New York's Joint Commission on Public Ethics (JCOPE) ordered disgraced former governor Andrew Cuomo (D.) to return $5.1 million he made in profits from his book about the pandemic.

The commission on Tuesday found that Cuomo used state resources or employees to write the book, in violation of New York law. JCOPE voted 12-1 to ban Cuomo from making outside income on American Crisis: Leadership Lessons from the COVID-19 Pandemic and ordered him to pay back the income he already made by next month.

JCOPE may not have the authority to issue the order, however, the New York Post reported Tuesday.

The commission "has exactly zero authority to issue an order such as this," former state ethics enforcer David Grandeau told the Post. "All [the law] says is JCOPE has the right to issue opinions."

Cuomo's attorney agreed, telling the Post, "Should they seek to enforce this action, we'll see them in court."

Cuomo resigned on Aug. 24 after state attorney general Letitia James (D.) found that the then-governor sexually harassed at least 11 women. Cuomo also ordered New York nursing homes to admit coronavirus-positive patients and then hid the number of nursing-home deaths, according to an independent report released last month.

More than 15,000 people died of COVID-19 complications in the state's nursing homes, the New York Times found in August.

Tracey Alvino, whose father died of COVID-19 in a New York nursing home, told the Post that American Crisis "was a blood money book of lies written off the graves of 15,000 people."

"Score one for the team of morals and ethics and everything that is just and right," she said about the commission's decision.

Chris Cuomo is preparing to sue CNN just days after the network fired the disgraced news anchor.

Cuomo has retained lawyers to secure the remainder of his four-year contract, worth $6 million annually, the New York Post reported Monday. CNN, however, has "no intention" of paying Cuomo.

"CNN has a standard morality clause in their contract that says if the employee does anything of disrepute, they can be immediately fired," a source familiar with the matter told the Post.

The news network on Saturday fired Cuomo over his efforts to help his brother, former governor Andrew Cuomo (D., N.Y.), combat accusations of sexual assault. CNN on Tuesday had suspended Cuomo after records released last week by New York attorney general Letitia James (D.) disclosed new information about his involvement in his brother's defense. According to the report, the anchor worked with the governor's office to uncover the identity of at least one of Andrew Cuomo's accusers and contacted journalists to track down upcoming stories about the accusations.

The Washington Post reported in May that Cuomo advised his brother's staff on how to respond to the allegations from several women who accused the governor of sexual harassment. CNN said an internal investigation last week found Cuomo misrepresented the extent of his involvement to network executives, providing cause to terminate his contract.

Cuomo, however, says CNN president Jeff Zucker was aware of his involvement in his brother's defense.

Cuomo and Zucker "were widely known to be extremely close and in regular contact, including about the details of Mr. Cuomo's support for his brother," a spokesman for Cuomo told the Wall Street Journal. "There were no secrets about this, as other individuals besides Mr. Cuomo can attest."

An adviser to disgraced former governor Andrew Cuomo (D., N.Y.) bragged about successfully laundering talking points through MSNBC host Katy Tur, who repeated the adviser's "spin" on the air at the height of the governor's sexual harassment scandal, according to text messages released this week.

"I’m texting w[ith] Katy Tur," the adviser, Lis Smith, wrote to a group of Cuomo aides and allies in March. "Katy is saying my spin live. Like verbatim."

Smith, who served as Cuomo's top spokeswoman during his 2018 reelection campaign, has largely avoided scrutiny for her role in the scheme to protect the governor by discrediting his female accusers. That was precisely what Smith wanted. In subsequent text exchanges, Smith told Cuomo's other advisers it would damage her "credibility" to become more visibly involved. She would later tell New York state investigators the "big fire storm" surrounding the sexual harassment scandal was "not something that I felt like I needed to be in the middle of," even as she continued to work "behind the scenes" to salvage the governor's reputation.

The text messages, released as part of New York attorney general Letitia James's investigation into Cuomo's conduct, took place following the governor's defiant press conference on March 3 after multiple women accused him of sexual harassment. Cuomo denied having "touched anyone inappropriately" and vowed not to resign. Smith and her fellow advisers concurred that the story had moved in a favorable direction since the press conference.

Tur is not the only prominent journalist revealed to have played a role in Cuomo's efforts to discredit his accusers. The governor's younger brother, CNN anchor Chris Cuomo, was also heavily involved. For example, the network star texted the governor's chief of staff, Melissa DeRosa, after obtaining a "lead" on one of his brother's accusers. CNN announced a "thorough review" of the anchor's conduct in response to the revelations. It remains to be seen if CNN considers helping a powerful relative discredit sexual harassment victims is worse than masturbating on a Zoom call.

Fun facts: Smith is the ex-lover of Eliot Spitzer, who is also a disgraced former governor of New York. Tur is the ex-lover of disgraced former MSNBC host Keith Olbermann.

‘Shame on CNN’: Stefanik Says Chris Cuomo ‘Complicit’ in Brother’s Corrupt Behavior

Rep. Elise Stefanik (R., N.Y.) escalated her feud with the Cuomo brothers on Tuesday, calling for CNN to immediately fire anchor Chris Cuomo in the wake of new documents that show the extensive behind-the-scenes work he did to help former New York governor Andrew Cuomo fight sexual harassment allegations.

"Chris Cuomo should be fired immediately," Stefanik said. "There does not need to be a review. The documents that were part of the attorney general’s investigation were quite clear—he is complicit in the criminal, corrupt behavior of the man I dubbed the worst governor in America. … Shame on CNN for not making that decision immediately."

After a "thorough review" of the documents released by New York’s Democratic attorney general that show Chris Cuomo conspiring with his brother's aides to discredit accusers, CNN announced Tuesday evening that it is placing Cuomo on indefinite suspension. The documents show the CNN anchor was much more involved in his brother's political decision-making than was previously known.

Now they're trying to claw some $5 million back from Cuomo.

What's the obsession with Cuomo's cash? The Dems aren't worried about the ethics of it or the fortunes of the publishing giant involved. They're worried that Cuomo, a guy who is about as forgiving as a pirhana, intends to use what money and influence has to go after those Dems who betrayed him, and maybe even get himself back into the governorship.

Cuomo's already got a sizable war chest, but those book deal millions gave him a fortune to play with that had even less restrictions on it than even his campaign cash.

Going after the money is about trying to limit the damage that the wrathful ex-governor can do to them. 

It's about money and power. That's what it's always about.
