Joe Biden’s Executive Order on Voting Tells Agencies to Push Vote-by-Mail, ‘Combat Misinformation’

President Joe Biden issued an executive order on “access to voting” on Sunday that instructs federal government agencies to promote voter registration, help Americans apply to vote by mail, and “combat misinformation,” among other measures.

The “Executive Order on Promoting Access to Voting” reads like a Democratic Party wish-list of “reforms” that enshrines many of the practices that were adopted on a temporary basis during the pandemic-affected 2020 election. Its provisions include:

• using federal agencies to promote voter registration;
• using federal agencies to inform Americans about voting;
• linking federal agency websites to state voter registration websites;
• providing voter registration and vote-by-mail applications;
• using “approved, nonpartisan third-party organizations” to register voters at federal agencies;
• using identification documents issued by the agency to help people register to vote;
• providing more multilingual services to potential voters;
• giving public employees “time off to vote in Federal, State, local, Tribal, and territorial elections”; and
• promoting voter registration for federal prisoners.

One provision states: “It is the responsibility of the Federal Government to expand access to, and education about, voter registration and election information, and to combat misinformation, in order to enable all eligible Americans to participate in our democracy.”

Legitimate (and accurate) news stories on the business dealings of Biden’s son, Hunter Biden, were suppressed by social media companies and mainstream media outlets during the 2020 election under the guise of fighting such “misinformation.”

The list of measures in the Executive Order parallels those included in Democrats’ legislation, H.R. 1, the “For the People Act,” which intends to override state measures that bolster ballot integrity. H.R. 1 recently passed the Democrat-run House.

The list also appears aimed at providing opportunities for the Department of Justice’s Civil Rights Division to pursue legal action against states that have photo identification requirements for voting, or that remove ineligible voters from the rolls.

The Democratic Road Forward on Immigration

It’s not the current bill.

The Democrats have put forward a very ambitious immigration bill. Ambitious, but without the remotest chance of passing. Republicans will not sign on to a bill that essentially does nothing to address their concerns about border security, so they will filibuster the bill in the Senate. And Democrats are not going to try to break the filibuster for this bill. Therefore, it will not pass.

The timing is also peculiar. The country is still reeling from the twin coronavirus and economic crises, which will take some time to resolve even if the Democrats are successful with their related legislative efforts and mass vaccination drive. Is this really the right time to pursue legislation that could drive increased border crossings, thereby melding border security with health security concerns? Democratic Rep. Vicente Gonzalez (TX-15), whose district is a border region heavily impacted by immigration flows, doesn’t think so:

The way we’re doing it right now is catastrophic and is a recipe for disaster in the middle of a pandemic…Our party should be concerned. If we go off the rails, it’s going to be bad for us…Biden is going to be dealing with a minority in Congress if he continues down some of these paths.

Democratic Congressman Henry Cuellar, who represents a border district in Texas, has raised similar concerns:

Hey, we don’t want the wall, but when it comes to the other issues, we gotta be careful that we don’t give the impression that we have open borders because otherwise the numbers are going to start going up. And surely enough, we’re starting to see numbers go up.

The views of these representatives from heavily Hispanic districts raises serious questions about whether this bill, leaving aside its possibility of backlash from white voters, would even improve Democratic fortunes among Hispanic voters. Roy Herrera, who advises Democratic Senator Mark Kelly from Arizona and was counsel to Biden’s successful 2020 campaign in the state, thinks the view that the bill would improve Democratic odds among Hispanic voters reflects a fundamental misunderstanding of the Hispanic vote (a point I also made in a recent post)::

While there’s some concern [about immigration], most Arizonans know they have two senators who want a solution to the immigration problem that is balanced… They want to provide some relief to folks who are undocumented, but they also want a secure border so that there’s not an increase and flood of migrants we can’t handle….

A lot of the Democratic-leaning groups still have not figured out how to talk to Latinos in that the overwhelmingly progressive messaging is not that effective… So, yes, immigration is important, but the focus for them is on jobs, the economy, the raise I got at work, the cost of health care and if I can take a loan out for my business.

