Five-Times-Deported Illegal Alien Jose Zarate Found Not Guilty in Murder of Kate Steinle
A jury found seven-time felon, five times deported illegal alien Jose Garcia Zarate not guilty in the case of the 2015 murder of Kate Steinle Thursday evening.
The only count Zarate was found guilty on was felony possession of a weapon.
Thirty-two-year-old Steinle was shot and killed on a pier in San Francisco in 2015 while walking with her father. Her final words were pleas to her father for help, as she died in his arms.
Zarate faces a maximum sentence of three years for the weapons charge, according to Breitbart News’ Joel Pollak. The time Zarate has served thus far will likely be factored in as time already served on the sentence, meaning he will likely be released soon.
Zarate, previously known as Juan Francisco Lopez Sanchez, previously confessed to shooting Steinle in a jailhouse interview with a local ABC News affiliate. He also told the outlet that he had chosen to go to San Francisco because he knew it was a sanctuary city.
Breitbart News reported:
An ICE official told Breitbart News that ICE Enforcement and Removal had begun processing the suspect for reinstatement of removal from the U.S. in March. But instead, Lopez-Sanchez was transferred on March 26 from the Bureau of Prisons in another city to the San Francisco Sheriff’s Department (SFSD) because of a drug warrant. ICE then filed the detainer request to be notified prior to Lopez-Sanchez’s release from custody.
California lawmakers have since voted to make California a sanctuary state.

A San Francisco jury on Thursday found Jose Ines Garcia Zarate, also known as Juan Francisco Lopez Sanchez, not guilty of the murder of Kate Steinle on a San Francisco pier on July 1, 2015. The jury of six men and six women, including three immigrants, found the Mexican national not guilty of all murder and manslaughter charges and guilty only of felony possession of a firearm.
For Garcia’s Zarate’s attorney, Matt Gonzalez, Ralph Nader’s running mate in the 2008 presidential election, the trial was all about Donald Trump.
“For those who might criticize this verdict – there are a number of people who have commented on this case in the last couple of years,” Gonzalez said after the verdict, “the Attorney General of the United States and the President and Vice President of the United States. Let me just remind them, they are themselves under investigation by a special prosecutor in Washington D.C. and they may soon avail themselves of the presumption of innocence beyond a reasonable doubt, so I ask that they reflect on that before they comment or disparage the results of this case.”
“From day one this case was used as a means to foment hate, to foment division and to foment a program of mass deportation,” added defense attorney Francisco Ugarte. “It was used to catapult a presidency along that philosophy of hate of others. I believe today is a day of vindication for the rights of immigrants.”
Alex Bastian of the San Francisco prosecutor’s office told reporters the verdict “was not the one we were hoping for,” but the Steinle family could be forgiven for any reasonable doubts about the prosecution.
“We’re just shocked — saddened and shocked ... that’s about it,” Jim Steinle, Kate’s father, told the San Francisco Chronicle. “There’s no other way you can coin it. Justice was rendered, but it was not served.” Kate’s brother Brad was “stunned that they couldn’t even get him on using the weapon.”
Attorney David Wohl told Fox News that with negligent discharge of a firearm, the defendant’s action met every standard for involuntary manslaughter. The verdict, Wohl said, was “an utter and complete and total failure by the prosecutor.”
Conservative Ben Shapiro told Fox news the verdict was “horrifying. . . Politics trumps evidence in California once again.” For Jeff Sessions San Francisco’s sanctuary city policy “led to the preventable and heartbreaking death of Kate Steinle.” According to the Attorney General’s statement, the Justice Department “will continue to ensure that all jurisdictions place the safety and security of their communities above the convenience of criminal aliens.”
For his part, President Trump tweeted: “A disgraceful verdict in the Kate Steinle case! No wonder the people of our Country are so angry with Illegal Immigration.”

The Mexican nation and career criminal enjoyed all the rights of the American legal system, the presumption of innocence, and a high-profile defense attorney funded by American taxpayers. During the trial, former vice presidential candidate Matt Gonzalez claimed that Garcia Zarate’s background and nationality played a role in his prosecution. As Gonzalez argued, “If this was a college student or Swedish kid would he be charged with murder?”
