to become the first multiracial, multi-ethnic superpower in the world,” Rep. Rohit Khanna (D-CA) told the New York Times in March 2022. “It will be an extraordinary achievement … We will ultimately triumph,” he boasted.
But the progressives’ colonialism-like economic strategy kills many migrants . It exploits the poverty of migrants and splits foreign families as it extracts human resources from poor home countries to serve wealthy U.S. investors.
Progressives hide this extraction migration economic policy behind a wide variety of noble-sounding explanations and theatrical border security programs . Progressives claim the U.S. is a “Nation of Immigrants,” that economic migrants are political victims, that migration helps migrants more than Americans, and that the state must renew itself by replacing populations.
Similarly, establishment Republicans, media businesses, and major GOP donors hide the skew towards investors by ignoring the pocketbook impact and by touting border chaos, welfare spending , migrant crime, and drug smuggling.
Many polls show the public wants to welcome some immigration, but the polls also show deep and broad public opposition to labor migration and to the inflow of temporary contract workers into the jobs needed by the families of blue-collar and white-collar Americans .
This “Third Rail ” opposition is growing , anti-establishment , multiracial , cross-sex , non-racist , class-based , bipartisan , rational , persistent , and recognizes the solidarity that American citizens owe to one another.

EXCLUSIVE: ‘Nightmare is Beginning’ as Title 42 Ends, Says CBP Source AP Photo/Eric Gay 4:46
Editor’s Note: Shortly after this story was published, United States District Judge Emmet G. Sullivan temporarily stayed his order at the request of the Biden Administration for a period of five weeks “with great reluctance.”
ORIGINAL STORY BELOW
EAGLE PASS, Texas — A source within Customs and Border Protection says an announcement was sent to Border Patrol ordering them to immediately discontinue using Title 42 authority to expel applicable migrants from the United States on Tuesday. The source, not authorized to speak to the media, says “the nightmare is just beginning for us — there is no ‘Plan B’.”
The operating instruction to Border Patrol comes after a court ruling was issued on Tuesday ordering a halt to the use of Title 42 to expel certain migrant cohorts. The ruling was issued by United States District Judge Emmet G. Sullivan of the District of Columbia.
The court order will effectively require hundreds of migrants currently detained for removal under Title 42 to be re-examined and re-processed under the legacy Title 8 asylum process. The source says processing migrants under the previous and inefficient asylum pathway will likely result in severe overcrowding at Border Patrol processing facilities. Most will be released into the United States to pursue asylum claims.
It takes less than 15 minutes to process migrants and return them to Mexico and other countries under Title 42, the source explains. Under Title 8, the process more paperwork time and a credible fear hearing with U.S. Citizenship and Immigration Services.
The source says the processing facility in Eagle Pass, where more than one thousand migrants are apprehended daily, averages more than 2,000 migrants in a space designed to hold half as many. Title 42 allowed the Border Patrol to return citizens of Mexico and many from Guatemala, Honduras, and El Salvador. The source says the authority has also been utilized to expel Haitian migrants to their home country through ICE flights referred to as “delayed Title 42.”
The source says the authority has kept Haitian migrants at bay and reduced the likelihood of a repeat of the mass migration event in Del Rio in September 2021. That incident saw more than 30,000 Haitian migrants enter the United States near the Del Rio International Bridge and set up a hastily constructed outdoor encampment.
As recently as September, a CNN report estimated more than 10,000 migrants were sheltered in Reynosa, Tamaulipas, opposite McAllen, Texas. Those migrants have been waiting out the enforcement of Title 42. According to the report, many of those were Haitians.
In mid-October, the Biden Administration added Venezuelan migrants to the ranks of those subject to expulsion under the Title 42. According to CBP, nearly 6,000 Venezuelans were expelled to Mexico in October. The source says those Venezuelans are now likely to make quick returns.
Currently, there are more than 1,000 Venezuelan nationals staging in a makeshift camp in Juarez, across the border from El Paso, Texas. A recent report describes how the migrants at the camp were waiting for a change in policy to re-enter. The source says Tuesday’s court decision is the opportunity they have been waiting for and expects the large group to rush the border.
The source also expects the cancellation of Title 42 to impact the agency’s ability to fully staff and patrol areas of the border. The increase in case processing requirements will likely lead to further reductions of field patrols from already historic lows, according to the source.
Another added burden of the ruling will focus on immigration courts. There is currently a backlog of nearly 2 million immigration cases before administrative judges as of the end of Fiscal Year 2022. According to the Transactional Records Access Clearinghouse (TRAC) , a Syracuse University research tool, more than 800,000 immigration cases were added to the backlog in FY22.
In FY22, more than 1,100,000 migrants were expelled under the emergency COVID-19 authority. Many of those would have otherwise been allowed to pursue asylum claims and add to the backlog.

