Feds Hit SpaceX for Hiring Americans Over Migrants
The Department of Justice is suing Elon Musk’s SpaceX for not hiring migrants before Americans — but is also ignoring many hiring managers who discriminate against Americans.
President Joe Biden’s deputies are “bullying employers who are trying to do the right thing — avoid hiring illegal workers — and are ignoring employers who are flagrantly discriminating against Americans,” said Jessica Vaughan, the policy director at the Center for Immigration Studies.
“They’re working harder to give illegal aliens access to jobs than they are to give to protect Americans’ access to jobs,” she said, adding,”This is entirely consistent with the approach of the Biden administration to tip the playing field in the favor of workers from abroad so that American workers are always going uphill.”
Biden’s deputies defended the lawsuit. “We will hold SpaceX accountable for its illegal employment practices and seek relief that allows asylees and refugees to fairly compete for job opportunities and contribute their talents to SpaceX’s workforce,” said a statement from the radical progressive Assistant Attorney General, Kristen Clarke.
The agency’s lawsuit asks the judge to favor migrants over better-qualified Americans, by “Order[ing] SpaceX to hire [foreign] applicants who were victims of the discriminatory practices alleged in this Complaint and were qualified for employment.”
Federal law says hiring managers cannot unfairly exclude legal migrants who have been given asylum or refugee status by government agencies. In practice, that legal status is rare because it is short-lived and is quickly converted into green cards and then into citizenship.
The company only hired one such person from 2018 to 2022, says the lawsuit:
According to data SpaceX provided to the federal government, from September 2018 to May 2022, out of more than 10,000 hires, SpaceX hired only one individual who was an asylee and identified as such in his application. SpaceX hired this asylee approximately four months after IER notified the company of its investigation. From September 2018 to May 2022, SpaceX did not hire any individuals who were refugees and identified as such in their applications.
The complaint cited a tweet from SpaceX owner Elon Musk:
On June 16, 2020, SpaceX’s CEO, who then had approximately 36 million followers on X, a social media platform formerly known as Twitter, posted, “U.S. law requires at least a green card to be hired at SpaceX, as rockets are advanced weapons technology.”
American companies need to be very careful about workers’ legal status and about forged documents, especially in high-tech jobs where small mistakes can have large costs, and in industrial jobs where small mistakes can kill or injure Americans, said Vaughan
“It used to be that these [federal discrimination] cases were handled with counseling,” said Vaughan. But Biden’s officials are trying to “intimidate employers into not asking questions and just accepting what the alien provides in terms of [possibly forged] documentation and to just look the other way.”
However, the Biden-run department only gives wrist-slaps to companies that discriminate against competent and honest Americans, Vaughan said.
In August 2022, the DOJ fined a Texas company $4,250 for importing visa workers instead of hiring qualified American workers. The company also to to pay $14,1164 in back pay. In May, the agency announced a tiny $3,855 settlement with a U.S.-based company that excluded Americans from technology jobs.
Another company was fined $25,000 for anti-American discrimination in six jobs. In July 2022, the Department imposed a fine of only $12,000 on a Virginia-based company named Technology Hub Inc.. for excluding Americans from white-collar jobs.
The IT cases were only brought after a now-deceased Florida tech expert pushed the complaints through lower-level legal hurdles.
Yet the agency eagerly imposes heavy fines on companies where managers try to make sure illegal migrants are not taking the jobs sought by Americans, and Biden’s deputies invite millions of illegal migrants to rush into U.S. jobs.
In January 2023, for example, the agency:
determined that Masterson Staffing routinely 1) required non-U.S. citizens to provide more, different, or specific Form I-9 documents, because of their citizenship or immigration status, and 2) requested more documents than necessary … Under the terms of the settlement, Masterson Staffing will pay a civil penalty of $250,000 to the United States, and make $100,000 available for a back pay fund to compensate victims of Masterson Staffing’s alleged discriminatory practices.
In October 2022, the agency fined another staffing company $300,000 for checking job-seekers identities:
The department’s investigation determined that PMM (Professional Maintenance Management) routinely required specific documents from newly-hired non-U.S. citizens to prove they had permission to work in the United States. Specifically, the department found that PMM asked lawful permanent residents to show their permanent resident cards (sometimes known as “green cards”), and asylees and refugees to show their employment authorization documents (sometimes known as “work permits”), to prove their permission to work. At the same time, PMM allowed U.S. citizens to choose from among various acceptable document types.
Under the terms of the settlement, PMM will pay a civil penalty of $300,000 to the United States. Additionally, PMM will train staff on the INA’s anti-discrimination provision, change its policies, and be subject to departmental monitoring for a three-year period.
Biden’s deputies are “penalizing employers that are trying not to hire illegal workers — or workers who may be using fake documents — instead of prioritizing, penalizing employers who are bypassing U.S. workers,” said Vaughan.
“We need to think about reforming the way verification occurs and putting [responsibility] on the federal government instead of employers,” she said.
