(CNS News) -- When asked if a 15-week-old unborn baby is a human being -- in relation to an upcoming Supreme Court case -- Sen. Diane Feinstein (D-Calif.) said, “I’m not going to get into that at all.”

At the U.S. Capitol on Wednesday, CNS News asked Senator Feinstein, “In the fall, the Supreme Court is going to review a Mississippi law that bans most abortions after 15 weeks of pregnancy. So, my question is, do you believe that a baby, an unborn baby, at 15 weeks is a human being.”

The exchange with the senator continued as follows,

Feinstein: “Do I what?”

CNSNews.com: “Okay, thank you so much for your time, I really appreciate it.”

Feinstein: “What’s the question? That an unborn baby at what?”

Feinstein: “Oh, I’m not going to get into that at all. Thank you, though.”

The Supreme Court will hear arguments in Dobbs v. Jackson Women’s Health Organization this fall. Specifically, the court will seek to decide "whether all pre-viability prohibitions on elective abortions are unconstitutional."

In 2018, Mississippi passed a law that prohibits abortion after 15 weeks of pregnancy, except in cases of a medical emergency or severe fetal abnormality. Under Roe v. Wade, abortions in most states are restricted past 24 weeks of pregnancy, the time at which an unborn baby is considered viable.

The SCOTUS blog reports that Dobbs v. Jackson is a case that could “upend the Supreme Court’s landmark decisions in Roe v. Wade and Planned Parenthood v. Casey, in which the court ruled that the Constitution protects the right to have an abortion before a fetus becomes viable.”

(CNSNews.com) - Sen. Ted Cruz (R-Texas) said Wednesday “the science is clear” that an unborn, 15-week-old child is “absolutely” a human being.

At the U.S. Capitol on Wednesday, CNS News asked Senator Cruz, “The Supreme Court this fall will review a Mississippi law that bans most abortions after 15 weeks of pregnancy. Is an unborn baby at 15 weeks a human being?”

“Absolutely,” said Cruz.

CNS News then asked Cruz what he has to say to his colleagues who refuse to answer that question, to which the senator replied, “The science is clear. I believe life begins at conception and that we should protect every human being from conception to natural death. That life is a precious gift from God.”

“The Supreme Court, beginning with Roe. v. Wade, began this country on a path that has tragically taken the lives of over 60 million unborn children,” he continued.

The Mississippi law has been challenged in the lower courts and the state lost in those rulings.

The Supreme Court's decision in this case could undercut Roe v. Wade or strengthen it, depending on how the justices rule.