President Joe Biden’s deputies will not appeal a judge’s decision to remove the Title 42 anti-disease barrier that is the only effective legal curb against a huge wave of economic migrants.
Instead, Biden’s pro-migration border deputies are asking for a five-week delay in lifting the Title 42 barrier so they can prepare to release the additional migrants who will compete for jobs and homes against Americans, according to a Wednesday evening statement from the Department of Homeland Security:
In response to the court’s [Title 42] order, the Department of Justice is filing an unopposed stay motion [asking for a delay]. The delay in implementation of the court’s order will allow the government to prepare for an orderly transition to new policies at the border.
…
During the period of this freeze, we will prepare for an orderly transition to new policies at the border.
However, Texas Gov. Greg Abbott (R) will likely ask the U.S. Supreme Court to block the Title 42 removal. He is already involved in a pending Supreme Court decision about the legality of Biden’s catch and release policies at the border.

Justice John Roberts may decide if the top court will intervene if Abbott asks for a delay.
Roberts has been entangled in migration fights since at least 2014 and may use this Title 42 dispute to impose some order on Biden’s pro-migration policies.
The Supreme Court is expected to soon hear the case United States v. Texas , No. 22-58, where Biden’s lawyers will argue that the border agency can release a huge number of foreign migrants into Americans’ labor market.
Breitbart News reported in June:
The Supreme Court will decide whether the Biden administration must detain and deport certain types of aliens – both legal and illegal – which would instantly force Joe Biden’s immigration policy to resemble Donald Trump’s policy on those issues.
Congress specifically orders in immigration law that aliens (i.e., noncitizens) who commit certain crimes must be detained and deported. Those provisions of law include 8 U.S.C. §§ 1226(c)(1), 1231(a)(2), and 1231(a)(1)(A), which use language like the attorney general “shall take into custody,” “shall detain,” and “shall remove” aliens that commit these different categories of criminal acts.
…
The court will decide three major issues: First, whether states like Texas and Louisiana have standing to sue the federal government in federal court on questions like these. Second, whether the [border agency] memo does indeed violate the federal immigration law and the APA. And third, whether federal district courts have jurisdiction to hold unlawful and set aside immigration enforcement guidelines.
A December argument will likely result in a decision sometime between March and June of 2023.
The Supreme Court may also intervene in a separate decision from a Washington, DC, court that dramatically expanded the “Optional Practical Training” work-permit program for white-collar migrants.
Next year, the narrow GOP majority in the House may try to pass legislation, or spending rules, to curb Biden’s mass migration.
However, many GOP and Democratic donors favor the inflow of more profit-expanding workers, renters, and consumers.
The judge’s decision, unveiled a week after Election Day, immediately bars the Department of Homeland Security from enforcing the Title 42 anti-disease barrier at the border. The decision was approved by Emmet Sullivan, a far-left, Democrat-nominated judge overseeing an American Civil Liberties Union lawsuit.
Without Title 42, nearly all migrants who trek to the border will be allowed to enter a tangled, complex immigration system that prevents their deportation for several years. Biden’s deputies also release nearly all of the migrants to take jobs and homes despite laws requiring the detention of asylum seekers.
In his Wednesday evening statement, Mayorkas prioritized his goal of smuggling the foreign migrants safely past the murderous cartels — and ignored his legal task of protecting Americans from waves of wage-cutting economic migrants.
He wrote:
We know that smugglers will lie to try to take advantage of vulnerable migrants, putting lives at risk. We continue to work with countries throughout the Western Hemisphere to take enforcement actions against the smuggling networks that entice migrants to take the dangerous and often deadly journey to our land borders and to address the root causes of irregular migration that are challenging our hemisphere as a whole.
Since 1990, the inflow of legal immigrants and illegal migrants has greatly benefited employers and investors — but it has imposed a huge cost on Americans.
The inflow has pressured down Americans’ wages. It has also boosted rents and housing prices, and it has reduced native-born Americans’ clout in local and national elections . The inflow has also pushed many native-born Americans out of careers in a wide variety of fields and spiked the huge number of “Deaths of Despair .”

