We need to be smart about our immigration laws

There is a lot of talk about immigration reforms.  As expected, the left wants an omnibus immigration reform.  The answer should be a resounding no to any further omnibus bills of any type.

Are immigration reforms even needed?  The immediate answer is again no.  As with so many things, we have adequate laws on the books.  We merely need to enforce them as written, not as a sitting president wishes they were written.  Then and only then can we proceed intelligently.

Our immigrations laws provide for admissions at our borders.  All persons seeking admission to the United States are subject to examination by U.S. Customs and Border Patrol officers.  That is a required first step.  You must have proof of your right to enter our country.  U.S. citizens and permanent resident aliens are passed through, although even they are subject to detention where appropriate.  An alien from another country, however, must show a right of entry.  This can be showing a passport from a country with whom we allow visa waivers.  Otherwise, a visa needs to be shown or some other acceptable reasons for entry.

The flood of alleged immigrants entering our country today largely claim to be refugees or seeking asylum.  Let's look at these laws.

A refugee is defined in 8 USC 1101 (a)(42).  A general summary of a refugee is someone who is outside his country and persecuted, or who has a well founded fear of persecution, on account of race, religion, nationality, membership in a particular social group, or political opinions, in his home country.  As to political opinions, there is recent language regarding abortions.  Please note that merely seeking a better life, seeking to escape poverty, wanting better employment opportunities, or however you wish to define it is not grounds to be classified as a refugee.

According to USCIS, those seeking asylum must (1) meet the definition of a refugee, (2) be in the United States, and (3) be seeking admission at a port of entry.  Note that, as with a refugee, merely seeking a better life, seeking to escape poverty, wanting better employment opportunities, or however you wish to define it is not statutory grounds for asylum.  Further, swimming across the Rio Grande in the middle of nowhere is not a designated port of entry.

The human-traffickers have told their "clients" to say they fear such to get their foot in the door.  It is our mistake to let them enter the country without more proof.  Currently, we are merely releasing them into the country with a promise to show up at a future hearing.  This isn't working.

At a June 2019 congressional hearing, the acting secretary of Homeland Security, Kevin McAleenan, was asked how many aliens were showing up at their asylum hearings.  He testified that they did a study, and in that study, 90 percent failed to show up for their hearings.  In other words, 90 percent of them are now illegal aliens without question and with removal orders against them.  We need more people at the border who can make the decision on the spot and reject those who do not qualify.

There are also exceptions as to who can claim asylum.  In 8 USC 1158 (a)(2), we find the following language:

(2) Exceptions

(A) Safe third country

Paragraph (1) shall not apply to an alien if the Attorney General determines that the alien may be removed, pursuant to a bilateral or multilateral agreement, to a country (other than the country of the alien's nationality or, in the case of an alien having no nationality, the country of the alien's last habitual residence) in which the alien's life or freedom would not be threatened on account of race, religion, nationality, membership in a particular social group, or political opinion, and where the alien would have access to a full and fair procedure for determining a claim to asylum or equivalent temporary protection, unless the Attorney General finds that it is in the public interest for the alien to receive asylum in the United States.

At this point, I am not sure what "determinations" have been made by the attorney general, but I believe I would be safe in saying those determinations are in the interests of the aliens and not the United States.  In this context, one might even include Democrats within the word "aliens."

We as a nation have a duty to protect our borders.  A nation with no border is not a nation or won't be for long.  Despite the recent rants by the babblative groundling serving as our current president, our border is not secure.  He has become so sensitive to this obvious failing that his rants about it in the presence of ladies require him to apologize for his vulgar language.

If we were to strictly enforce our existing immigration laws as written, we could correct our border catastrophe very quickly and without further laws.  We should do this, see how well it works, and only then consider what tweaks, if any, need to be made.  No omnibus, but rather piecemeal corrections, where we can understand precisely what is being legislated.  We need to be smart about it.

Don't Buy What Democrats Are Selling as Reality

We live in a topsy-turvy world, where true reality is often altered and replaced with a new surreal Democrat reality.  This new pseudo-reality is then forced upon society and reinforced until those who imposed it eventually claim that this newly created reality is indeed fact.  Hence, Democrats want to force a paradigm shift in what is considered reality.