The federal E-Verify system is helping employers by providing government-backed verification of workers’ legal status, she said. “That’s why employers who use it like it because they’re not making the decision or the judgment on whether the workers are authorized — the government is doing it.”
But federal agencies “are using resources and the power of government to go after employers who are trying to do the right thing instead of turning their attention to employers who are deliberately flouting the laws on hiring illegal workers,” she said.
Canada Probes Slavery Allegations in Walmart and Hugo Boss Supply Chains
The Canadian Ombudsman for Responsible Enterprise (CORE) announced on Thursday it is investigating the Canadian branches of Walmart, Hugo Boss, and Diesel for the alleged use of Uyghur slavery in their supply chains.
CORE is a human rights watchdog agency whose purview includes human rights abuses along international supply chains connected to corporations in Canada. CORE can act on both referrals and its own initiative.
In this case, CORE acted on allegations from human rights groups that Chinese suppliers for the three firms used slaves from the oppressed Uyghur Muslims of East Turkistan, which China calls Xinjiang.
Forced labor contamination is an especially pernicious problem in the garment industry since China provides a great deal of the world’s cotton, and Xinjiang produces almost 90 percent of China’s supply.
CORE’s ombudsman and chief spokeswoman, Sheri Meyerhoffer, said Friday that Walmart, Hugo Boss, and Diesel all refused to participate in a preliminary assessment of the slavery reports, so her agency had no choice but to launch an investigation:
The investigations will provide all three companies with an ongoing opportunity to provide further relevant information, and mediation of the allegations remains open. We are hopeful that the investigation findings will provide the companies with information to support their ability to strengthen their due diligence practices.
All three companies denied they purchased goods tainted by forced labor.
A spokesperson for Hugo Boss said the company “does not source any goods in its direct supply relationship that originate from the Xinjiang region.”
“As a matter of principle, we do not tolerate forced or compulsory labor or any form of modern slavery. We believe it is wrong to launch an investigation based on an alleged supplier relationship which no longer exists,” the spokesperson said, alluding to a relationship with a supplier that ended in 2022.
Hugo Boss was among several brands that purchased cotton from the Changji Esquel Group, a massive Chinese supplier that made efforts to conceal its sourcing of cotton from Xinjiang. When human rights groups exposed Esquel’s practices, some of its clients terminated their relationships. Hugo Boss initially said it had audited Esquel’s operations and found no trace of slavery, but in February 2022, it quietly severed its ties with the Chinese supplier.
According to a report at JustStyle on Friday, the coalition of human rights groups that complained to CORE said there is “evidence that the company linked to Hugo Boss Canada owns a subsidiary in Xinjiang, purchases Xinjiang cotton, engages in state-sponsored labor transfers, and purchases cotton from a Xinjiang based cotton provider.”
Diesel, an Italian-owned fashion company, purchased garments from a company called Jiangsu Guotai Guosheng, which allegedly employs Uyghur slaves. Walmart was accused of doing business with a half-dozen companies under suspicion of using slavery, including Jiangsu Guotai Guosheng.
Diesel said in response to the CORE investigation:
Diesel is deeply committed to ethical sourcing. We respect global human rights and comply with international laws across our supply chain. We take immediate remedial and disciplinary action if we find that any supplier is not acting in accordance with our code of conduct.
Walmart Canada likewise said it “does not tolerate forced labor of any kind” in its supply chain and takes “allegations of human rights violations seriously”:
Walmart made it clear to the CORE that we have developed and executed policies, standards, controls, and supply chain monitoring systems that support Walmart Canada’s corporate mandate to prohibit the use of forced labor. Our policies are diligently enforced.
CORE replied that Diesel’s refusal to participate in preliminary assessments raised “questions related to the degree of transparency in its human rights due diligence practices,” while Hugo Boss “does not appear to consider fully the complex nature of the garment supply chain.”

LOS ANGELES, California — Democratic presidential candidate Robert F. Kennedy Jr. launched a short documentary film on Thursday about his trip to the southern U.S. border last month, highlighting an issue few other Democrats have dared to touch.
As Breitbart News reported at the time, Kennedy visited the border near Yuma, Arizona, at the dead of night, arriving without fanfare so that the scene would not be sanitized in preparation for his visit. A guide informed him that he and Sen. Mark Kelley (D-AZ) were the only two Democrats who had visited the border to see firsthand what is going on under the Biden administration.
The documentary, a 19-minute film, was released at the Saban Theatre in Beverly Hills before an audience of several hundred local supporters of the Kennedy campaign, along with members of the media.
The film shows Kennedy meeting, and speaking with, migrants from all over the world, including Africa and Asia — only one of whom was seeking asylum. The rest, he said, were economic migrants seeking a better life for themselves and their families.
Kennedy, who is fluent in Spanish, is shown speaking to migrants from Spanish-speaking countries — though there are many migrants from other parts of the world as well. He hears, firsthand, their stories of distress and dislocation along their journey.
He also tours gaps in the border wall (or fence) that were left behind when President Joe Biden dropped former President Donald Trump’s program to build a physical barrier, along with patrol roads and electronic sensors, to stop the flow of illegal migrants.