GRAPHIC: Cartel Gunmen Try to Hang Victim from Highway Overpass in Mexican Border State Breitbart Border / Cartel Chronicles 2:10
A group of cartel gunmen tried to hang a man from a highway overpass in the Mexican border state of Nuevo Leon. The attempt failed and the cartel members left the tied-up body at the scene. The hanging of bodies is a common tactic used by drug cartels in order to inspire fear in their rivals.
The incident took place Friday morning along the highway that connects the Monterrey metropolitan area with the border city of Nuevo Laredo. Authorities initially received a call regarding a man hanging from a highway overpass near the city limits between the towns of Cienega de Flores and Salinas Victoria.
Authorities claim the victim was not hanging from the overpass but had been placed in a grassy area next to the overpass. It remains unclear if the gunmen did hang the body and it was later moved.
The victim had his hands and feet tied up and appeared to have had his pants pulled down; additionally, his pink shirt had been pulled over his head. Authorities have not publicly identified the victim nor revealed which criminal organization is responsible for the crime.
The gruesome crime scene comes as the Sinaloa Cartel is fighting with other groups, including the Cartel Del Noreste faction of Los Zetas and some independent groups, for control of the local distribution of drugs as well as control of lucrative drug corridors to the Texas border, Breitbart Texas reported . This fierce turf war has led to hundreds of murders and gruesome executions in recent months.

Leaked Mexican Army Report Unveils Cartel Drug Routes to Arizona, California Breitbart Texas / Cartel Chronicles 3:24
A recently leaked Mexican military report courtesy of hacktivists revealed the routes cartels use to reach Arizona and California.
The documents show land, rail, air, and sea routes used primarily by the Sinaloa Cartel to move large quantities of drugs. In October, hacktivists called Guacamaya managed to break into the servers of Mexico’s Army and steal a large trove of documents . Those data revealed key issues that Mexico’s government has tried to keep hidden from public view.
According to some of the documents first reported by Infobae , cartels in Sonora and Baja California use four federal and two state highways to run tractor-trailers loaded with hidden drug loads: -Federal Highway 15, which runs from Hermosillo to Nogales, Sonora.
-Federal Highway 2, which runs from Agua Prieta, Sonora to Mexicali, Baja California.
-Federal Highway 8, which runs from Puerto Penasco (Rocky Point) to Sonoyta, Sonora.
-Federal Highway 7, which runs from Hermosillo to Agua Prieta, Sonora.
-State Highway 3, which runs from Miguel Aleman to Puerto Libertad, Sonora.
-State Highway 37, which runs from Puerto Penasco (Rocky Point) to San Luis Rio Colorado, Sonora.
The documents revealed there are several military checkpoints along those routes. However, according to Sonoran journalist Jesus Alberto Ibarra, the checkpoints do little to stop any trafficking.
Another mode of transporting drugs is through train routes which connect throughout Sonora to border cities.
The third mode of transportation is a mix of commercial airlines and private planes using clandestine landing strips.
Most of the clandestine air routes start from Topolobampo, Sinaloa. From there, small planes take routes to Puerto Penasco or Delicias, Baja California. The document also lists sea routes throughout the Gulf of California.