So, what is the road forward on this issue then? First, concentrate on solving the COVID-19 and economic crises, which is what will really endear Democrats to voters in general and Hispanic voters in particular. Second, accept that if any aspect of this bill moves forward, it will be only after it is broken up into chunks, as Nancy Pelosi has suggested. The most obvious approach is to improve the situation of the “Dreamers,” and even then a bill along these lines would probably have to include border security provisions that would be responsive the concerns of Republicans and some Democrats.

More generally, Democrats moving forward have to accept the reality of American public opinion and politics that border security is a huge issue that cannot be elided in any attempt to reform the immigration system. Indeed, the most popular part of the current immigration bill is the provision most directly related to border security (technologically enhanced port of entry screening) according to Morning Consult. And public opinion polling over the years has consistently shown overwhelming majorities in favor of more spending and emphasis on border security.

This suggests a serious revamp of the Democratic approach to immigration flows and immigration reform. The public has indeed become more sympathetic to immigrants and immigration, partially as a thermostatic reaction to the practices of the Trump administration. But that does not mean that Democrats can simply be the opposite of Trump on this issue. He was closed; we’re open! He was mean; we’re nice! Any moves toward greater leniency at the border and the creation of legalization regimes for undocumented immigrants raises the possibility of knock-on effects and unintended consequences that would be highly unpopular. How do you prevent people from gaming the system? How do you handle the possibility of surges at the border to take advantage of leniency and legalization regimes? Any immigration reform package worth its salt must have serious answers to these questions.

America is a very desirable destination, and it is simply a fact that many more people want to come here than can possibly be accommodated. Therefore, choices will have to be made about the numbers to be let in. What is, in fact, a desirable level of legal immigration? If Democrats wish it to be much higher, which is a defensible position, then they must have an answer for who these people should be. How are slots to be allocated—would the country be served well by moving to more a skill-based system or at least a hybrid that leans in that direction? And if the immigration system is to be more generous, how are levels of illegal immigration to be controlled? It will not do to make the immigration system more generous, while doing little to control flows of illegal immigration. Most of all, voters want an immigration system that is both reasonably generous and humane and under control. Democrats ignore the “under control” part at their peril.

Harris’s Senate Replacement’s First Bill: Pathway to Citizenship for Illegal Alien ‘Essential Workers’

As the discussion over President Joe Biden’s open border immigration policies heats up, at least one Democrat Senator wants to go even farther than allowing tens of thousands of illegal aliens into the country based on asylum claims.

Sen. Alex Padilla (D-CA), who took Kamala Harris’s Senate seat, wants to give millions of illegal aliens a pathway to citizenship if they are deemed “essential workers.”

That wish is now in the form of a bill, the first Padilla has unveiled since taking his seat. Padilla told the San Francisco Chronicle:

I think nothing speaks to the moment more than COVID response and fairness for essential workers. On a parallel track, we know that immigration reform is long overdue in the United States of America and there are no states that have more at stake in immigration reform than the state of California.

“A standalone measure allows us to uplift specific elements of a comprehensive package as you continue to gain momentum and support,” Padilla said.

The Chronicle reported on Padilla’s motivation:

In an interview, Padilla said his Citizenship for Essential Workers Act was an easy choice for his first piece of legislation as a senator on a personal and policy level. He noted his Mexican immigrant parents spent four decades working in the service industry — his father as a short-order cook and his mom cleaning houses. Padilla is the first Latino senator from California and one of only a handful in the Senate, and he has already used that position to voice concerns of the Latino community in Washington.

On its own, it’s virtually impossible the bill would become law. The legislation would apply to some legally present immigrants and undocumented immigrants alike, providing an immediate opportunity to start the naturalization process for an estimated 5 million or more people who work in more than a dozen essential industries, including health care, agriculture, service, child care and manufacturing. But the legislation is emblematic of how Padilla hopes to shape the perpetual debate on immigration as it unfolds in coming months.

