Supreme Court to Decide if States Can Protect Title 42, Leaving Policy in Place for Now

WASHINGTON, DC – The Supreme Court will hear arguments on whether states can ask courts to preserve Title 42 border safeguards when the Biden administration tries to let the policy die, voting on Tuesday to leave the Trump-era policy in place until it hands down a decision in the case by early summer 2023.

Title 42 allows federal agents to turn away illegal aliens immediately without taking them into custody if the agent believes the alien might have Covid-19. Even though the number of illegal crossings is at an all-time high, the numbers at the border would be up to double their current levels without that policy in place.

With President Joe Biden’s clear support, Homeland Security Secretary Alejandro Mayorkas has called for an end to the border control policy, but the Biden administration has not gone through the legal process to end the CDC measure. Instead, when leftwing groups sued to end the program, Attorney General Merrick Garland decided not to appeal a lower court ruling against the policy, which would have the effect of ending Title 42.

But 19 states filed a motion to intervene in the case, asking the courts to allow the states to step into the shoes of the Biden administration to defend the policy and to issue a stay of a federal trial judge’s ruling declaring Title 42 unlawful.

Chief Justice John Roberts referred the matter to the full Supreme Court for a vote. The justices on Tuesday decided to grant the stay by a 5-4 vote. The justices also voted to review the case, setting the case for argument at the end of February.

The sole issue the Supreme Court will decide is whether the 19 states have standing to intervene in court to defend the policy. If the states do, then the matter will go back to the D.C. Circuit appeals court for the states to pursue an appeal. If they do not, then Title 42 will end.

Justices Sonia Sotomayor and Elena Kagan voted to deny the stay. Justice Neil Gorsuch –appointed by former President Trump – dissented from taking the case up for review, joined by Biden-appointed Justice Ketanji Brown Jackson.

Gorsuch dissented on grounds that would resonate with many Republicans, however, noting that Title 42 is based on the Covid-19 public health emergency, opining that “It is hardly obvious why we should rush in to review a ruling on a motion to intervene in a case concerning emergency decrees that have outlived their shelf life.”

“And courts should not be in the business of perpetuating administrative edits designed for one emergency only because elected officials have failed to address a different emergency,” Gorsuch added. “We are a court of law, not policymakers of last resort.”

The case is Arizona v. Mayorkas, No. 22-592 in the Supreme Court of the United States.

Bombshell Footage: Biden DHS Freed over 150K Border Crossers into U.S. without Court Dates in Summer 2021

President Joe Biden’s Department of Homeland Security (DHS) released more than 150,000 border crossers and illegal aliens, without a Notice to Appear (NTA) in immigration court, into the United States in the summer of 2021, bombshell footage reveals.

As part of a lawsuit against Biden’s expansive Catch and Release network, Florida Attorney General Ashley Moody obtained internal DHS footage revealing the extent to which the agency released hundreds of thousands of border crossers and illegal aliens into the U.S. interior without court dates.

In particular, an Immigration and Customs Enforcement (ICE) official can be heard telling agents that more than 150,000 border crossers and illegal aliens were released into the U.S. interior without NTAs in the summer of 2021. Biden’s DHS started the practice in March 2021.

“You know over the summer, we had well over 150,000 folks come in,” the ICE official states. “They were issued a piece of paper that said, ‘Find somebody in ICE,’ and that was pretty much it. There was no processing. I know this isn’t something that you guys asked for, and I can assure you that no one in the criminal alien program asked for it either.”

Moody suggested in a statement that the Biden administration is proactively releasing border crossers and illegal aliens into American towns and cities with no intention of deporting them even if they are found to not have valid asylum claims.

“… this has been this administration’s plan all along,” Moody said.

The latest estimates show that from February 2021 to October 2022, Biden’s DHS has released at least 1.4 million border crossers and illegal aliens into the U.S. interior. Many of those released last year were given only Notices to Report (NTRs), which asked arrivals to check in with ICE wherever they resettled.

The foreign-born population grew across all 50 states and Washington, DC, this year, a result of the nation’s decades-long legal immigration levels, the latest United States Census Bureau figures show.

While the foreign-born population grew nationwide, California, Florida, and Texas saw the highest gains.  California, which lost overall residents this year, added nearly 128,000 immigrants to its population.

Florida, the fastest-growing state in the nation, added more than 125,600 immigrants to its population, while Texas added almost 119,000 immigrants this year.