That sort of politically correct nonsense plays well in San Francisco, so any observer of the case could be forgiven for believing that prosecution and defense both got the outcome they wanted, regardless of the tragedy for the Steinle family. The felony firearms charge, the only charge on which Garcia Zarate was found guilty, carries a sentence of 16 months to 3 years. Since Garcia Zarate has been languishing in jail, the authorities could commute any sentence to time served and he could walk free within weeks.
San Francisco is not likely to hand the felon over to ICE for deportation. Should that happen, Garcia Zarate has already proved five times that anybody can get away with violating U.S. immigration law. He has already proved that in the sanctuary state of California, false-documented illegals are a privileged class.
Jose Ines Garcia Zarate, or whatever his real name is, has also proved that a career criminal who is not even supposed to be in the country can literally get away with murder in broad daylight. When that happens, the killer’s public defender will call it a “vindication for the rights of immigrants.”
In San Francisco, and across California, this verdict will surely give new meaning to the cry of “no justice, no peace.”

Democratic leader Nancy Pelosi demands Representative John Conyers resign over harassment claims

House Democratic Leader Nancy Pelosi demanded Thursday that Representative John Conyers Jr., the chamber’s longest-serving lawmaker, resign from Congress because of unproven allegations of sexual misconduct. “Zero tolerance means consequences—for everyone,” she said. “No matter how great the legacy.”
The move marks a reversal by Pelosi, who defended Conyers Sunday on NBC’s "Meet the Press", calling him an “icon in our country” who has “done a great deal to protect women” and should be entitled to “due process.”
Conyers, who has already stepped down as the top Democrat on the House Judiciary committee, participated in the civil rights movement and helped found the Congressional Black Caucus. As the longest-serving member of the House of Representatives, he holds the honorary title of “dean.”
A spokesman for Conyers said Thursday that the congressman, who is nearly ninety years old, has been hospitalized due to a stress-related illness.
Demands have also been made for the resignation of Senator Al Franken, though both have said that they will not. Responding to Pelosi’s demand, Conyers’ lawyer declared, “Nancy Pelosi did not elect the congressman and she sure as hell won’t tell the congressman to leave.”
The accusations against Conyers and Franken come as the Trump administration is pushing through a watershed bill that would slash taxes on the rich, raise taxes on low-income households, and gut social spending. Both Conyers and Franken have been among the more vocal opponents within the Democratic Party of the Trump administration’s domestic agenda.
Conyers and Franken are the latest victims of the ongoing “sexual misconduct” witch hunt that has been heavily promoted by the Democrats and their semi-official news outlets, the New York Times and Washington Post.
The Times lifted the lid on the some of the bitter factional divisions motivating the campaign against Conyers in an article published Tuesday that declared the Conyers scandal “has highlighted schisms that are as much about generations as they are about gender.”
It quoted Representative Hakeem Jeffries of New York, who observed, “House Democrats have been in transition since the 2016 election with younger members being given the opportunity to be on the playing field in a meaningful way,” adding that the downfall of Franken and Conyers “may accelerate the elevation of younger voices.”
It continued, “Especially among Democrats, Mr. Conyers’s troubles have…underscored the difficulty that newer members of the House have in rising up in a system where leadership positions, including committee chairmanships, are determined almost solely by seniority.”
It added, “The three top Democrats in the House—Representatives Nancy Pelosi of California, Steny Hoyer of Maryland and James E. Clyburn of South Carolina—are all in their late 70s. Mr. Conyers has been the top Democrat on the Judiciary Committee—either as chairman or ranking member—for 10 years.”
It noted that Pelosi had come under political pressure following her public defense of Conyers, including by Jeffries and other members of the Congressional Black Caucus. The Times highlighted other members of Congress who were unhappy with Pelosi’s leadership, including Tim Ryan of Ohio, who declared, “It’s been no secret that I think we need new people stepping up across the board in the party providing leadership.”
The Times, which has been at the forefront of promoting the sexual misconduct witch hunt, made no effort to square the naked careerism and factional infighting it profiled with any defense of women’s rights.
It does make clear, however, some of the political considerations leading to Pelosi’s about-face. She appears to have received a clear message: throw Conyers under the bus or her own position as Democratic leader would be in jeopardy.
As these events played out in Congress, Today Show host Matt Lauer, whose firing was announced while the program was on air Wednesday, made a contrite apology, declaring, “To the people I have hurt, I am truly sorry. As I am writing this I realize the depth of the damage and disappointment I have left behind.”