Kennedy is also shown learning about sexual assaults committed against women and children on the journey to the border, including both girls and boys.
He says at the conclusion of the documentary that he has learned that the current U.S. border policy is just a way of funding “a multibillion-dollar drug and human trafficking operation” to benefit the Mexican cartels. He promises, if elected, to seal the border, while allowing pathways to legal immigration.
Former TV news anchor Bob Jimenez, who accompanied Kennedy to the border, introduced the documentary. He said that it exposed “the lie that has been told to us” about the border, and about what happens to the immigrants “who are in harm’s way, all the way,” while the cartels get “richer and fatter every year” because “our southern border in open.”
The documentary was produced internally by the Kennedy campaign.
In remarks following the film, Kennedy declared, to applause, that “a country cannot exist if it can’t secure its borders.” He said that unlike other candidates who had approached the issue with “xenophobia,” he would do so through “compassion.”
He framed the issue not as one of immigrants’ rights — which he respected — but as the self-enrichment of the cartels.
Kennedy confessed to having had a change of heart on the issue, after learning more about the border.
“I was against Trump’s wall. I thought it was a crazy idea,” Kennedy admitted.
He said he still believed that the U.S. did not need a wall along the entire border — “the 2000 miles from Brownsville to San Diego” — partly because of natural barriers.
“But we do need something.”
He said that he would use a physical barrier for part of the border, and restore electronic surveillance of the boundary where it had been abandoned. He added that the U.S. had to work more effectively with Latin American countries to stop the migration.

Mexican President Mocks Texas Governor Over DOJ’s Border-Barrier Lawsuit

Mexico’s President Andres Manuel Lopez Obrador mocked Texas Governor Greg Abbott this week over the recent lawsuit filed by the U.S. Department of Justice against the state seeking the removal of various border barriers including buoys and fencing.
During his morning news conference, Lopez Obrador talked about the recent lawsuit filed by the DOJ against Texas seeking the removal of various border barriers. As Breitbart Texas reported, Abbott ordered the placement of buoys and various other barriers claiming that the administration of U.S. President Joe Biden was not doing anything to stop illegal immigration or drug trafficking.
“We celebrate that Biden is presenting this complaint because it is not his (Abbott’s) to meddle in international affairs,” Lopez Obrador said. “It is the faculty of the federal executive. States are not supposed to have any type of accords with foreign nations. But we have to look at it for what it is, it’s a publicity stunt.”
In his conference, Lopez Obrador said that people from Texas and Mexico are supposed to be united, and the fencing promotes division instead of fostering unity.
“He (Abbott) is doing everything for votes,” Lopez Obrador said. “I think it’s going to be counterproductive for him. I don’t think people are going to vote for him. They are NOT going to vote for him.”
Lopez Obrador said that Texas has a large population of Hispanic descent and a large population of migrants from Latin American countries who will vote against Abbott.
As Breitbart Texas reported, Lopez Obrador has called for Hispanics to oppose Republican politicians such as Abbott and Florida Governor Ron DeSantis over their stances on immigration and border security. The Mexican politician has even called for Hispanics in the US to vote against those politicians.

Biden Labor Department Under Investigation After Mass Exploitation of Child Migrants Revealed
The independent watchdog of the Department of Labor is investigating the agency's role in a wave of child labor violations of migrants across the country.
The department's Office of Inspector General said in an Aug. 21 memo that it plans to audit the department's "efforts to curtail child labor law violations, as well as the cause for rising child labor law violations."
It's the latest development in a scandal involving the Labor Department, the Department of Health and Human Services, and the White House.
The New York Times first broke the story in April, when it showed documents proving the administration was quickly releasing unaccompanied migrant children into the country by the thousands. Many of those children ended up working grueling jobs, often for long hours and in dangerous conditions where they worked with chemicals and industrial equipment.
The probe comes amid rising cases of illegal child labor, Bloomberg reported:
Agency officials said in July that over the past 10 months alone, the DOL’s wage division has concluded 765 cases involving 4,474 children employed in violation of federal child labor laws. Overall, the department reported that it’s seen a 69% increase child labor violations from 2018 and 2022.
Sen. Josh Hawley (R., Mo.) slammed the Biden administration in June for its failure to address the widespread crisis.
"This administration has let tens of thousands of children be sold into slavery," Hawley said. "They are doing nothing about it."
Five former HHS employees said they were pushed out of the agency after they raised concerns about children's safety.
The Times report also implicated former domestic policy adviser Susan Rice. Rice and her team reportedly failed to act, even as administration staffers called for stricter vetting of the sponsors migrant children were placed with to prevent human trafficking. A week after the Times report, the White House announced that Rice would step down.
Further reports found that children were sent to the homes of unscreened adults, some of whom could have been registered sex offenders or had a history of child neglect.
The Times reported that though the two departments did flag the problem for the White House, the notices were not marked as urgent and did not properly explain the scope of the crisis.
