American professionals who were replaced by H-1B foreign visa workers are asking a federal court to strike down an Obama-era regulation that allows companies to outsource United States jobs to the spouses of H-1B foreign visa workers.

Save Jobs USA, made up of American professionals who were fired and forced to train their H-1B foreign visa replacements in 2015 by Southern California Edison, is asking the U.S. District Court for the District of Columbia for summary judgment to prevent an Obama-era regulation governing H-4 visa holders, the spouses of H-1B visa holders, which allows them to take U.S. jobs.

In 2015, the Obama administration implemented a Department of Homeland Security (DHS) regulation that allowed H-4 visa holders to obtain work permits to take U.S. jobs. In 2017, the Trump administration had sought to eliminate the regulation, but it was never finalized.

President Joe Biden, last month, announced that his administration would not seek to eliminate the regulation allowing H-4 visa holders to take U.S. jobs after lobbying from the U.S. Chamber of Commerce and other corporate interests.

Save Jobs USA’s lawsuit, in which plaintiffs are represented by the Immigration Reform Law Institute (IRLI), alleges that “the statutory terms of the H-4 visa do not authorize employment” and ultimately that the Biden administration is unlawfully inflating the U.S. labor market.

The lawsuit states:

These American workers bring this action under the Administrative Procedure Act to challenge a DHS regulation designed to increase the amount of foreign labor in the United States and circumvent statutory protections for American workers by allowing — without authorization in the statute that governs the visas for both H-4 dependents and their spouses — certain aliens with H-4 visas to work in this country. The issue in this case is whether, as DHS claims, Congress has validly conferred on DHS a work-authorization power so sweeping and general that it permits DHS to issue the H-4 Rule even without any authorization in this governing statute. [Emphasis added]

Because Congress has not conferred upon DHS general authority to define classes of aliens eligible for employment through regulation, and because any such delegation of power would be unconstitutional, the H-4 Rule is in excess of DHS authority. Therefore, the Court must set it aside. [Emphasis added]

“The media has largely ignored the problem of DHS creating guestworker programs through regulation,” IRLI counsel John Miano said in a statement. “The Constitution gives Congress authority over the immigration system, but more labor now enters the U.S. job market through regulation than under laws passed by Congress.”

Today, there are nearly 100,000 H-4 visa holders who are eligible to obtain work permits to take U.S. jobs.

Meanwhile, the H-1B visa program allows companies to bring 85,000 foreign workers to take U.S. jobs each year and likely thousands more as universities and nonprofits are exempt from this annual cap.

There are about 650,000 H-1B visa foreign workers in the U.S. at any given moment. Americans are often laid off in the process and forced to train their foreign replacements, as highlighted by Breitbart News.

The case is Save Jobs USA v. U.S. Department of Homeland Security, 1:15-cv-00615-TSC in the U.S. District Court for the District of Columbia.

Some Democrat lawmakers and immigration activists hammered U.S. President Joe Biden’s approach to the border crisis by wasting valuable time on determining the long-term root causes of migration rather than dealing with the problem now.

Biden has been reaching out to Congress members, staffers, and activists to push a narrative that the problem at the U.S. border is mainly former President Donald Trump’s fault in combination with the “root causes” of migration in Central America, Politico reported Saturday.

However, some Democrat lawmakers assert that the government is already fully conscious of what attracts people to America after looking into the issue for decades.

Rep. Henry Cuellar (D-TX) welcomed Biden’s effort to address long-term causes of migration surge with combating root causes of migration but stressed that the U.S. also needs a solution for the problem afflicting the border now.

Cuellar, a border congressman known to criticize immigration policies from his party, told Politico:

We already know what the root causes are. We can send researchers down there, but we know the answers already. The question is, how do you address this issue? Private investment is going to be key. Foreign aid and private investment take time. It’s not going to be done today, tomorrow.

Biden is “betting big on nuance” to change what Americans think of immigration as a poll released Monday showed a majority disprove of the commander-in-chief’s handling of border security and immigration, particularly the flood of unaccompanied children, Politico noted, adding:

The revised approach from the administration is a tacit acknowledgment that their initial posture — in which they downplayed the problem and steadfastly refused to call it a crisis —wasn’t working, at least politically. But when it comes to actually fixing the conditions forcing migrants to flee their home countries, the White House has its work cut out for it.

On Monday, the Associated Press-NORC released a poll showing the border’s situation has put a dent on Biden’s approval rating on immigration.

A majority of respondents disapprove of the president’s handling of border security (55 percent) and immigration overall (56 percent).

