Federal Judge Orders Biden Admin to Stop Cutting Texas Border Barriers

A federal judge in the Western District of Texas issued a Temporary Restraining Order against the Biden administration prohibiting the “disassembling, degrading, tampering with” border barriers put in place by the State of Texas. The move comes after multiple reports of Border Patrol agents cutting the concertina wire barriers put in place by order of the governor of Texas.

Texas Attorney General Ken Paxton and the Texas Public Policy Foundation filed a lawsuit against the U.S. Department of Homeland Security, U.S. Customs and Border Protection, the U.S. Border Patrol, and multiple Biden administration appointees to stop the federal government’s interference in the State of Texas’ efforts to stop illegal border crossings.

U.S. District Judge Alia Moses granted a Temporary Restraining Order (attached below) directing the federal government from “disassembling, degrading, tampering with, or
transforming” border barriers put in place by the State of Texas under Governor Greg Abbott’s Operation Lone Star. The judge carved out a small exception where the federal government my “take immediate action to obtain medical attention” for a migrant in distress or who suffered injury.

“This Order therefore includes a narrow
exception to permit the Defendants to move or cut the concertina wire to aid individuals in medical
distress, as noted above,” the judge noted.

Judge Moses’ order states there is a “public interest” that “demands effective measures to prevent the illegal entry of aliens at the Mexican border.”

The order explains that the actions of the federal government in cutting or removing the concertina wire border barriers “facilitate rather than prevent unlawful conduct.”
The order by Judge Moses expires on November 13, unless extended by the Court at a later time. A preliminary injunction hearing is scheduled for November 7.

Breitbart Texas reported in July that Border Patrol agents cut through the razor wire near Eagle Pass, Texas, to allow migrants to enter the United States. A source within U.S. Customs and Border Protection told Breitbart Texas’ Randy Clark an internal memo put in place during the 2021 Haitian migrant crisis requires agents to allow migrants who cross the Rio Grande to make entry into the U.S.

Because of the damage to the wire caused by the cuttings implemented by Border Patrol agents, two Texas National Guardsmen offered to cut the wires to make repair easier. Those Guardsmen and two supervisors were disciplined by the State of Texas and removed from their Operation Lone Star duties.

Border Patrol agents in the five Texas-based Border Patrol sectors apprehended more than 2.6 million migrants during the past two fiscal years. The number of migrants apprehended during this period exceeds the city of Houston’s population by more than 300,000 people, Breitbart reported.

Border Patrol agents assigned to the Rio Grande Valley, Laredo, Del Rio, Big Bend, and El Paso Sectors apprehended 1,216,501 migrants during the recently ended Fiscal Year 23. One year earlier, agents in these Texas-based border sectors apprehended 1,395,690 migrants.

This brings the total number of migrants apprehended to 2,612,191 during the past two fiscal years, according to the CBP Nationwide Encounters Report. This exceeds the population of the city of Houston (2,302,878) by more than 309,000 people — slightly less than the city of Corpus Christi.

Mexican Government Downplays Abduction of Colombian Family

Mexican authorities in the cartel-controlled state of Zacatecas are trying to downplay the abduction of a Colombian family who are believed to have been taken by gunmen. Through the use of semantics and word games, government officials are hiding the raging cartel violence in Zacatecas.

The abduction took place on October 27, when Jorge Alejandro Garcia Villamil, 44,  his wife Yulieth Andrea Alfonso Alfonso,36, and their children David Alejandro, three, and Mia Garcia Alfonso, six, and their brother Daniel Jose Martinez Alfonso, 11, were in the town of Calera when a group of gunmen took them by force, Mexico’s Reforma first reported. Other versions of the event claim that a group of gunmen took the family from a passenger bus while they were traveling.

Days later, Zacatecas state authorities issued a series of Amber alerts for the children and similar alerts for the adults, asking for information on their whereabouts. However, Zacatecas Secretary of State Rodrigo Reyes Muguerza claimed the information about the abduction was false. Reyes Muguerza tried to play word games to claim they had issued the alerts at the request of the Colombian government, who notified them that the family was reported as missing. According to the politician, the family traveled by bus from Mexico City to Ciudad Juarez and were last seen in Zacatecas.

On Friday evening, Reyes Muguerza claimed that the Colombian family had been found in the state of Durango and had not been abducted from a house as reported by Reforma.

The attempt by Reyes Muguerza to minimize the abduction comes as Zacatecas continues to be ravaged by cartel violence. Rival criminal organizations have been carrying out several abductions and forced disappearances where the victims are never heard from again.

As Breitbart Texas reported, in January 2022, cartel gunmen left ten dismembered bodies outside of the Zacatecas governor’s office. At the time, Governor David Monreal claimed that the violence was the result of prior administrations. Since then, Monreal and his staff have been unable to stop the raging cartel violence in their state.

Report: Juarez Drug Gangs Planned Halloween Day Killing Spree in Mexico

Authorities in the Mexican border city of Ciudad Juarez are claiming that various drug gangs in the city planned a Halloween day killing spree to get the city’s murders to more than 100 for the month of October.