The problem with this approach is that the new pseudo-realities are almost always totally implausible.  People using old-fashioned common sense, and powers of observation, can easily see through these new false realities.  However, those who refuse to accept the new pseudo-realities are then labeled as conspirators and as anti-government.  The main creators of these new realities are Democrats and their many allies.  Beware of what those in today's Democrat party hierarchy are pushing as reality.  By the standards of long held societal traditions, common sense, and ultimate truth, what the Democrats offer as reality is often anything but.  Following are some examples.

Under their new pseudo-reality, the Democrats would have us believe that our southern border is safe and secure when, in truth, they are open like a sieve.  Illegal aliens are pouring into our nation by the millions.  Imbedded among this unchecked influx are terrorists, criminals, and communicable disease–carriers.  This unabated alien onslaught has also set up conditions for drug cartels to infiltrate the U.S. more easily with tons of horrible drugs, which are killing American citizens daily at an unprecedented rate.  The United States' southern border is far from safe or secure.

Under their new pseudo-reality, the Democrats would have us believe there is equal justice under the law, while the truth is that conservative Americans are regularly charged, convicted, and sentenced to maximum penalties.  Conversely, Democrats like the great majority of BLM and Antifa rioters go scot-free after committing felonious crimes.  Democrats like Hunter Biden are not prosecuted at all in the face of overwhelming evidence of significant criminal wrongdoing.  There is no longer equal justice under the law in our country.  It is now an unequal, two-tiered justice system.

Under their new pseudo-reality, the Democrats would have us believe that President Biden is fit for service, while anyone using the simple powers of observation will see a senile old man in the throes of dementia, who, instead of leading, is himself being led by Democrat handlers around him.  He is the victim of elder abuse by those Democrats who have allowed him to hold a position in which he is totally incapable of serving.  President Biden would need only to take a public mental acuity test if he wished to prove his mental fitness and reveal his true cognitive status.

Under their new pseudo-reality, the Democrats would have us believe that all U.S. elections are free and fair when many are plainly not.  Democrats act as though once an election is complete, it is automatically fair and finished.  They then label anyone contesting election results as a perpetrator of fake news.  The facts are that in the 2020 and 2022 elections, the Democrats ignored or discounted hundreds of sworn and damning affidavits by disenfranchised voters, poll-watchers, and ballot support personnel.  They ignore credible expert testimonies from statistical analysts and auditors who say the chances of Democrats to have won some elections in the way they did are astronomically tiny (unless fraud is factored into the equation).

Regarding election fraud accusations against Democrats, they choose not to prove their innocence, but instead just declare themselves innocent absent proof.  Meanwhile, they fight commonsense election reforms like voter ID and signature verification (and a whole list of others) with every ounce of opposition they can muster.  These denial actions project guilt, not innocence.  Democrats label non-Democrats who doubt election results as election deniers.  The Democrats themselves are obviously election fraud deniers in the face of massive evidence of election malfeasance.

Under their new pseudo-reality, the Democrats would have us believe that killing human babies for convenience is acceptable as long as the babies are pre-born.  Democrats disrespect those who believe that the Bible condemns abortion, and they call Bible believers bigots.  Democrats desire that pro-life individuals be labeled as anti-abortion, but they themselves are aghast if someone rightfully refers to anti-abortion advocates as pro-death.

Under their new pseudo-reality, the Democrats would have us believe that authoritarian government controls and mandates during COVID were acceptable measures and that further government lockdowns, school closures, mandates, and business restrictions should continue to be allowed without question.  Really?

Under their new pseudo-reality, the Democrats would have us believe that the COVID vaccine program, which used an experimental and non-fully tested drug, which turned out not to protect recipients from either getting or transmitting the COVID disease, was perfectly normal and non-problematic.  Note that the definition of "vaccine" had to be changed to suit this new Democrat reality.

Under their new pseudo-reality, the Democrats would have us believe that everyone should continue to receive COVID vaccine boosters.  This in the face of mounting evidence that current COVID vaccines are neither safe nor effective.  The current mRNA vaccines have, in fact, been deadly to thousands of people.  To many other individuals, the COVID vaccines are the cause of debilitating conditions that adversely affect circulatory, neurologic, reproductive, musculoskeletal, and immune body systems.  Cover-ups need to stop, boosters-for-all need to cease, and responsible people and entities need to be held accountable.