On Wednesday Oscar-winning actor Geoffrey Rush hit back against the Sydney Theatre Company, which announced it had received a complaint against him. “Not to afford a person their right to know what has been alleged against them let alone not inform them of it but release such information to the public is both a denial of natural justice and is not how our society operates,” he wrote in a statement.
The same day, Minnesota Public Radio (MPR) said it fired Garrison Keillor, creator of the iconic “A Prairie Home Companion” radio program, over allegations of “inappropriate behavior.” Commenting on the firing, Keillor said the story was “more interesting and more complicated than the version MPR heard.”
MPR reported on Thursday that it had received widespread criticism from the public for its summary action, based on an accusation that Keillor has said involved him mistakenly touching a woman’s back while offering an expression of condolence. “Hundreds of Minnesotans are expressing anger, disappointment and disbelief” over the decision to cut ties with Keillor, MPR reported.
“Some Facebook and email commenters accused MPR of ‘McCarthyism’ and called MPR’s investigation of Keillor’s conduct a ‘witch hunt.’ Others asked for a more complete explanation of the accusations from the company.”
Just hours before he was fired, Keillor published a column in the Washington Post defending Franken, entitled, “Al Franken should resign? That’s absurd.”
“On the flight home, in a spirit of low comedy, Al [Franken] ogled [accuser] Miss Tweeden and pretended to grab her and a picture was taken,” Keillor wrote. “Eleven years later, a talk show host in LA, she goes public, and there is talk of resignation. This is pure absurdity, and the atrocity it leads to is a code of public deadliness.”
The Washington Post now carries an editors’ statement above the online version of the column, declaring that Keillor “failed to meet” a “basic level of transparency” in publishing the article, adding “we do not intend to publish his columns in the future.”

What’s clear is that the producers are leaving the state and the takers are coming in. Many of the takers are illegal aliens, now estimated to number over 2.6 million. The Federation for American Immigration Reform estimates that California spends $22 billion on government services for illegal aliens, including welfare, education, Medicaid, and criminal justice system costs. Liberals claim they more than make that up with taxes paid, but that’s simply not true. It’s not even close. FAIR estimates illegal aliens in California contribute only $1.21 billion in tax revenue, which means they cost California $20.6 billion, or at least $1,800 per household.
Nonetheless, open border advocates, such as Facebook Chairman Mark Zuckerberg, claim illegal aliens are a net benefit to California with little evidence to support such an assertion. As the Center for Immigration Studies has documented, the vast majority of illegals are poor, uneducated, and with few skills. How does accepting millions of illegal aliens and then granting them access to dozens of welfare programs benefit California’s economy? If illegal aliens were contributing to the economy in any meaningful way, California, with its 2.6 million illegal aliens, would be booming.
Furthermore, the complexion of illegal aliens has changed with far more on welfare and committing crimes than those who entered the country in the 1980s. Heather Mac Donald of the Manhattan Institute has testified before a Congressional committee that in 2004, 95% of all outstanding warrants for murder in Los Angeles were for illegal aliens; in 2000, 23% of all Los Angeles County jail inmates were illegal aliens and that in 1995, 60% of Los Angeles’s largest street gang, the 18th Street gang, were illegal aliens. Granted, those statistics are old, but if you talk to any California law enforcement officer, they will tell you it’s much worse today. The problem is that the Brown administration will not release any statewide data on illegal alien crimes. That would be insensitive. And now that California has declared itself a “sanctuary state,” there is little doubt this sends a message south of the border that will further escalate illegal immigration into the state.

Mark Steyn: Steinle Verdict ‘a Miscarriage of Justice in the Profoundest Sense’
Thursday on Fox News Channel’s “Tucker Carlson Tonight,” conservative commentator Mark Steyn ripped a San Francisco jury’s decision to acquit Jose Ines Garcia Zarate of murder and manslaughter charges for the death of Kate Steinle.
“I think it is a miscarriage of justice in the profoundest sense in that Kate Steinle is dead because she went for a walk in a popular destination in her own city and her parents will never see anybody convicted for that crime,” he said. “There’s no dispute — I mean, this is slightly different from the O.J. [Simpson] case, where he pretended to look for the real killers for the last 20 years. There is no dispute that this guy actually fired the shot, or picked up the gun that then shot itself and that this gunshot killed Kate Steinle. And there’s no dispute either that this man should not have been in the country and in fact, he had been deported six times.”