The South, with 128.7 million residents, was the fastest-growing region in the nation this year, fueled by 868,000 Americans moving to the area from other states and the arrival of almost 415,000 immigrants.

As Breitbart News reported, the U.S. population hit 333.3 million residents this year. More than 80 percent of that population growth is due to the nation’s legal immigration levels, where more than a million foreign nationals are given green cards each year and another million arrive on temporary work visas to take American jobs.

The process known as “chain migration,” wherein newly naturalized citizens can sponsor an unlimited number of foreign relatives for green cards, drives more than 70 percent of the nation’s legal immigration every year.

Without the continued flow of legal immigration to the U.S., the population would have stabilized naturally with about 245,000 new residents added.

Research conducted last year shows that the nation’s foreign-born population is projected to hit a record nearly 70 million by 2060 if current legal immigration levels go unreduced. Today’s foreign-born population, at 48 million, is already the largest number of immigrants ever recorded in American history.

The latest Rasmussen Reports survey finds that 69 percent of Americans want legal immigration levels reduced — including a plurality of 36 percent who want levels cut in at least half. Likewise, 57 percent of Americans want to end chain migration.

President Joe Biden has lied a lot before and during his presidency. Here are the top 15 most outlandish lies from his career.

1) Law School Grades

Biden claimed in 1987 he graduated in the top half of his class at Syracuse College of Law. He was 76th in a class of 85.

2) Arrested in South Africa 

Biden falsely claimed in 2022 he was arrested for trying to see Nelson Mandela in South Africa. The Washington Post marks this claim as false.

3) First Job

In 2021, Biden claimed in Idaho his “first job offer” was from a local lumber and wood products business, Boise Cascade. The company said there is “no record” of Biden’s claim.

 4) Visiting a Synagogue 

Biden claimed in 2021 he visited Pittsburgh’s Tree of Life synagogue, where 11 people were murdered in 2018. Biden did speak to the Tree of Life rabbi. He never visited the synagogue, as he claimed.

5) Unemployment Numbers

Biden claimed in 2022 unemployment was the lowest in 50 years, down from 6.5 percent to 3.5 percent. Biden’s claim was false. The unemployment rate was 3.5 percent under his predecessor.
6) Visited Afghanistan 

Biden claimed in 2022 he had visited Afghanistan and Iraq twice as president. The New York Post marked Biden’s claim as false.

7) Naval Academy Appointment 

Biden claimed in 2022 claimed he was appointed to the Naval Academy in 1965 by the late Sen. J. Caleb Boggs (R-DE). A search of Boggs’ records fails to produce evidence to support Biden’s claim.

8) Beau Died in Iraq

Biden has falsely claimed twice in 2022 that his late son Beau died in Iraq. Beau died at a Maryland hospital.

9) Never Spoken to Hunter About Family Business

Joe Biden falsely claimed in 2019 that he never discussed business deals with Hunter. But Joe Biden left Hunter a voicemail in 2018 about a business deal with Chinese energy giant CEFC, directly contradicting Joe Biden’s statement in 2019.

“Hey pal, it’s Dad. It’s 8:15 on Wednesday night. If you get a chance just give me a call. Nothing urgent. I just wanted to talk to you,” Joe Biden said. “I thought the article released online, it’s going to be printed tomorrow in the Times, was good. I think you’re clear. And anyway if you get a chance give me a call, I love you.”

10) Visited 54 States

Biden falsely claimed in 2022 he campaigned in all 54 states. There are only 50 states in the union.

11) Passing Student Loan Legislation 

Biden falsely claimed in 2022 he passed “student loan forgiveness.” But no student loan legislation has been passed through Congress.

12) Raised by Puerto Ricans

Biden claimed in 2022 he was “sort of raised in the Puerto Rican community at home, politically.” But Biden told the BBC he is Irish. Media reports suggest Biden is five-eighths Irish, stemming from two Irish families.

13) Gas Prices

Biden falsely claimed the price of gas is “down from over $5 when I took office.” The day before former President Donald Trump left office, the national average price of gas was $2.38.

14) Biden Traveling 17,000 Miles with Chinese President

Biden claimed in 2021 he ‘traveled 17,000 miles with’ Chinese President Xi Jinping. The Washington Post marked Biden’s claims with three Pinocchios.

15) Inflation Is Temporary 

Biden claimed in 2022 that inflation was only temporary. Before his statement, inflation had raged for months. About six months later, inflation is still soaring at 7.1%.