Under their new pseudo-reality, the Democrats would have us believe that they stand for truth when in fact many are proven liars.  Their 46th U.S. president is chief among them.  He has a lifelong habit of bloviating falsehoods about his personal achievements and education.  He tells us his son Hunter and he himself have done nothing wrong when there is Hunter's abandoned laptop chock-full of factual and incriminating evidence that proves Biden's statement false.

Also, another bald-faced Democrat liar is Adam Schiff.  He spent two years insisting repeatedly that President Trump was colluding with Russia.  In fact, investigators proved him wrong, leaving Schiff with zero credibility.   It turned out that Hillary Clinton's campaign initiated this falsehood by using unverifiable misinformation supplied by a professional Russian misinformant.  These few examples of Democrat untruths are just the tip of the iceberg.

Under their new pseudo-reality, the Democrats would have us believe that male athletes can change their sex simply by declaring themselves female.  This even though male athletes can never change their inherent XY male chromosome make-up.  Not so astonishingly, these mediocre male athletes often skyrocket to being top-tier "female" athletes after their declaration.

In short, Democrats want you to believe whatever they desire to be real is true.  At the same time, anyone who opposes them and tries to correct them is automatically labeled by Democrats as being wrong and false.  If facts and details don't exactly line up with the Democrats' viewpoint, they just create a new and alternate realty that suits their goals and needs (but which may have nothing in common with actual verifiable reality).

Beware!  If you believe in the Democrats' faux reality, you do so at your own peril!  The spider will have caught you in its web.

Sanctuary California should be a cautionary tale, not a goal

From the moment Joe Biden assumed the presidency, immigration has been at the top of his agenda.  One of his first acts was to sign a series of executive orders that reversed the Trump administration's policies on things like border wall funding, travel bans, and sanctuary laws.

While Trump's goal for immigration policy was clearly articulated in his "Make America Great Again" concept, we have heard little on where Biden intends to take us with his immigration plank.  Judging from his actions so far, though, the destination is clear.  He wants to make America into California, and that should deeply concern every U.S. citizen.

What anti-borders politicians have done to California over the last 30 years is a disgrace.  The home of Hollywood and Silicon Valley, once a beacon of opportunity and prosperity, is today a sinking ship.  Immigration policy is a significant factor in that decline.

Taking on a massive population of illegal aliens has come at a colossal cost to Californians, in terms of finances, safety, and job opportunities, to name a few.  State residents foot the bill for more than $23 billion that is directly attributable to illegal immigration and its effects.  That breaks down to almost $2,000 for every legally present household each year.  This from a state that is already carrying more than $1.3 trillion in total state, county, and municipal debt.  Who wouldn't want to pay a hefty tax each year to encourage more illegal aliens to move to your community?

The chief catalyst for California's illegal alien crisis has been its embrace of sanctuary laws.  By preventing local law enforcement from cooperating with federal immigration authorities in the deportation of criminal aliens, there are virtually no consequences for violating our nation's immigration laws inside the state of California.

While the Orwellian-named California Values Act (S.B. 54) made sanctuary policy state law, it seems downright moderate compared to what some cities and counties have done.  S.B. 54 at least allows cooperation with ICE in only the most extreme of circumstances.

The sanctuary law in Santa Clara, the largest county in northern California, takes an even more radical position, stating that the county "does not, under any circumstances, honor civil detainer requests from U.S. Immigration and Customs Enforcement (ICE) by holding inmates on ICE's behalf for additional time after they would otherwise be released from County custody."

Before sanctuary laws, it had long been a practice of local law enforcement to cooperate with detainer requests as a way to expedite criminal aliens toward deportation.

The results of this policy have been about as bad as you might expect.  In Santa Clara County last November, police arrested Fernando De Jesus Lopez-Garcia after he allegedly stabbed five people inside the Grace Baptist Church, killing two and leaving three others seriously injured.

One witness called 911 to say a "man was going crazy, stabbing people and there was blood everywhere."  He was arrested on two counts of murder, three counts of attempted murder, battery on a spouse, and violation of a protective order.