Steve King Pledges to Block ‘Every Form’ of Amnesty for Illegal Aliens in Kate Steinle’s Honor
Rep. Steve King (R-IA) says he will do his part in honoring 32-year-old Kate Steinle — whose illegal alien killer was acquitted of her murder — by blocking “every form” of amnesty that the GOP-led Congress attempts to push.
After five-time deportee and seven-time felon illegal alien Jose Garcia Zarate, also known as Juan Francisco López-Sánchez, was not convicted of the murder of Steinle — despite previously admitting to shooting and killing the woman while she was walking on a pier with her father — King called the decision “Sickening!”

King also vowed to oppose any amnesty for illegal aliens that the Congress may attempt to pass by the end of the year.
“I will spare no effort to do my own killing-of all amnesty in every form!” King continued.
Since September, when Attorney General Jeff Sessions announced the end of the President Obama-created Deferred Action for Childhood Arrivals (DACA) program which shielded nearly 800,000 illegal aliens from deportation, the Republican establishment and Democrats have scrambled to push multiple amnesty bills for illegal aliens.
Pro-American immigration reformers with the Center for Immigration Studies said in a statement in the wake of Steinle’s killer being acquitted that Congress should be laser-focused on passing legislation that protects Americans, rather than illegal aliens.
“Addressing the problems in our immigration system that allowed all this to happen should be a top priority for Congress, not rushing to pass a DACA amnesty, as some members have called for,” spokeswoman Marguerite Telford said.
Federal immigration officials at the Immigration and Customs Enforcement (ICE) agency have committed to deporting — for the sixth time — the illegal alien who caused Steinle’s death, as Breitbart News reported.
Steinle was killed while walking with her father on a pier in San Francisco in 2015 when the illegal alien shot her. Steinle pleaded with her father to not let her die, but she soon passed away in her father’s arms.
Steinle’s death has not only caused a national debate on immigration policy, but the killing has galvanized a grassroots movements of pro-American immigration reformers and Angel Parents — the family members of Americans killed by illegal aliens — to demand a crackdown on illegal immigration and a legal immigration policy that puts the jobs, needs, and lives of Americans first.

Following the not guilty verdict of seven-time felon and five-times deported illegal alien Juan Francisco Lopez-Sanchez, also known as Jose Ines Garcia Zarate — who previously admitted to shooting and killing 32-year-old Kate Steinle while she was walking on a pier with her father — Sessions said the woman’s death was “preventable” if not for San Francisco’s sanctuary city policy that allows criminal illegal aliens to take refuge in the region.
“When jurisdictions choose to return criminal aliens to the streets rather than turning them over to federal immigration authorities, they put the public’s safety at risk,” Sessions said in a statement. “San Francisco’s decision to protect criminal aliens led to the preventable and heartbreaking death of Kate Steinle.”
Sessions said Steinle’s murder and the not guilty verdict for the illegal alien who shot her should be an example of the danger sanctuary cities put Americans’ lives in when they refuse to cooperate with federal immigration officials in deporting illegal aliens.
“While the State of California sought a murder charge for the man who caused Ms. Steinle’s death—a man who would not have been on the streets of San Francisco if the city simply honored an ICE detainer—the people ultimately convicted him of felon in possession of a firearm,” Sessions continued.
“The Department of Justice will continue to ensure that all jurisdictions place the safety and security of their communities above the convenience of criminal aliens,” Sessions said. “I urge the leaders of the nation’s communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers.”
In his 2015 confession, a local news station interviewed Lopez-Sanchez, and he said he sought out San Francisco because it was a sanctuary city that would not deport him from the U.S.
“Sanchez said he knew San Francisco was a sanctuary city where he would not be pursued by immigration officials,” the local report added.
While walking with her father on a pier in San Francisco in 2015, Steinle was shot by the illegal alien. Steinle pleaded with her father to not let her die, but she soon passed in her father’s arms.
Steinle’s death has not only caused a national debate on immigration policy, but the killing has galvanized a grassroots movements of pro-American immigration reformers and Angel Parents — the family members of Americans killed by illegal aliens — to demand a crackdown on illegal immigration and a legal immigration policy that puts the jobs, needs, and lives of Americans first.

