To restore order at the border, Democrats must fund enforcing the law, not handouts to cities and migrants

(CNSNews.com) - The Biden administration has a plan to address the border crisis it created, and that is, "Let's let the states mop this up for us," Sen. Marsha Blackburn said on Tuesday.

Blackburn said once Title 42 is lifted, her state can expect busloads of migrants to await processing under Title 8 in Tennessee and other states.

Title 8 says, "An alien present in the United States without being admitted or paroled...is inadmissible." But those aliens must be deemed inadmissible at a court hearing, so they are not immediately expelled.

Blackburn told Fox News Tuesday night:

"The (Tennessee) governor was notified that they were going to begin to bring these...single adult illegal immigrants into Tennessee while they wait for their court proceeding. They're working with the Tennessee immigration and refugee resettlement program and going to put them in Tennessee.

"Now, the problem with this is, as you said, they're turning every state into a border state, every town into a border town. And the Biden Administration has no plan on how to deal with this situation at the border once Title 42 goes away.

“So what are they doing? They’re going to farm out, they're going to send these individuals all across the country, and say, all right, Tennessee or other states, you pay the bill, you take care of this, because we, the federal government, can't figure out how to handle this, and we have to move these illegal immigrants from the border into other areas where they're not going to be noticed.

"Now, in Tennessee, we know it's going to be 50 at a time. They will have at least two buses, maybe more, every single week, and so far, that's what we know. We've written ICE, but we haven't gotten a response from them yet, but we're working with the governor and trying to get more information.” 

Blackburn said the Biden administration "has broken the border," and now that they're seeing a record-breaking surge -- thousands of migrants crossing every day -- "they have to move them away from the border.”

“So this is their plan -- send them to other states, send them to other cities and let the taxpayers in those cities and in those states foot the bill for the social services, the education, all of the health that these immigrants (need)."

Blackburn accused the Biden administration of disrespecting the states. "They feel like keeping the power at the federal level, and having the states do their bidding, that is the way to handle the mess that they have made. Let's let the states mop this up for us.” 

In a filing with the U.S. Supreme Court on Tuesday, the Biden Justice Department asked the court to lift its temporary stay keeping Title 42 in effect at the southwest border.

Although the DOJ argued that the Supreme Court should allow Title 42 to expire, it also asked for a few more days, until Dec. 27, to prepare for the end of the public health measure that allows for the immediate expulsion of migrants.

In its court filing, DOJ said Title 42 "has outlived its public health justification." And when Title 42 is lifted, the Biden administration intends to rely on Title 8, a law passed by Congress, but as the court filing said, "those processed under Title 8 need to be moved to various screening and holding locations before removal."

Meanwhile, at the southwest border, amid freezing temperatures, enormous crowds of people are waiting to claim asylum in Texas border cities, notably El Paso.

On Tuesday, the Department of Homeland Security said over the last week, it has moved more than 3,400 migrants out of El Paso through Title 42 expulsions to Mexico or ICE expedited removal flights. (Yet it wants to get rid of Title 42.)

It also said Border Patrol agents have "alleviated capacity" in that sector "by moving almost 6,000 other migrants...to other sectors for further immigration enforcement proceedings."

DHS said average daily encounters have also dropped 40 percent -- from roughly 2,500 a day to roughly 1,500 a day -- over the last three days, "as we continue to work with partners in Mexico to discourage disorderly migration and disrupt criminal smuggling operations."

Rep. Tony Gonzales (R-Texas) told Fox News on Wednesday the Biden administration's plan is to "increase capacity by standing up some soft-sided facilities," or tents that will hold about a thousand people -- "while they create this expedited removal process."

"But I worry, that they're only going to increase capacity, and then just release more people into El Paso and throughout the country."


TX Gov to Biden: 'This Terrible Crisis' at Border is a 'Catastrophe of Your Own Making'

(CNS News) -- In a Dec. 20 letter to President Joe Biden about the increasing migrant crisis at the border, Texas Gov. Greg Abbott (R) said this "is a catastrophe of your own making," and warned that "your policies will leave many people in the bitter, dangerous cold as a polar vortex moves into Texas."

It is expected that as many as 14,000 illegal migrants will be crossing the U.S-Mexico border every day by the end of this week. The surge is happening because Title 42 is expected to be lifted on Dec. 21, although the Supreme Court has temporarily suspended the policy's expiration at the request of 19 governors. 

Title 42 is a WWII-era health policy that was re-implemented by President Donald Trump during the COVID pandemic. It allows Customs and Border Patrol to expel illegal aliens at the border before they can ask for asylum to protect public health. 

In his letter to Biden, Gov. Abbott said, "With cold temperatures gripping Texas, your inaction to secure the southern border is putting the lives of migrants at risk, particularly in the City of El Paso. With thousands of men, women, and children illegally crossing into Texas every day, and with the expectation that those numbers will only increase if Title 42 expulsions end, the state is overburdened as we respond to this disaster caused by you and your administration."

"Your policies will leave many people in the bitter, dangerous cold as a polar vortex moves into Texas," said Abbott.

"This terrible crisis for border communities in Texas is a catastrophe of your own making," he continued.  "These communities and the state are ill-equipped to do the job assigned to the federal government – house the thousands of migrants flooding into the country every day. With perilous temperatures moving into the area, many of these migrants are at risk of freezing to death on city streets."

"Texas has borne a lopsided burden caused by your open border policies," said the governor.  "The need to address this crisis is not the job of border states like Texas. Instead, the U.S. Constitution dictates that it is your job, Mr. President, to defend the borders of our country, regulate our nation’s immigration, and manage those who seek refuge here."

Abbott then wrote that he is using all the resources at his disposal, including the Texas Military Department, to protect Texans "from the torrent of migrants and cartel activity streaming into our state."

In conclusion, Abbott wrote, "You and your administration must stop the lie that the border is secure and, instead, immediately deploy federal assets to address the dire problems you have caused. You must execute the duties that the U.S. Constitution mandates you perform and secure the southern border before more innocent lives are lost."

On Dec. 19, White House Press Secretary Karine Jean-Pierre said, "It would be wrong to think that the border is open. It is not open. And I just want to be very, very clear about that."

She further said, "We're doing the work. The president has been doing the work at the border since day one."

According to National Border Patrol Council President Brandon Judd, the U.S.-Mexico border is broken and Border Patrol officers are overwhelmed trying to process about 8,000 illegal migrants every day.