More respondents disapprove of how Biden is handling the growing number of unaccompanied migrant children arriving at the U.S.-Mexico border.

While 40 percent of Americans somewhat or strongly disapprove of how the president is dealing with unaccompanied migrant children, only about a quarter strongly or somewhat approve. The remaining 36 percent neither support nor disapprove.

More Democrats (44 percent) approve of Biden’s way of handling unaccompanied children than disapproved (15 percent) by a substantial margin. Leaked pictures have shown the children in crowded cage-like enclosures.

Democrats blasted Trump for holding migrant children in detention centers.

Rep. Emanuel Cleaver (D-MO) stressed that the Biden administration needs to look beyond the root causes of immigration to solve the ongoing situation.

“We can’t just deal with the symptoms,” said Cleaver, who appeared more receptive to Biden’s new approach of changing how people view immigration. “That’s all that we’ve been dealing with for the last two, maybe three decades, are the symptoms. That won’t work anymore.”

The Trump administration warned the Biden folks that there would be problems if they rescinded the former president’s border security measures.

Some immigrant rights advocates suggested that Biden dismantled his predecessors’ border policies without a clear strategy to fill the vacuum left behind.

“The White House needed to be or should have been more proactive, framing and telling the story three weeks before they really started to do it. If you don’t define the narrative, you give your opponents the power to do so,” Lorella Praeli, executive director of Community Change Action, a progressive grassroots group, told Politico.

Republicans who have traveled to the border have lambasted Biden for not calling the situation at the U.S.-Mexico international boundary a “crisis.”

GOP lawmakers who have visited the border said the crisis is putting the lives of unaccompanied children and family migrants at risk, including girls who can get raped on the journey to the U.S.

They also pointed out the potential for jihadis from the Middle East and Africa and other terrorist countries entering the nation.

Biden appointed Vice President Kamala Harris to lead the White House response to what a majority of surveyed Americans consider a crisis despite the administration’s claim that it is only a “challenge.”

The president charged Harris with focusing on the root causes of migration that Cuellar, Clever, and activists note are not secrets.

Various U.S. presidents have devoted billions in U.S. taxpayer funds to improve Latin American conditions to prevent people from leaving to no avail. Biden has promised $4 billion.

Republicans and independents largely drive the disapproval rates of Biden’s handling of immigration and border security, the AP-NORC poll showed.

DHS Erases Report About Illegal Aliens on FBI Terrorism Watch List Crossing U.S.-Mexico Border

The Department of Homeland Security (DHS) has erased a report that detailed illegal aliens on the Federal Bureau of Investigation’s (FBI) Terrorism Watch List and No-Fly List crossing the United States-Mexico border.

On Monday, the U.S. Customs and Border Protection (CBP) agency published a press release detailing Border Patrol agents’ apprehension of two illegal aliens from Yemen who are on the FBI’s Terrorism Watch List and the No-Fly List.

“Two Yemeni Men Arrested by Border Patrol Identified on the FBI’s Terrorism Watch List,” the title of the CBP press release read. By Tuesday morning, though, the release had been removed from the CBP website and has not been republished.

A CBP spokesperson told Breitbart News in a statement:

The news release in question was not properly reviewed and contained certain disclosure and policy information related to national security that required CBP to remove it from our website.

As Breitbart News reported, the CBP report revealed that on March 30, Border Patrol agents in southern California apprehended a 26-year-old illegal alien from Yemen. When they ran checks on his background, they found he is listed on the FBI’s Terrorism Watch List and the No-Fly List.

Months before — just eight days after President Joe Biden took office — on January 29, a 33-year-old illegal alien from Yemen was apprehended in southern California by Border Patrol agents. A background check found he is listed on the FBI’s Terrorism Watch List and the No-Fly List.

Both are in federal custody, according to the CBP report.

On Tuesday, White House Press Secretary Jen Psaki attempted to downplay the national security threat of illegal immigration at the southern border.

“First let me convey that these sets of incidents are very uncommon,” Psaki said when asked about the two illegal aliens from Yemen who were apprehended. “… while this is rare, this is a reflection of [Border Patrol] doing their job.”

Those on the FBI’s Terrorism Watch List and No-Fly List seeking to cross illegally into the U.S. are not isolated incidents, as reports over the years have confirmed. From October 2020 to the beginning of March, for example, congressional aides have said there have been at least four separate Border Patrol encounters with illegal aliens on the FBI’s Terrorism Watch List.