Illegal Immigrant Allegedly Kills Texas Cheerleader in Thanksgiving Day DUI Crash
A 14-year-old Texas student was killed after a car driven by an illegal immigrant allegedly crashed into the back of her grandparents’ vehicle Thanksgiving evening. Authorities say the Mexican man was driving at a high rate of speed and ran a red light.
The family of Rhyan Moody, a cheerleader at Colleyville Heritage High School, says a drunk driver caused the fatal collision and her grandparents were injured.
Moody’s stepfather, Caines Johnson, told the Fort Worth Star-Telegram, “She was coming home from dinner with her grandmother and grandfather in Fort Worth. The driver was going 68 [miles per hour] in a 40 and T-boned their car.”
The casualty occurred in Lake Worth, a suburb of Fort Worth.
Police arrested 38-year-old Jose Victor Chaparro-Saenz and charged him with manslaughter, two counts of aggravated assault with a deadly weapon, and resisting arrest, Fox 4 News in Dallas reported.
Breitbart Texas confirmed with officials from U.S. Immigration and Customs Enforcement that Chaparro-Saenz is a Mexican national who illegally entered the U.S. in 1998. Immigration officials at that time offered the Chaparro-Saenz the opportunity to voluntarily return to Mexico. Immigration officials had no contact with the man following his return to Mexico.
Immigration officials explained that a Voluntary Return (VR) does not have the same legal consequences as a deportation.
Upon learning of Chaparro-Saenz’ arrest, immigration officials placed a detainer on him to secure custody of the man if he is released from the Tarrant County jail.
The local Fox affiliate reported that first responders found alcohol in Chaparro-Saenz’s SUV and he appeared to be intoxicated.
“He rolled up the window on officers and wouldn’t get out of the vehicle,” Lake Worth Police Department Chief Corry Blount told reporters.
Officers had to break the glass and unlock the door to get to the suspect. He tried to fight the officers, the police chief explained. The officers successfully subdued and handcuffed him.
A mugshot of the illegal immigrant shows that he had blood on his face and a black eye.
Chaparro-Saentz is being held without bond and Immigration and Customs Enforcement (ICE) has an immigration hold on him.
The Tarrant County Medical Examiner’s Office reported that Moody died from blunt force head trauma sustained during the crash, the Star-Telegram reported.
“She was truly an outstanding young woman. She was the nicest, most kind-hearted person to her family, friends, and anyone who needed help,” Moody’s stepfather Gaines Johnson told reporters. “This wasn’t an accident. It was just a senseless, reckless, and selfish act.”

Kansas Secretary of State and candidate for governor Kris Kobach (R) blasted “open borders liberals” for their defense of sanctuary cities which he says cost 32-year-old Kate Steinle her life.
His intervention follows the acquittal of the illegal alien killer who caused her death in sanctuary city San Francisco, California.
After five-time deported and seven-time felon illegal alien Jose Garcia Zarate, also known as Juan Francisco López-Sánchez, was not convicted of the 2015 murder of Steinle — despite previously admitting to shooting and killing the woman while she was walking on a pier with her father — Kobach told Breitbart News in an exclusive statement that the verdict “obscures the real problem” which is that Zarate should have never been in the United States to begin with.
Kobach told Breitbart News:
The verdict of not guilty obscures the real problem. Regardless of whether Zarate shot the bullet intentionally or accidentally, the facts are: 1. Zarate was a five-times-deported illegal alien who should never have been in the United States, and 2. by his own admission, Zarate went to San Francisco because it was a sanctuary city.In short, San Francisco’s sanctuary policy led to Kate Steinle’s death. The open borders liberals who continue to defend sanctuary policies are putting American lives at risk.
In 2015, a local news station interviewed Zarate. In this interview, the illegal alien admitted that he had relocated to San Francisco because of its sanctuary city policy.
“Sanchez said he knew San Francisco was a sanctuary city where he would not be pursued by immigration officials,” the report added.
Since Steinle’s death in 2015, the state of California has become a sanctuary state, Breitbart California reported in October, allowing illegal aliens to roam freely across the West Coast region without being detained or deported by federal immigration officials.