On December 22, 2020, Governor Gavin Newsom appointed Padilla to succeed Harris. Padilla served in the California State Senate for the 20th district from 2006 to 2014.

Study: 1986 Reagan Amnesty Invited a Surge of Immigration, Terrorism, Fraud

The last widespread amnesty, signed by former President Ronald Reagan in 1986, invited a surge of immigration to the United States, allowed terrorists to stay in the country, and inflated fraud, according to a new study.

This month, President Joe Biden unveiled the details of his amnesty plan which would legalize the roughly 11 million to 22 million illegal aliens currently in the U.S., fly deported illegal aliens back to the country to receive amnesty, and increase legal immigration levels, among other things.

A study by the Federation for American Immigration Reform (FAIR) suggests Biden’s amnesty would result in the same issues past amnesties have spurred: Increasing immigration, displacing American workers, and adding to national security concerns.

“You don’t need to be Albert Einstein to figure out that the massive amnesty the Biden administration is proposing will not produce any results other than those we have seen with past amnesties—only exponentially larger and infinitely more damaging to the national interest,” FAIR President Dan Stein said.

The study reviewed the results of the 1986 amnesty, finding that while lawmakers initially sold the legislation as a crackdown on illegal immigration with a one-time benefit to a small group of illegal aliens, the opposite occurred.

After its passage, illegal immigration levels slowed for about six months before returning to pre-amnesty levels. A decade later, the total number of illegal aliens had skyrocketed to more than eight million.

With that increase in illegal immigration, the study finds, came a spike in legal immigration largely thanks to the process known as “chain migration” where newly naturalized citizens can bring an unlimited total of foreign relatives to the U.S. Since 1990, annual legal immigration levels have doubled.

The impact on the nation’s workforce, the study suggests, meant that more than 1.6 million illegal aliens who were originally legalized as a result of the amnesty displaced an average of 187,000 Americans and legal immigrants from their jobs each year. Public assistance for those displaced workers accumulated to $9.9 billion between 1996 and 1997.

As noted by the FAIR study, previous research on the 1986 amnesty has revealed major fraud and national security implications. For instance, a Center for Immigration Studies estimate found about one-quarter of all applications for the amnesty were fraudulent.

More alarming is the amnesty “helped enable terrorism” in the U.S., according to FAIR. Specifically, Egyptian national Mahmud Abouhalima was given amnesty by fraudulently claiming to be a farmworker even though he actually had overstayed his tourist visa.

The amnesty provided him the ability to travel outside the country, which he used to train in terrorism by traveling to Afghanistan and Pakistan. Abouhalima, now a convicted terrorist, was one of the leaders of the 1993 World Trade Center bombing.

Likewise, Palestinian national Mohammed Salameh applied for the amnesty but was denied relief. Despite the legislation’s promise to ramp up deportations of ineligible illegal aliens, the enforcement measures never came to fruition and Salameh was allowed to remain in the U.S.

In 1993, Salameh aided in the World Trade Center bombing and was subsequently convicted of terrorism.

“There is little reason to believe that terrorists wouldn’t again take advantage of an amnesty to embed themselves into American society,” FAIR researchers state.

To pass the Senate, Biden’s amnesty plan would need the support of at least 10 Senate Republicans, as well as every Senate Democrat and those who caucus with the Democrats. While a number of Senate Democrats remain silent on the plan, many have indicated in recent votes where they may stand on the issue.

In the first week of February, eight Senate Democrats — including Krysten Sinema (D-AZ), Mark Kelly (D-AZ), Debbie Stabenow (D-MI), Gary Peters (D-MI), John Hickenlooper (D-CO), Maggie Hassan (D-NH), Jon Tester (D-MT), and Joe Manchin (D-WV) — voted with Senate Republicans to block giving stimulus checks to illegal aliens.

The White House, though, has downplayed the plan’s potential lack of support among swing state Democrats who face tough reelections in 2022 and 2024. About 28 vulnerable House Democrats, for instance, have stayed mostly quiet on whether they would support or oppose the plan.