Lopez-Garcia is an illegal alien with an extensive criminal record who had successfully avoided ICE apprehension after each arrest because of local and state sanctuary laws barring cooperation with federal immigration authorities.

In 2019, police arrested Carlos Eduardo Arevalo Carranza, an illegal alien from El Salvador, for allegedly beating and stabbing Bambi Larson to death in her San Jose home.  Reports later disclosed that police had previously arrested Carranza ten times for drugs, kidnapping, battery against a police officer, and burglary.  ICE had requested an immigration hold on Carranza seven times, but the Santa Clara Sheriff's Office (SCSO) refused every request.  Facing criticism for the sanctuary policy, the county supervisors met and inexplicably voted 5-0 to double down on the policy.

My organization, the Immigration Reform Law Institute (IRLI), recently concluded an investigation into these practices in Santa Clara and found some disturbing results.

We submitted a records request with the Santa Clara County Sheriff's Office to discover just how many ICE detainers it has received in recent time and how many of them applied to aliens with serious criminal backgrounds.  That request revealed that ICE lodged a total of 1,757 detainers in just two years — 909 requests in 2019 and 848 in 2020.  The law enforcement records technician with the sheriff's office confirmed with IRLI that every single one of these requests was ignored.

The Sheriff's Office refused to disclose to IRLI how many of the detainer requests applied to aliens who were convicted or charged with serious or violent felony offenses.  When IRLI asked about the last year an ICE detainer request was honored by the county, a records technician there replied that he could not find records that showed the last time a detainer request was honored.

The results of these laws are clear.  The county has become a haven for illegal aliens, particularly those with criminal records.  The communities are demonstrably less safe, and the influx of new arrivals creates a heavy financial burden on legal state residents.  Is it any wonder that taxpayers are fleeing the state in droves?

As the Biden administration goes full speed with its anti-borders agenda, however, there will be no place for concerned Americans to flee.  California-style laws will soon become federal laws.  We're about to conduct a national experiment in anti-borders cause and effect.  Buckle up.

A bad year for IT companies

It has just been reported by Human Events that in 2022, big tech lost $7.4 trillion. Perhaps it has to do with the fact that many are leaving the platforms due to their tyrannical policies, or -- in Twitter's case -- are rebuilding. Many of these companies reported groundbreaking numbers of layoffs. In Twitter’s case, Elon Musk rightfully fired half of the staff that Jack Dorsey had.

Human Events also reports that not one of the fifteen tech companies in the United States made a profit in 2022. This is a great thing. Consequently, due to the loss of money by these companies, many of the CEOs apologized for one mistake or another. However, they never come out and apologized for censoring conservative opinions.

Concerning Meta, Facebook’s parent company, Human Events reports, “after spending billions of dollars on the largely failing metaverse project, and forcing revenue to nosedive, CEO Mark Zuckerberg was forced to layoff around 11,000 employees and admit “I got this wrong.” Moreover, Amazon lost more than $1 trillion in market value, becoming the first company to reach such a number. Accordingly, Microsoft lost more than $889 billion, laying off 8,000 employees. Apple, whose products are made in China, did not suffer the same losses. But the company had to cut hundreds of jobs all the same. Lucky Twitter cut only around 3,500 jobs. Of course, the dichotomy with Twitter is that is has become a free-speech platform under the ownership of Elon Musk. Thanks to Musk, Twitter has seen a larger audience and more engagement now, than ever before. These tyrannical big tech companies should look at Twitter for success. Social Media companies should not become a front for the Democrat Party.

Approximately 210,000 employees were laid off by the fifteen tech companies. All fifteen have engaged in the surreptitious censorship of conservatives. In fact, in 2021, all these companies banned the sitting president of the United States, President Donald Trump. If they can do this to Trump, imagine what they can do to you. These parochial companies have demonstrated their will to “follow the money,” and this year all that money went down the toilet. These companies sunk, and that is a fantastic thing on behalf of the American people. The next Congress should repeal Section 230, which offers legal protection regarding what appears on their platforms. Will the repeal occur? Probably not, since our politicians have a copious number of lobbyists associated with Silicon Valley. However, great steps should be taken immediately to strip big tech of their protections.