The Immigration and Customs Enforcement (ICE) agency has committed to deporting — for the sixth time — the illegal alien who caused Steinle’s death, as Breitbart News reported.
Steinle was killed while walking with her father on a pier in San Francisco in 2015 when the illegal alien shot her. Steinle pleaded with her father to not let her die, but she soon passed away in her father’s arms.
Steinle’s death has not only caused a national debate on immigration policy, but the killing has galvanized a grassroots movements of pro-American immigration reformers and Angel Parents — the family members of Americans killed by illegal aliens — to demand a crackdown on illegal immigration and a legal immigration policy that puts the jobs, needs, and lives of Americans first.

Have We Been Lied To About The Kate Steinle Case?
The illegal immigrant who killed Kate Steinle in 2015 was found not guilty of her murder by a San Francisco jury today. Outrageous, right?
Before the killing, Garcia Zarate had been released from a San Francisco jail despite a standing federal deportation order. He had been deported five times before. This made him a very effective villain for Trump’s border security campaign messages — proof that sanctuary city policies kill! — and it’s natural to be sympathetic about Steinle, who died in her father’s arms at the far too young age of 32.
The trouble with a politically-charged case like this is that there are many who seek to benefit from twisting, if not outright lying, about what really happened. And the facts here are far more complicated than any campaign slogans would lead you to believe.
These two facts are undisputed by the prosecution and defense:
- On July 1, 2015, Kate Steinle was fatally struck in the back by a single bullet as she walked on Pier 14 with her father to view the San Francisco Bay.
- Jose Ines Garcia Zarate, a Mexican citizen illegally in the United States, fired the gun that killed Steinle.
The complicated part is pretty much everything else.
[One quick but important note: Garcia Zarate is not going free. The jury did convict him of a lesser charge of being a felon in possession of a gun, and he now awaits sentencing, which will be 16 months, two years, or three years in state prison. He has already served two years and will get credit for that time, but even if he is not given the maximum sentence, there is an outstanding U.S. Marshals Service warrant against him, and despite the sanctuary cities policy, San Francisco apparently does turn over undocumented immigrants to the feds when they have a warrant. So he is either getting deported, or spending more time in prison first, and then getting deported.]
In a detailed write-up of the verdict, the San Francisco Chronicle describes many details that have rarely or never been mentioned in the vast majority of the media coverage of this case. The main issue is that the defense was able to present a credible case that the shooting was an accident, and the prosecution aggressively overplayed their hand. Add in a misguided police interrogation strategy and you have reasonable doubt:
Defense lawyers said the shooting was an accident that happened when Garcia Zarate, who had a history of drug crimes but no record of violence, found the gun wrapped in a T-shirt or cloth under his seat on the pier just seconds before it discharged in his hands. Matt Gonzalez of the public defender’s office said his client had never handled a gun and was scared by the noise, prompting him to fling the weapon into the bay, where a diver fished it out a day later.During the trial, jurors watched video from Garcia Zarate’s four-hour police interrogation, in which he offered varying statements about his actions on the pier. At one point he said he had aimed at a “sea animal,” and at another point, he said the gun had been under a rag that lay on the ground near the waterfront, and that it fired when he stepped on it.Gonzalez said it was clear in the video that Garcia Zarate — who has spent much of his adult life behind bars, was living on the street before the shooting, and has a second-grade education — did not fully understand what the officers were asking him through an officer’s Spanish translation.Grainy surveillance footage taken by a camera positioned a quarter-mile away showed that just before Garcia Zarate took his seat on the pier, a group of six people gathered at the spot. Gonzalez said it was possible that those people had discarded the gun that killed Steinle.
The Chronicle also notes that Steinle was not hit directly, but rather the bullet hit the concrete ground and then ricocheted up to hit her. The gun was a SIG Sauer pistol that had been stolen four days prior to Steinle’s death from a federal ranger’s car parked in the area.