Biden's Deathly Presidency
By Jeffrey Folks
For four years under President Trump, America enjoyed peace, security, and unparalleled prosperity. Trump's presidency was a historic era of good times in which we began to regain faith in the American Dream. Now we have the nightmare, and the death and destruction that go with it.
Yes, the Trump Era was prosperous, with historically low unemployment rates, low inflation, energy independence, and rising wages. But aside from that, the most important thing about Trump's presidency was the fact that Americans were secure, as they had not been under Obama and certainly are not under Biden. Under Trump, America was in so many senses vibrant and "alive" with pride in our country and hope for its future.
Now we have regular mass shootings in which citizens disarmed by the State have no way to defend themselves. Overseas, we have a war in Ukraine, the threat of a Chinese invasion of Taiwan, and Iran developing nuclear weapons with the encouragement of the Biden administration. The common thread is death and the fear that goes with it. And this does not even include Biden's aggressive defense of abortion on demand.
Under President Trump, I lived without fear. I knew that Trump supported my right to defend my home and that he supported the police who defended me as well. Just having the president and his administration on my side made me breathe easier. America was moving in the right direction, as was confirmed by every opinion poll during Trump's time in office before COVID was unleashed.
Long-term death rates are more a matter of demographics than policy, and they have been rising ever since Obama took office in 2008. But murder rates, deaths in war and civil unrest, drug overdose deaths, and accidental deaths are attributable to policy, and they have been rising under Biden, even during his short time in office. Under Biden, the U.S. murder rate, which had been declining under President Trump, is the highest in 25 years. According to former N.Y. police commissioner Howard Safir, the spike in violence is partly attributable to lack of support for police and soft-on-crime prosecutors. And it is Biden, with his anti-police rhetoric and refusal to prosecute (as in the case of those picketing Justice Kavanaugh's home), who is responsible for this climate of anarchy.
Now I plan my trips carefully, avoid eye contact with strangers, and carry only a driver's license and credit card. I drive inconspicuously as well, given the explosion of road rage incidents.
The most galling thing is that Biden never says a word about the victims of crime unless he can twist the incident into an anti-gun lecture, and he takes no action to protect anyone, especially law-abiding citizens in middle-class neighborhoods like my own. In this and so many other ways, he seems on the side of those who wish to destroy us. It's no accident that murder rates are spiraling at home and war is breaking out overseas. Both are a response to Biden's weakness, and death is the consequence.
I fear there will be more death ahead. I expect an invasion in Taiwan, Moldova, or Finland, and new outbreaks of violence in the Middle East involving either Iran or its surrogates. The incomprehensible Iran deal, which Biden is pushing, would "make Biden 'the biggest funder of terrorism in the world,'" according to Rep. Jim Banks. "Terrorism" is not just a derogatory word; it is the act of murdering innocent human beings, including women and children. Hasn't that fact entered into Biden's Iran deal calculations?
Biden's weakness has emboldened our enemies, and their actions pose a threat to our security. This is the way major wars begin. They can be prevented only by the projection of force of the kind we saw under President Trump, and Biden projects about as much force as a lady's fan. His weakness will get us into another war, and our young men and women will die in that war. There is death hanging over us, and Biden seems oblivious, fumbling with his note cards to find some kind of answer.
There is a new national mood in America unlike anything I've seen since the 1960s: a sense of foreboding and caution based on the very real threat of violence and collapse. There are more threats to our country, including the wealth destruction of inflation, to which Biden simply rolls his eyes, chuckles, and whispers some idiotic riposte. There are more criminal gangs, and Biden just welcomes more in. There is more road rage, more random shooting, more felons out on no bond/low bond. And there is a callous and brutal disregard for the lives of the unborn.
In response to the mounting violence, Biden seems remote, fuddling with his microphone like a man slipping into dementia, and those around him seem inept, if not callous, including his new press secretary, Karine Jean-Pierre, who is said to have "frequently stumbled" during her first weeks. A president who is weak and advisers who are incompetent and anti-American to boot — that is a recipe for disaster, and disaster will end, as it always does, in poverty, destruction, and death.
There are bullies in the world who watched as Biden stumbled out of Afghanistan, and bullies don't have much respect for doddering fools who just want to survive a four-year term and leave a mess for someone else to clean up.
As a citizen, it is difficult to watch my country besieged by violence. Biden's presidency has been deadly in every respect: turning off economic growth and imposing environmental restrictions, proposing inflation-adjusted cuts in national defense while paying off student loans, and putting citizens at risk with his anti-police rhetoric.
There is little chance of a second Biden term, but just another two and a half years is painful to imagine. How many thousands will lose their lives because of one incompetent and wrong-headed leader? How far will America go into danger and destruction? And how much more difficult will it be for our next president, Trump or a Trump lookalike, to repair the damage and Make America Safe Again?

Republican Study Committee Creates Holistic Immigration Plan to Raise Wages, Grow Middle Class The RSC Budget would prohibit federal funds from going to cities or jurisdictions operating as sanctuaries for illegal immigrants. There are at least 190 of these so-called sanctuary jurisdictions across the country, [7] and many cities have seen increased crime rates since declaring themselves sanctuary cities. [8

Mexico’s president is reviving calls for a continental superstate that would combine North American employers and South American employees – and sideline tens of millions of middle-class Americans. NEIL MUNRO
What's more, Mexico generally benefits from shipping its surplus uneducated population to the states to take the pressure valve off the potential for unrest. Corrupt Mexican officials often reap "fees" from letting illegal migrants from other countries as well as their own pass through their territory. MONICA SHOWALTER
The same continent-wide superstate was pushed in 2001 by President G.W. Bush and Mexico’s then-president, Vicente Fox. Their unpopular “Any Willing Worker” plan would have allowed U.S. employers to easily import low-wage employees from central and south America. It was derailed following the 9/11 attack.
The policy would spike Wall Street and Fortune 500 profits by giving them floods of cheap foreign workers plus many new foreign consumers. NEIL MUNRO

“The greatest criminal threat to the daily lives of American citizens are the Mexican drug cartels.”

“Mexican drug cartels are the “other” terrorist threat to America. Militant Islamists have the goal of destroying the United States. Mexican drug cartels are now accomplishing that mission – from within, every day, in virtually every community across this country.” JUDICIAL WATCH

“Mexican authorities have arrested the former mayor of a rural community in the border state of Coahuila in connection with the kidnapping, murder and incineration of hundreds of victims through a network of ovens at the hands of the Los Zetas cartel. The arrest comes after Breitbart Texas exposed not only the horrors of the mass extermination, but also the cover-up and complicity of the Mexican government.”
“Heroin is not produced in the United States. Every gram of heroin present in the United States provides unequivocal evidence of a failure of border security because every gram of heroin was smuggled into the United States. Indeed, this is precisely a point that Attorney General Jeff Sessions made during his appearance before the Senate Judiciary Committee hearing on October 18, 2017 when he again raised the need to secure the U.S./Mexican border to protect American lives.” Michael Cutler …..