Any time that these left-leaning platforms lose money, it is a good thing. They censored a sitting president, deplatformed conservative thought, lied about January 6th, and lied about COVID-19. The Twitter Files have shed light on all the darkness that these companies kept hidden away from the world. In many ways, the loss of money these companies experienced this year represents justice for all the catastrophes they unleashed. Always remember that a bad day for Silicon Valley is a good day for America.

Could It Be That Our Rulers are ‘Blithering Idiots?’

Back when I was a young-un growing up in Limeyland in the 1950s, there was a Thing called "a blithering idiot." You readers, having been socialized to "lived experience" America, may shy away from such direct talk, such violation of the eternal culture of "safe spaces," especially if you have internalized the CIO Council culture at Stanford.

But, in our present pass in the good old USA, nearly two years since the start of what experts agree is the Biden "bomb cyclone" administration, I think that the only way to make sense of today's America is to say that we are governed by "blithering idiots."

When we say "blithering idiots" we are saying that the problem is not so much the malevolence our rulers demonstrate as just ordinary human stupidity, of the type immortalized by the Keystone Kops.

I think that the present annual event of an annual one-size-fits-all omnibus spending package is not a sign of evil intent on the Pelosi and Schumer front, but a sign that we are governed by blithering idiots.

Because, you see, if the Pelosis and Schumers were really in control of things, they wouldn't need to fund the government by gussying up an annual government-shutdown emergency, and finalizing all their dirty deals with special interests high and low in the dark of 4,000 pages. Every year. Their spending plans would be gloriously broadcast in the light of day.

If our liberal friends were really confidently in charge, they wouldn't need to be oppressing us with their cancel culture. You don't need cancel culture when you already own the future. Cancel culture, like Reigns of Terror and Great Purges, is a backhand admission of failure.

If our Democratic friends really felt that they owned the future they wouldn't need to bother about chasing Trump around and stigmatizing his followers as "armed insurrectionists," and going to enormous effort to prosecute January 6 rioters. They would just know that they would win at the next election.

If our Bidenoid friends were really in the saddle they would not be passing fake-arama Inflation Reduction Acts, no fact-checkers need apply.

If university liberals were really confident and secure they would not need to exclude racist-sexist-homophobe conservatives from faculty appointments, because since their ideas were better, they would be bound to win the future, no matter how many bigoted conservatives were trying to pollute innocent student minds.

If political liberalism were the answer to life, the universe, everything, it wouldn't be necessary to have the Cybersecurity & Infrastructure Security Agency run web pages detailing misinformation, disinformation, and malinformation and their relation to foreign and domestic "threat actors."

If our national "intelligence community" were on the up and up it wouldn't be necessary for the FBI to respond to the publication of the Twitter Files by issuing whining complaints about "conspiracy theorists and others are feeding the American public misinformation with the sole purpose of attempting to discredit the agency." Hey, nobody beats the FBI at discrediting the FBI.

Here’s sci-fi author Sarah Hoyt listing a few Things that are broken, that our rulers are Making Worse. Sez she:

  • Our education system is broken. We really don’t teach much of anything.
  • Our distribution is broken. As in just-in-time and outsource production to slave states.
  • Our production is broken. Our people need a purpose: making things.
  • Our commerce and service industry is broken.
  • Our thinking jobs are broken.

Hoyt mentions the problem of “that our ‘governing’ classes are mentally damaged morons trying to run this according to the always idiotic philosophy of a guy who died at the edge of mass industrialization.” Do you think she is just being too polite about government by blithering idiots?

I have an idea. My idea is that government is not really good for too much in this world, unless the Nazis are marching or the Commies are coming. Most of the things of this world are best done by humans learning to trust each other and working together in the little platoons of life: families, churches, mutual aid associations, businesses supplying products and services. Because the basis of successful human endeavor is humans working together and learning to trust each other.

You think that Inflation Reduction Acts or annual omnibus spending bills or cancel culture at universities or FBIs gnawing on the bones of suspected domestic threat actors or social media shadow-banning conservative actors is going to do any good?

If you think that you are moving the arc of history towards justice with your politics then, as the Brits would say, you are probably a blithering idiot. And it is probably time for you to take your arthritic fingers off the levers of political power.

Or, as I would say:

Big government and lefty politics is the royal road to injustice.

Not to mention a good way of building a mountain of skulls.