The defense also presented evidence regarding the SIG Sauer’s propensity to accidentally fire. One of Garcia Zarate’s attorneys detailed the issues in a San Francisco Examiner article:
It’s an elite handgun intended for law enforcement and military personnel who may need to fire it with split second notice. Hence, it has a hair trigger in single-action mode. Even among well-trained users, it has a lengthy history of accidental discharges.Most police agencies don’t make records public, but those that do reveal disturbing data. In a four-year period (2012-2015), the New York City Police Department reported 54 accidental firearm discharges, 10 involving SIG Sauers. Los Angeles County reported more than 80 accidental discharges between 2010 and 2015, five involving SIG Sauers. From 2005 to January 2011, the San Francisco Police Department reported 29 accidental discharges (a time when it issued SIG Sauers as its primary sidearm)…The SIG Sauer in Lopez Sanchez’s case has three features prone to accidents:1. No safety lever, making it perpetually ready for firing.
2. Manufacturer-issued trigger pull of 4.4 pounds of force (in single-action mode), which is among the lightest on the market.
3. An unlabeled decocking lever despite being essential to disengage the single-action mode. (The SIG Sauer safety manual urges “DO NOT THUMB THE HAMMER DOWN the consequences can be serious injury or death — only and ALWAYS use the decocking lever.”)New York City requires officers using SIG Sauers to disable its single-action function because the hair trigger is too dangerous. Those using the gun can only do so in double-action mode, which has a 10-pound trigger pull.Still capable of accidentally discharging, it provides some modicum of greater safety. However, single-action was not disabled on the handgun involved in this case, which Lopez Sanchez says he found wrapped in a T-shirt, thereby concealing its danger.
(Note: “Lopez Sanchez” is an alias of Garcia Zarate. This matter was corrected before the trial, as CBS San Francisco reported.)
So, we have a defendant with zero connection to Steinle. He had a history of drug crimes but no known violent crimes. The bullet that killed Steinle hit the ground and then ricocheted upwards. There was a video possibly showing another group of people disposing of the gun where Garcia Zarate said he found it.
Reviewing the SIG Sauer website shows these handguns cost $1,000 or more. You can see how defense counsel could easily argue that a homeless illegal immigrant would be unfamiliar with one.
All of this adds up to the defense presenting a plausible explanation for how Garcia Zarate could have fired the gun and killed Steinle by accident. That’s reasonable doubt.
The prosecutors were under tremendous political pressure. People wanted Kate Steinle’s killer’s head on a platter, even before Donald Trump ever tweeted her name.
So it’s not that surprising that “San Francisco prosecutors told the jury that Garcia Zarate intentionally brought the gun to the pier that day with the intent of doing harm, aimed the gun toward Steinle and pulled the trigger,” as the Chroniclereported, adding that the Assistant District Attorney also “spent much of the trial seeking to prove the gun that killed Steinle couldn’t have fired without a firm pull of the trigger.”
This seems to be a classic example of prosecutorial overreach.They pushed hard for a first degree murder verdict, which requires not only proving that the defendant killed the victim, but that he did it intentionally, and that it was premeditated (planned or thought out beforehand).
Focusing their strategy on the lesser charge of involuntary manslaughter would have allowed the prosecutors to simply argue that Garcia Zarate acted in a criminally negligent way that resulted in Steinle’s death: he knew the object was a gun, he knew guns are dangerous, he should have known not to point it in the direction of people, etc.
Add to all of this that four-hour meandering police interrogation that allowed defense counsel to present their client as confused and intimidated by the police. Just one more little piece of the puzzle making it easier for defense counsel to portray their client as a naive fool who picked up a gun and caused a terrible accident rather than a vicious killer who stalked his victim.
Those who followed the Casey Anthony case in Florida will find this familiar. There, prosecutors also pushed hard for a first degree murder verdict, requiring them to convince the jury that Anthony killed her daughter Caylee intentionally and with premeditation, knowing the death penalty was on the table. This was extremely difficult, especially with no witnesses to Caylee’s death and the state of the forensic evidence when her body was found. If instead the prosecutors had focused on arguing that there was no justifiable reason for duct tape to be applied over the toddler’s face, or for her to be in the trunk of her mother’s car (plus Anthony’s period of lies about Caylee’s whereabouts), establishing manslaughter or at least the aggravated child abuse charge may have been easier.
So was Steinle’s killing an accident? Maybe. The defense put forward a plausible explanation that it was, and that was enough for the jury to find reasonable doubt after six days of deliberation, and that’s enough for a not guilty verdict.
What’s not an accident: the many political figures and media personalities who have distorted this case for various reasons. These misrepresentations are a disservice to our justice system, and to Kate Steinle’s family as well.