Likewise, in 2016, Breitbart News reported exclusively on a series of leaked documents from the FBI’s Terrorist Screening Center revealing that from July 2015 to July 2016, the FBI documented more than 7,700 encounters with illegal aliens who appeared on the Terrorism Watch List. Subsequent reports show encounters numbering in the thousands annually.

The tentacles of criminal organizations like the Gulf Cartel or the Cartel Del Noreste faction of Los Zetas do not end at the Texas border, said U.S. Congressman Chip Roy.

Congressman Roy made those statements during a series of exclusive interviews with Breitbart Texas as he traveled the Texas border in a fact-finding effort amid the current border crisis, which he attributed to the policies of the Biden Administration. Roy stepped away from the formal congressional delegations to border hotspots like McAllen, Laredo, Carrizo Springs, Eagle Pass, and others.

One of the largest takeaways of those visits is that Mexican cartels have real operational control of the border as Mexico’s government remains unable to do anything about it, Roy said.

“That’s something that the American people don’t fully understand,” he said. “The Mexican government–they can’t have their force mean anything in that area. The cartels have control there.”

However, according to Congressman Roy, the power of the cartels does not end at the border. In some cases, U.S. agencies in San Antonio and others have turned a blind eye to the presence and power of cartels, he said.

In the Rio Grande Valley, the Reynosa faction of the Gulf Cartel has been benefiting from the lack of enforcement at the border, while in Laredo the CDN-Los Zetas are the ones reaping the benefits, Roy said.

“They are the ones making a lot of money moving human beings for profit,” he said.

During those visits, Roy has encountered several groups of migrants, some of those who had been trying to run away from authorities such as in Laredo, while in the Rio Grande Valley, migrants became lost in the brush after crossing the river after not being able to find any agents.

“The word has gotten out that Border Patrol is now distracted,” Roy said, explaining that agents from other sectors have been moved to the Rio Grande Valley to man detention and processing facilities. “What does that mean? You don’t have patrols going out and stopping the flow between the ports of entry. So now we have fentanyl up, pounds of marijuana up, human smuggling between ports of entry up, and that is kind of where your bad guys are generally coming. This is the state of our border.”

Nearly 200,000 illegal aliens living in New York will soon receive $2.1 billion in taxpayer-funded stimulus checks and unemployment benefits thanks to a budget agreed upon by Gov. Andrew Cuomo (D).

While more than a million jobs have been lost in New York and an estimated 80,000 New York businesses may not make it to the end of the Chinese coronavirus pandemic, Cuomo and elected state Democrats agreed on a budget deal that provides billions to illegal aliens at the taxpayer’s expense.

Specifically, according to the New York Times, the state budget includes $2.1 billion in taxpayer-funded one-time payments in the form of stimulus checks and unemployment-style benefits for about 187,000 illegal aliens — about $1.1 billion more than small businesses are set to get in grants and tax credits after being forced to close by Cuomo’s economic lockdowns.

The budget also provides about $2.3 billion in federal funds for tenants who have been behind on rent as a result of Cuomo’s lockdowns, just $200,000,000 more than what illegal aliens will receive.

Previous estimates suggested illegal aliens could receive up to $28,600 a year thanks to the taxpayer-funded benefits approved by Cuomo. Weekly, illegal aliens could receive $500. For those unemployed since March 2020, illegal aliens could receive, on average, $12,600.

New York Republican Party Chairman Nick Langworthy called the New York state legislature “even more radical than the Biden-Harris administration” and said the budget deal “has replaced any last semblance of common sense with woke insanity.”

“Democrats are about to pass a budget that raises taxes on New Yorkers and businesses by $4 billion while enacting a $2 billion fund that will provide $25,000 payouts to illegal immigrants,” Langworthy said in the statement:

The few brave Democrats who have dared to speak out against this outrageous proposal are being called racists by their own party. While many will appreciate the irony in Democrats turning on each other, the terrifying truth is our state has been hijacked by extreme leftists where racism is cheapened and once again, those who break the law are given priority.

New York, and particularly New York City, has been ravaged by Cuomo and Mayor Bill de Blasio’s (D) economic lockdown measures that have now been in place for more than a year. Historic venues, hotels, restaurants, nightclubs, and local neighborhood spots have had to close their doors for good as a result of the lockdowns.

Those forced to close include The Roosevelt hotel in Midtown East, which opened in 1924; the Copacabana nightclub, which opened in 1940; The Paris Cafe, which opened in 1873; and Empire Coffee & Tea, which opened in 1908 among hundreds of others.