This week, the Chihuahua Attorney General’s Office revealed that they obtained communications between members of various drug gangs where they plotted to carry out several murders on Halloween Day to raise the murder statistics for Juarez to more than 100, El Diario de Juarez reported, citing government sources. Ciudad Juarez is immediately south of El Paso, Texas, and has historically been a hub of cartel activity, with several criminal organizations having a presence there. These include the Juarez Cartel, the Sinaloa Cartel, and Cartel Jalisco New Generation, among others.

The claim is based on a series of messages between drug gang bosses that law enforcement managed to intercept. The report does not detail which drug cartels or gangs the messages were between. However, Ciudad Juarez has a long history of cartel violence. Most recently, the violence in Juarez is tied to fights over the control of not only the drug markets but also the human smuggling market and extortion operations.

In response to the intelligence, law enforcement officials reached out to the Mexican military, and they increased the intensity of police patrols virtually flooding the streets with cops to dissuade more killings.

On Halloween day, cartel gunmen managed to kill three people in the morning and six in the afternoon, El Diario de Juarez reported. The murder statistics showed 94 killings for the month, making October the fourth deadliest. Despite the high figure, cartel leaders did not surpass the 100-murder marker that authorities claim the criminals were looking to break.

Mexican Government Impotent as Gulf Cartel Spreads Terror Through Border State Highways

Mexico’s government remains impotent as the Gulf Cartel continues to spread terror through highways in the border state of Tamaulipas. Either for political beliefs or because of widespread corruption, local, state, and federal forces left residents to their fate as convoys of cartel gunmen freely roamed the state highways, clashing with rivals. In addition to the fighting, gunmen have also been carrying out carjackings, kidnappings, and other crimes targeting innocent civilians.

State government officials continue to claim that the violence in Tamaulipas is due to isolated incidents and that crime continues to decrease. Claims to the contrary are brushed off as attacks from political rivals. However, locals claim that is a complete lie.

One of the chief complaints is the lack of police and military patrol along the state highways that connect main cities such as Ciudad Victoria, Matamoros, Reynosa, and San Fernando. It is in those areas that factions of the Gulf Cartel have been waging a fierce turf war with minimal interference from authorities.

Last week, a citizen journalist shared a video on social media that captured the moment when a group of gunmen forced a man out of his vehicle and pushed him into one of their vehicles. That abduction took place in broad daylight, along a busy highway, and without any interference from police forces. Government officials have yet to release any information about the case.

Breitbart Texas spoke with a local man who was traveling in a passenger bus headed from Matamoros to Ciudad Victoria. According to the local who asked not to be identified out of fear, halfway through the journey, the bus turned back after being warned by the Gulf Cartel that there was going to be a shootout just down the road.

As the bus passed the city of San Fernando, they came across a row of trucks with gunmen on the side of the road. According to the passenger, another truck pulled up next to the bus, passed them, and cut them off. Gunmen got out of the vehicle and told the driver to turn back because they were about to clash with rivals down the road.

The driver turned around and headed back to the Matamoros bus station.

“During the whole way, we did not see a single police vehicle or anyone that we could tell them about what was going on,” the traveler said.

Border Patrol agents assigned to the southwest border with Mexico apprehended more than 187,000 migrants during October — the first month of the new fiscal year. A source within U.S. Customs and Border Protection stated another 30,000 migrants were reported as “known gotaways.”

Agents assigned to the nine southwest Border Patrol sectors apprehended more than 187,000 migrants during October, according to documents reviewed by Breitbart Texas. This is the fourth consecutive month that agents apprehended more than 130,000 migrants.

In addition to the more than 187,000 apprehensions, agents reported more than 30,000 migrants as known gotaways. This is a conservative estimate of migrants observed crossing the border but not apprehended by agents.

The unofficial report revealed the Tucson Sector had the most apprehensions. More than 55,000 migrants were apprehended in this sector alone. This is up from 51,000 in September. One year ago, agents in this sector apprehended less than 23,000 migrants. This represents a year-over-year increase of 149 percent over the prior October.

The Del Rio Sector followed Tucson with the apprehension of approximately 38,000 migrants. This is down slightly from the nearly 43,000 migrants apprehended in October 2022 and is up significantly from the 28,000 apprehended in October 2021.

The Rio Grande Valley, San Diego, and El Paso Sectors rounded out the top five sectors with approximately 32,000, 29,000, and 22,000, respectively. The Rio Grande Valley and San Diego Sectors are up significantly from the prior October reports.

Along the Canadian border, the Swanton Sector continues its spike in migrant apprehensions. Agents in the sector that covers the Canadian border in eastern New York, Vermont, and New Hampshire apprehended more than 1,000 migrants in the first month of FY24.

This is up by nearly 200 percent over October 2022 and is roughly equal to the apprehensions for the entire Fiscal Year 2022.
